Mayor, it is my privilege to introduce everybody to Sam Hennenfett.

Now, I'm lucky.

I don't have to go very far to give out special actions.

Last year, two years ago, I gave a special action to Emma Nye, who is my next door neighbor.

And Sam lives across the street from my neighborhood.

But I think what more telling is how impactful that neighborhood must be on the young kids.

The Sam is like unbelievable.

This is this is a young man who goes to Staley High School, who is a scholar and an athlete at the same time.

The everything he's done.

He started competitive swimming when you were in eighth grade.

He uh four years as a varsity swimmer at Staley, two-time Missouri State champion in the 500-yard freestyle swimming, set four school records, and has been named a USA swimming scholastic all American three times.

He's maintained a now, this is a school of 500 seniors, right?

He's maintained a 4.75 weighted GPA, number one in his class out of 500 kids.

He was twice the vice president, or he was the vice president of Staley High School's National Honor Society, a national merit semifinalist, and two-time AP scholar with distinction.

This fall, Sam will uh attend Duke University, a little school out in North Carolina, you might have heard of it.

Um, and he plans to pursue it, pursue a degree in biomedical engineering.

Sam has recently named the Kansas City Star.

I don't know if you saw the article in the star about uh two weeks, a month ago, three weeks ago.

Um he was uh named this Kansas City Stars Boys Scholar Athlete of the Year for the for his both his academic and athletic accomplishments.

Now, my wife will tell you the greatest asset or the greatest virtue of this young man is the fact that he doesn't make his parents do the mow the yard, he does it himself.

And uh I I'm just I'm so his parents are great, both of them pharmacists, um uh lived in the neighborhood for a long time, wonderful people.

I I just I can't tell you enough how proud the city is of having a young man like you, and I would only ask that when you do get out of college and you do come back to the city, try to keep your talents here because we love we hate to lose a guy like you.

I actually just I like to rise and honor when we see greatness, and I know we have greatness in front of us today, so I I just want to say congratulations, and I echo everything that Councilman O'Neill just said, and we want you to make sure you come back and make Kansas City be your permanent home forever, because I know once you get out there to do it, you'll probably uh have other people that'll try to get you to come to other cities, but congratulations and thank you so much for uh making Kansas City shine the way that you do.

Obviously, uh I could tell from talking to him earlier.

Not only is he blessed with wisdom and athletic talent, but also humility, and I greatly appreciate that.

Three of the eight intents listed in the overlay encouraged maintaining the pedestrian oriented development to achieve these intense drive-through facilities were listed as a prohibited use within the district.

The proposed amendment require review or rezonings and text amendments as standards for the overlay were codified.

Staff does not believe the amendment meets the required criteria for text amendment.

It does not correct or an error or inconsistency in the code, and it is not within not consistent with adopted plans or stated purpose of the Westboard overlay and is not in the best interest of the city as a whole and does not meet criteria for rezoning.

The property is suitably used and in current operation under the current zoning and overlay standards, and the property is not vacant due to zoning and amending overlay.

So as you can tell by that, the um staff, uh this was not recommended by staff.

Um I will just say briefly, um, this is this was actually a somewhat unique um situation where we are amending an overlay district.

Um I did ask a question at the committee because the the criteria that we are using as provided in the code um was such that as if we were um rezoning a property.

And so I think there is an I since um ask staff um you know perhaps that may not be the exact criteria we should be using.

Um but have setting that aside, um it is what is in the code.

Um this is a very narrowly tailored.

Well, I should not use those words because that does have legal meaning.

Um it is a it is not bad to be narrowly tailored.

It is very specific and narrow um changes to the overlay district district.

Why it while it does uh allow for drive-through facilities, it is not your typical drive-through facilities.

It does not allow for um call buttons, it does not allow for screens, it is specifically a um uh drive up window where you can pull um the like a bag from the window.

So for those reasons, I was supportive of this change to the overlay district to allow a special use permit.

The special use permit would still have to go to uh the CPC.

Um, and so this was very limited in its uh change in application.

So uh that's why I was supportive of it.

This would allow for a special use permit for a drive-thru in Westport.

Um so what this does is it would and I want to uh touch on the drive-thru versus the drive-up.

The it's being referred to as a drive-thru because that's the only definition we have in the development code.

And so this is actually um it's it's more specific than a drive-thru.

So I just wanted to be careful clear on that.

It's not a as Councilwoman Boo pointed out, there's not a call box, there's not a menu board, it is a order order ahead of time and come and pick things up.

Um but what this does is it changes the the base overlay to allow for in very very specific instances, no new curb cuts.

Um and so this is very again, it's very narrow in in what is allowed for and it changes again.

It does not change it for one specific property, it does not draw this property out of the overlay, it simply allows for this process um um under certain circumstances like a drive of uh it has to be pickup window and the curb cut already has to exist.

I know there was a no vote in committee to I'll join on the no side for a few reasons.

Understanding, I think the work that has been um at least that has been attempted to resolve here.

One, I I do think that we have a number of entities in this business in the greater midtown westport area.

Some of that is just pure adjacency to the state line and the fact that the same product isn't available on the other side.

Um I I think that um granted it's a pickup, so more like going to your CVS pharmacy to pick up of an order that you've already called for, but I do get worried about what secondary effects occur from um just that sort of activity centered in a district where we already have a number of entertainment facilities, alcohol sales, and others, um, and actual um criminal activity uh at times, and so uh I'm just not sure it better the neighborhood necessarily while having the greatest respect for otherwise lawful businesses that I and many other Missourians voted to support their legality.
