These words were first spoken to people who were weary and discouraged, reminding them that hope and renewal are found when we depend on God.

Manny Lopez was born on July 3rd, 1938 in Kansas City, Kansas, to Joseph and Lucy Garcia Lopez, and throughout his life embodied the values of dedication, hospitality, and love for his community.

Mr.

Lopez developed his passion for the restaurant industry at an early age, working alongside his father at the historic Mulebach Hotel in downtown Kansas City, and later refining his skills at Regan's River Boat, where he earned bartending awards and built lasting relationships to those he served.

With partnership of his beloved wife Vivian and support from their family, Mr.

and Mrs.

Lopez founded Manny's restaurant at 20th and South Post Boulevard, an establishment that has served the Kansas City community with excellence and heart for 45 years.

Manage restaurant became more than just a place to dine, it became a welcoming and inclusive gathering place where neighbors, families, and friends from all walks of life came together to share food, fellowship, and community.

And this legacy of generosity, service, and resilience was evident in their unwavering support for local causes, charitable initiatives, and those in need, offering meals, comfort, leadership during times of crisis and celebration alike.

And I want to take this point to point out that my uncle Junior, my deal junior, I think for years coached, uh helped coach the baseball team that Manny's used to have.

And I I didn't, I I grew up on the East Side, so I played on uh Eastside baseball, but I remember uh my cousin and going to watch his game uh playing for the Manny's baseball team.

Uh Manny's uh Manny Lopez's life was a testament to hard work, entrepreneurial spirit, and deep devotion to family and the foundation he built, continued by Vivian and their family to this day.

Positive positively impacting the Kansas City restaurant community and the many lives he touched throughout their kindness and service.

Uh and for this resolution, uh, we ask as this as an opportunity to honor uh Manny Lopez and Manny's restaurant for their years of service to the Kansas City community.

We have David Lopez here, who is the current owner and I think everything to the restaurant.

Uh I have seen firsthand.

You work incredibly hard to protect that legacy and continue to try and grow it, uh, not just in the crossroads area, but for everyone who loves Manny's and continues to enjoy so thank you so much for all of your service.

I'm sure this is something that you are all used to putting hard work into.

Uh it's certainly not lost, and I love driving by on a Friday night or a Saturday night and seeing it absolutely packed in.

Appreciate you guys and all the work that you've done.

You know, resolutions like this always make me kind of happy and kind of sad too.

So, you know, my dad did business with your dad, and he's gone now as well, and I miss him.

Um but yeah, I mean the restaurant industry is what fuels the city.

It's you know, the more the more foot traffic we get in from Kansas, from North River, from these other places, that's that's what generates so much tax revenue, generates great paying jobs, generates what people think of when they think of Kansas City, and that part of our city has changed a lot over the last 45 years, and one of the very few constants is that Manny's restaurant has been there, and uh I've got to know a lot about your family and your kids, and I'm hopeful that I'm 43, so 45 years from now when you're turning 90, I hope I'll be able to stumble in there and see one of your kids or grandkids running your restaurant 45 years from now.

And the crossroads will probably look a lot different then.

But I do think and hope that one of the things will be the same as you guys are still there, uh delivered great food to our CS, pardon me to our city.

So I've known Manny for a long time.

He's uh probably one of the great entrepreneurs of our city.

I will say, for the first time, I understand how your kids got their looks now that I see a lot.

Um but I want to say it's not only the economics that you bring to the city, but it's the passion that you bring for all the things around your community, around your restaurant, and how you you reach out to people and you you get things done.

And it's not easy in the city to get things done, so I just really appreciate you and you know, having served on the board with you for several years.

Uh I just really there's a lot of people in your life you run into, and you just think, you know, these are really great people.

And I appreciate that about you so much.

And I'll just say uh definitely, you know, that the impact that you all have made on not just the crossroads, but Kansas City as a whole uh is monumental, and I just want to thank you and your family for uh uh the 45 years and congratulate you on at least another 45 and more.

And rightfully so.

But my mother is an unbelievable asset to Kansas City to the community.

