Kansas City Council Meeting Summary – April 23, 2026
STREAMING COPY IN PREPARATION — RECORDING AVAILABLE FROM THE ORIGINAL SOURCE
The meeting will come to order.
Our guest chaplain is Pastor David McDaniel with Holmeswood Church.
Would all who are able, please stand for the invocation and remain standing for the Pledge of Allegiance.
It's been a true pleasure this month being with you.
Leaders, let me very quickly say that you are loved just the way you are.
Not because of your title, not because of your work, but because you are you.
And today is bring your daughter and son to work today, which means the generations are watching each and every one of us.
So into the space, let me invite you into prayer and meditation.
Creator.
Today, as young eyes watch, we give thanks for their reminder of what is possible.
So stir in each of us a sense of holy imagination.
One that refuses to settle for what is and dares to shape what ought to be.
For the members of this council.
Give them a courage that reaches beyond today.
But opens doors for generations coming after us.
And let the decisions made in this room lean toward a future where every young person, regardless of skin tone, financial status, orientation, or culture, is welcomed, protected, and given space to flourish.
Not just someday, but beginning today.
And may hope rise here.
Not as an idea, but as an action.
So the generations watching today will one day say this was a place where love took shape in public life.
I pray all of this.
Amen.
And to the Republic for which it stands.
The clerk will call the rolls.
Yes, ma'am.

So the clerk will start with the special actions.
Yes, ma'am.
Two six zero three six four, declaring April twenty-third, twenty twenty-six says take your kid to work day.
My moose and others are present to receive the special action.
Thank you.
Come on in.
Why don't somebody start coming on this side?
Come on this side.
And then let's have some more from this way.
We had fun today.
Did they feed you anything?
All right.
All right.
I'm gonna go ahead and get started.
What a special day today is.
Today, obviously, is Take Your Kid to Work Day, which is held on the fourth Thursday of every year in the month of April.
The Miss Foundation for Women founded Take Our Daughters to Work in 1993, and in April 2003, decided to broaden the discussion about the competing challenges of work and family, understanding for girls to achieve their full potential, whether it is in the home, workplace, or community.
Boys also must be encouraged to reach their potential by participating fully in work, family, and community, which launched the Take Your Daughters and Sons to Work Day, also known today as Take Your Kid to Work Day.
Children want and envision a future where they can be involved in all aspects in a study conducted by the Family and Work Institute.
90% of students who said they plan to have a job, also plan to have children, and that 81% of those girls and 60% of the boys said they will reduce their work hours when they have children by creating an opportunity for children to share their expectations expectations for the future in the context of seeing new opportunities.
So the big question that I have today is did you all have fun today?
Yes.
Yes.
So I want to just take a moment to acknowledge uh not only all of the youth here today, but all of your parents, because your parents give and sacrifice every day on behalf of the residents of Kansas City.
And I know that you all are gonna be extra nice to your parents and make sure you give them big hugs and thank them for letting you come and hang out with us today.
So this was presented on behalf of Mayor Lucas.
Obviously, I'm filling in for him today, but it is such an honor to welcome you all to City Hall, and I love the t-shirts that you guys have today.
Council members, these are our future leaders.
Let's celebrate them.
Anyone else?
Anyone else want to say anything?
Okay.
All right.
Uh if there's no further discussion, all in favor, please say aye.
Aye.
Any opposed?
Okay.
All right.
This special action passes.
We will now hear from the moose.
Oh, are you speaking?
Are you just moving out the way?
Okay.
But before I speak, this is heaven to everybody.
She's a ninth grader.
She's going to be speaking on behalf of all the kids who came to visit that.
Okay.
Hello, my name is Heaven Jones Barnes, and I'm a freshman at Lincoln College Preparatory Academy.
Thank you so much, Mayor Council, for having us today.
It's pretty cool to see what our parents do behind the scenes, and it gives us a new perspective about our city.
Before today, I think a lot of us saw the outside of what our parents do.
We hear about their jobs and but we don't fully understand the impact that they make.
Being here has shown me the most that much hard work planning and dedication goes into keeping the city running.
For me, this experience is especially meaningful because my dad, Anthony Barnes, has been working with the city for over 20 years.
That's over two decades of showing up, putting up and being the best possible version of himself.
I am so glad to succeed with this guy now.
For all the amazing careers I got to hear about today, my biggest takeaway is that there's a place for everyone, no matter your skills and interests, everyone has something that they contribute to our community.
So thank you.
So thank you again for giving us kids the opportunity.
This house shows the value of hard work and the importance of community.
And another thing.
See you next year.
I would like to say something.
When do you get out of school?
Because we got a job waiting here for it.
One, two.
All right.
All right.
Thank you.
Okay.
Yes.
I brought my son.
Oh, yeah.
Thank you.
Thank you.
Good job.

All right.
Uh um, as the current cup club president on behalf of our Syroptimus International of Kansas City Club, I'd like to thank you all for this recognition.
As mentioned in the proclamation, we are part of a global uh organization, volunteer organization.
Our Kansas City Club is about a small but mighty group of about 20 members, but we've given over a million dollars, like mentioned, um, over our hundred years to support women and girls here in the Kansas City Metro area.
So this recognition is really just the cherry on top of the cake.
As we welcome over a hundred other women from across this region to Kansas City this weekend for our conference, and so we look forward to continuing our work in the future, and again, thank you for recognizing us.
Thank you.

