8:23I um I've known known Ron Smith probably since 2008 when he joined the board and was saddened to hear that he passed away unexpectedly because he served well, and I would like to present with to you all from Mayor Kelly a proclamation of recognition to Mr.
8:41Whereas the City of Chattanooga is strengthened by citizens who generously dedicate their time, experience, and leadership in public service for the benefit of others, and whereas Ron Smith faithfully served the citizens of Chattanooga for 17 years as a member of the Chattanooga Beer Board, carrying out his responsibilities with integrity, professionalism, and an unwavering commitment to fairness and accountability.
9:05And whereas throughout his tenure, he worked diligently to ensure the local businesses operated responsibly while thoughtfully balancing economic vitality, neighborhood safety, and the overall quality of life for residents.
9:31And whereas Ron Smith's service reflected the highest ideals of civic engagement and exemplified the spirit of collaboration, stewardship, and quiet leadership that supports effective local government.
9:44And whereas his dedication of time and expertise made a lasting and meeting meaningful impact on this governing body and on the continued responsible growth of our community.
10:00And whereas the City of Chattanooga now pauses to remember and honor Ron Smith life following his passing with gratitude for his years of service and with appreciation for the legacy he leaves behind.

13:26We're an event marketing company that we do food truck festivals all across the country based out of Massachusetts.

13:35This is our fourth year.
13:37Um, it's grown to be a pretty pretty good event where this year we're doing a two-day event.
13:42Usually we just do Saturday, we're doing Saturday and Sunday.
13:46Um, I believe our our our ruling is is is held up for for um we had a letter of good standing put in to the uh online portal.
13:57It was only valid for 60 days from when we put that in yesterday.
14:02I went to Boston and got an updated letter and put that in the portal last night.
14:06Um I I believe we should be all set.
14:09We're we're up to date with um Department of Revenue as well.
14:13So I'm not sure what is holding it up.
14:16So he's referring to the uh their LLC standing with the Tennessee Secretary of State.
14:23So just for the record, can you just think your name is?
14:26Uh Harold DeBrison, uh assistant city attorney for the city of Chattanooga, and it is currently on hold for legal approval because the LLC status needs to be brought to active with the Tennessee Secretary of State, but he did uh inform me.
14:42We were out in the hall talking that he's submitted that paperwork and he's going to send that to me, so it should hopefully be cleared up in the next few days.
14:56So if we can just put a motion and just send this back to regulatory, yes.
15:00Um once the paperwork is done.

16:22I'm with the City of Chattanooga zoning division.
16:24So the property at 2716 Dockson used to be zoned, a C2 zone, and that allowed for his type of business, eating and drinking establishments is the actual use type.
16:38So when the new zoning uh was put into place across the city, that particular property is now zoned industrial heavy.
16:49Heavy industrial does not allow for eating and drinking establishments permitted by right.
16:56However, it does allow it permitted by special exception.
16:59So he must apply to the Board of Zoning Appeals for a special exception permit, which he did get a zoning verification letter, and we put that information on there.
17:09I just believe he's having his his family member help.
17:13She I stepped out of the appeals meeting yesterday to try to help her begin her application for that, but she will have or he will have to appear at the next meeting.
17:22Uh we Board of Zoning Appeals, the Boza is in one month.
17:26We had it yesterday, so it'll be another month.
17:28So he's essentially on hold until he can get that permit to operate his business whatsoever.
17:34And then once he gets that permit, then I can move forward pardon me.
17:38I can move forward with the zoning approval.
17:41And yeah, the other steps can move forward for his his uh regular beer permit, his permanent beer permit.

17:49So that that's his status.
17:51So I sent him uh down to our office for a form that he's gonna need the property owner to sign for that application.
17:57And uh I guess my uh my understanding is once he gets that taken care of, if he gets that uh then regulatory can approve.
18:07So that's the information I gave him.
18:10So for the sake of the record, he is he's clear that he should not be selling any beer uh in this establishment.
18:22Okay, no, that's what I was gonna say.
18:24Uh is my understanding he's not open yet.
18:28I should also mention that um something came back in his background check that I think the bear board should consider when his application does come up.
18:38So seeing as how he's not here, I'm not gonna mention exactly what it is, but I just wanted to let y'all know that that is something that y'all have to consider as well.
18:51Uh so we are moving this until we move this out two weeks out.
19:00Because he has to go to Boza.
19:02Um, I would suggest that we move it out to um the second meeting in April.

23:04So what does this board say we want to do with cabanas?

23:15Well, I believe that number two deals specifically with the fact that the violation didn't matter because we declined their application for a new beer application.
23:25So I don't think there's any recommendation or any need to discuss because we declined.

23:40This is according to the findings of the hearing officer.
23:50The recommendation is that based on the totality of the circumstances, the bear board uh impose a 1,000 civil penalty for cabanas.
24:14Where is I don't see that documented?
24:18So it's in the actual report that was sent to y'all.
24:28I'll read it into the record.
24:30Um, therefore, based on the foregoing, the hearing officer finds that the permittee failed to report fights occurring on the premises immediately to the Chattanooga police department in contravention of section 5-51B, and that sanctions are appropriate against a cabanas.
24:48Due to cabana's present lack of a valid beer permit, the only sanctions available are civil monetary fines slash penalties, but the recommendation would include a suspension of the beer permit if there were a valid beer permit to suspend.
25:03It is therefore recommended based upon the totality of the circumstances that the beer board impose a thousand dollar civil penalty.
25:11Report and recommendations respectfully submitted this 27th day of February 2026.
25:17And for the record, that was my mistake.
25:30And I remember the recommendation being different that she couldn't do anything.
25:38That's why I didn't it didn't jump out to me on the agenda that was any different from that.
25:44I remember her saying that the difficulty about them not having a um a ballot permit, but I also remember her making that recommendation at the end.
25:59Because it was the same recommendation for all of them.
26:05I think they they ended up walking out with like a four thousand dollar total penalty.
