Killeen Planning and Zoning Commission Regular Meeting - January 27, 2025
The Planning and Zoning Commission met on January 27, 2025, at the Utility Collections Large Conference Room, 210 W. Avenue C, Killeen, Texas. A workshop was held at 4:30 p.m., followed by the regular meeting at 5:00 p.m. All commissioners were present except Commissioner Ellis and Commissioner Rowe; Commissioner Sabree was present. The commission approved the agenda, the consent calendar, and one public hearing item (PH-1) to rezone property at 945 Schrader Road.

- CA-1: Approved the minutes of the regular Planning and Zoning Commission meeting of January 13, 2025, unanimously.
Public Comments & Testimony
- No citizens signed up for the citizen comment period.
- During the PH-1 public hearing, no members of the public spoke for or against the request. Staff reported receiving one written response in opposition from a property owner south of the subject property; that response was provided to the commission.

- PH-1 – Rezoning Request (Case #Z24-37): Richard and Cathryn Dadamo requested rezoning of approximately 2.161 acres from “A” (Agricultural District) to “A-R1” (Agricultural Single-Family Residential District) at 945 Schrader Road, Killeen, Texas.
- Senior Planner David Hermosillo presented the case. The property was annexed into city limits on January 27, 2008, and subsequently zoned default agricultural district on November 25, 2008. The property is not currently platted.
- The applicant intends to build a single-family residence. The rezoning is required because Section 31-158(b) of the city code prohibits structures on lots in the agricultural district that are less than three acres.
- The property is in the limited growth sector and designated as rural estate on the future land use map, which allows up to 100% residential uses with large lots and minimal infrastructure investment.
- Staff notified five surrounding property owners: two reside outside the 200-foot state notification boundary but within 400 feet, and three live outside the city of Killeen. One response in opposition was received.
- Water service is available via a 2-inch line on Schrader Road; wastewater and storm sewer are not available, so a septic system would require Bell County Health Department approval. The property lies within special flood hazard areas (A and AE) and has a freshwater emergent wetland encroaching on the northern portion, per the National Wetlands Inventory.
- Staff recommended approval, finding the request consistent with the 2040 comprehensive plan and compatible with existing land uses.
- The applicant, Richard Dadamo, appeared and gave his name; no questions were asked. Commissioner Giacomozzi moved to approve, and Commissioner Wilson seconded. The motion passed unanimously.

Let the record show that all commissioners are present except Commissioner uh Ellis, Commissioner Rowe, and Commissioner Sabri. Um is present. Uh first item on the agenda is the consider the approval of the regular meeting of the clean planning zoning commission meeting for January 27th, 2025. Uh seeing none, we will now move to consent agenda item CA1 consider minutes of the regular planning zone planning and zoning commission meeting of January thirteenth, two thousand twenty-five. Case number Z twenty four-thirty-seven to rezone approximately two point one six one acres out of the J Joslin survey abstract number three four three four-one from A agriculture district to AR1 agriculture single family residential district. The property is locally addressed as nine four five Seder Road, Killing, Texas, and I'll turn it over to staff. Good evening, Commissioners. Tonight we have uh PH1. So uh case number 2437. We're going from AG to AR1. So we're holding a public hearing uh for case number 2437 to rezone two point one six one acres uh from ag to AR1 single family uh agricultural family single family district. Subject properties locally addressed is nine four five Schrader Road. So we have the uh location map here on the screen showing you the approximate location of the property. So this is an aerial view of the property as we discussed earlier in the workshop. You have um a couple of acres there, and then you've got a single family residence to the northwest and another single family residence to the southwest. Um and a lot of uh larger acreage land around them with some single family homes. So Richard and Catherine Datamo submitted a request to rezone this 2.161 acres from AG to AR1. If approved, the applicant intends to build a single family residence on the property. And the reason for the request to from AG to AR1 is Section 31158B is no structure shall be erected on any lot in an agricultural district that is less than three acres. So the applicant has turned in to move to AR1. So the subject property was annexed into the city limits on January 27th in 2008 via an ordinance 07112. The property was subsequently zoned for a default agricultural district, and after the annexation on November 25th, 2008, via another ordinance 08097, it still retained the agricultural district zoning. So the property is not currently platted. So this is a view of the property looking to the east. This is looking to the north. This is looking to the south and to the west. So it is in limited growth sector. These areas include the furthest extents of our city limits, which primarily includes farmland and large homesteads and agricultural and natural habitat and open space. So expansion of infrastructure and development in these areas is discouraged, at least for the planning horizon in this plan, and resource stewardship is and physically responsible growth should be considered in these areas. So it is on the future land use map. It's in rural estate. This allows up to 10% non-residential and up to 100% residential uses.
