The Erie Planning Commission met virtually on June 2, 2021, at 6:30 PM, adjourning at 9:19 PM. The meeting included two public hearings recommending approval of preliminary plats for Canyon Creek Filing No. 7 & 8 and Parkdale Preliminary Plat No. 2, as well as a postponed study session, staff reports, and commissioner discussion.
Consent Calendar
- Approved the agenda of the June 2, 2021 meeting (unanimous roll call vote, with Commissioner Luthi unable to vote due to technical issues).
- Approved the minutes of the May 19, 2021 Planning Commission meeting (unanimous roll call vote).
Public Comments & Testimony
Canyon Creek Filing No. 7 & 8 (Resolution P21-09):
- Kimberly Stewart (1369 McGregor Circle, Erie) expressed concerns about: the 350-foot oil and gas setback being insufficient, preserving environmental aspects (ditches, trees), the trail near the oil well, short alleys over 150 feet (dead-end alley issue), the Jasper Road extension, and traffic safety at Red Hawk Elementary (Telleen Avenue and Jasper Road). She questioned the timing of the traffic study (pre-COVID).
- Emailed comments from Shayne Summers and Leon Schneider were forwarded to the commission.

Parkdale Preliminary Plat No. 2 (Resolution P21-08):
- Maria Zabel (1002 N. 119th Street, Lafayette) opposed the duplex dwellings, citing safety concerns for Foxhole Airport (airstrip) – wind shadows, approach hazards, and lack of proper zoning or avigation easements. Also raised concerns about livestock trespassing, obstruction of views, noise, and ditch burning.
- Jerry Howard (12025 Baseline Road, Lafayette) opposed the development, questioning the density (stated 5 units/acre but shown 12-16), proximity to the airport, drainage/flooding, traffic on 119th Street, and that the plat map did not match the applicant's renderings.
- Tracy Davison Parks (12121 Baseline Road, Lafayette) attended to collect information.
- Neil Bresler (1002 N. 119th Street, Lafayette) opposed the entrance location (close to Baseline Road turn) and the turn lane ending at the entry spot.
- Eric Folwell (121067 Baseline Road, Lafayette) noted the plat doesn't match the description, questioned why future access roads are planned through properties still zoned agricultural in the county, and asked if Erie intends to annex those areas.

Discussion Items
Canyon Creek Filing No. 7 & 8 Preliminary Plat:
- Senior Planner Chris LaRue presented the 70+ acre plat with 106 single-family detached units and 88 alley-loaded paired homes, plus 26 tracks for landscaping, parks, trails, utilities, and open space. Constraints include an oil/gas well (350-foot setback met), a mine shaft (to be capped), and undermining issues. Staff recommended approval with conditions.
- Applicant Roger Hollard (Stratus Companies) provided additional details: the site is the final phase of the Canyon Creek PD (30-year history), includes the adjacent Lafferty property, and addresses oil/gas flowline relocation, subsidence mitigation (Chase and Jackson mines), ditch preservation, and trail connectivity. He noted KB Homes is under contract to build.
- Commission questions covered: mine locations (Jackson mine anomaly), traffic at Jasper Road and the school (four-way stop, possible future signal), trail connectivity, snow storage in townhome areas, privacy fencing, ditch maintenance, gas line relocation, housing diversity, density, and the timeline for Jasper Road extension to J Road (roundabout included).
- Commissioner Sawusch noted the traffic study was done pre-COVID (Feb 2019). Commissioner Hoback expressed concern about traffic flow and resident frustration. Commissioner Luthi appreciated the lower density and larger pocket parks. Commissioner Witt, a geologist, commended the thorough mine report but noted additional borings needed for Jackson mine.
Parkdale Preliminary Plat No. 2:
- Senior Planner Audem Gonzales presented the 34-acre plat with 204 lots (107 single-family detached, 96 duplex lots, 1 existing residence lot), one pocket park, spine trail, and a plugged/abandoned oil well (25-foot setback). The overall Parkdale density is 3.2 du/ac (consistent with low-density residential), but this plat is 6 du/ac (exceeds LR max of 5 du/ac, but allowed when considering the whole community). Housing diversity not met; future filings will provide additional types. Staff recommended approval with conditions, including a special review use for existing agricultural uses and off-site easements.
- Applicant John Prestwich (PCS Group) presented the site design with alley-loaded garages, green courts, and a roundabout entrance. He noted the project has been in development since 2015, with filings 1 & 2 under construction. The current plat extends the spine trail and provides future access stubs.
- Commission questions focused on: ingress/egress (only right-out onto 119th Street, future connection to County Line Road and Highway 7), traffic study dates (2016, 2018, 2020 – Commissioner Sawusch suggested an updated study), Foxhole Airport (staff said no FAA-regulated zones, no adverse impacts expected), mining/subsidence (CGS found no hazards), density calculations, open space (met by filing 1), snow storage, metro district, and road widening of 119th Street.
- Commissioner Hoback expressed concern about safety if only right-turn allowed, forcing residents to meander through residential areas. Commissioner Witt asked that housing diversity be addressed in future filings. Commissioner Luthi noted the importance of looking at the whole project.
Key Outcomes
- Canyon Creek Filing No. 7 & 8 Preliminary Plat (Resolution P21-09): Approved unanimously (5-0) with conditions. The resolution recommends the Board of Trustees approve the plat with conditions related to oil/gas, mine capping, right-of-way, ditches, and traffic improvements.
- Parkdale Preliminary Plat No. 2 (Resolution P21-08): Approved 4-1 (Commissioner Hoback dissenting) with conditions. The resolution recommends Board of Trustees approval with conditions including off-site easements, existing residence access, special review use, and flowline removal.
- Planning Commission Study Session (21-224): Postponed to the next meeting to allow full commission participation (Chair Zuniga and Commissioner Ames absent).
- Staff Reports: Deborah Bachelder reported that Design Workshop was selected as the top candidate for the Comprehensive Plan project; a consulting contract will go to the Board of Trustees on June 22, 2021. She also reminded commissioners to route documents through staff for agenda packets.
- Commissioner Reports: Commissioner Luthi asked about tree lawn maintenance in rights-of-way; staff clarified that changes to street trees typically require a permit but not a development plan amendment. Commissioner Sawusch inquired about the Comp Plan scoring process (weighted cumulative score from 21 reviewers) and expressed confidence in the chosen consultant.