260366 recognizing Historic West Bottoms Association for its work and dedication to the historic area in celebration of more than a decade of activities and events drawn attention to the Kansas City region and attracting visitors to the West Bottoms.
Ian Davis and others are present to receive a special action.
Councilman Raya.
Thank you, Madam Mayor Pro Tem.
This resolution recognizes the Stork West Bottoms Association for its work and dedication to the historic area and in celebration of more than a decade of activities and events drawing attention to the Kansas City region and attracting visitors to the West Bottoms.
So I've had the opportunity to work with these folks the last two and a half years, and I've been very proud to represent this neighborhood on the city council and all the work that they've done.
But in a way that will make sure it'll stay true to its nature and keeping the West Bottoms true to what it's always been.
The Storic West Bottoms Association is partnering with many organizations and businesses for over 75 events since Heritage Days began in 2015, which is Heritage Days is coming up over the next couple of weeks.
There will be a number of festivals, events down in the West Bottoms to go and uh enjoy and participate in.
Like I said, I've been honored to represent uh this community on the city council and these incredible folks that do such a good job of preserving the West Bottoms history.
Um so thank you all for coming out today.
Thank you.
And if there's no further discussion, um I'll just add also a thanks as well on behalf of uh the residents of Kansas City and just your commitment to ensuring that uh we continue to preserve West Bottoms and uh just excited about the resurgence and what we will see in the years to come.
If there's no further discussion, all in favor, please say aye.
Aye, aye.
Any opposed, okay.
This special action passes who speak.
Uh good afternoon, uh Mayor Pro Tem and members of the City Council.
On behalf of the Historic West Bottoms Association, thank you for this recognition.
We're here today to invite you to celebrate the 12th annual heritage days throughout the month of May.
Our theme this year is the art of revitalization.
It's a celebration of how our district's storied history as a commercial industrial hub is fueling a new area, new era of creativity and investment.
We're particularly excited to kick things off of the iconic his uh livestock exchange building with the debut of the newly unveiled exchange room event space.
We have an incredible lineup this month, including our first Friday weekend, the fifth annual taste of AAPI on May 2nd, the Ride and Roll Bicycle event on May 9th, and the Stockyards Legends dinner on May 20th, where we will honor uh Pat O'Neill.
The West Bottoms is a living canvas where Kansas City's history and future intersect.
We invite each of you to join us this May to experience that momentum firsthand for your support and for recognizing the hard work of our artists, developers, and small business owners.
Thank you, May.
Appreciate you.
Congratulations.
Just bought a table today.
Thanks, May.

Councilman Bunch.
Request the clerk receive docket and read an additional special action to be included on today's docket.
The clerk will receive the resolution, assign a number and read the title.
That number is going to be 260405, honoring artists involved with the weaving nets art installation commemorating Kansas City hosting the FIFA World Cup 2026 matches.
Councilman Bunch.
Thank you, Madam Mayor Pro Tem.
Um so today we are celebrating Maddie Rhodes uh many so many uh contributions to the local community and the way of arts uh and honoring a specific uh art installation that will be here during FIFA World Cup.
Um it is called uh weaving nets.
It is uh actually incorporating a soccer whole net and and to the community um and in partnership with the Mexican consulate.
So thank you for for the contributions there.
But um the artist uh Betsabe Romero is an internationally renowned Mexican artist um who will be helping with this installation, and under the direction of of Jenny Mendez, the cultural arts director for the Matty Rhodes Cultural Center.
The organization has joined Romero in this creation of a metaphorical net, binding together diverse voices and fostering a sense of unity among the participants.
Uh the public's invited to experience this installation through July 30th on the South Lawn of the Kansas City Convention Center.
Uh Councilman Rea and I are really proud to be a part of that and part and proud to bring that to our community to add a bit of cultural flair to the World Cup.
And with that is 16 local artists.
Um I'm not going to read all their names, but I believe some of them are here today.
And we're really excited to celebrate your work here and your contributing contributions to the local community and and really celebrating and honoring Matty Rowe's continual, continuous uh uh contributions to the community.
So thank you so much for everything you do.
Um, and we're really excited to see this installation happen.
And again, Councilman Ray and I are very proud to be a part of that.
So thank you so much.
And if there's no further discussion, I will just also add us a uh thank you and excitement uh for the opportunity to celebrate the wonderful work that you all put together.
And I want to also uh take a moment to thank uh General Council.
Oh, okay, you moved on me.
Thank you so much for being here, uh, General Council of Mexico.
Thank you.
Uh if there's no further discussion, all in favor, please say aye.
Aye.
Any opposed?
Okay, the special action passes.
Okay, and who speaks?
Thank you, Mayor Pro Tem Shaw and members of the City Council.
My name is John Fierro.
I'm the president and CEO of Matty Road Center.
Great to be here.
You know, for more than 50 years, Matty Roads Center has celebrated art, has worked to provide a venue for our local talented artist, and really to preserve the Hispanic culture.
Um it was back in the mid-1970s, we converted an old garage into an art studio for neighborhood kids.
Um about 30 years ago, we opened up Kansas City's first gallery uh that provided a venue for local, regional, national, and at times international Hispanic artist.
And about 30 years ago, under Jenny Mendez, our Cultural Art Center Director's leadership, started a three-decade-long celebration that continues for Day of the Dead.
And many of you have been there to celebrate with us.
