The first item we have, item number four is the street vacation for a to vacate all of 32nd Street abutting lot six, except the west 100 feet of set lots, lots six, seven, and eight block seven, and all of 32nd Street.

Abiding lot one, lot two, and lot three in uh all in um block eight, all in Perkins and Harford's addition to the city of Kearney.

My name is Craig Bennett's 1111 Central Avenue here, and um I'm here to represent three different owners that have a part of this, um, all of which are listed here, the Abeglans, the Zumbrunnans and the Bramassas.

They all abut the proposed street that's being vacated here, and uh in your packets was also included a vacation petition, which they all signed in agreement voluntarily uh requesting that.

Um so the street that we have here is located um just west of the Harmon Park area here.

This is 32nd Street.

It has been vacated where what used to be the old E Free Church west of the Harmon Park, that portion of the street was vacated years ago.

There's another portion that's lying west of what I have highlighted that has already previously been vacated as well.

And so this is the remaining portion of this probably two-block area of that street, which is left unvainted.

Um the primary reason I believe, probably over the years of which this street was not vacated, was due to the access to this lot here, which does have an alley, but um it's not improved or anything like that, so um it doesn't really provide access.

These parcels here are all owned by the Vermosas here, um, and actually up into this lot here, so they own up through this area here, all by this house.

Abegland and his wife own this parcel here, and then the Zombrunnans own this parcel here.

And so the end goal is really ultimately that um a Beglin has um family has wanted to build a building located here for a garage.

So that's really kind of the primary reason for it.

And so they've all agreed to um say that they would not protest or whatever the vacation in fact on the Zumbrunnans and the Abeglans are are looking at where they would after vacation because half of the right-of-way goes to each abutting landowner.

Um then they'll divvy it up afterwards after after they get it uh vacated, but at the initial stats stage right now would be just getting it vacated.

So the goal is really to vacate this street here, what's remaining between the end of the vacated street right there to the west edge of 8th Avenue.

Um before you then is the proposed vacation plat, which will be a portion of um 32nd street, and here you can see the ordinance when it was uh vacated in 2001 on that western portion, and that's the the letter in which they've all all families, husband and wives of both of all abutting properties have signed um requesting it to be vacated.

Staff noted the land has been vacant for 13 years, infrastructure (water, sanitary sewer, stormwater detention) is available, and the layout is compatible with surrounding uses. A commissioner asked about sanitary sewer depth; the applicant explained that the new design connects to a deeper trunk main on Avenue M, avoiding the need for basements and a longer sewer line. The commission voted unanimously to approve each of the four items.
  • Code Amendment No. 2026-01 (Item 9): City staff requested withdrawal of the proposed amendments to the Aviation Overlay District code. The withdrawal was noted without a vote.
