Joplin Zoning and Planning Commission Meeting – October 14, 2024

The Joplin Zoning and Planning Commission met on October 14, 2024, to consider four cases: a rezoning request, two easement vacation requests, and a special use permit for a home beauty salon. All cases were approved unanimously. The meeting also included amendments to the previous meeting's minutes.

Consent Calendar

  • Minutes Approval: The commission voted to amend and approve the minutes from the previous meeting after corrections were noted (missing name on page 5/6 and misspelling of "Mrs." vs. "Miss"). The motion to amend carried unanimously.

Public Comments & Testimony

  • Case 033‑24 (Special Use Permit for Home Beauty Salon):
    • Applicant: Tim Curtis, 2805 North Highland Avenue, requesting a special use permit to operate a home beauty salon. She stated she had to quit her 30‑year career due to neck and back surgery and wants to serve a few long‑time clients from home. She reported serving about 7–10 clients per month, with parking in her driveway.
    • Supporters (in order of testimony):
      • Dorothy Folk (717 South Orinovo Street, Webb City, MO): Spoke in favor, noting she has been a client for 10 years and that parking is consistently in the driveway. She complimented the applicant’s property upkeep.
      • Terry McMillan (2729 North Highland Avenue): Next‑door neighbor with no objection; stated traffic is minimal.
      • Patrick Wells (720 West 15th Street, Webb City, MO): Client for seven years; emphasized the applicant’s integrity and adherence to parking rules (only one car in driveway).
      • Dennis Murlison (806 North Island, Joplin): Neighbor across the street, reported no issues.
      • Marcia S. Miller (717 South Orinovo Street, Webb City, MO): Stated general support, seeing no reason to deny.
    • Opponents:
      • Kenneth Hines (2901 North Island): Expressed opposition on grounds of “spot zoning,” traffic, and potential impact on residential property values. He questioned the city’s enforcement of home‑business restrictions.
      • Doug Myers (2824 North Katie Lane): Spoke on behalf of neighbors on a no‑outlet street east of the property, concerned about traffic from the business and potential expansion into a vacant lot behind the applicant’s home.

Discussion Items

  • Case 030‑24 (Rezone from R‑1 to C‑1 PD):` Applicant Brandon Freed (Rotha International, 712 South Maine, Joplin) requested rezoning of 2517 East 20th Street. The property was previously a church; half was purchased the previous year, the other half this year. The commission voted unanimously to approve.
  • Case 031‑24 (Partial Vacate of Utility Easement):` Tyler Ledford (Ledford Construction, 2806 Arizona Suite C) requested partial vacation of an easement at 1403 East Valley Street to place a single‑family home. No opposition. Approved unanimously.
  • Case 032‑24 (Vacate Sanitary Sewer Easement):` Representative (name not provided) requested vacation of an easement at 2128 South Maiden Lane to allow a building to be constructed over the easement. No opposition. Approved unanimously.
  • Case 033‑24 (Special Use Permit for Home Beauty Salon):` Staff member Tyler confirmed two petitions of protest were received (protest percentage 6.79%, within the 185‑foot notification limit). Commission members asked about traffic (applicant estimated 7–10 clients per month, parking in driveway) and the difference between “spot zoning” and a special use permit. Staff explained that a special use permit is temporary (two‑year renewal), does not change the underlying residential zoning, and includes conditions on hours, number of vehicles, and off‑street parking. The applicant stated she does not intend to put up a sign.

Key Outcomes

  • Case 030‑24: Approved unanimously (motion by Mr. Landis, second by Ms. Warren; all in favor).
  • Case 031‑24: Approved unanimously (motion by Dr. Rosenberg, second by Mr. Spruce; all in favor).
  • Case 032‑24: Approved unanimously (motion by Mr. Landis, second by Ms. Phillips; all in favor).
  • Case 033‑24: Approved unanimously (motion by Ms. Clue Michael, second by Ms. Phillips; all in favor).
  • Adjournment: Motion by Mr. Landis, second by Ms. Clue Michael; carried unanimously.