So we really uh feel that one of our roles here in our city is to honor our artist, preserve the Hispanic culture, and today celebrates just another accomplishment.
And really, we can't do any of this without the artist behind me.
Um the names of all of those involved with this particular project are listed in the resolution, and I know Councilman Ray Um Bunch, excuse me, uh, presented that.
We've had the honor to work with Betta Bel Romero, an Mexican artist, who has uh designed several soccer goals that you will see in most, if not all of the World Cup cities here in the United States.
That's Atlanta, Seattle, Los Angeles, Kansas City has the distinction of having the first set of goals placed and opened and have an opening ceremony this Saturday.
So we're very fortunate to be number one uh as it pertains to the United States, and you'll also be able to see her work in Guadalajara, Monterey, uh, or other cities.
And they're pretty unique.
Uh each of the nets are uh hand woven, very colorful.
They're still plate images with different silhouettes, and I've shared this with many people.
The artist uh responding to Jenny Mendez's call.
Uh I remember being there a couple of evenings and just being there long enough to realize this is not a 10-minute, two-hour type one evening uh event.
They were there over several weeks, several hours reviewing the video that Betsa Be had produced, instructing communities on how to put these soccer uh artistic goals together.
And and I would just conclude my comments by saying that one, uh I really want to say thank you to the Kansas City Convention Center, uh, Camiko Gilmore, uh, Matthew Cunningham, others.
They have been a big part of this in in that they will help to build some platforms, anchor the goals that the community and the general public can go and observe and not necessarily play on the goals.
I also want to acknowledge our fourth district council members bunch and Reya who were very critical in supporting us with this, uh, and also uh the the consul general from Mexico uh Soleil uh Padilla uh Meyer, who is to my right.
Uh, you know, uh having this opportunity to really extend our network internationally uh is certainly a great benefit to our artists, and I would just ask you all to thank as as you all know me very well.
Well we will be back.
Uh I think what this project has an opportunity to do is to create a sister art relationship.
I would very much love to have opportunities for these artists to be able to go to those various cities here in the United States and in Mexico and vice versa, and to work on several other projects.
So thank you.
Thank you.
She said that by wire friends.
Thank you.
Thank you so much.
Thank you.
Councilman Duncan.
Thank you, Honorable Mayor Pro Tim.
Thank you all, Honorable Mayor Pro Tim.
I request that the clerk receive Docket and read an additional special action to be included on today's docket.
The clerk will receive the resolution, assign a number and read the title.
That number is going to be 260406, recognizing April 29, 2026 as National Denim Day and honoring the Missouri Coalition against domestic and violence against sexual violence against women for their work in the community.
Council McDonough.
Thank you, Alba Mayor Pro Tim.
Uh, as the clerk read, uh, we're declaring April 29th as National Denim Day and honoring the Missouri Coalition Against Domestic and Sexual Violence or Moxa for their work in our community.
Um, we've done this a number of years, and and Mayor Pro Tim has asked me to read this today, and I feel very honored.
Um, I'm not going to read the entire resolution.
What I will say is that we know that sexual violence continues to be a pervasive issue in our city.
Um we also know, and it doesn't say it in here, that it is incumbent upon us, right, to teach our young men not to be perpetuate uh perpetuators of violence rather than um teaching our young women um that they that they should be better victims.
Um I think that uh what this resolution does is remind folks that it doesn't matter what you wear, it doesn't matter who you are, you don't deserve to be a victim of violence.
And it's about teaching folks not to be violent, not blaming victims for what they had on that day.
Um so I want to thank uh Moxa for your continued and very tough work.
I can't even imagine.
Um, as a man myself, um, we have privilege, it's it's it's incumbent upon us, right, to teach and to to be the better example.
So thank you.
Yes, Councilman Rogers.
Yeah, oh thank you for bringing this forward.
And um, you know, Mox is one of those organizations that I got to work with as a prosecutor when you guys are doing such incredible work for victims of violent crimes.
Saw your advocacy when I was in the state legislature, and then also in this building, and of course, my mom worked there for a long time too, and so I've got a soft spot for you all anyway.
But um, yeah, I've seen it from a thousand different perspectives, it's always amazing, and we're sure thankful for what you do.
So, uh colleagues, I want to thank Councilman Duncan for bringing this forward for me uh because I had the other one that I had already committed to.
Um, but you know this is really important to me.
Um, and I just for those who might be listening today who this is your first time.
Uh National Denim Day, yes, people like to wear jeans, but the significance and the significance of it uh was established back uh in 1998 when a court ruling uh found a perpetrator who had uh sexually assaulted a young girl who was getting her taking her driver's test and he assaulted her while she was taking the test, and the court ruled that uh he was innocent because she was wearing tight jeans and there was no way that he was he would have been able to get those jeans off if if you know she didn't want that to happen.
And that uh spark that is what really is the impetus behind this denim day.
And so for all of the victims there out that maybe who are uh carrying this that maybe have been assaulted, I want to say please tell someone we believe you, and that and I want to empower someone today to make sure that they come forward, and I also want to thank um all of those behind me.
So, and I'm gonna try to read this because I've it's actually definitely I thank Moxa.
We also have uh members obviously from KCPD.
We have members from uh St.
Louis Clinical Forensic team as well as I think there's another team.
That's it.
Okay, I thought I had another email there.
All right, but thank you all so much for the work that you do every day, um, really saving saving victims' lives.
Um, because I know this is a a harsh burden to bear.
