1:12It's time we set aside on the agenda to allow residents to address council on an item not on the agenda this evening.
1:18I do have two public comment forms.
1:21Uh the first will be Michael Padilla.
1:30Good evening, Council members.
1:32Michael Padilla, 323 Apache Trail.
1:36I'd like to start off by saying congratulations to Mr.
1:39Scott Bradley on his re-election to mayor.
1:42Congratulations to Mr.
1:45Debbie Ison on being elected to City Council.
1:48And I also wish to extend my thanks to Mr.
1:51Andrew Chase and Mrs.
1:53Laura Deal for their many years of public service to the citizens of Murphy.
1:59Last but not least, I certainly wish to say thank you to every American citizen in Murphy who voted during early voting by mail and on election day.
2:09Your vote is an exercise in political power and governance.
2:16I like to talk about the perfect balance.
2:19Imagine a straight line sitting on top of a fulcrum.
2:23On the right on the left-hand side is tyranny, and on the right hand side is anarchy.
2:28And right in the middle is the U.S.
2:32Our founding fathers, when writing the document were inspired by Judeo-Christian values, the tenets of capitalism, and the existing governments at the time.
2:42They created a political foundation that is the perfect balance between individual rights and government.
2:50That's government with a small G.
2:56I say this because I'm opposed to any other form of government, governance, such as communism, socialism, or Islam.
3:05So how do we move forward with our perfect balance?
3:10Well, we must be unapologetic unapologetically American and Texan.
3:16We must choose to defend our Judeo-Christian values, our Western civilization, and our American way of life.
3:24This has been my consistent message for many, many weeks.
3:29Yes, we do welcome all those who wish to become Americans and assimilate into our culture, just as I would be to expect it to assimilate if I moved to a foreign land.
3:46Sixty percent of the electorate provided a mandate to those who govern.
3:53Remember, the perfect balance between individual rights and government.
4:04James and Debbie uh Debbie uh Brumit.
4:13This is my husband James.
4:14We're at 423 Rocky Glenn Circle.
4:17Last week we attended the zoning and planning commission meeting.
4:21Our neighbor at 424 Rocky Glenn Circle wants to put a metal building within five feet of our fence, as opposed to the 10 feet in the ordinance.
4:32The fire marshal requested it be 10 feet, but they approved it 5 to 2.
4:38And I'm not real happy about that.
4:40We don't have fence right now.
4:42We're in the process of selling some property at Canton.
4:46Then we're going to put a fence in.
4:48The fence has fallen down.
4:50And so we just took it down.
4:52And it was before they moved in.
4:54And I told the planning and zoning, we had no idea no interest in putting a fence up.
5:00It's just been a matter of money until now.
5:04So I just want to anything you want to say.
5:08We need uh we need to go by the survey.
5:11And we've yet to find a survey in my backyard to see exactly where my property line is.
5:20We can't get to the pen because he's got stuff piled on it.
5:24So we can't get to the pen.
5:25I mean, he may be closer than five feet, you know, the way it looks now.
5:34I asked myself to other people, would you want this in your backyard?
5:39And I know it's going to be a nice building.
5:41I know it's going, it's a garage.
5:43And he works on cars.
5:45And during the night, about 9 30 at night, won, won, won.
5:51You know, it gets old.
5:53You know, he doesn't think anything about it, but I do.
5:56You know, and you know, I I really don't have a problem with the cars, but we have an ordinance, and and we're we're not abiding by the order.
6:05Uh ordinance is a law.
6:08And and we're cutting him some slack, you know.
6:11And I and what's that gonna do to my property?
6:14That that's my property value.
6:18Uh someday I may want to sell.
6:21So, you know, I don't know.
6:23We only had a week and a half's notice.
6:25We didn't have time to get a survey because you've got to get on waiting lists or months behind.
6:32The survey is like $611.
6:35And I don't feel like I have to pay for it, but I will if if need be, if if that's what it means, you know.

