5:58

Uh Chairperson Von Dalen, members of the board, Joe Calderon, 11 South Meridian here in Indianapolis.

6:05

I call your attention to item number four on your agenda, and that is 2026 DV2017 921 East 66 Street.

6:17

Uh we are requesting a continuance to your July 14th hearing without additional notice.

6:24

Um as you may recall, we uh continued this uh from May to June because there were some additional variances that did require notice.

6:36

We sent out notices timely.

6:38

However, unbeknownst to me, Broad Ripple Village Association moved, and the notice didn't catch up to them until they uh and by the time I reached out, they said that hey, we've already canceled our May land use meeting, so we're gonna see them on June 23rd.

6:59

And that should get everybody all on the same page with respect to this case.

7:05

So we'd appreciate your consideration of a continuance again to July 14th.

7:10

Thank you.

7:10

Is there anyone else in the audience with an interest in petition number 2026 D V two-017 with an address of 921 East 66th Street?

7:20

I'm being seen with code of comments from staff, Mr.

7:22

Mullenhake.

7:23

Thank you, Chair Person Von Dale, members of the board.

7:25

Staff has no objection to continuing this to the July 14th, 2026 hearing.

7:29

That would be without additional notice.

7:31

Very well.

7:32

I understand a motion to continue without additional notice.

7:34

Petition number 2026 DV2-017.

7:37

Do I hear a motion?

7:38

Brandon, so moved.

7:39

And a second.

7:41

All right, I'll call the roll.

7:43

Ducky Brown.

7:44

Dougie Brown, yes.

7:45

Brandon.

7:46

Brandon, yes.

7:47

Barnes.

7:48

Barnes, yes.

7:48

Duke.

7:49

Duke, yes.

7:50

And I'm also a yes.

7:50

Thank you.

7:51

This is continued.

7:52

Thank you.

7:56

Good afternoon, Justin Kingan.

7:58

Addressed 2722 Manker Street, Indianapolis, Indiana 46203.

8:03

Here before you regarding petition 2026 DV2 020, which is under the special request portion of the docket.

8:12

As noted in the staff report, uh this is a petition that was filed on behalf of the Biltwell Events Center to allow for a parking lot overflow parking lot across the street from the events center.

8:25

We've since been able to redesign the plan for the parking lot and therefore do not need a variance in order to build um build the parking lot.

8:33

Um so we are withdrawing the variance petition.

8:37

We've also sent uh correspondence to staff requesting uh a refund of the filing fee of the variance petition.

8:44

We got feedback from staff that they were agreeable to 50 percent um refund, which we're in agreement with, and I'm just here before you making that request.

8:53

Happy to answer any questions you may have.

8:55

Well, first we acknowledge the withdrawal.

8:57

Second, is there anyone else in the audience with an interest in petition number 2026 DV2-020 at 951 South White River Park Drive West Drive?

9:07

None being seen.

9:07

We'll go to comments from staff about the request for the refund.

9:11

Yep.

9:11

Uh thank you very much, Chairman Von Dalen, members of the board.

9:14

Um, our staff had suggested 50% as a point of compromise to acknowledge the review that we had already conducted, while also acknowledging the fact that we hadn't generated a full staff report.

9:24

There had also been a previous rezoning petition recently filed at this address, which had incurred its own set of fees.

9:29

My understanding is that some of these fees might be applied toward a future regional center approval petition that might be filed at the same site.

9:36

So a lot of activity here.

9:38

Given the circumstances, we think a 50% compromise is reasonable.

9:29

Okay.

9:43

Then I'll entertain a motion to grant a 50% refund to petition number 2026 DV2-020.

9:49

Do I hear a motion?

9:49

Brandon, so move.

9:51

Second.

9:52

Called Royal Ducket Brown.

9:53

Ducky Brown, yes.

9:54

Brandon.

9:54

Brandon, yes.

9:55

Barnes.

9:56

Barnes, yes.

9:56

Duke.

9:57

Duke, yes.

9:57

I'm also a yes.

9:58

Thank you.

9:59

Thank you.

10:04

All right, staff.

10:07

Yes.

10:08

Thank you, Chairperson Von Dalen, members of the board.

10:11

Staff would draw your attention to item number one on your agenda.

10:16

There was an error in the uh notice that went out as it went out.

10:23

We noticed that an additional uh variance for the uh open space was needed.

10:28

Um as such uh that has require new notice, um, and we have spoken with the petitioner and also um indicated we would support a transfer to the July 7th BCA1 hearing to help expedite um that as a result of the error.

10:46

Thank you.

10:46

Is there anyone in the audience with an interest in petition number 2026 DV2-01 018 with an address of 2230 East 75th Street?

10:58

We are only discussing this particular continuance.

11:01

Please state your name and address.

11:03

David Stevenson, the address is 2230 East 75th Street.

11:07

Okay, so you're the petitioner.

11:09

Yes, and you have no objection to this continuance.

11:12

It's okay.

11:13

I mean, we talked about it so you have everything you need though, right?

11:17

So two different variances.

11:19

One is for the setbacks, and the other is for open space, correct?

11:23

Okay, then I'll entertain a motion to continue to the or continue and transfer to the July 7th BCA hearing without additional notice.

11:30

Petition number 2026 DV2-018.

11:33

Do I hear a motion?

11:34

Brandon, so moved.

11:35

Second.

11:36

Call the roll of Ducket Brown.

11:38

Ducky Brown, yes.

11:39

Brandon, yes.

11:40

Barnes, yes, yes.

11:42

And also, yes, you've been continued.

11:43

Thank you.

11:48

All right, I think we're at the end of the line here, and we're gonna go ahead and move on to uh expedited petitions unless there was any changes to those.

11:57

So, Mr.

11:57

or Mr.

11:58

Secretary, you go ahead and call those.

12:04

Continuance and Withdrawal Requests

  • Petition 2026 DV2-017 (921 East 66th Street): Petitioner Joe Calderon requested a continuance to the July 14, 2026 hearing without additional notice, citing that notice sent to the Broad Ripple Village Association did not reach them due to their relocation. Staff had no objection. The board unanimously granted the continuance.

  • Petition 2026 DV2-020 (951 South White River Park Drive West Drive): Petitioner Justin Kingan requested withdrawal of the petition because the parking lot design no longer required a variance. • Petition 2026 DV2-018 (2230 East 75th Street): Staff noted an error in the notice regarding an additional variance for open space and requested a continuance and transfer to the July 7, 2026 BCA1 hearing to expedite the case. Petitioner David Stevenson had no objection. The board unanimously granted the continuance and transfer without additional notice.

Expedited Petitions

  • Petition 2026 DV2-019 (1244 West 26th Street): The petitioner requested a variance of development standards to allow a 6.4-foot corner side setback where 8 feet is required. The board unanimously voted to grant the variance.

The board unanimously voted to grant the variances.

Key Outcomes

  • The board granted continuances for three petitions, all without additional notice.