She actually gave Manny Lopez's dreams a road, a path.

She brought them to reality.

I'm so fortunate, and I am so blessed.

I am nothing but a steward.

I am a steward and I am a protector.

I serve the wonderful employees that work for me.

I serve this wonderful community.

I serve my association.

I serve this city.

And I serve my God who without him.

I can't even imagine where I would be.

I have these beautiful people behind me.

These people that love me.

These people that care for me.

Even when it's not easy.

I have two more sons.

One's in TCU getting ready for his first paid performance at the Dallas Lyric Theater.

Another one's working for Shamrock in Kansas.

This uh particular project, this is related.

You'll see an ordinance later today, or um on the agenda, the with this rezoning.

This was a uh project located at the corner of 39th and Rowanok and uh in the Valentine uh near Volcker neighborhoods for uh uh I believe it's gone to 69 units, uh so uh just under 70 units.

Uh neighborhood, uh the neighborhoods around had a lot of issues.

Um I will add that this will require nine votes.

Um I think it's important to note that this includes a protest petition that the neighborhoods filed and then later rescinded their opposition.

Um, and so uh there is no legal way for us to rescend the um and and that's not related to the resolution, it will be late related to the ordinance, I believe.

Um because I think that the uh protest position is only in regards to the rezoning later.

So um I just want to clarify that right now.

Um this I believe will only require seven votes as I'm staring daggers at our city attorney to help me out.

But I think that the that the protest is only related to the ordinance.

However, the neighborhood came and while they you know expressed that they were enthusiastically supporting, they were rescinding their opposition to this project.

Um I think in the end we're getting a great uh project with some new apartments and uh on a on an important corridor on 39th Street.

Um and so uh neighborhood planning development recommended advanced that you pass.

Um because of the uh history can you start speaking your mind absolutely sorry?

Um I just want to I don't want to reiterate anything that Councilman Bunch says I agree with everything that he says, but I do want uh my colleagues to understand that I also support this project.

Neighborhood folks and the developer came together, they were able to reach a compromise for this project on an important uh corner on 39th Street that needs to be thriving with economic activity that is currently a vacant lot.

That's not this one, this is Shoal Creek.

Uh we heard some of the this one is another one that uh there was a there was some concern from the neighborhood and and to give uh credit to Councilman Willet uh did a lot of work to bring the community together and have a public meeting uh on Monday, I think it was, so fairly recently, uh, and answered a lot of questions, and so we ended up hearing that and uh it stayed in committee for two weeks, so we we discussed it at length uh in the end.

The neighbor planning development committee recommended in advance that you pass on this as well as the later ordinance that we'll discuss later.

I want to thank the uh neighbors who showed up in um express concerns and the concerns are more broadly just on how the area, not necessarily it's development, but traffic, and this is somewhere near a school zone that's on a parkway, uh school that was built in 2008 and was not built properly to handle the traffic, and that's something that I'll be introducing a resolution down the line, working with public works, working with their parks department to figure out how we can do that to make that court or in front of that school smooth as the Northland continues to grow.

Um but I appreciate the developers coming uh back and making a few amendments to the plan to alleviate some of the concerns of of the neighbors.

Um but this is a uh a development um that fits this area underneath the even current zoning that it it that it has.

Um so I appreciate all stakeholders coming and invoicing their opinions and um look forward to improving the school zone down the line uh with the support of colleagues.

Today we pause to acknowledge the neighborhood leaders who embody that spirit.

And we have with us today neighborhood leaders who are from just about every district across our city if they all made it today.

I know they all were invited.

You are the ones who bring people together for block meetings, organize cleanups, welcome new families, and stand up for the needs of our community.

You are the advocates who make sure that every voice is heard and the visionaries who see what neighborhood what a neighborhood can become with hard work and determination.

Kansas City would not be the city that it is today without your leadership.

Because of you, neighborhoods are safer, more connected, and full of pride because of you.

Residents know that they are not alone and they have a community to belong to.

Honorable mayor, um ordinance number two five zero one seven zero uh set the levy rates on tangible real and personal property located in the city with the 2526 adopted budget.