Uh with that, if there's oh, Councilman Willie.
That's co-sponsor, please.
Yes.
And and and me as well, please, as a co-sponsor.
All of them.
Uh, if there's no further discussion, I'll let the record reflect councilman Councilwoman French as a co-sponsor.
How about we just add everybody?
Okay, please add everybody as co-sponsors.
Um let the uh all in favor, please say aye.
Any opposed?
Okay, this special action passes for speaking to me.
Good afternoon, and thank you all.
My name is Julie Donolin, and I'm the president and CEO at the Metropolitan Organization to Counter Sexual Assault.
We want to thank Mayor Pro Tem and Council members for you your unanimous support of this resolution.
I think this really shows uh it's very this is a very important issue to Kansas City, so thank you.
Um with us today are our partners, uh St.
Luke's and also the Kansas City Police Department.
It takes all of us working together to make sure that survivors are met with care, compassion, and support when they report sexual violence.
So we're very grateful for the long-term support of these organizations behind us.
Um denham Day is is a time when it we can show through small visible actions, uh small this small visible signs that can help dispel myths about sexual violence, like Mayor Pro Tem had described earlier, and also let survivors know that they are not alone and to support them.
So thank you very much for your support of survivors and for Moxa.
We appreciate all that the city does for Moxa and for survivors.
Thank you.
Thank you.
We appreciate you.
Thank you.
Thanks for that.
Mayor Pro Tim, I think we were gonna do a photo at the diet school.
Oh yeah, we were okay.
Yeah, we were sure.
Oh, yeah, thank you about that.
Thank you.
Thank you.
Council members in your denim.
We're gonna circle back behind the diet.
We're gonna take a picture real quick.
Yeah, thank you.
Those who are wearing denim, if you want to come up real quick.
Thank you so much.
Oh, sorry.
We could go.
We get to go.
I'm going.
Even if you're not wearing denim.
Come on.
Denim in the front.
Okay, uh you forgot.
All right, ready?
All right.
Thank you.
Thank you so much, everybody.
Oh, okay.
Thank you.
What's that?
Oh my gosh.
Okay, did I?
Oh.
Oh, yes.

Direct and city manager engaged with the economic development corporation of Kansas City, other relevant incentive agencies, as well as city staff and the civil rights equal opportunity employment department to develop standard operating procedures to be used consistently across all state agencies for the purpose of waiving minority and women business enterprise participation goals.
Pursuant to section 3437B as amended by committee substitute for ordinance number 260286.
And report back to the city council within 30 days for their findings and a proposed codified version of said standard operating procedures for city council consideration.
I was going to say Councilman Curls, you're the lead sponsor.
Well, okay.
Thank you, Madam Mayor Pro Tem.
Uh this resolution is kind of self-explanatory, but it's basically uh emanated out of the discussion that we had in finance committee in regards to uh prevailing wage and uh MBEWBE waivers uh and this basically directs the city manager to look at the uh possibility of a collaboration between the EDC and the other entities that were discussed in regards to this ordinance uh to making sure that uh we as a council are covered as well as if there's any uh issues or concerns that we need to discuss as we go forward with this uh ordinance that which will be held which we be which will be heard in a couple more weeks.
This gives us an opportunity, although the 30 days is a little longer out, but we're also looking at a commit uh uh committee sub also, and I've spoken with some of my colleagues in regards to this, so we all kind of wanted to try to make sure that we are doing the right thing as a council when it comes to this ordinance and the waivers that have been in the uh headlines and and out front in regarding this ordinance.
Councilwoman Bull.
Um thank you, um honorable mayor um uh pro ten.
Um as I'll speak on as my role of um chair of the EDC um board chair.
Um I would support this ordinance and ask others to as well.
Um today we have the LCRA board member meeting.
Um Dan Moy as the executive director uh discussed the ordinance that was pending, and we talked uh somewhat about this, and so I think there is support for this even at the the committee meeting um on Tuesday.
Um Mr.
Moy testified that um you know he would be in support of having some discussion and and consistent um procedures for this.
So um I just wanted to stand and offer my support as well.
Thanks.
Thank you.
Uh and colleagues, I will offer my support for this as well, and uh would like to be added as a co-sponsor on this.
If there's no further discussion, a clerk will call the roll.
Aye, Barkshaw, aye.
Blue, aye, document, no, French, aye, Rogers, aye, Paterson Haslin.
Aye, Robinson, Raya?
Aye, Barn?
Denise one day.
Resolution is adopted.
Please proceed with the final readings debate.
Docket.
Yes, ma'am.
260340 reduced appropriations any amount of 5.9 million dollars in the legal expense fund appropriating that amount for non-appropriate fund balance of the legal dismissed fund as a transfer to the Kansas City Police Department for legal settlement expenses.
Designate recognition authority and established an effective date.
Finance committee to pass.
And go ahead.
Honorable Mayor Pultim.
This ordinance authorizes the transfer of 5.9 million of previously appropriated funds within the city's legal expense fund to support the Kansas City Police Department's anticipated legal settlement obligations.
The ordinance also designates the appropriate positioning authorities for both the city and the police department to ensure proper oversight and administration of the funds.
The transfer and associated appropriations are structured to take effect on May 1st, 2026, aligning fund availability with projected legal expense needs.
So I don't know if we want to take that up at the same time or just note that for consideration.
Well, hey, Councilman Duncan.
One of clarification.