7:19Well, I'm Mary Pat Elage.
7:21I live at 150 Shelby Trace.
7:23And I'm uh in Heron Murphy.
7:26And I came for some good news tonight.
7:29Um, our Murphy Veterans Tribute is almost finished.
7:34And we are so excited about this.
7:37Yeah, it's looking really good.
7:39And we're very excited, and um I've uh I hope you have an invitation in front of you.
7:47And I'd like to share some invitations with some of you here.
7:51But uh we're going to have our ribbon cutting and our dedication service on May 27th, just about three weeks from now.
8:00It's gonna be at 1130 and um 11.30 sharp down at the site.
8:07And um in the next three weeks, we're gonna have our our uh beautiful statue and some of the other elements, but if you haven't been to the site, I invite you to to go there.
8:18It's just east of the big flags here, just look east.
8:21So we're so excited about this.
8:24We have some flyers here to hand out, and um we wanted a special invitation today for the council to come, city manager, mayor, and all those who are here today and be looking for on your Facebook pages, and I think it's on the um city website now.
8:44So thank you so much for all of you who have supported this through these years.
8:50We're really excited and we hope that uh we'll see all of you at the groundbreaking.

9:23Presentations item 6A proclamation, National Police Week.
10:10What a great showing tonight.
10:12Appreciate you all being here tonight.
10:14Let me read this proclamation.
10:15Uh, whereas in every American community, law enforcement officers are committed to the preservation of life, property, risking their own lives to protect us who who protect us from those who mock the law, providing protection, law and order, and serving the cause of justice.
10:33And whereas law enforcement officers, including members of the Murphy Police Department, accept a profound responsibility and work to uphold our laws, safeguard our rights and freedoms, and serve on the front lines in the fight against crime and terrorism.
10:48And whereas we honor the heroism of our law enforcement officers, especially those who have given their lives so that others might live, asking God's blessings upon the families and friends they leave behind.
11:03Whereas by joint resolution approved October the first, nineteen sixty-two, as amended Congress authorized President Kennedy to proclaim May fifteenth of each year Peace Officer Memorial Day in honor of local, state, and federal officers who have been killed or disabled in the line of duty, further designating the calendar week in which May fifteenth falls on police week and directing that flags be flown at half staff on police officers memorial day, and whereas across the nation, police week is observed with ceremonies including the wearing or displaying of blue ribbons to honor law enforcement officers who have sacrificed their lives in a lot of duty and those who strive to keep us safe.
11:48So now there is Oscott Smith, on behalf of Scott Bradley and the City Council do hereby proclaim May 10th through 16th, 2026 as National Police Week.
12:05Good evening, Marin, Council from the Murphy Police Department.
12:11We are certainly grateful for you recognizing this proclamation.
12:16And we felt it was important to also do something a little different tonight.
12:20You'll see some young men and women that have joined us, and this is our police cadet program, a program designed to educate young men and women to enter into the noble profession of law enforcement.
12:33And they are just as important to hear the emphasis that we place on this noble career.
13:16You can stand in front of us.
14:51Whereas these infrastructures, facilities, and services cannot be provided without the dedicated efforts of public workers, public works professionals.
15:00Engineers, managers, and employees from state and local governments and the private sector who are responsible for rebuilding, improving, and protecting our nation's transportation, water supply, water treatment, and solid waste systems, public meetings, and other structures and facilities essential for our citizens.
15:17And whereas it is in the public interest for the citizens, civic leaders, and children in Murphy to gain knowledge of and maintain a progressive interest and understanding of the importance of public works and public works programs in their communities.
15:31And whereas Public Works connects us all, whether through infrastructure or first responder services, and public works professionals continually enhance the life in the communities they serve.
15:42And whereas the year 2026 marks the 66th annual National Public Works Week, sponsored by the American Public Works Association.
15:51Now therefore, be it resolved that I ordeal on behalf of Scott Bradley, the mayor of the City of Murphy, and on behalf of the entire city council to hereby designate the week of May 15th through 21st, 2026 as National Public Works Week.
16:06I urge the citizens in Murphy to join with representatives of the American Public Works Association and government agencies in activities, events, and ceremonies designed to pay tribute to our public works professionals, engineers, managers, and employees, and to recognize the substantial contributions they make to protecting our nation's health, safety, and quality of life.
16:36Mayor and members of council, thank you very much for honoring us with this proclamation.
16:41It means a great deal to us and to the gentlemen that are up here with us right now.
16:46I appreciate your services you've given us.
16:49This is truly a calling to service to uh to do the type of work that these guys do.
16:54It's uh hazardous conditions, it's dangerous conditions, and uh y'all put yourselves out there every day, and and I greatly appreciate it.