The estimated levy rates used for budget formulation were based upon prior year assessed value from the four counties in which the city is located.

During the summer of each year, the counties provide revised certified assessed values.

These revised values are used to complete complete the state levy certification process.

The purpose of the levy certificate certification process is to ensure that no jurisdictions receive a windfall or experience a shortfall due to change in assessed value in accordance with the Hancock Amendment to the Missouri Constitution.

The levy certification forms must be delivered to the county clerk no later than October 1st each year.

Taxes for the fiscal year 2526 commencing on first the first day of May 2025 in the total amount of one dollar one dollar fifty.

I don't know actually how to say this 1.5073 per 100 assessed value will be the new uh levy under this ordinance.

Um this is due to an increase in the assessed value based upon the new um uh certifications.

So this will require nine votes, but it is important to note that again the neighborhood uh did did resend their act actually rescend their opposition and they said as such in the committee committee uh testimony.

Um and I would speak for myself that I am supportive of this uh much needed housing at this uh long vacant corner and uh the neighborhood planning development committee recommended it advanced that you pass.

I think to me, I think having been on the council for the past six years, we keep going down rabbit holes, and we don't want to go down rabbit holes again on a temporary jail.

So I'm I mean, I support this, and I know there's numbers out there, and everybody will tell you it's not, but we haven't had an engineer's report that says if we just did two full.

My point is is I think we have time to to look at that for a permanent solution.

I want to recommend and I support this wholly because we need something today, as quickly as possible, before the World Cup gets here, before we keep turning down people for signature bonds.

So I want to thank you for your introduction.

This also addresses, if I may respond, Ms.

Mayor, the permanent option, because not what we sold voters on.

Uh and you're correct, there's not a number on what it would cost to rehabilitate because in 2020, when SFS architects evaluated that site for this specific purpose, they stated that no amount of investment could make that facility safe for our inmates or for our employees.

Councilman, Councilwoman uh Patterson has it.

I would stand to just say that we have enough vacant buildings in our inventory that are in disarray, and so I would just caution us to take on another government's uh bad buildings.

I am becoming an advocate of not of not demolishing buildings, but um, we've just got enough.

I think we are dealing with a building that once belonged to the school district that we are um having to invest our time and resources in, and so I would just caution us um for taking on somebody else's blight.

I think section one is very important, and it states the city council reaffirms its commitment and pathway to develop and construct both a modular detention facility as well as a permanent facility at the city-owned or city-controlled parcels.

Uh there's a lot of noise out there, and there continue to be there can continue to be noise, but just want to make sure that we reaffirm that we're still on the same path.

Uh, what we passed fourth, and uh want to reiterate to constituents, this is our intention.

I'll just uh add this.

Uh and it's probably just to uh kind of reaffirm some of what Councilman O'Neill says.

I think we have clearly agreed on a path as to the temporary facility.

The impetus to this all relates to I think a Jackson County piece of legislation that is yet to have actually been reviewed, debated, or discussed.

Uh, but I I can't speak to the rationale for the introducer.

Uh that being said, it seems highly impractical that when they still have inmates in this facility, that they would actually be able to provide us a temporary facility, and so agree with that.

On everything else, I've you you were talking to me on when you mentioned we don't need extra facilities and failed government facilities.

I'm very sensitive to that.

I do think that we should always take the call from anyone uh, and as I read this resolution, it doesn't prohibit us that if someone tomorrow said we've I'll just be honest, state of Missouri said tomorrow you can have the Cameron facility that we evaluated before and say you get it for two dollars and you can incarcerate people there, I would suggest we take the call.

I think that exists for any other Clay County, Jackson County, anybody else we live with, and so that's that's why I think I actually appreciate the sponsors for how you've tailored this resolution.

Um just one little persnickety thing for me.

Boo always notices when I say that.

We still do have an active at this point unoverruled ordinance relating to the A floor, too, just in case y'all wondering in terms of detention facilities that uh has never been overwritten by council, so but I won't bring it up.

Go ahead.

