If you recall at the last planning commission, Director Allen, who is in the audience today, and myself presented the proposed changes to the parts and private parts ordinance in order to meet with chapter 212 of the local government code.

Today's purpose of public hearing is to hear from you on your thoughts about our proposed changes as well as anything else related to the parts and private parts presentation.

So, with that said, I welcome uh Chair Clark to open the public hearing.

Thank you for your consideration of the changes to the open space ordinance.

This ordinance has been largely unchanged since 2007, and I am grateful for the attention it is being given, as it is a very important source of funding for our Houston parks.

In addition to the updates that you see on the screen, I am here to that that will align us with state law.

I am here to advocate for an increase to the fee.

5:33

This fee of $700 a door has not changed since 2007.

5:38

Now I can't really name too many things in my life where the cost has not changed in almost 20 years.

This fee has not been changed in spite of the fact that the ordinance calls for an annual analysis of the taxable value of land and an accompanying presentation to the planning commission.

The ordinance further states that the parks and planning directors may recommend an increase to the fee based on increases in appraised values.

Since 2009, Parks and Rec has collected a hundred million dollars in fees.

With this funding, 199 parks, 52% of our 382 city parks have been improved, and 65 acres of parkland have been acquired.

By ordinance, these funds are to be used for the acquisition and improvement of parks, not for park maintenance or city staff overhead expenses.

Five percent is set aside for indirect costs like design.

In recent discussions with the parks director, that's not quite enough of a percentage for design.

He's not able to do the projects that need done without a little more money.

6:46

So that's another thing that I think should we should be looking at in when we're opening up this ordinance.

Houston Parks and Rec estimates current unmet needs over the last next about seven years of over 700 million dollars.

This number includes 34 million dollars in critical unmet immediate needs, 105 million dollars for playgrounds, 210 million dollars for community centers, 120 million dollars for aquatic facilities, 90 million dollars for basketball pavilions, nine and the list goes on and on.

These are big numbers.

And that's not to mention the need for requiring additional parkland to accomplish each part's goal of having everyone in Houston live within a 10-minute walk to a park.

Current estimates from the Trust for Public Land show that only 64% of Houstonians meet that standard.

A world-class city needs world-class parks, and not just our signature parks like Memorial and Herman and Emancipation, but how about our neighborhood parks, the ones near people's homes and apartments?

I think the success we've had along the Bayou Greenways and at Herman and Memorial and others kind of masks the true need of our neighborhood parks.

As an at-large council member, I travel all to all corners of this city, and I see that the condition in many of our parks is deplorable.

Broken swing sets, busted lights, rusty playground equipment, damaged basketball pavilions, sports fields and disarray, rundown community centers.

You know, we see we see a whole lot, and it takes a lot of funding to get those things improved.

There is a case definitely to be made for increasing the fee.

The city's costs have certainly gone up over the past 20 years.

8:28

Adjusting the fee for inflation would bring it to 1,11.

Based on appraised land value increases, the fees should be $1,470.

8:40

Now there's a state state legislation that caps us at 1295.

8:44

Austin, Dallas, El Paso, Fort Worth, all charge considerably higher fees.

While our needs are great, I also understand these fees impact the cost of development and will ultimately pass be passed along to Houstonians.

That is not lost on me.

Affordability is a big issue these days, and one we can't ignore.

So I don't I'm not advocating we go to the very top.

I do think it is reasonable to ask to go to the adjusted to CPI of 1,113.

The planning and parks director submitted their report at the last commission meeting, and this report showed our current fee.

You can see up on the screen the fees that were shown.

According to Chapter 2, Section 253C, the report shall include an analysis of changing in the taxable value of land.

It further states the planning commission shall review the report, conduct a public hearing on any recommended increase in the fee, and issue a final report.

So you however this commission wants to handle it.

And I've spoke with Director Tran and Marlene Gafferick and Director Allen.

You know, you can either perhaps delay consideration of all the changes to have more discussion.

We're in the middle of budget season right now.

We're not going to increase a fee right now.

We're but but later in the summer, I think we really ought to take this up and really make sure we hear from all the stakeholders.

Um the five percent in indirect costs.

I think that's worthy of discussion.

So we either, depending on what the administration wants to do, um, pass the pass the the earlier changes that you saw on the screen now and come back to you in a couple months with with the the additional matters, or just put the whole thing off.

That that's not up to me, that's up to you guys.

I'm just here on record to to really talk about uh how we need this fee.

Better and more parks mean safer communities and improve property values and an enhanced quality of life for all Houstonians.

Parks are an essential part of this city.

Parks are public treasures.

Every resident and family in Houston should be able to enjoy a nice safe park nearby.

With additional funding for improvements and new parkland, the city will be in a much better position to make this happen.

I am a resident of Third Ward, Vice President of the Third Ward Super Neighborhood, uh founder of a nonprofit called Friends of Columbia TAP, and I'm also an urban planner.