17:24Since I took a moment to make a comment, since I took a moment to make a comment uh to the police chief uh about the fantastic young kids.
17:31I wanted to say that that uh public works has the best facial hair in the entire organization.
17:41It is that is an impressive presentation of facial hero.

17:50Item seven, city manager staff reports.
17:53All right, Mayor and Council, just a couple of updates tonight.
17:56Um starting on May 15th, Moonlight Movies is back, and this time it's going adults only.
18:03If you are interested and want more information, please check out our website.
18:06And then mark your calendars for June, every Friday in June sounds at sundown is returning to the Murphy Central Park from 7 to 10 p.m.
18:17And lastly, I want to mention that the Murphy Youth Citizens Academy is coming back for the second year.
18:23Um applications are being accepted right now.
18:27This is a very beneficial program.
18:29If you want to know more about how your local government runs and operates and who's behind the scenes doing it, this is a great way to immerse yourself in all of that valuable information.
18:40The academy will be held from June 11th through August 6th.
18:43It will be on Thursday evenings from 5 30 p.m.
18:47We are limited on spots.
18:49We have about 20 spots available, so please get those applications in as quickly as possible.

19:00All consent agenda items are considered to be routine by the city council, be enacted by one motion.

20:00Item 8 C consider and/or act on a resolution designating the authorized official program director and financial director for fiscal year 2027.
20:10SB 2024 catalytic converter grant program.
20:16This this resolution is specific to giving us approval to undergo the process of entering into a FY27 grants through the catalytic converter program, which will be specifically used to fund our current flock cameras in use now.
20:37So I was reading through it.
20:40So our city costs will be the 3,000, right?
20:44Annually, and that's coming from the special investigative fund.
20:47That's a good question.
20:50And so what are our current theft trends in Murphy for these catalytic converter thefts?
20:57Like do we have like an uprise or an uptick in this, or is this just something that we're just putting in place because we're relying on other cities right now to provide that service for us?
21:07It's a proactive measure.
21:09Our thefts are incredibly low, and we intend to keep them that way.
21:15And then where would the cameras be placed?
21:20They're not moving from the current locations right now.
21:25And then are these like real-time cameras versus after the fact, like how are we covering this, or who actually monitors it?
21:35Okay, so we uh obviously there's been some controversy with the flock program itself.
21:40So I'm going to give you a uh uh a pathway that we have implemented to safeguard us here in the city of Murphy.
21:48Previously, any member that any uh participant in the flock program could have access to our cameras.
21:56We have now limited that to only to the state of Texas.
21:59So we have significantly reduced any type of potential problems that could result in hacking, if you will, which was one of the uh previous problems.
22:09And we have been very successful with doing that.
22:12Currently, our administrative lieutenant runs a 30-day audit process.
22:16You can't look at our flock cameras if you're a sworn officer unless you have a case number.
22:22You have to have a specific reason to do that.
22:25And that is that is viewed through that 30-day audit.
22:29And we have had absolutely no issues at all with the checks and balances that we have implemented internally versus any type of external issues as well.
22:41Okay, perfect, because I was wondering who was managing, monitoring it, what type of audit were we having, who had access to it.
22:48Okay, and I think something else that's very, very important is our participation in this process where we gain the greatest amount of value is access to the camera systems throughout the state more so than just in our our city.
23:05Okay, and that's incredibly important.
23:07We lose that component should we make the decision to deactivate those cameras.
23:15And there are there any other compliance reporting requirements that we have to abide by?
23:22We actually go above and beyond for for compliance as mentioned in our internal process that we have we have implemented.
23:32And then how often were we relying on other agencies cameras?
