Huntington Beach City Council & Public Finance Authority Special Meeting (2025-11-21)

The Council convened a special meeting primarily to take public comment and then meet in closed session regarding a stated “threat of litigation.” The City Attorney advised there would be no open-session business following closed session. The meeting drew heavy public participation (41 emails received and 40 speakers), largely focused on whether the City should proceed with (or reconsider) employing former City Attorney Michael Gates, with speakers expressing sharply divided views about his record, alleged workplace conduct, and potential liability to the City.

Public Comments & Testimony

  • Multiple speakers expressed support for Michael Gates returning to the City Attorney’s office, characterizing him as a strong defender of Huntington Beach and its policy positions, and asserting he “saved the city millions” and fought state housing mandates.
  • Several speakers urged rejection of Michael Gates and/or delaying any hiring decision, citing allegations of hostile work environment and discrimination, reputational risk, and legal/financial exposure to the City.
  • Some speakers emphasized process and due diligence, including calls for an independent, outside investigation into the circumstances surrounding Gates’ reported DOJ separation/termination and any employment-related allegations.
  • Questions were raised by members of the public about timing and disclosure, including when Gates learned of any federal termination notice, when/if Council was informed, whether a rehire offer/contract exists and whether it is public, and what policies apply when a candidate has threatened litigation.
  • Meeting management notes: the Mayor warned against disruptions; at least one attendee was referenced for repeated outbursts and staff/security were asked to address it.

Closed Session

  • The City Attorney stated the purpose was to discuss a threat of litigation; the City Attorney also advised there would be no open session after closed session beyond any required reporting.

Key Outcomes

  • Council adjourned to closed session on a motion (seconded).
  • After reconvening, the City Attorney reported no action to report from closed session.
  • The meeting was adjourned; the Mayor referenced the next regular meeting date as Tuesday, December 25 (as stated on the record).
