Greenville Board of Adjustment Meeting – November 20, 2020
The Greenville Board of Adjustment held a remote quasi-judicial hearing on November 20, 2020, chaired by Michael Glenn. The meeting was conducted via electronic platform under session law 2020-3 due to the emergency declaration. The only agenda item was a request for a special use permit to place a mobile home on a vacant lot. All participants consented to the remote format. The board unanimously approved the permit and also addressed a follow-up question from the previous meeting regarding Sandstone Court.
Consent Calendar
- The board unanimously approved the minutes from the October meeting. Motion by Ann Bellis, second by Rodney Bullock. Vote: 6-0.
Discussion Items
- Special Use Permit (David Rice / Levon Johnson) : The applicant requested permission to place a mobile home on a 0.37-acre vacant lot at 1110 Benjamin Drive (tax parcel 4589). The property is zoned RA20 (Residential Agricultural) and is surrounded by other mobile homes. Staff representative Elizabeth Blunt presented the staff report, noting that the surrounding uses are consistent with the request, the property is within the low-to-medium density residential character type per the Horizons plan, and the future land use recommends single-family detached residential development. Staff had no objection. No conditions were recommended. The board found that the request met all special use permit criteria (comprehensive plan, health and safety, detriment to public welfare, injury to properties, nuisance/hazard) without a formal vote. The board then voted to approve the petition unanimously (6-0).
- Sandstone Court Follow-Up : At the request of board member Ann Bellis, staff reported that Sandstone Court is a privately owned roadway, not city-owned or state-maintained (NCDOT). Chair Glenn noted the matter was outside the board's jurisdiction.
Key Outcomes
- Approval of Special Use Permit : The board unanimously approved the request by David Rice for Levon Johnson to place a mobile home at 1110 Benjamin Drive. Motion by Rodney Bullock, second by Christopher Lilly. Vote: 6-0.
- Adjournment : The meeting was adjourned unanimously (motion by Rodney Bullock, second by Ann Bellis).
Meeting Transcript
Okay, this is Ballerie. I'm so sorry. You all you all are now live on YouTube. All right. Uh are we good to proceed, Ms. Blunt. Okay. All right. Uh good evening. The meeting will now come to order. I want to welcome you all to the November 19th meeting of the City of Greenville Board of Adjustment. My name is Michael Glenn, and I'm the chair of the board. I'd like to start by acknowledging that we're conducting this meeting using a remote electronic platform. I'd ask for your patience as we proceed, as there might be a slight delay as we transition between uh slides and speakers. The Board of Adjustment is a quasi-judicial body that is governed by the North Carolina General Statutes and the City's Code of Ordnance. We conduct evidentiary hearings and requests for special use permits, variances, appeals of administrative decisions, and interpretations. Before we begin, I'd like to provide some important information about the steps taken to ensure that each party's due process rights are protected as we proceed in this remote platform. First, tonight's meeting will be conducted in accordance with the newly enacted statutes in session law 2020-3, which allow for remote meetings and quasi-judicial hearings during declarations of emergency. Second, each applicant on tonight's agenda was notified before being placed on the agenda that this meeting will be conducted using a remote electronic platform. Every applicant on tonight's agenda has consented to the board conducting the evidentiary hearing on their request using this remote platform. We will also confirm tonight at the start of our only hearing that the participants in the evidentiary hearing consent to the matter proceeding in this remote platform. No case is proceeding tonight in which the city has been contacted by an individual who objects to this meeting being heard by way of simultaneous remote meeting platform. Third, notice of this meeting was provided to the applicants and to the public in numerous ways. Specifically, notice of tonight's evidentiary hearing was provided by mail to all property property owners within 250 feet of each subject property. The mailed notices were sent two weeks in advance of the meeting date and within the law to provide such notice. Each notice letter notified the recipient of the remote meeting platform. Notice was also provided by posting signs on the site of each property, publishing notice in the newspaper, and providing notice on the city's website. Each of these notice methods were also done with within the legal requirements to provide such notice. No new documents will be presented at tonight's meeting, and all decisions of this board are subject to appeal with the Pitt County Superior Court. Finally, all individuals who signed up to participate in an evidentiary hearing on tonight's agenda were mailed a witness oath form. Any individual planning to testify or submit evidence in an evidentiary hearing was notified that they must sign the oath form prior to tonight's meeting. I will reaffirm everyone's oath on the record uh as we begin. All right, uh Mr. Clerk, if you would please uh call the role for us. Yes, sir. Michael Glenn. Yes, present. Rodney Bullock. Yes. Ann Bellis. Hunt McKinnon. Christopher Lilly. Here. Sharon Evans. Stephen Atkinson? Here. Nathan Cohen. John Landrine? Mr. Chair, you have uh a quorum.