23:37That that is a very challenging answer.
23:40Um our crime is low.
23:42We intend to keep it low.
23:44Again, this is another proactive measure that is identified if we look at SafeWise Cities.
23:51Why are we the sixth safest city?
23:53Because we put a lot of significant influence into proactive, proactive measures.
24:01So the answer to your question is I can't give you an answer.
24:07And then um, how will our your success be communicated to the public?
24:11Like metrics, are they gonna see that like on the website of who is like or your inventory of like your performance, reports, transparency of how that program is going?
24:23So to clarify, your question is are we showing the the results of apprehended suspects and or how the the cameras have involved themselves in criminal activity?
24:37So we do an end-of-year report, uh an annual annual report.
24:43And it is my opinion that that is the best place to put that data in analytics.
24:50Our numbers are very low, very low.
24:52Okay, and then how often will council receive updates like we can do that?
24:58Often as you would like.
25:00I can do it quarterly.
25:01We can do it on our quarterly stats.
25:06I will follow whatever direction you get.
25:09So that's all that I have.
25:10You know, it's low upfront costs, you know, for us, and then it's proven because it's been used by other agencies and it's a proactive.
25:18So I just wanted just more information about what it was.
25:26Any other questions on that?
25:28I guess that was the only one with all the 500 questions, huh?
25:33Well, I move that we approve the resolution designating the authorized official program director and financial officer for the FY2027 SB 224 catalytic converter grant program.
25:55Motion pass to unanimously.
25:58Consider under act on an ordinance amending the FY26 general and ARPA funds to adjust budgeted transfers and to increase the budget for unanticipated expenses.
26:10Good evening, Mayor.
26:11Good evening, Council.
26:12This was brought forth to me to try to come up with the funding associated with the reorganization.
26:33The um area where the Chamber of Commerce was.
26:50And so it was using the ARP funds.
26:52The ARP funds are the interest that it was being held in the ARP funds waiting for the project to be finished.
26:58Now that has been closed out.
27:00And so now we're ready to use utilize those funds.
27:04It was originally set as a transfer into 26 for the full amount.
27:08And there had been some discussions with other things we might use those ARP funds for, which will come forward to you with with some future changes and some direction on that as well.
27:18But tonight we wanted to just take the $37,000 from the ARP fund transfers and transfer it to the line item for capital outlay and facilities so that they'd be able to move forward with the $67,000 modification on general on City Hall 41.
27:39We're we're taking money.
27:41They're doing a transfer also from their line item.
27:44So it's coming from facilities and then it's going into the capital outlays, so we'll have it in one particular location.
27:51So it's just not new spending, but just reprioritizing.
27:56The existing resources.
27:58And then what specifically are those modifications going to be?
28:02We're so it's hard to get into that.
28:04Facilities is working with a contractor.
28:06This is really if you if you're familiar with that space right now, it's kind of a garage door type style.
28:13So because it will be an interface directly from public to an employee, we need to have a safety glass there.
28:20So those are some of the things, and then new furniture, a different counter, so that they really can use it for a public-facing space.
28:27And then that'll come back to us whenever you guys are ready with.
28:32No, the design on that on that space will not come back to council.
28:35Generally, from the policy perspective, you all are going to tell us whether or not you agree as a policy measure that we use the money this way, but we won't bring back the design.
28:46And so hopefully just one-time costs is what we're anticipating with this.
28:55This is the this is the one-time cost just to modify that space for use.
28:59And then do we have any controls in place to just prevent any cost overruns?
29:04Well, the if if it if the cost goes up, we'll have to do either a budget transfer or another budget amendment.
29:11But based on quotes, this is the price that facilities feel is appropriate.
29:19Any other questions?

