The Greenville Board of Adjustment convened virtually on January 27, 2022, at 6:00 PM, chaired by Rodney Bullock. The board conducted three quasi-judicial evidentiary hearings on special use permit requests and addressed routine business. All three applications were approved unanimously with staff-recommended conditions.
Approval of Minutes (December 16, 2021)
- The board postponed approval of the December 16, 2021 minutes to the next meeting after a request to add a parenthetical explanation regarding a condition on generator testing timing. The motion to continue passed unanimously.
Public Hearing: RF Storage LLC – Special Use Permit for Mini-Storage (No Outside Storage)
- Applicant: RF Storage LLC, represented by Rocky Russell (co-applicant) and expert witness Steve Janowski (Rivers and Associates, civil engineer). The request was for a mini-storage warehouse (household items, excluding outside storage) on a 20.55-acre parcel at 0 Whitley Drive (tax parcel 13361), zoned CG (General Commercial). The proposed use would occupy about 6 acres with multi-unit storage buildings, including climate-controlled units and a few large enough for boat storage.
- Staff Report (Elizabeth Blunt): Noticed property owners within 250 feet, published in newspaper. Recommended conditions: final platting, stormwater management, erosion control, and site plan approval prior to building permit; prohibition of exterior storage.
- Board Decision: The board approved the findings of fact and the petition with staff conditions. The motion to approve the permit was unanimous (7-0). No opposition or public comments.
Public Hearing: Triple B #6 LLC – Special Use Permit for Warehouse/Mini-Storage with Outside Storage
- Applicant: Triple B #6 LLC, represented by attorney Jerry Eatman, expert witness Brian Fagundis (Arts Consulting Group, licensed professional engineer), and owner Robert Hye. The request was for a warehouse/mini-storage facility with outside storage on two parcels totaling 9.64 acres at 1015 SW Greenville Boulevard (tax parcels 04604 and 58456), zoned CG. The outdoor storage component required the special use permit.
- Staff Report (Elizabeth Blunt): Noticed properly. Recommended conditions: compliance with building codes.
- Board Decision: The board unanimously approved the findings of fact and the petition with staff conditions. No opposition.
Public Hearing: Joel Torres – Special Use Permit for Restaurant with Regulated Outdoor Activities
- Applicant: Joel Torres, represented by Michelle Clements (expert in site planning/development) and Mariah Schuchuk (expert in project management/landscape architecture) from The East Group. The request was for a restaurant with outdoor dining on a 0.96-acre parcel at 2516 E. 10th Street (tax parcel 16442), zoned CG. The outdoor activity area would be on the front portion of the building.
- Staff Report (Elizabeth Blunt): Noticed. Recommended conditions including restrictions on outdoor activity hours (7 a.m. to midnight or restaurant close, whichever earlier), lighting directed away from residential properties, no neon/flashing signs, and compliance with building codes.
- Board Decision: The board unanimously approved the findings of fact and the petition with staff conditions. No opposition.

Mr. Chair, you are now live. Very good. This meeting will now come to order. Welcome to the January 27, 2022 meeting of the City of Greenville Board of Adjustment. My name is Rodney Bullock, and I am chairman of the board. I'd like to start by acknowledging that we are conducting this meeting using a remote electronic platform. This is the virtual meeting of the Greenville Board of Adjustment. I would ask for your patience today as we proceed. There may be slight delays as we transition between speakers, participants, and presentations. The Board of Adjustment is a quasi-judicial body that is governed by the North Carolina General Statutes and the City's Code of Ordinance. We conduct dividendary hearings on requests for special use permits, variances, appeals of administrative decisions, and interpretations. Before we begin the evidentiary hearings on tonight's agenda, I would like to provide some important information about the steps taken to ensure that each party's due process rights are protected as we proceed in this remote platform. First, tonight's meeting will be conducted in accordance with the enacted statutes in session law 2020-3, which allow for remote meetings and quasi judicial hearings during declarations of emergency. Second, each applicant on tonight's agenda was notified before being placed on the agenda that this meeting would be conducted using a remote electronic platform. We will confirm tonight at the start of each evidentiary hearing that the participants in the evidentiary hearing consent to the matter proceeding in this. I'm sorry, hearing consent to the matter proceeding. Um in this matter, no case is proceeding tonight in which the city has been contacted by any individual who objects to this meeting being heard by way of a simultaneous remote meeting platform. Third, notice of this meeting was provided to the applicants and the public in numerous ways. Specifically, notice of tonight's evidentiary hearing was provided by mail to all property owners within 250 feet of each subject property. The mail notices were sent at least two weeks in advance of the meeting date and within the law to provide such notice. And each notice letter notify the receipt of the remote meeting platform. Notice was also provided by posting signs on the site of each property, publishing notice in the newspaper and providing notice on the city's website. Each of these notice methods were also done within the legal requirement to provide such notice. Tonight's meeting notices contain information about the means by which the public can access the remote meeting as the meeting occurs. All individuals participating in tonight's evidentiary hearings were also required to submit a copy of any presentation, document, exhibit, or other material that they wish to submit at the evidentiary hearing prior to tonight's meeting. All materials that the city received from the participants of tonight's cases, as well as a copy of city staff's report and documents were posted online on the Board of Adjustments meeting schedule and agenda prior to this meeting. All materials that will be discussed today can be viewed at any time during tonight's meeting by visiting the Board of Adjustment page on the city's website and clicking the November, I'm sorry. And clicking uh the January 27, 2022 agenda and meeting pack link. No new documents will be presented at tonight's meeting. All decisions of this board are subject to appeal with the Pitt County Superior Court. Finally, any individual planning to testify or submit evidence in an evidentiary hearing will have to provide their consent for tonight's meeting.
