I have some prepared remarks because this is a um this is a pretty substantial um policy change.

She um we owe her a debt of gratitude for the time she spent in the OED conference room, um, beating this to death and in put in putting together a policy for you to review today.

So we're very grateful.

Um, some background on this.

13:40

On June 25th, 2020 2019 ordinance 2019-239 was approved by city council creating a zoning overlay with specific design and performance standards for commercial multi-property multi-family properties located within the renew Arlington CRA.

The overlay mandated that all commercial and multifamily properties come into compliance with these new standards as well as for the mandatory components of landscape, signage, and fencing.

It was agreed that the deadline for compliance would be five years and 90 days after a grant program was approved to assist property owners with the cost of coming into compliance.

On January 28th, 2020, the Renew Arlington Agency Board approved the renewed Arlington Mandatory Compliance Grant Program with resolution RACRA 2020-03, solidifying the deadline of compliance as April 28th, 2025.

This grant is provided on a reimbursement basis to those applicants within the CRA boundary whose properties are deemed to be out of compliance with the requirements of the overlay.

It was created to assist them to offset the cost of coming into compliance.

Fast forward to today, here we are over a year past the deadline with many applicants in the program who are not advancing, not responding to staff emails or to phone calls.

Our policy has always been if you're in the program and you're moving forward, even though that deadline has come and gone, we will work with you to get you over the finish line to completion.

And with that, you will not be cited by code enforcement.

However, if you're in the program and you're not being and you're not moving forward, we cannot protect you from code enforcement, and you're putting your grant eligibility at great risk.

You have for your consideration or proposed policy to define active and inactive grant applicants as well as to establish the process for addressing inactive grant applicants, including termination from the program.

Active applicants, those demonstrating a good faith effort to make to move their project forward and to be responsive to staff.

Inactive applicants are those not demonstrating a good faith effort to make progress on their projects and not responding to communications from staff.

Those are the ones we are going to be addressing today as defined in stages with potential termination for failure to act.

The quick highlights of their policy are written in stages as follows.

Stage one, we haven't received any survey quotes.

What does that mean after submitting an application?

Their next step is to go and get two survey quotes.

The people in this category have not even done this, done that.

The applicant is directed to obtain two survey quotes containing all the properties and property information, such as topography, tree location, ground improvements, etc.

They send those two quotes to Brian Wheeler, our OED Renew Arlington Design Review.

He comes back to them and says, This is the lowest most qualified bid, go with them, hire them, and work on your survey.

This category they have not even done step one.

So at this stage, they will be sent an email as well as a FedEx giving them five business days to submit or be terminated from the program.

If they comply, they will be allowed to stay in the program.

However, from that this point forward, they will no longer be eligible for soft costs.

They will be required to take the to move all the way to conceptual site plan, at which time they will send it to us.

We will get it through the radar process, which is city review, expedited permitting process, and they will we will get them through the grant process.

At this juncture, they will no longer be required for soft costs.

We won't work with them through that point.

They will have to get us a conceptual site plan on their own.

However, we will cover their project costs.

Again, 19 applicants in that category.

Stage two, no survey produced.

There are 10 applicants in that in this category.

So they submitted the two quotes for surveys, but they never hired a company that we recommended to get the survey completed.

In this stage, they will be sent an email and FedEx giving them 10 days to produce a contract from a survey company to produce a survey, or they will be terminated.

Like the other, if they comply, they will be responsible for product from taking it from the survey to a conceptual site plan at which time they can send it to us.

We will get them through the radar process and create a grant agreement for them, however, their soft costs will not be covered, only their project costs.

Stage three, there are 16 applicants in this category.

We have received no quotes for design professionals.

At this stage, staff has created a mutual mutually agreed conceptual site plan.

That was approved through the radar process.

The applicant must now obtain two quotes for design professional to take the conceptual plan and create plan specifications for the permitting process.

If they produce the two quotes for review, they can stay in the program, but again, soft costs will not be allowed as part of their grant agreement.

They can get us a finalized agreement, we'll get it through radar process and create a grant agreement covering just their project costs.

Lastly, stage four, no design contract at all.

There are eight applicants in this category.

They have provided the due quotes for design professional, however, they have not pulled the trigger on the one that we recommended that they hire to move them forward to the next step.

They will have 30 days to hire a design professional and move forward.

Otherwise, they will be terminated from the program.

Once the grant applicants have been terminated from the program, the notice is final and non-appealable.

Um we have to make some changes and and and get those through the process that are that are responding to us in earnest.

I can only I can only speculate because they're not responding to us.

I think the biggest problem is change is hard for people.

They don't want to change, and they are putting their heads in the ground like an ostrich, and I guess they think if we're not there to um to enforce what we need to enforce, they're not gonna move forward.

We are there as staff every stage of this process.

We walk them through it.

We have emails that give direction, we do zoom calls, we we are there with them from A to Z.

There is no issue with us abandoning any kind of a grant applicant.

We spend an amazing amount of time with each one of those independently.

These that aren't responding, they just don't want to change.

That's my guess.

But because they don't respond to us, I have no way of knowing.

I mean, this is going on some of them from 2023 to current, that they're just not responding, and we have to move on.

I think at the beginning of this process several years ago, there was an impression that if you got an application in to this process, you'll be okay.

And I think there are people that weren't real supportive of this process that got in an application and they've just sat on it and done nothing since then.

So I I frankly think that's what's going on.

And I think most of these, and uh, Miss Ms.

Ralla were probably very early on in the process, and they've just done nothing since.

We have it documented of emails that we've sent that have gone, um, they haven't responded to, and we try everything because we want them in the program.

We want to make Arlington better, but we can't force them, and it's now time to either make a decision to remove them or unfortunately, I think they were given bad information that that just getting an application in solves the problem and and that's obviously that's not the case.

So I don't know where it came from, but I have my suspicions, but they're they're simply suspicious.

Now the first agenda item is considering of the KSC fiscal year 2026, 2027 preliminary budget. So is there any public comment here on the King Suitel budget? Do we have cards? And so this is the King Suitel Crossing, and I see on here the uh the budget and public comment prior to the vote. And with the King Soutell, you know, uh, you know, I'll be supporting it. And I just want to say, you know, Ernest Smith, the third's in the house, and I'll be you know, uh, you know, talking about this a little bit later, with the biggest thing with these CRAs, and even with this budget, any, even if it's a buck, if there's any waterway components associated with any of this, open or waterways for everyone now the where in the geographical area of this. I mean, I'll be looking and asking, but with this budget, I want to be on the record for everyone, and that's why, even with leadership, you know, you know, that's right, Colonel Miller, he's the man.