29:36Item 9A, hold a public hearing and consider and or act on the application of Westwood PS to approve a replat of lot 3A block 1 McQuery Marketplace.
29:48And this is a public hearing.
29:50Good afternoon or good evening, Mayor and Council.
29:53As you just mentioned, this is a public hearing to consider a replat.
29:56This is for the HEB property known as lot 3R1, Block 1, McCree Marketplace.
30:03They're at the south uh west corner of McCurry Road and FM 544.
30:08I believe they'll pull up a copy of the plat.
30:11Uh it's really fairly simple.
30:12It is because it is a replat and removing and uh existing easements around on the site, state law requires that it uh be a public hearing, otherwise this would normally be under your consent within the items.
30:24You're happy to answer any questions you have.
30:29So on the review summary, item number four says to provide a pedestrian access easement along the western border of the site in conformance with conditions of the approved site plan.
30:42So does that does that mean there's enough room for like a future trail to go through there?
30:46Is that what that means, or does that work?
30:48That is what that's related to.
30:49So there's a so hopefully in the next couple of meetings we'll have the development agreement that is between us and HEB uh and it goes into the detail uh about that specific easement, the pedestrian easement.
31:02Uh that was something that was discussed when we were doing the zoning for HB was uh believe that was the desire of council was to try to accommodate that.
31:10It's going to be a little bit of a challenge.
31:11It's not there are places where only six foot foot fits.
31:16So whether we'll actually choose to use that in the future for uh expanding the trial, but that that'll be up to you all.
31:24But yes, that's what that's related to.
31:26Um but more details of that will be in that development agreement.
31:30Um and once that's all finalized, that development agreement also needs to be in place before we file this flat.
31:35So there's still some couple of moving pieces and parts to this.
31:40Thank you for answering that.

32:14May I move that we approve the application of Westwood PS uh to replat lot three R block one, McCreary Marketplace.

