The Erie Planning Commission met on Wednesday, February 5, 2020 at 6:30 PM in Council Chambers at 645 Holbrook Street, Erie, CO. Commissioners present: Witt, Fraser, Zuniga, Hedahl, Vice Chairman Harrison, and Chairman Bottenhorn; Commissioner Ames was absent/excused. The commission approved the agenda and prior minutes, conducted a public hearing for the Sunset Preliminary Plat, and unanimously recommended approval of two resolutions to the Board of Trustees.

Discussion Items: Sunset Preliminary Plat (Agenda Item 20-033 / Resolution P20-02)
- Senior Planner Hannah Hippely presented the application, describing the property location (adjacent to Erie Highlands, a gun club, the landfill, town open space and bike park, and the Westerly development), existing on-site conditions (topography, surface and subsurface oil/gas facilities, overhead WAPA power lines), proposed access points, pocket parks, open space with a conservation easement, a spine trail connection, and a staff recommendation for conditional approval. Staff stated the expected density is 2.06 dwelling units per acre.
- Applicant representatives presented: Steve Foley (FS Erie Estates, LLC), Karen Henry (Henry Design Group), John Chaney (Lennar), and Brian Connolly (Otten Johnson). They highlighted the project's history, including annexation and a 2014 approved plat, and described the proposed 238-lot plan. Karen Henry stated a gross density of 2.29 dwelling units per acre. John Chaney said the project would include about 12 floor plans with 36 elevations, solar as a standard feature, and projected more than $13 million in building permit revenue for the town. Brian Connolly argued the project meets comprehensive plan and UDC criteria.
- Commissioners asked questions about County Road 5 improvements, truck traffic rerouting, open space purchase history, rear-yard storm drainage, access points and setbacks, visibility, traffic calming, loss of greenways, compliance with urban vs. rural zoning, landfill lifespan (stated as 2035), oil/gas activity, storm drain maintenance, expansive soils, duplex price points, power line connections, school capacity, housing styles, sightlines for homes along the road, and the option of backyards facing the gulch.
- Commissioner Hedahl expressed support for the project's design but raised concerns about surrounding uses (gun club, salvage yard, landfill, oil/gas) and emphasized the need for full buyer disclosures. Commissioner Witt asked about maintenance responsibility for the rear-lot storm drain system, which was answered as a metro district responsibility. Commissioner Harrison, a Compass resident, asked about drainage access, soil mitigation, noise abatement, and school capacity. Commissioner Zuniga commended the layout and asked about grade, traffic calming, and price points.
- Motion by Commissioner Fraser, seconded by Commissioner Witt, to approve Resolution P20-02. The motion carried unanimously.
Discussion Items: Planned Development Zoning Amendment (Agenda Item 20-055 / Resolution P20-01)
- Deborah Bachelder, Planning Manager/Deputy Director, presented the proposed amendment to Erie Municipal Code Section 10-7-23(A)(1). The amendment would remove the current restriction limiting PD modifications to specific UDC chapters (use regulations, dimensional standards, subdivision layout/design, and development/design standards), instead allowing modifications to any portion of the UDC. Bachelder noted this was in preparation for the Erie Town Center Planned Development.
- No commissioner questions or comments were offered.
- Motion by Commissioner Fraser, seconded by Commissioner Hedahl, to approve Resolution P20-01. The motion carried unanimously.
Staff Reports
- Deborah Bachelder noted there were no items on the February 19, 2020 agenda and that a cancellation notice would be sent. The March 4, 2020 agenda would include Erie Town Center and Nine Mile Corner.

- Commissioner Zuniga asked whether a designer had been selected for Crescent Park. Deborah Bachelder responded that the Parks Department would decide that.

This apportion of the evening for anyone wishing to address the commission on an item that is not on this evening's agenda. Doesn't appear to be the case, so we're on to our general business items. Uh first is a resolution recommending that the Board of Trustees approve the sunset preliminary plat with conditions. Turn it over to staff and open the public here. Thank you. Good evening. Hannah Hipley, senior planner at the town planning and development department, and I will be presenting the sunset preliminary plat to you this evening. This slide here is showing the property in red. Um, just to give you some context to where it's located. Um, Erie Highlands is to the north, um, the gun club is to the west. The landfill in the town open space and bike park to the south, and the westerly development to the east. Um, one thing I did want to point out on this slide is to note the locations of the schools because we did receive feedback from the St. Brain Valley School District that they would not need uh a land dedication with this application. This is the existing conditions on the site.