I am here to support the uh fee increase.

I'm also here to support the 7030 split.

Um I was actually the resident who back in 2021 filed a public information act request to actually get a breakdown of the park dedication funds because they hadn't been presented to the commission or the city council for years and years and years.

And it was from that PIA that I was able to present the data to the City Council, and I'm so grateful that ever since then, uh Sally Elkhorn has been a great advocate and ally uh to the citizens of Houston in rectifying this long-overdue update.

Um I support as Sally Elkorn laid out an increase that's more um uh amenable to the adjusted land value change because it's the parks themselves that have contributed to that increase in property values.

Study after study show that access to quality parks increases property values.

We've done studies on the bio greenways.

13:44

You can just look at what's happening around Levy Park, around Emancipation Park, around all of our trails, the MKT trail in the heights.

We owe it to our residents to reinvest back in parks, especially because at the general fund level, you know, we've been seeing cuts year after year.

And so at the very least, this fund, we need to um not only stay up with inflation, but we need to look at uh where we should be in terms of property values in our pure cities.

Um, in terms of the 7030 split, we should not be locking these parks funds into boundaries that were established because of our location of highways.

Our need for park space does not end at the highway, and those highway boundaries were themselves uh placed over historic redlining.

So the 7030 split helps to rectify some of that historic injustice, and I support that fully.

I work for the Greater Houston Builders Association.

We're a trade association of 1,500 members that work in single-family home building across our region.

Um, and our members are the ones that have paid into the fee uh since 2007.

And I'll say that our members are not necessarily against a fee increase, a nominal fee increase.

However, like Ed had just mentioned, the big issue that they have is they've spent thousands and thousands and millions of dollars and don't have any and have not had a and have not seen what that money's been spent on annually, like the ordinance requires.

So I think if there's a promise that's that uh the what the money's been spent on is reported more consistently to the commission and to the council, I think we can be more amenable to um a nominal fee increase.

But like the council member mentioned, um, even though the three hundred dollars or four hundred dollars might not seem like a lot per single-family home, when you add that along with all the other fees to build a single-family home, inspection fees and and plating, um, it adds up over time.

Um, and I like to say it's like it could be like death by a thousand paper cuts.

So um I I hope um that that's taken into consider into consideration.

Um, we're we're not anti-a fee increase.

We just want to be sure that what the fees are being collected are actually being spent to um make our city and our parks great places to be in.

Um, so uh I was delighted to to see uh Councilmember Alcorn here.

So I am a Houstonian, I am uh neighbor to Levy Park, which I love, and I am also a design and planning professional and vice president of Friends of Columbia Tap.

And I also am a huge fan of the 70-30 split, uh, because I think more people should have a Levy Park in their backyard.

I absolutely love it, and I don't see why our friends in other neighborhoods who do not uh have natural occurring dollars coming from the higher end developments benefiting the parks.

The parks are the lungs of our cities, they do heavy lifting for the industry that we conduct here, and it's really important that we invest in those.

Definitely a fan of the extension of the three from three to five years on uh use of that.

I love hearing uh industry folks saying that they're okay with a nominal fee increase, uh, because I don't believe that it will make things unaffordable to also have a uh responsible fee increase.

And so I am a fan of whether like uh council member said whether you do it now as an add-on or you revisit it, please.

Um, for those of us working with the small parks, the ones that are actually accessible that you don't have to drive through to and pay to park for our Houstonians.

I'm here representing the Houston Apartment Association.

Uh the Houston Apartment Association is made up of over 1,500 members who represent over 750,000 doors, our units in the Greater Houston region.

And first I'd like to thank you all for allowing me to speak on this proposed change to the open space ordinance.

While it's not in the current proposal, the increase in the park dedication fee raises concerns for HAA members.

18:41

Greater development costs, including on projects with hundreds of units, would have an adverse effect on our members' ability to provide affordable housing in the city of Houston at a time when affordable housing is needed the most.

For example, increasing the fee from $700, potentially as high as $1,200 for a project that is currently coming online with 388 units, would add 194,000 in development cost.

This is just one example for one property.

But when applied industry-wide, this would amount to a significant cost to HAA members and substantially impact the ability to deliver affordable housing.

As this commission and city council consider these amendments to the open space ordinance, we ask that you be mindful of the impact these decisions would have on the construction of affordable housing in Houston moving forward.

My name is Sylvia Rivas, president for the Brays Oak Super Neighborhood Council, representing Super Neighborhood Council 36, representing 39 communities within the super neighborhood boundaries.

The collection of park dedication, parkland dedication fees under Chapter 47, Division 7, has been comparatively limited because Brays Oaks, like many areas throughout the Houston, has not experienced the same level of development as other parts of the city.