So if we were to vote this down and vote the other one, we would still appropriate the funds correctly.
You have it mostly right.
265 already assumes the appropriation in the city's budget.
So it's been previously appropriate by the city's budget.
It sits in the legal expense fund as it's currently as we're as we're going towards May 1st.
What does that mean?
The reappropriation only would occur in 340.
No.
Council's already taken steps commensurate with the budget to give effect to 6.5.
Everybody clear.
Go ahead, Councilman Rogers.
What?
Madam, it might be make sense to just read both ordinances, maybe read the second order.
Sure.
Yeah.
Okay.
Okay.
260065.
Director City Manager assigned cost incurred by the Board of Police Commissioners beyond the 25% annual budget threshold for Missouri by Statute 84730 to the new fund entitled KC to be overgerund.
Establishing a staff fund in the books and records of the city, director and city manager negotiate with the Board of Police Commissioners a process to the city council approval and costs related to the Board of Police Commissioners' established settlement agreements as including settlements with costs structured over future budget cycles and directed city magistrates to include an appropriation of point of 5.9 million dollars in fiscal year 2627 submitted budget from the KCPD overage fund for legal settlements and subjecting such payments to the council ordinance process.
Legal review recommends do pass.
I think I'm the only member of legal review present in the chamber.
So I will um I will read from the docket memo.
Oh I have it here.
Oh thank you.
The City Council has a responsibility to approve the annual budget, including the yearly funding appropriation for the Board of Police Commissioners.
Pursuant to Missouri revised statutes 84730.
City Council is not required to appropriate amounts exceeding one fourth of the general revenue fund in any fiscal year to the Board of Police Commissioners.
The board periodically makes funding requests above and beyond the required one-fourth funding allocation, including requests for settlements and judgments from litigation involving the department.
The board in its 2627 requested budget seeks funding beyond the required one-fourth funding allocation mandated by state law.
I just said that uh mandated by state law to address costs for legal settlements previously approved by the Board of Police Commissioners, the fiscal impact and future years and budget cycles.
City Council has received no information on the nature, size, or scope of structured settle legal settlements impacting this in future years and budget cycle seeking appropriations in excess of state statutory mandate.
The city has established procedures for review of costs arising from legal settlements and has responsibility for properly anticipating and budgeting future costs to the city, including seven and eight-figure legal settlements approved by the Board of Police Commissioners.
The city desires to reduce the detrimental effect of structured legal settlements impacting the current and future years and budget cycles on policing and public safety in Kansas City.
One would address the 5.9, but I believe because this was introduced prior to when it adopted the budget, as our city attorney said it does not this would uh direct the appropriation.
Section one would assign costs over the 25% annual budget threshold to a new fund, which is established on the books of the city of Kansas City, and section two would direct the city manager to negotiation negotiate with Board of Police Commissioners a process for council approval of costs related to Board of Police Commissioners.
Approved settlement agreements, including settlements with cost structured over future budget cycles.
So I think that if we were to pass 260065, there would be the need for some type of floor amendment.
I think this is purely my opinion.
And to the extent there is information in 260065 that members would like to address, either send that back to committee.
So that is my um, and I would welcome anyone from our uh esteemed departments to add anything to that that they would like.
Go ahead, Councilman Maria.
Thank you, Madam Uh Madam Mayor Cro Tem.
Um why are there two ordinances?
And the mayor's filed both of them.
So not that I'm speaking on behalf of the mayor, but I well, and before you go there, it's just gonna create some confusion.
I think you should be here for that, so maybe we just hold it until these years.
So I think here's the problem that I'm gonna speak for myself, and I think I'm going to try to explain the issue.
Um, the 5.9 million dollars is what the the police department is required to pay out in structured settlements that are due on May 1st.
We do not meet again until after May 1st.
So this is an amount that we need to address and be able to pay over to the police department for obligations that come due on May 1st.
Existing obligations, existing obligations and obligations, not in the term of bonds, but those obligations.
Yes, legal obligations.
Legal obligations.
Um the the ordinance um 26065 was introduced some time ago as a way to address not only this 5.9 million dollars in the in the 2627 budget, but a way to address a process for moving forward.
I think that um came to the council.
There was it came out of legal review, there was some questions about it, it came to the floor of the council, there were some questions about it, it was held, and in an effort to address the 5.9 million dollars that we knew was going to become due on May 1st.
million dollars in the in the 2627 budget but a way to address a process for moving forward I think that um came to the council there was it came out of legal review there was some questions about it it came to the floor of the council there were some questions about it it was held and in an effort to address the 5.9 million dollars that we knew was going to become due on May 1st the mayor introduced a separate ordinance so that we can address the 5.9 million dollars and not address the other issues that were contained in 260065 because 260065 includes um not only a process but the setting aside of anything over the 25 percent statutory requirement and that I'm gonna guess on for some people that is positive for other people not so positive.
