The members of the Board of Adjustment are laypersons, and as such, the rules of evidence that are followed in a court are relaxed for cases heard before this body.

However, such an opinion may be admissible if it is made by an expert or a person who is qualified to give opinions concerning traffic hazards, is making a presentation to the board concerning his or her investigation and the basis for his or her conclusion in the report.

5:22

A lay person can give an opinion, but he or she must also present facts to show how the proposal affects his or her piece of property specifically and not just in a general way.

5:32

A statement that another person who is not present and not testifying either supports or doesn't support the petitioner or application is hearsay and is not admissible.

5:41

The same rule applies to both the applicant and those in opposition.

Greenville Board of Adjustment Meeting - June 22, 2023

The Greenville Board of Adjustment met on June 22, 2023, at 6:00 PM in City Hall Council Chambers. The meeting included approval of previous minutes, a decision on an old business special use permit, two public hearings for new business, announcements, and adjournment. Attorney Phillips provided procedural guidance on quasi-judicial hearings.

Consent Calendar

  • February 23, 2023 Minutes: Approved unanimously.
  • May 25, 2023 Minutes: Approved unanimously.

Old Business

  • Proposed BOA Decision and Order Granting Special Use Permit for Richard P. and Meridith Rizzuti: This item concerned a special use permit for a multi-purpose center (not a parking lot, as clarified). Due to two board members' absences and two non-voting members, only four voting members remained. Attorney Phillips confirmed a quorum existed and a majority of four (three votes) could decide. The board voted to move forward with the previously drafted decision (motion by Ann Bellis, seconded by Daniel Worrell, 4-0). A second motion to adopt the proposed decision (motion by Daniel Worrell, seconded by Ryan Purdle) passed 4-0. Later, a technical correction was made to change the signing authority from Sharon Evans to Vice Chair Christopher Lilly; this amendment passed unanimously.

New Business

  • Public Hearing – Ahamed Saleem (Tobacco Shop Expansion): The applicant sought a special use permit to expand an existing tobacco shop at 141 SW Greenville Boulevard into an adjacent unit. Staff presented conditions. However, the application packet contained pages from a different applicant (Ulysses Cisneros) and included construction details unrelated to the special use permit. After discussion about standing and application completeness, a motion to continue the matter to the next regular meeting was made by Hunt McKinnon and seconded by Ann Bellis. The board voted 4-3 to continue, with the requirement that the applicant submit a corrected, complete application free of additional fees.
  • Public Hearing – Kevia Braxton (Mobile Home Placement): The applicant requested a special use permit to place a mobile home on a lot at 3900 Azalea Street. Staff noted the site is in a floodplain and must comply with elevation requirements (2 feet above base flood elevation) and state building codes. No opposition was present. The board approved the finding of facts and the petition with staff-recommended conditions, each motion passing unanimously.

Key Outcomes

  • Old Business: The Rizzuti special use permit decision was adopted (4-0). The signing authority was corrected to Vice Chair Christopher Lilly.
  • Saleem Tobacco Shop: Continued to July meeting (4-3 vote). Applicant must submit a corrected application with no additional fee.
  • Braxton Mobile Home: Approved unanimously with conditions, including floodplain compliance.
  • Announcements: Hunt McKinnon and Ann Bellis were recognized for their six years of service on the Board of Adjustment as they rotated off.