I only bring it up because we have 300, you know, we've had we've had uh act estimates of 300, 315 million coming out of the public safety sales tax to build the jail.

And to my colleagues' position on not taking any more assets, 350 million dollars is a new asset.

So at the same time, I think we still have to look at other ways that we could, you know.

I'm I'm like you, I want to get this done.

But I also want, I mean, if we could do it for a hundred million versus 350 million, that's 200 million in our public safety sales tax, it could go to better things.

So that's all that's all I bring it up for.

Now to say that's Council Patterson has I think we should look for better assets, uh, Councilman.

So I mean, to the extent that, as I heard somebody refer to the building as is uh, I won't say that it's insulting, but it's it's um in bad shape.

And um, if it's it's inhumane at the moment, and so it seems a heavy lift to to bring it back online.

Uh, but to the extent that we can find buildings that um are not everybody else's problem, like our land bank and our homestead authority, where we tend to take on folks problems that they want to get rid of, um, I would encourage us to look for buildings that we can bring online faster.

Um if it costs us 200 million dollars and we feel like it's a good deal, then yeah, but if it's just gonna sit there for another 15 years and we do nothing with it, I would prefer it not be on our balance sheet.

Um so I I really just want to get to uh talk about the details.

So July, we had a resolution that was sponsored by myself, Councilman Rogers, and uh the mayor, and in that resolution, ultimately it um directed the city manager to uh to pursue the temporary um modular jail, modular facility, put out an RFQ.

In the sections, uh, and and I just want to make sure we're not um I don't know, I just want to make sure that I bring rise to this and that we understand and we're not kind of overriding or confusing the city manager.

So in section three, it states um that the city manager was hereby directed to present a plan for operations of the facility and to the council within 30 days.

Now I know that we have a an email, we have information that was presented to us on August the 8th that provided an update, but to my knowledge, we don't actually have the plan uh unless I'm missing it.

So if I am just correct me, uh but in the sections of this resolution, it states um section two, the city manager is here by directed to expedite the delivery of the modular facility and report to the council the substantive actions taken related there to within 60 days of the effective action at date of this resolution.

And so my my concern is are we I feel like we are somewhat confusing the uh directive because we we've given direction back in July to provide a plan, you know, and there's some other other items in this other sections specific to putting out the RFQ, securing all the necessary permits, providing a plan to us in 30 days that we I would like to have an update on of kind of you know where we are on that um prior to directing adding another 60 days to this.

And so I while I'm in support of us moving forward with a template with temporary uh modular jail, I actually would like to have some information or an update to us about what where we are if if we can do that in open session, where we are on this, because I'm not sure we where we are on the RFQ.

I know that's been put out there, or the RP has been put out there, but we haven't received an update today.

Sure, I'm happy to provide an update.

Um we received uh proposals uh from two vendors to supply uh facilities.

Uh we are vetting those vendors right now.

We think one of those vendors uh well there's two price ranges.

We want to make sure that the vendor that we select can meet the uh certification requirements that are uh in place by the Missouri Public Service Commission, and we're working through that process right now.

Um with respect to the operations plan, which is one of the things that um the uh resolution from July required.

Um we uh the one thing I can report is one way or the other, we need to have in place uh new department of corrections or something similar to that nature.

Um and we uh we will present a plan a more detailed plan of um what exactly that means and hiring up for hiring and staffing those folks.

Uh and we're gonna have to have those positions in place by the time new module jail opens up.

So I guess in short the the short of it is on the construction and and and design and uh design and construction new module facility.

We have a designer in place.

We are waiting to make make sure that the vendors that have submitted our vendors that we want to work with, and they can they can comply with the requirements, and on the operation side, we understand that we need to create a new department in order to staff it up uh in order to staff up and um provide support for the jail.

So I written and then I will provide a written summary of uh current status to the council.

Uh whether we're discussing a Jackson County Fishing facility who has many reports of it being terrible conditions in that facility and insuitable uh for people to be in, or we're talking about an alligator Alcatraz or a Kansas City Alcatraz, which is gonna be our own trailer jail, which we'll be responsible for.