So in a way to move forward the 5.9 million dollars the alternative I do not think it was anticipated that both ordinances would be adopted in the exact point that they are before the council so I it's going to be necessary to either to not adopt both adopt one and amend the other adopt one not adopt the other I see uh actually councilman will it was next thank you mayor pro tem uh thank you uh chairwoman for explaining that I would my preference is to adopt the first one that was read and send um the the second one to committee and I actually would prefer to go to the committee that the chairwoman chairs to have more representation of the council on it you have you would then have Northland representatives and more a variety of folks across the city rather than this uh special legal um committee that doesn't meet on a regular basis so I would prefer adopt the first one and uh make sure that we're able to uh do our commitment um and then the second one send it to committee I'd prefer to go I I think you chair a committee better than the mayor does so um no just so thank you councilman Duncan thank you honorable mayor pro tem uh just to some traffic here uh while I appreciate um councilwoman boo's uh point that this could be sent back to committee I don't believe that's necessary um I understand that the 5.9 million is due uh on May 1st I would say that if if this body would like to ensure that the police can the police department can ensure they can pay their legal expenses by May 1st that uh 260340 is passed and if we're looking to also provide I think what is necessary uh transparency and of what's going on with with those legal expenses in the future that 260065 um is passed but amended to strike section three I don't think that needs to go back to committee to do that so the payments get made we also get the establishment of an of a fund that provides us with the with the transparency that we've all said that we want councilman o'Neill I would uh my only issue here is I don't believe this ordinance captures the true problem here I think we we're just expanding a problem because I I think that if we hold this money if the 25% or above is held then we're they will come back to it I and tell us if they don't get it they're gonna cancel this this and this and we can't afford that as well I just think this is poorly prepared at this point I think it needs to go back for fine tuning so that and I I do tend to agree with my colleagues advice of putting this into finance so that there is more representation on the uh on the debate that goes forward with so that would be my go ahead councilman currents then we'll come I was going to say you went to councilman o'Neill before me age before beauty um thank you madam mayor pro camp say that um I I know that there is some concern about uh 260065 I thought that we had talked about possibly having a closed session but saying how the mayor's not here uh and I agree with councilman rea that saying how he sponsored this ordinance he should probably be involved in the conversation so that we can kind of hear from him before we move forward on this and make sure that there's a clear understanding as to uh what this ordinance is actually going to do and then have further discussion for those of us who have concerns or questions that may need to be answered uh that can't be answered at this particular time so I would suggest that we possibly go ahead and proceed with approving uh 260340 and and maybe hold the other one on docket or send it back to committee I'm open for either way but not advance or vote on two six
So I would suggest that we possibly go ahead and proceed with approving uh 260340 and and maybe hold the other one on docket or send it back to committee.
I'm open for either way, but not advance or vote on 260065 at this time.
Okay, Councilman Rogers was next.
So I'm gonna concur with my Northland colleagues here.
This this ordinance ending in 340.
This is an immediate need, and we need to make sure that this money gets where it needs to go.
The one ending in 065 is a policy issue we can debate, and frankly, I think we're in way different pages about how this money needs to be spent and where and how and what kind of oversight.
So it sounds like a really good conversation for committee to me.
I concur the finance is the right place for that to go.
So I'm I'm imploring this body to make sure that we get that 5.9 done today because as uh Chairwoman Blue mentioned, we need that done by May the 1st.
So I I concur with Councilman Willett and Councilman O'Neill.
Is that what he said about uh councilman councilwoman Robinson?
Uh I'm sorry.
Councilwoman Boo.
Um first of all, I just want to let record to reflect that all of our chairs of the committee are wonderful chairs and they treat them equally.
Even councilman O'Neill.
I'm giving you props.
Um I really forgot why I was standing up.
Um you just wanted to cut me down.
No, I was giving I was saying how great of you are in common.
Oh, I do think that to uh councilman uh Croll's point.
Um whether it's sent back to committee or held, it would give us an opportunity to the extent anyone wants to go into closed session, we could do that.
Um we could do that any time, frankly.
Um I I did get a message from the mayor staff that they're fine with it going to any committee, despite what Council Willett may have said.
Um that um that either way is is fine.
So right, any other discussion.
Is there a motion?
Well, so we got two.
We have two on the yes.
We have to vote on two separate, right?
Well, which I think Madam President Officer, I would suggest which ordinance you if there's a there's a motion to re-refer Bush, you might be calling for uh on either item.
You might be calling for a vote on one item or another, but then you'd want to declare which one you're calling to vote for.
Um so it looks like I um have an amendment to 2603.
Okay.
I move that ordinance number 260340, which is the first ordinance be amended so that reads as in the document entitled ordinance number 260340 as amended, which has been distributed to all council members.
Zero seconds.
The scope of the amendment adds an accelerated effective date so we can make sure this is taken through.
340, thank you.
It has been moved and seconded that ordinance number 260340 as amended be amended.
Is there any discussion on the motion?
This amendment will change section six by recognizing the ordinance as having an accelerated effective date.
Councilman Duncan.
Thank you, Honorable Member for Tim.
Um while I understand there's an immediate need to provide this money.
Uh, I think it's irresponsible if we kick the can down the road of to provide additional transparency that how these funds are being settled, what the type what what are we settling, right?
It's it's it's our budget that's being affected.
We've been put into a financial bind, not because of fault of ours, but a fault of a department that we don't have direct control over.
And so I think it's important that we have transparency moving forward.
I I cannot vote to allocate funds if we're not going to also look forward and say, yes, we want better transparency so that we understand exactly what we're paying for in the future.
Um, and I believe um duly noted don't disagree.
Um at the committee we had that um um that discussion.
This I think I can say because it's been said is the nature of the 5.9 million dollars is structured settlements that have already been settled.
Um, and so I think that there is and will be time for discussion about the policies and the procedures that are addressed in 034 and how we continue to address um future legal settlements because it's my understanding, and I think I think it's okay.