Allowing up to 30% of the fees that are collected from public and private park requirements in compliance with the Texas local government code would provide a critical funding source to help support the continued improvements, expansion, and maintenance of community parks in all areas.

This flexibility would help address longstanding disparities in park investments, enhance recreational opportunities, improve quality of life for Houston residents, and ensure that growing communities needs can be met despite lower rates of new development.

It addresses inequity, directing funds to underserved neighborhoods rather than just where the development is occurring.

It's responding to rapid growth by prioritizing critical needs in high density areas that lack sufficient green space.

And the strategic maintenance that's tackling a city's most urgent park repairs, regardless of the location.

Our parks create shared spaces where people of different ages and backgrounds can meet, interact, and build stronger communities.

These areas can help manage stormwater to help reduce flooding that's impacted so many of our communities throughout the Houston area.

Well maintained parks can reduce neglected spaces, improve neighborhoods, appearances that contribute to greater sense of safety and civic pride.

And by day, I'm a real estate broker.

I am in favor of the increase or price adjustment of the fee that was proposed by councilwoman Sally Alcorn.

And I also want to thank her for her strong commitment to our communities.

I want to paint a picture for everyone.

Our community is comprised of mostly seniors.

Seniors that had historically been afraid of going to the parks because many of our parks, unlike the parks that are known to the majority of Houstonians, was lacking something as simple as street lights.

Many of our parks go without the grass being cut regularly.

Now we can say that's another issue or handled by a separate department.

But the fact is many of our parks in our low-to-modern income communities have gone overlooked for many, many years.

I am definitely in favor of the 7030 split.

I do believe that it would give us what we need to be able to service our community properly.

I'm also an affordable housing specialist in my career.

And with that being said, prices, sales prices of homes and sales prices of apartments, rental prices are continuously going up, and that fee has remained the same at $750 dollars.

I do not feel that the fee is significantly a significant increase, but I do feel that it is mandatory for our communities to continue to thrive.

I'm Taylor Valley Presley, the parks equity analyst and advocate for the coalition of environment equity and resilience, and also a former historic preservation planner here at the city.

So it's weird being on the other side.

Here in Houston, we love our parks and want to see them continuously grow and flourish from the smallest neighborhood parks to the larger, more well-known parks.

However, we are aware that cuts to the parks and recreation department from this past fiscal year continuing into 2027 budget cycle have made park resources scarce, and we want to explore everything we can to bring resources and equity to our parks.

But we want to see the city raise the developers' fees that go towards the parkland dedication fund.

The city can still raise the fee from the current $700 per dwelling unit while still being considered a low fee option, which was defined as less than 2% of the medium family income as long as is as long as it does not exceed 1,296.26.

The approximate adjusted inflation from $700 in 2007 to 2026 is just a little over eleven hundred dollars, like Council Member Alcorn um specified earlier, and that's still below the 1296-26 quoted in the last presentation.

There has been hesitancy to raise these fees due to the belief that this could further encourage unaffordability by developers raising their pricing based on these higher fees for them.

But even the smallest raise from the current $700 can make a big difference towards our parks through the parkland dedication fund while both staying in compliance and keeping housing within affordable margins.

We believe the inflation and raise in land value from two thousand from 2007 to 2026, nearly 20 years later, warrants a fee raise to benefit our Houston parks.

We think we deserve that.

I'm the vice president for the Civic Club, but I also am a climate ambassador with SEER, my colleague there, Coalition for Environmental Equity and Resilience.

So we are in favor of raising the fee.

We are advocating for more funding to go towards the parkland dedication fund by raising the raising the in lieu fees that developers pay, which have never been raised since the inception of the ordinance in 2007.

While we highly support the 70 30 split of the collected funds and the expanded amount of time to oblige the collected funds from developers, we strongly believe that with the inflation and raises in land value that have occurred since 2007, that the current fee of seven hundred dollars per dwelling unit is highly outdated, and a raise is warranted.

The fee can be raised even if even slightly while still being in compliance with the low fee option and not making the prices of homes and apartments to skyrocket while making a difference for the benefit of our parks.

Something I love about the work we do is learning about Houston's history from an architecture and urban point of view but also a community point of view.

When we undertook the redevelopment of the Barbara Jordan Post Office just a few blocks away, I realized how important it is to showcase our history while encouraging future growth and not let things stagnate or, as is too frequent in our city, get torn down.

Since then I've been involved in a number of other adaptive reuse projects, including the uh Houston Post Newspaper Building in Edo, and many others.

And let me tell you, these are tricky projects, but they're really worth it.

Um we started looking at kind of the design for the Folgers Coffee Building.

I learned it was the third Folgers plant in the country after San Francisco and Kansas City.

When it opened in 1930s, it coincided with an expansion of the ship channel.

And at the time, coffee was Houston's number one import through the port, which I just found fascinating as an economic driver for the neighborhood and an existing legacy that we have.