We have evidence of folks being killed in both in Wyandotte and Jackson County.

This will this will be on us.

Meanwhile, um people are asking how are we going to fund the rehabilitation portion?

So I will continue to advocate for our money to be better spent, um, not on a temporary trailer jail, um, but looking for our rehabilitation and reintegration efforts, which actually um fix the issue of crime rather than just housing people in trailers um and putting them back on the street with nothing.

Oh, um, so there's I guess nothing has impacted me on this council in the last six years like this.

Um I have I've been uh watching this case for the last three, four years, and it's impacted how I view the city, it's impacted how I view uh how we hire and fire people here at the city.

And I I just this doesn't have to include any of you, frankly, because it's my way of stating publicly my viewpoint on this particular issue.

And this particular issue stems from an accident that occurred uh in 2021.

Okay, where a firefighter driving a fire truck ran into a building killing three people, and going to a arbitrator who felt that there was a enough in this to give them three months uh lease, yeah.

And uh and then going back to the courts who said no, we're gonna send it back to the arbitrator who stayed with the same decision.

Now the decision is to bring this gentleman back and hire him and pay him back pay.

And I think as a city, I think we have to do better than that.

And I think the idea that we are uh vacating this uh decision and moving to the courts, and uh hopefully we go all the way to the Supreme Court with this because I feel it it's relevant to that.

Um so I'm I'm putting this out for my I want my public position on this very well known, and I bring this resolution to you for your support of it.

Yeah, I um this uh I think Councilman O'Neill summed it up pretty well by saying this was something that I think has a pretty pretty big impact on uh on me as as a legislator for this city, and you know what what can we do to prevent tragedies like this from happening, but also making sure that those responsible for those tragedies are held accountable.

And in this case, you know, this this ultimately you would like to think that this falls on us uh to to be a part of these decisions and to not let this happen and to not reward someone who is responsible.

Um but you know if you look in the you look in the media as you know, patrolling, I was looking through uh social media, in particular Reddit recently, and you know this this come this comes up all the time.

This came up just recently because it's timely.

And and and who do they look to when something like this happens?

Who do they who they look to blame?

And it's to look at look at us.

Um and so I think I want to thank you, uh Councilman O'Neill for you know this as a gesture at the moment to say this is this is not what the city council stands for.

Um, and and to memorialize uh you know, to do something uh for the three individuals who lost their lives by naming them in here.

And we have uh Jennifer San Nicholas, Michael Elwood, and Tammy Knight.

Two people were in a vehicle, and one person was just walking by and were in the the wrong place at the wrong time, but uh by actions that were um uh to me unforgivable uh as the city employees.

So I just I just want to thank you and put it on the record of uh of my position on this matter.

Um I certainly agree with the subsection two here and heartfelt condolences.

I actually know some of the folks that are connected to these families that are grieving.

Um and I I've seen firsthand how it's impacted them.

I I do have some level of discomfort with section one, just not having had uh a full debrief of what the ruling means and what all the legal options on the table are.

The last time we discussed this, we spent a good hour to an hour and a half in closed session understanding the legal implications of the statements and uh things we would put our names behind as an official position by the city and how we would direct the law department.

We have had that conversation, so I'm always hesitant to vote on things.

I don't feel like I'm fully informed on it.

So uh I for that reason I will either be abstaining or voting them.

Um I have to agree with my my colleague.

I I definitely agree with with section two and our heart thought condolences and you know supporting our staff in this as well, but I just not having enough information and not really being in that closed session beforehand as well.

Um, and for section one.

Um just having a full understanding uh I'm just I guess I'm trying to figure out the full understanding of of this.

I I mean I I can I can speak to that.

Three people died.

A man's getting three months suspension for it.

He is uh being paid for the three years he's been on suspension.

So that's the answer.

That's been I mean that's really concerning.

It definitely is just our legal, I guess process of this.

I'm more than happy to make a motion to go into closed session and we can have our attorneys explain the process.

Now we'll happen.

I I'm somewhat more with Councilman O'Neill's point.