I've already said it once.
Can I say it again?
Um that these are settlements that have already um occurred in the past and they are structured, and this is not may not necessarily be the first year, and they are due on May 1.
So I think it's absolutely um to your point you know the city is not gonna have zero settlements starting with our May 1st fiscal year, and I suspect that the police department department is gonna not have zero settlements.
That's with sort of a double negative.
So I think that there is time to have the discussion with respect to what process moving forward.
Um for whatever that's right.
Uh go ahead, Councilman Duncan.
Thank you, Albert Mayor for Tim.
I would just hope that you know we're not looking to delay future transparency and and future information coming to this body regarding settlements, whether it be structured or otherwise.
It's it's incumbent upon this body as executive of this corporation, city of Kansas City to understand exactly what is impacting our budget.
Um I I believe uh that 065 provides us with an opportunity to do that.
Um so I I and I fully believe that we have the ability, this body has the ability to have that robust discussion, either if it's if it's appropriate for closed, we can do it in closed.
If it's appropriate for in the open, let's do it in the open.
Um but I don't I don't believe we need to kick this back to committee when it's already gone through a committee once before.
Councilman curls.
Thank you, madam, mayor pro chem.
I I just want and and maybe uh our law department can kind of give us the what would be the consequences if we do not pass 340 at this particular time.
Uh I I can only give you what's been represented to me.
Is that they the police department has contractual responsibilities to pay uh defendants or other beneficiaries out of structured settlements out of agreements they've already negotiated that comes due on May 1st.
The failure to do so.
Uh the I I don't know what action the board would take.
I'm not their lawyer.
I would probably have any number of of ideas that I would give them, uh, but they would uh risk potentially contractual non-compliance uh or they would have to engage in some sort of uh statutory process by which they make themselves whole here and then come back later and ask for uh additional funding, which which has been the practice uh when they have to make a uh a change in classification or character of the funds.
Okay, but that's pure speculation on my part.
Just that's what I would think how I would answer the question.
All right, if there's no further discussion, uh the clerk will call a roll on the motion to amend.
Curls.
Aye.
Aye.
Aye.
All right, oh neil, aye.
Will it?
All right, Grant?
Aye, Rogers, Patterson Hasley.
Aye, Robinson, Raya, aye.
Borns, aye, Lucas, 11 ayes.
Motion passes.
All right, so now we will um the items before you the items before you as amended on the amended 260340.
There's no further discussion of corporate call the role.
Um sorry, maybe uh 260340.
We are voting on now.
You're voting on approving the 5.9 appropriation.
As amended.
As amended.
Okay.
Okay.
And this is the one that goes.
Which is the one that will have the accelerated effective date to ensure that it's paid by May 1st.
Gotcha.
Thank you.
Just want to make sure.
All right, if there's no further discussion, the clerk will call the roll.
Parkshaw.
Aye.
Who canal?
I will it?
Aye.
Aye.
Rogers.
Aye.
Robinson.
Raya.
Aye.
Yes.
Eleven eyes.
All right.
So now let's hear better.
Uh 260.
065.
065.
Uh Councilman Duncan.
Uh Madam Mayor Pro Tim, thank you.
Uh I move that we hold this item on docket.
Docket.
You don't have to move.
There's no objection.
There's no objection.
Off docket or on.
All right.
So is there a second?
Or can I have that objection?
Point of order here.
I object.
Okay, hold on.
Okay.
Can we debate that?
I don't know what he's talking about.
I don't know what the C is asking to hold it on the floor so when we come back, it'll it'll stay here rather than re referring it back to committee.
Okay, I I'm I'm I object, so I would like to vote.
Well, actually there's no yeah, it's objections.
Yeah, okay.
Go ahead.
Go ahead, Councilman Duncan.
I would move to hold the item on docket.
All right.
Is there a second?
All right.
So the everybody looks confused.
So there's a motion on the floor to hold the uh 2600 six five on the on the docket to hold it on the docket.
Second.
Uh uh.
Okay.
All right.
It's been moved and seconded.
Is there any further discussion?
Um councilwoman.
So clarifying question.
It seems like the options are holding on docket versus sending back to committee.
Right.
I mean that's not the option before us, but those options we've discussed.
Councilman Duncan got his motion in before anyone else got their motion and just send it back to committee.
That's where we are.
Is that correct?
Practical difference between keeping it on docket and going back to committee.
We can still all do our due diligence and have the conversations we need to have.
Right.
I I mean I I I would think that there actually yeah, go ahead.
Go ahead, Councilwoman.
I I think he was actually asking you a question.
So I was asking anyone a question.
Okay.
He was just looking at me, probably because of the question.
I was looking at your document.
Oh, oh, he and oh either one of you.
I so I I think let me explain my reasoning.
I I I believe that this body is fully capable of I think this is a minor amendment.
If we're gonna make an amendment at all on this on this item, if we're gonna have additional robust discussions, I think it's appropriate for this body to have that discussion here rather than open this up to public comment and have and have additional a parade potentially um where this has already gone through committee.
Like the frame, though.
What did you say?
I said you liked the braid.
Oh I think you said you like it.
All right.
Uh Crispin, can you use your mic?
All right.
So and I I think the other uh potential benefit for those of us who are not on the finance committee or legal review committee is that uh if there's a closed session, um you know there's an opportunity really for us to weigh in and put to and have a vote on the floor as well.
