0:10
Okay, everyone, hello.
0:11
I'd like to call in progress.
0:13
I'd like to call our special meeting of October 7th to order, and I'll ask the clerk to please call the role to establish our quorum.
0:29
Supervisor Fournada Bass.
0:35
The first item before us is the county administrator's office approving the following recommendations.
0:41
A approving consent to a license agreement, B delegating authority to the county administrator.
0:48
We have the attachments here.
0:50
This is a license agreement for route soccer.
0:55
Is there any other staff report or introduction to this?
0:59
I was just gonna introduce is uh both of these items are seeking your board's consent to actions taken by the Oakland Alamedy County Coliseum Authority Board last Friday.
1:09
The executive director Henry Gardner is online and available if there are questions from members of your board as supervisor.
1:16
Howvert mentioned the first agreement is to approve consent to a license agreement between the Coliseum Authority and Oakland Pro Soccer, contingent upon consent of Coliseum Way Partners and Oakland Acquisition Company or OAC.
1:32
And secondly, that you delegate authority to the county administrator to execute the consent upon receipt of the written consent from Coliseum Way Partners and Oakland Acquisition Company.
1:44
I would also note that the City of Oakland also needs to consent to these same agreements.
1:50
It's my understanding they will not be considering it until later this month.
1:53
However, in any event, I would recommend that the county not execute the agreements until after approval by the city of Oakland.
2:02
So we can make approval today, but um we'll delay signing until Oakland signs.
2:08
And I understand and I'd like to thank uh our staff for being flexible.
2:12
We generally wouldn't even take this item up until um Oakland has completed their side, but um we're going to approve this today.
2:22
A little bit out of order, but uh because of the timeliness of this item.
2:27
Before we go to questions or advocacy, I'll ask if there's any public comment.
2:36
We do have in public hand.
2:44
Good afternoon, President, the Vice President, members of the board.
2:48
My name's Lydia Tan, and I'm chief real estate officer for the Oakland Roots in Seoul.
2:53
Before I talk about the Coliseum, I just want to give you a little update on our trading facility, the former Raiders facility.
3:00
Uh as you know, the county and the city uh disposed of that property at the end of June of this year, and I just want to announce that last night, around midnight, we uh signed an agreement with FIFA, and we are now eligible to be a home base for a visiting team come the World Cup in 2026.
3:19
So really excited about that.
3:21
And we are actually the only facility in Northern California right now that's in the catalog.
3:33
So I just want to express uh gratitude to the JPA of the county and the city of Oakland for providing the Oakland Roots with a home at the Coliseum for this year.
3:43
Uh, tonight actually is our second to the last game of the season, and it's really been our privilege to continue the tradition of professional sports at the Coliseum.
3:52
Um we've played 15 games so far, two more to go, and aside from a season opener, which attracted 26,000 fans, we've been averaging between six and seven thousand tickets issued for every game, and that's well above what we've been able to accommodate in the past.
4:06
So we're really grateful for this opportunity.
4:08
We continue to grow our fan base, which we're really excited about.
4:11
We're also very proud of the fact that we did invest to install a pitch at the Coliseum, and that made the Mexico Japan uh match possible and made cricket uh possible as well this summer, and so we're really really excited about the idea of making that investment and allowing um thousands of people to enjoy the Coliseum this year.
4:31
So, as you know, last Friday, the JPA voted to um uh approve the license agreement subject to the consent of the city and the county.
4:39
And uh we know there are a lot of steps still between now and then to make the agreement effective, but this is the first step, and we really appreciate your support.
4:47
Uh thank you very much.
4:49
If you could just um take a minute or two if you if need, uh just follow-up questions.
4:55
If you mentioned the few next steps, if you would comment on what those steps are and um what you might need to accomplish those steps, uh sure.
5:06
So uh one um it is certainly the administrative administrator talked about needing the consent of OAC and CWP.
5:14
Uh we've been in conversations with OAC, who then represents CWP, and so we do know that consent is required, and we've been talking about that.
5:24
Uh city of uh City of Oakland also needs to consent to the agreement, and we are working with uh uh President Jenkins around uh agendizing that as soon as we can.
5:36
Um, and then the last topic of conversation really is uh thinking about post-close.
