They are text amendments would provide exceptions to allow for the construction of non-habitable

structures and public infrastructure such as trails, non-habitable maintenance facilities

and similar equipment to be located within the 100 year floodplain on a case by case

basis when such construction would not result in upstream or downstream impacts.

The amendments consist of revisions to Title 16 as well as Title 23 specifically Chapter

1650 and 23100 as well as concurrent revisions to the general plan.

The need for the proposed amendments was identified while reviewing a capital improvement project

and as part of the hydraulic analysis it was determined that the project wasn't able to

meet the current regulations.

Pursuant to the current municipal code no increase in water service elevation is allowed

and according to FEMA's definition that means 0.00 feet.

The hydraulic model that was used to calculate the water service elevation increase is developed

with assumptions that can easily affect its accuracy.

City staff reviewed the municipal codes from other agencies within our stormwater partnership

and to determine how they regulate these increases and most of the agencies that we looked at

limited that water surface elevation increase to a foot.

Given the level of accuracy of the modeling software as well as the policies of these

neighboring agencies staff determined that the current adopted regulations were too restrictive.

Additionally during this review staff also determined that there was a clerical issue

in the general plan flood policies related to non-havital structures that needed to be

The previously adopted amendments from 2014 were inadvertently left out of the 2019 general

plan update and these proposed amendments will reinstate the previously adopted policy

Here are the proposed amendments to the general plan.

It would amend general plan policies ER2-6 and ER2-16 to allow the development of non-habitable

structures and public infrastructure within the 100 year floodplain on a case by case basis.

As I mentioned such exceptions must result in no net increase to the water surface elevation

The amendment to the general plan would also include a definition of habitable and non-habitable

The amendment would also revise and add definitions of habitable and non-habitable structures

to be internally consistent between the municipal code and the general plan.

The review of the environmental analysis for the project staff determined that no further

environmental review is required under state CEQA guidelines 15183 and 15162.

In February of 2019 an EIR was certified by the city council as part of the Elk Grove

general plan update and no potential new impacts related to the project have been identified

that would necessitate further analysis beyond the impacts and issues already disclosed and

analyzed in the general plan EIR.

Staff recommends that the planning commission adopt a resolution recommending that the city