So uh any further discussion on the motion to hold this item on the floor.
Can we get it?
Did I get a second?
Yes, there was a second.
I forgot who though, but there was a second.
Councilman Raya was the second.
Punch.
I apologize.
Bunch was the second.
So go ahead.
So the thank you, uh, Madam Mayor Pro Tim.
So the last thing that was said was hold it on the floor for the benefit of the full council um being in front of the item.
And if there's a closed session where I'll present rather than if it were in committee, some people may not be in finance and to participate in a closed.
Um, and so I mean, for that reason, I'm fine with holding it on the floor now.
I wasn't at first, but I'll I'm fine with holding it here so we can all participate in the closed um if if that were to arise because schedules.
And at the risk of having us here all night, we could actually go into close right now, but the mayor is not here, and I know it's been said several times since he was the sponsor of this, that we we'd like to hear from him.
So uh councilwoman boo was next.
I think um the I think the only reason I was thinking it would be best to go back to committee would be to be able to work through the amendment, but I think if as long as someone will take leadership and working on an amendment, um and we can get that somehow get that done before we go into close or during what we go you know, go into close early.
So the the timing all works.
I think having everyone present would be a better option for the closed session, unless y'all just all want to come to finance again.
I've enjoyed having all y'all there, so you know I'll be there.
I always welcome I think you just volunteer, councilwoman.
Uh councilman O'Neill.
I mean there's some strong arguments on both ways.
I guess my only uh thought on this is off docket or in committee the the various uh nuances of this.
I think it's a very I think it needs a lot of work, and I think a committee is better at getting those uh that work together and and putting more more effort into it and then coming back to us with a full uh docket that we don't have to think of right at that.
We we will have a very short period of time to debate that.
We'll have a long period of time, but it's going to be given to us the day of, and then we'll have to do it.
Lot of work and I think a committee is better at getting those uh that work together and and putting more more effort into it and then coming back to us with a full uh docket that we don't have to think of right at that we we will have a very short period of time to debate that we'll have a long period of time but it's going to be given to us the day of and then we'll have to do it you know we'll we'll debate it on on the floor come up with some uh compromises or whatever and then we have to have it written and then we're in a very quick method of turning this around right during legislative session and that's the only reason I would think that there would be need for uh a better version of this would be done in uh in committee councilman duncan since it I was volunt told uh to to I will work with the mayor's office to uh get an amendment to you all next week okay so you can have a look at it way in advance but councilman rogers even if there isn't presented next week would still be better to have a conversation about it in committee so nothing stops you from doing that and then we can still send it back to committee and have a full conversation about it so I'll be voting no to hold it I'll follow up with a motion to send it back to finance councilman will it yeah thank you uh mayor pro time I kind of expressed some of my uh feelings on on the definition of calling it an overage fund to begin with and so the whole creation of this I understand where different people are coming from on this but the fact that we're calling it an overage fund is pretty and send it to a committee that doesn't have any north line representation on it I think is pretty insensitive um given certain history but I trust with um mayor uh excuse me um with the chairwoman's committee with Darrell Curl's expertise coming through before um we'll get all our questions answered and and maybe there's other amendments one thing is I know there might be a couple public comment which I think is good on this um especially at a time where people are normally show up on on finance you know legal review is not a time that people normally anticipate on showing up for legal review with the amazing chair that they have people like to make a point to come but also I think does it limit our ability for um police to or KCPD to comment on it once we go into like a closed session um here during council versus a conversation um during a council committee uh no so I don't know how to respond to the I'm gonna ask the attorney to respond to I don't I don't know that you have a response or necessarily you've got a pending uh motion I don't know if there's any further discussion on Mr.
Duncan's motion uh councilman curls thank you madam mayor pro channel um I mean it's been a considerable amount of time on this we sure have uh I I just want point of clarification make sure that everybody understands uh what their vote means when they vote on this so the motion as I understand it and and clarification for myself as well is that if we hold this on docket councilman duncan is going to prepare an amendment that we will all have an opportunity to look at prior to us voting on this ordinance in two weeks is that accurate yes yes I will okay and if we vote and that that would mean a yes vote if we voted yes that's what that would do.
Well just to be fair what a yes vote will just hold it here you guys will move on to your next business.
Mr.
Duncan is represented he's going to file and has amended yes and a no vote would mean that that motion fails and then we're back to the original ordinance as presented right now.
Correct that's correct for any motion practice or adoption or consideration other consideration.
Okay.
I just won't make sure I understand is how to vote or what their vote is going to mean.
I guess I just think there's some ideological differences on this and I don't think uh saying uh councilman duncan just gives his input into a new ordinance but that's what we're talking about we're talking about one person creating a new amendment to the ordinance and frankly I just think there's there's more conversation that needs to be that's why I want to send it back to committee.
Okay that's fine yeah that's good councilman Raya just to be clear councilman Duncan has volunteered anyone else can also volunteer my thoughts exactly all right in committee so yeah we've spent about 30 minutes on holding this or not okay all right so uh the clerk will call the roll and just to confirm it is uh on a motion to hold the item on the floor or not so a yes vote will hold it on the floor and no vote will will not hold it on the floor madam clerk please call the roll curls no partshaw aye boo aye o'Neal no fringe no rogers no anderson has no Robinson Raya aye Bond aye Lucas five ayes and set six nays sorry okay the motion fails all right councilman rogers I make a motion to send it back to the finance committee our home