32:30Item B, consider indoor act on a resolution authorizing the city manager to execute a construction contract with Niam LLC to construct the FY uh 2026 sidewalk replacement project for their low bid of 279,446 and three cents.
32:49Uh, and approve a change order to increase the approved amount by 69,861 dollars and fifty-one cents.
32:57Total 25% for a total construction cost of 349,307.
33:09I mean linear feet is that.
33:11That's gotta be a lot.
33:12How many linear feet of sidewalk is?
33:14I don't have the linear footage in front of me right now, but the square yardage yardage is two thousand two hundred and seventy-five.
33:20So it is it is quite a bit, quite a bit.
33:23And this resolution is just a little bit different than than some you'd see before you for a construction contract, and that it's it's really two-fold.
33:30Uh VM had a very favorable bid of the uh 279,446 and three cents, uh, which we are asking you to approve.
33:40We recommend that you approve that.
33:42However, it also left some room in our budget to um to expand this contract.
33:47Uh by state law, we're allowed to uh expand by up to 25% without taking it back out for bid.
33:53So we're also asking you to consider uh approving a change order that we will add to this, which would uh add about uh I just lost it this I'm sorry.
34:0569,861 dollars and fifty-one cents, uh which would be about five hundred and sixty-nine additional five hundred and sixty-nine square feet and allow us to complete approximately another 41 locations.
34:20Um again, these bids came in very favorable.
34:22I think we were all surprised how well they came in.
34:25The uh engineer record BHC has done their due diligence and vetted this uh contractor very heavily to make sure that they could uh to do this work and all their references came back uh exceptional.
34:37So uh as I mentioned, we are recommending that uh our staff recommends approval.
34:41Happy to answer any questions you might have.
34:44Um how did we come up with the 41 locations?
34:48How were those prioritized?
34:50So the 41 locations haven't really been prioritized.
34:54That's just kind of an estimate based on 25 percent.
35:00Okay, but they will be prioritized in the same manner the other ones are by the worst trip hazards, starting at the worst trip hazards and knocking those out until we eventually get all these trip hazards taken care of one day.
35:13Well, I'll appreciate that on my nightly walks tripping around here.
35:17I will tell you that our first area is that we're gonna hit is that uh South Murphy area that we've heard a lot about, kind of what is that the east side uh where there's been some issues.
35:27So we will that's gonna be our our main focus right off the bat.
35:30And then how will residents be notified of the construction?
35:34We will put out uh obviously do some uh social media, but when we're in an immediate area, we will uh do some door hangers and knock on some doors and let them know that we're coming.
35:46And so pretty much it's just we're just being cost efficient with this.
35:50Um so just opportunity to fix more sidewalks, and then we're just leveraging those low bids for the most part, and using the maximum allowable change order.
36:00Just to improve okay.
36:02So improving safety and accessibility.
36:06Donald here have a few questions.
36:09So it's at 167 and then an additional 41, so it's 208.
36:14How many do you currently have like as far as like sidewalks that have been so identified?
36:20So I can tell you on that list, it's somewhere around the 460 mark.
36:24But we are reviewing that list again because I was informed recently that there are some that aren't really trip hazards, they're more like uh, you know, they kind of dip and maybe hold hold water.
36:36So we're going to try to look at those again and maybe separate them out and and figure out really what is really a trip hazard, where do we need to focus at?
36:45Because I think we can narrow that list down and really fix the items that are trip hazards and then come back and and catch the ones that are just you know hold water or have a little bit of a ramp or something on it.
36:56What's the time frame for that?
36:57Do you think so um they have 120 days on the original contract?
37:03Once we get into uh contracting with them, uh we'll probably discuss with them to see if they need some additional days because we're adding to the change order, and then we'll do a change order for the days as well, which doesn't need to go through council, it's just administrative things.
37:19So but we need to talk to them to see how many days they they need for that.
37:22And how about the time frame for dwindling down that 460?
37:27Uh so we will have a little bit more budget uh left and and it's something that the city manager and I can discuss uh that we could maybe do another like a phase two project at the after this one's complete that would hit it a little bit harder.
37:42But I would say you're probably looking at three years before we including this year before we really get put a big dent in these.
37:52So that's one of the concerns that I've had internally, and I've talked to the public works director.
37:57That list is very misleading, right?
38:00It's a it's a very long list, but it includes, like he said, just pooling water, some cosmetic stuff.
38:06And I want to be clear that those aren't the priorities for us to address, so let's take them off the list and not mislead the public that we're going to to actually make those a priority and try to get to them.
38:16What we're concerned about is health and safety first and foremost.
38:19If there is a cosmetic issue or chipping issue that's close to a safety issue for cost efficiency, we might go ahead and address that, but it's not something to be included on the list.
38:30So I think just the very nature of making that list um something real that we're attacking and and prioritizing it in the right way.
38:38That in itself is going to dwindle it down, but then the way that these bids came in this year, I think we're gonna be able to start making some real progress.
38:46So it'll start to look different because it's been very stagnant that it looks stagnant.
38:50We've been doing things every year.
38:53But you're adding and it and it just doesn't look like progress is being made.
38:56And so I think it'll be a more real view of what's actually happening now.
39:02Donald one question.
39:06Um, I'm all about saving money, I'm also always concerned about the low bid.
39:12Uh I know in the past there's been some incidents here in Murphy that uh concrete work has been maybe been subpar before your time, and I don't know if that is attributed to a low bid or not, but I heard you say earlier that they've been vetted.
39:26I read that earlier.
39:27Um they this particular company has they've never worked in Murphy, is that correct?
39:32That's that's correct.
39:36I have two questions.

41:58So we the good thing behind that is it is that we do have you know a project manager, Joseph, and we have a hired started today a new construction inspector.

42:23Maybe something we were missing before is not really checking that work and then finding out when we already had a really big issue, you know, and then it's on us to go back and try to fix it.