I mean, in very short order, it's this.

Right.

Accident happens, several persons are killed.

Building is destroyed for what that's worth, too, right?

Um city staff takes an election.

This is all public stuff.

It's really just from the star story, so I'm not divulging anything that he doesn't know, right?

Um city takes action.

Then there's a plea deal, uh, a plea bargain agreement.

The defendant in that case, who's also our member, right, accepts a plea.

City had already taken action.

We are there's a grievance filed against the city.

That's where the legal issues get interesting.

Arbitrator fines with the union, thus then suggesting that the only punishment that we can provide is the three-day suspension and then reinstatement.

And of course, as the years have gone by, right?

That increases the value at issue.

Previously, in ordinance action, we were proposed a settlement uh that came from our staff, city council, and that's the closed session you're talking about.

Previously rejected it, and you know, largely just because we thought in many ways it's inappropriate uh in this situation to settle that action when you look at the magnitude and the gravity of the issues uh before us.

And I think that's the spirit with which Councilman O'Neill brings the ordinance.

The technical legal issues relate to motions to vacate, what are the standards of a motion to vacate?

We're looking for Jackson County Circuit Court to find an essence some error with the arbitrator's decision.

We can get into the depth there, and indeed there will be extensive legal debate on that.

I see the spirit of this resolution just saying where there is this gravity of impact on persons, then it's worthy of us continuing at least to pursue our legal rights in some ways, and this is now where I'm talking to stand up for the the victims that we saw in that case.

I would just say, look, I'm this is my feeling.

I I know everybody might have a different feeling on this, but at the end of the day, if you you know vote no or vote, you know, don't vote.

Um I don't I don't think this is uh about there's some issues uh that we are dealing with when we when we argue this about past you know past uh decisions made 30 years ago that are still involved today.

I don't think we should be responsible for our predecessors' decisions, and that's why I hope this goes to the full Supreme Court uh to uh negate some of those past differences.

Yeah, I'll just say this.

I first of all want to thank you, Councilman O'Neill for bringing this because I'll share I think what I heard was frustration, and he's been here for six, I've been here for ten.

Um we hear about a lot of things, uh, and we're told later that it just has to be this way, or that this decision was made, or the arbitrator did this or that.

Um frankly, I learned too much about it by hearing the news or watching it.

There's been a lot of reporting lately on things that I don't know if this council is fully aware, and this isn't a complaint necessarily to you, other than to say it seems like at a certain point we have to say when something's wrong.

And you know, and I I I got a world of qualms against the existence of a board of police commissioners, and this isn't me changing my opinion.

But over there, right?

People tend to separate from the force when things happen.

Um, and we didn't get this far along the line.

There was an officer who believed he should have been innocent for something who ultimately separated voluntarily from the force in connection with that issue.

And part of that I think was the Board of Police Commissioners and others saying it's best for us to recognize no matter what happens, we need to move forward as an institution.

For whatever reason, that's not the situation here.

But I think it is important for the city um to share that position to continue to fight legally in connection with it, to not just turn the other way and say it's all a contract issue, because they look I love contracts, maybe the rest of my life is making money off of litigating contracts, but at the end of the day, and at its base, and back to what councilman uh bunch noted sure feels like right and wrong.

And I I I'm sorry, but three lives lost, and the totality of what happens at the city is three days of suspension, a life that's worth it a day.

That's tough.

That's that's really tough.

And that day we did deal with the prior settlement ordinance, which the committee rejected.

We had friends and family of the victims here for whom they still carry this each and every day.

So maybe this seems like a mere contractual provision, and I get people who get that, but this isn't punishing somebody for coming in late to work or being drunk one day or something like this.

To me, this is entirely different, and for that reason, I think Councilman O'Neill for bringing the action, I'll be in support.

The reality of the development conversation in this region right now, it is in no way realistic that the tools aren't being used to attract businesses to places Kansas City should be consistent with others in connection with that, including our peers all around the region.

When we have residents here in the state of and here in the city of Kansas City who are wondering how they're gonna pay their next property tax bill, it hurts everyone.
