Kearney Planning Commission Meeting – January 19, 2018
The Kearney Planning Commission met on January 19, 2018, at 9:00 a.m. in City Council Chambers. The commission considered three major development applications: a revised development plan for a surgical center addition, a rezoning and platting for a rural residential lot, and a subdivision plat for a lakefront property. All three items were approved unanimously.

Item 4 – Lind Eye Care Surgical Center Addition: Jeff Depper and Grant Craig of CGID Architecture presented the revised planned district development plan (No. 2000-28) for a surgical center addition at 4107 7th Avenue. The proposal included a four-foot deviation from the 25-foot rear yard setback and a shared parking agreement with the E-Free Church for a minimum of 10 staff parking spaces across the street. Staff noted the parking demand would shift rather than increase, and the church’s peak usage (weekends/evenings) is compatible with the clinic’s weekday hours. The commission discussed the setback reduction, parking enforcement, and future expansion. The applicant confirmed that employees would use the church lot to reserve on-site spaces for patients.

Items 5, 6, 7 – Van Pool Subdivision: Mitch Humphrey of Buffalo Surveying Corporation represented James and Mary Beth Van Pool for a rezoning (AG to RR-1), preliminary plat (No. 2018-01), and final plat (No. 2018-01) for a 1.61-acre site at 6970 West Highway 30. The property contains an existing house; the owners wish to add another structure. The rezoning to rural residential standards was requested to conform with the use. Staff noted minor setbacks (one-foot rear yard encroachment) but supported the request as an existing rural residential site outside the city’s long-term service area. The commission approved all three items.

Items 8, 9 – Tschirren-Fox Subdivision: Mitch Humphrey also presented the preliminary and final plats (No. 2018-02) for a 5.1-acre and 5.1-acre split around a pond, located east of Sweetwater Avenue and south of East 11th Street. The owners (Janet Fox, Richard and Judith Tschirren) sought to divide the property so each owns a separate parcel with exclusive use of the pond. The lots exceed the minimum size for RR-1 zoning. Staff noted a two-foot side yard setback issue but supported the plat as existing rural residential. The commission approved both plats.

Reports and Comments from Board Members: The commission discussed several topics: enforcement of sidewalk blocking (using Access Kearney complaint system), the upcoming NPZA conference, an update on the city’s housing study (ongoing inventory and best practices), and a prior council decision on a development near E-Free Church. Addition on the property zone district COPD Office Plan Development Overlay District and described as lot one and two of Windsor Estates 10th edition in addition to the city of Carney Buffalo County Nebraska properties located at 4107 7th Avenue. Mr. Chairman, I'm gonna recuse myself from item number four. Okay. I have to admit that too. I I would also like to add that the lens are very good neighbors. Uh uh, but uh there is no conflict of interest, so I will participate in the discussion and the vote. Thank you. Sir I'm Jeff Depper with CGID architecture out of North Platte, we're representing uh Lynn Dye Care. Um what we're asking for for the Planning Commission's approval for uh surgical center. Um their surgical center is she's kind of limited on the hours that she can spend at the surgery center they're currently using, so she's wanting to put the addition so she's more readily available to take care of more patients. Um, first sheet up here is um off of the existing plans for the building showing the 200 foot radius around the existing property and the existing landscaping plan. There is um one addition that we have to make to comply with the existing landscaping plan. You'll go to the next one. Well, let's see if there's a pointer up here as well. Oh, very far. Um here is the existing proposed um addition to the plan. Um we're asking for a four-foot deviation off of the back side of the lot, which is the setback is currently at 25 feet. Um, and we would like to build the building four feet into that setback if we can get your approval. Um the building next to it um is in approximately the silk same location to the south. Um our planning for the parking um with the new building audit on there, we need approximately 47 or excuse me, 46 parking stalls. We currently have 32. The hatched area, we are showing seven future stalls, um, which brings us up to the 39. Uh we have a agreement with the evangelical church. Um I don't believe it's signed yet. They are signing it at their board meeting. Um they have already approved it. Uh Steve Lend is uh talked to the church, they've already approved it, but they need to sign it, I believe, on the 29th. They're gonna sign it on the 23rd, they've already given the verbal approval for an additional of addition of a minimum of 10 parking stalls directly across the street for staff members to use. They currently, with the Diana Lynn and her associate in there, they currently don't utilize their full parking space that they've currently got. So we're hoping that rather than taking out all the green space and adding the extra seven parking stalls with the parking agreement, that we can go ahead with the addition. One of the things um showing the placement of the new addition. This is currently parking area. So they'd not be doing that. Your name, sir. Mine's Grant Craig. I'm a CGID architecture, so thank you. Any questions for the applicants? I I do regarding the parking. Uh first of all, will there be increased traffic or business at the facility after this is constructed? There may be in the future. Um currently, when Diana is over in the surgical center, that traffic will not be in the eye care center. So it will be moving over. Um maybe sometime down the road, they may add another eye doctor in there. Um, but as of right now, the people that are in the eye care center, when she's over in the surgical center, they won't be in that portion of the eye clinic. Now the other doctor will still be there, but they're the patients will be split and be going into the two different places. There seems to be just a moderate amount of traffic right now between the proposed parking lot on the church, which the agreement is is to be signed in the facility itself. Will the employees be parking in the church parking lot or will customers be park parking over there and having to cross the street? What they see as reality for the parking is um where we're adding square footage, they won't be adding usage because when um she is practicing in the surgery center, she won't be practicing in the eye. Okay.
