Good evening, Commission.

3:01

Uh cities representing this case tonight.

3:08

This was annexed in 2022.

3:11

The owners of the property had an out-of-town sewer agreement with the city.

3:16

Um after so much time, the uh city was to annex the property into the city as is pretty consistent with these out-of-town sewer agreements.

3:25

Um they have never uh hooked up to uh sanitary sewer, this property around with everything else in the uh the neighborhood.

3:33

So this is an existing subdivision outside of city limits.

3:37

It has not accounted for uh utilities infrastructure that the city would typically want to see uh roads are not designed to uh city standards, so there's a lot going on in this property, and a little bit of uh background information.

3:49

Generally, we do not um de-annex property upon request.

3:54

Um there is some very site-specific stuff going on here, which I'll get into in a minute, but that's the background on the property.

4:00

Umers do not want to be within the city limits.

Joplin Zoning and Planning Commission Meeting – December 11, 2023

The Zoning and Planning Commission of the City of Joplin met on Monday, December 11, 2023, at 10:00 AM. The meeting was called to order with all seven commissioners present: Dr. Rosenberg, Ms. Warren, Mr. Kimball, Ms. Phillips, Mr. Jackson, Mr. McCullough, and Mr. Landis. The primary agenda item was Case 05-23, a request to voluntarily de-annex a property from the city of Joplin. The commission heard staff presentation, deliberated, and voted unanimously to approve the de-annexation.

Consent Calendar

  • Meeting Minutes: The commission unanimously approved the minutes from the previous meeting. Motion by Ms. Phillips, second by Mr. Landis; all voted in favor.

Public Comments & Testimony

  • No members of the public spoke in favor or opposition to Case 05-23.

Discussion Items

  • Case 05-23 – Voluntary De-Annexation: City staff representative Tyler presented the request. The property (approximately one acre) was annexed into the city in March 2022 as part of an out-of-town sewer agreement. The owner had signed the agreement but never connected to city sewer, remaining on septic and well water. The surrounding subdivision (New Addition) is outside city limits; none of its homes are in Joplin. The property owner later objected to being annexed, and the city agreed to file the de-annexation request on their behalf. Staff noted that the city generally does not de-annex property, but site-specific circumstances—lack of city-standard infrastructure, limited service capacity, and the owner’s disinterest in city services—supported this request. Commissioners asked clarifying questions about the annexation process, utility rates, and whether other properties in the subdivision were affected. The owner was aware that de-annexation would mean losing access to city fire and police protection.

Key Outcomes

  • Motion to Approve De-Annexation: Mr. Jackson moved to approve Case 05-23 for the de-annexation of the property. Dr. Rosenberg seconded. The motion passed unanimously (7-0).
  • Adjournment: The meeting was adjourned after a motion by Dr. Rosenberg and a second by Mr. Landis, with no old or new business.