5:44
So that as you as you know, um there's a uh there's an assumption that the sale of the Coliseum will happen sometime middle of next year, uh, and our season actually goes all the way till December next year.
5:58
So thinking about what happens for post-close and trying to get agreement on that as well.
6:02
So it's another task that we are um hoping to engage and work on as well.
6:07
I note that um that is related to this, but it's not the agendized item.
6:14
I will just say that uh I'm committed to helping solve that of having to fund and operate and be responsible for a stadium that maybe maybe we don't own at a certain time, but we're booking ahead of time, hopefully, with this agreement, pending consent, we'll be booking, so um, I'll just be on record, say any other questions uh of either the applicant or the speaker, Supervisor Miley.
6:55
Um, so you're optimistic that we will be able to get consent of OAC, uh CWP beyond June 30th.
7:10
I mean, this particular agreement uh requires consent during the time that the city and county are in ownership position, so it is the consent we will go and look for.
7:20
And then in terms of the post-closed discussion, yeah, that's that's that'll be a second step.
7:31
We've been having wonderful conversations.
7:33
I mean, I would say, you know, it's probably a conversation for another day, but by virtue of the routes being in the Coliseum, paying for expenses and helping to defray the overhead for 17 games of the year, allowing the Mexico-Japan game to come in and make some real money for the Coliseum, allowing cricket to come in and also take advantage of the field.
7:54
It means that we are generating not only ticket sales and stadium facility fees, but also the F and B the parking income, and that all helps to defray the cost of of um of the cost of the Coliseum.
8:08
So we're hoping that there is a solution there, and our sales team is actually very committed to try and help continue to uh generate revenue for the for the Coliseum.
8:17
And I think it's just a conversation we're gonna have to have over the next couple of weeks.
8:21
And I know you're covering the cost of um you're covering all your cost of playing there.
8:27
That's what we are and um director Gardner could probably talk more about that, but yes, our understanding is we not only cover our cost, variable cost, but also we also contribute toward the towards the overhead of keeping the Coliseum open.
8:42
So no um Gardner, uh he's a tough negotiator, and he he knows he's got a um uh uh kind of a theme that uh you know we we can't lose any money on anything we do.
8:56
I have never heard that before, maybe him him.
8:59
Yes, he's very clear about that.
9:01
Very good steward of your.
9:03
He's a great city manager when he managed the uh Oakland and he's been a great uh um manager uh for us at the Coliseum and the JPA since he's been since he's been there.
9:16
Um and I would second what President Halbert said, um whatever support we can provide to help actualize the future, uh count me in, you know, just follow the lead of my president uh Albert to help this be achieved because um I mean it's important and the other thing is with Harbor Bay, I believe uh they've been uh some upgrades to Harbor Bay.
9:49
You've done any remote any remodeling or upgrades at Harbor Bay.
9:54
Um, sorry, what's up?
9:55
Have you done any remodeling or upgrades at Harbor Bay?
9:59
Uh we we've uh in process, we've uh done quite a bit of just remedial repairs, um taking away broken pieces, um, some old remediation.
10:12
We're about to embark on a uh roof repair, uh as well as uh HVAC um systems repair as well.
10:19
Yeah, so we're slowly incrementally making improvements.
10:22
Yeah, so I was really pleased that we could actualize that you know that deal.
10:27
Yeah, because I think that serves everyone's uh benefit.
10:30
So that's great, and it's great that FIFA.
10:32
Yeah, that's really fantastic.
10:34
Yeah, we're very excited.
10:36
With our action today, seeing that it's um not going to be executed until a later date, seeing as how it needs concurrence consent from CWP and OAC.
10:48
How does that affect your timeline?
10:50
You have to announce your schedule, you have to make commitments to your league, you have to make you have to move on this.
10:59
How's that gonna work?
11:01
Well, um step by step.
11:03
Uh we would really appreciate the vote today, uh, even if the agreement isn't gonna be signed, so that once that the city does uh approve, fingers crossed the consent, uh, and we're hoping that we'll come to city council on the 14th of October, um, then we can have go ahead and have that uh agreement signed.
11:22
Uh we'll work on the consent in the meantime.
