Planning and Zoning Commission Regular Meeting - June 9, 2025
The Killeen Planning and Zoning Commission held a regular meeting on June 9, 2025, at 5:00 p.m. in the Utility Collections Large Conference Room, preceded by a 4:00 p.m. workshop. The commission considered three rezoning requests, a consent agenda, and staff updates. All commissioners were present except Commissioner Luvina Sabree, who arrived during the third public hearing. Eligible actions were taken on all items.

Discussion Items
- PH-1 (Z25-15): Request by Tracy Epting on behalf of Marlboro Heights Missionary Baptist Church Inc. to rezone approximately 0.52 acres (Lots 23, 24, 25, Block 12, Marlboro Heights Revised Addition) from R-1 (Single-Family Residential) to B-3 (Local Business District). Properties addressed as 3103 and 3105 Longview Drive and 706 Rev R A Abercrombie Drive. Staff explained the application was for an accessory structure (storage building) that could not meet the R-1 side yard setback of 25 feet for non-residential uses. Staff found the request consistent with the Killeen 2040 Comprehensive Plan and recommended approval. No written responses were received from the 32 notified surrounding property owners. The commission approved without discussion.
- PH-2 (Z25-16): Request by Jason Jinks on behalf of Alejandro Gabriel Llorente Alvarado to rezone approximately 0.21 acres (Lot 1, Block 13, Evening Hollow 3rd Extension Replat) from B-1 (Professional Business District) to R-3F (Multifamily Residential District). Property at 2018 Cedarhill Drive. Staff stated the rezoning aligns the designation with the current and intended use as a residential fourplex and with surrounding neighborhood character. The property is in the Neighborhood Infill area on the Growth Sector Map and designated Residential Mix on the Future Land Use Map. Staff notified 57 surrounding property owners; no written responses were received. Staff recommended approval. The commission approved without discussion.
- PH-3 (Z25-17): Request by Gary W. Purser Jr. on behalf of True Fountain, LLC to rezone approximately 5.251 acres (Lots 18 and 19, Block 1, Southwest Crossing Addition) from B-3 (Local Business District) to R-2 (Two-Family Residential District). Properties at 6306 and 6309 Trimmier Road. Staff noted the applicant had submitted multiple prior rezoning requests for the same property (2019 R-2 - withdrawn; 2020 R-2 - denied by City Council; 2024 R-3F - withdrawn). The property is in the Controlled Growth area on the Growth Sector Map and designated Neighborhood Commercial on the Future Land Use Map. Staff recommended disapproval, arguing that existing B-3 zoning supports small-scale retail and service businesses, and that duplex development would limit neighborhood commercial opportunities and long-term economic sustainability, and would not be consistent with the rural character on the east side of Turkey Trot Road. Commissioner Ricky Wilson questioned how much commercial opportunity would be limited, noting that 34.24% of the development zone is commercial and that the request aligns with the comp plan. Senior Planner Maria Lopez responded that the property's Future Land Use designation is Neighborhood Commercial, intended to create commercial nodes within walking distance. Commissioner Wilson and Commissioner Sabree noted that similar R-2 rezoning had been approved by City Council for a property further south on Wells Fargo, questioning the difference. The applicant, Gary Purser Jr., expressed frustration that the same character argument was not applied to the first two cases, and stated that the property has been owned by his family for 40 years and has not been developed. He argued that the proposal meets the 2040 Comprehensive Plan and that the area is not consistent with the older county subdivision used as a comparison. Commissioner Sabree asked about the number of duplexes; the applicant said he personally would not build any, and the owner's plans were not finalized. The commission debated the motion: a motion to disapprove failed for lack of a second; a motion to approve was made by Commissioner Giacomozzi, seconded by Commissioner Sabree, and passed 6-1. Commissioner Randy Ploecklemann, the sole dissenter, stated that nothing has changed from previous requests and that packing in houses without providing parks or trails contradicts the comprehensive plan's goal of reducing auto orientation.

All in favor? Motion passes unanimously. Uh next item on the agenda is citizens' comments. Is anyone signed up for citizens' comments? Okay. Uh next item is uh consent agenda, CA1. Consider the minutes of the regular planning and zoning commission meeting of May twelfth, two thousand and twenty-five. I have a motion on the consent agenda. Mr. Chairman, I'll move to approve CA1. Hold a public hearing and consider a request submitted by Tracy Epting on behalf of Marlborough Heights Missionary Baptist Church, Inc., case number Z twenty five-fifteen to rezone approximately point five two acres being lots twenty-three, twenty-four, and twenty-five, block twelve out of the Marble Heights revised edition from R1 single family residential to B three local business district. The subject properties are locally addressed as uh thirty-one oh three and thirty-one oh five Longview Drive and 706 Reverend R. A. Amber Crombie Drive, Kleene, Texas, and I'll turn it over to staff. So Tracy Epting on behalf of Marlborough Heights Missionary Baptist Church Inc. has submitted a permit for an accessory structure. And due to the proposed location of the structure, um the required side yard side yard setbacks in the R1 zoning district would not permit an accessory structure to be located closer than 25 feet from the side property line. Per section 31-188 um two area regulations side yard, no side yard for allow allowable non-residential uses shall be less than 25 feet. This property is located within the neighborhood and field area on the growth sector map and designated as residential mix on the future land use map. This is the um location map. And there are no surface waters or wetlands listed on the national wetlands inventory maps for these properties and no visual evidence of other environmental impediments is apparent on the uh properties at this time. Staff notified 32 owners of surrounding properties regarding this request? As of the date of the staff report, staff has received no written responses regarding this request here's the notification map. Uh there is an existing structure located on two of the properties. Staff finds that the applicant's request is consistent with the recommendations of the clean 2040 comprehensive plan. Staff recommends approval of the request to rezone the properties from R1 single family residential district to B3 local business district as presented. Do you have any questions?