11:24
So the the hope is that by mid-October, uh at least for the current license as it sits, we would have uh an agreement in place.
11:35
We would not be able to uh announce our season until we understand what happens post-close.
11:41
And now that's gonna be a lot of work between now and then.
11:45
The um action we're taking today will give you an approved but unsigned contract.
11:54
That gives you time to work out the consent needed for us to sign.
12:00
By when do you need to have that done to meet your timeline?
12:07
Well, uh so this time so last year we were able to announce our season in August, so we are very behind schedule.
12:16
Um the post-close situation is obviously more complicated than last year.
12:22
Uh we were hoping to announce uh by mid-October.
12:26
We don't think that's gonna happen.
12:28
Uh we'd love to be able to announce before the end of the month, though.
12:30
So it's it's gonna be a lot of work.
12:32
I know that we've had some conversations, we've done some analysis, and um uh, you know, we're really hoping that we can have the county and the city come together to try and help us work on a solution with OAC and NCWP.
12:46
And so just to be very clear, you you'll you'll this is holding up your announcement of schedule.
12:55
That the consent will be okay.
12:58
Uh, Supervisor Forts Not About.
13:02
Um I just wanted to share that.
13:04
I have seen the roots from the beginning when you used to play in the council district I used to represent at Laney College, and it's been excuse me, very positive to see.
13:25
It's been very positive to see the club grow.
13:30
I'm losing my voice all of a sudden.
13:51
It's been really positive to see the club grow over the years, and I similarly want to be supportive of being creative and working together to support the club as well as to generate more economic activity here in the county as well as the Oakland.
14:12
Any other comments?
14:17
You have a quick comment?
14:20
I'd want to say that the contract itself also has contingencies in it that have to be met.
14:26
So just for the record, I want to be clear that is the case as well.
14:33
With that, I note that Supervisor Miley wants to make a motion.
14:40
I'll move the item.
14:46
Miley wants to move.
14:47
Supervisor Fortnite Bass will second.
14:50
Um may I ask for clarification just uh on the B part.
14:55
So the delegation of authority to county administrator to execute the county's consent upon receipt of written consent from the Coliseum Way Partners and OACC also includes upon consent and approval by the city of Oakland.
15:15
She signs after the city of Oakland signs.
15:19
That's what I believe it's saying.
15:21
Can we be explicit in the motion?
15:28
So you'd like for me to make a motion saying that it's add the city of Oakland in addition to OACC and CWP.
15:42
In terms of delegating authority to the county administrator to execute the county's consent upon receipt of Coliseum Way Partners and the Oakland Acquisition Company, and also after consent and approval by the city of Oakland.
15:58
Sure, that's my motion.
16:01
So happy to second it.
16:03
Motion's been made and seconded by Supervisor Miley and seconded by Supervisor Fortunato Bass.
16:09
Would the clerk please call the vote?
16:11
Supervisor Marquez.
16:13
Supervisor Tam, aye.
16:17
Supervisor Fortnite of Bass.
16:22
Passes unanimously.
16:23
Thank you very much and congratulations.
16:25
The next item is item two, the County Administrator's Office again asking to approve consent to the First Amendment to amended and restated management agreement between County of Alameda, the City of Oakland, and the Oakland Alameda County Policy Authority, otherwise known as the JPA.
16:46
So this is extends the contract with the JPA.
16:53
I'll let the county administrator explain more.
16:57
This uh first amendment to the management um agreement extends the term as your board is aware both the city and county have committed to selling their respective 50% undivided interest in the Coliseum Complex.
17:09
However, those transactions will not close until after the expiration of the current management agreement.
17:15
The proposed amendment before you would extend the term of the management agreement through the date on which either the city or the county is no longer an owner of the Coliseum Complex.
17:26
So this provides continuity during the interim time, and the recommendation is that your board approve the consent.
17:35
And again, this was approved by the JPA, so we're just ratifying that.
17:39
Any questions or comments?
17:41
Any public comment on this item?
17:44
There are no public comments.
17:47
Fortunately, second.
17:50
Roll call vote, please.
17:53
Supervisor Marquez.
17:59
Supervisor Fortnite of Bass.
18:04
Henry, congratulations.
18:11
Seeing as how we have exhausted all the items before us for our special meeting.
