Avenue C. All commissioners were present, with Commissioner Sandra O'Brien arriving after the regular session began. Workshop Session (4:30 p.m.)
Staff presented the two public hearing cases ahead of the regular meeting.
- Case Z25-28 (PH-1): Theresa Lau, on behalf of 440 Group, Ltd., requested a rezoning of approximately 0.04 acres at 1044 South Fort Hood Street from B-5 (Business District) to B-5 with a Conditional Use Permit (CUP) to allow on-premises alcohol sales in conjunction with a proposed bookstore and café. Staff recommended approval.
- Case Z25-29 (PH-2): National Logistics Training Center, Inc., on behalf of the Catholic Diocese of Austin, requested a rezoning of approximately 14.751 acres (Lot 11, Willie F. Stefek Addition) and 13.711 acres (G. W. Farris Survey, Abstract No. 306) at 102, 108, and 110 West Elms Road from R-1 (Single-Family Residential) to B-4 (Business District) for a vocational trade school (CDL truck driving school). Staff recommended approval.
- City Council Updates: Staff reported that at the September 16, 2025 City Council meeting, three items were approved: (1) Case Z25-26 (rezoning property on Old FM 440 from R-1 to B-5), (2) a thoroughfare plan amendment for an east-west collector through the Green property, and (3) an ordinance adopting a site development permit (amendment to Chapter 31).
- Recognition of Outgoing Commissioners: Certificates were presented to Commissioner Randy Ploeckelmann (6 years of service), Commissioner Ricky Wilson (3 years), and Commissioner Louie Minor (5 years). Each offered brief remarks thanking staff and citizens for the opportunity to serve.

- Public Hearing PH-2: Amber Hughley, a nearby property owner, spoke. She stated she is not against the school development but requested that a wooden or metal fence be installed between the new school and her property for privacy and safety. She expressed that she purchased the last duplex in the neighborhood expecting it to remain residential.
- Applicant Representation: For PH-2, Armando Prescott confirmed the school would be a CDL (commercial driver's license) training facility.

- PH-1 (Bookstore/Café CUP): No discussion was held on the merits; commissioners moved to approve after the public hearing.
- PH-2 (Vocational School Rezoning): Commissioner Ricky Wilson asked whether an ordinance already requires a fence or screening between residential and commercial uses. Staff confirmed that screening requirements would be addressed during the site plan review process and that the ordinance was recently amended to require a masonry screening device between residential and commercial uses. Commissioner Wilson noted this to assure the public commenter that the fence would be considered.

So the case I'm presenting today is um Z twenty five-28, which is B5 to B5 with the C UP, and hold a public hearing and consider a request submitted by Teresa Lau on behalf of 440 Group LTD, case Z twenty five-28 to rezone approximately zero point zero four acres out of the lot for out of lot for block one of the four forty plaza shopping center edition from B5 business district to B5 business district with a conditional use permit to allow for the sale of alcoholic beverages for on-premises consumption. The subject properties locally addressed as 1044 South Fort Hood Street. The applicant's request is for a conditional use permit to allow the sale and on-premise consumption of of alcohol sales in conjunction with a proposed bookstore and cafe, which will serve both cocktails and non-alcoholic drinks. Alcohol service will be a secondary to the primary use as a bookstore and cafe. This is the location of the property. And then this is it's a suite that is within the 440 plaza. And this is the aerial. And staff recommends approval of the applicant's request to rezone the subject property from B5 to B5 business district with a conditional use permit to allow for the sale of alcoholic beverages for on premises consumption as requested by the applicant. All right, thank you. Good evening, Commissioners. Case 2529. We're going from R1 to B4. So we're holding a public hearing and considering a request submitted by National Logistics Training Center Incorporated on behalf of the Catholic Diocese of Austin to rezone approximately 14.751 acres, being a lot 11, Willie Steffic and GW Ferris Survey, Abstract Number 306 from R1 Single Family Residential District to B4 Business District. These subject properties are locally addressed as 102, 108, and 110 West Elms Road, Colleen, Texas. So the applicant national logistics uh they've submitted this request uh for the change of for going from R1 to B4. Um if you remember, we recently had a flume case over this same this same property. So on the future land use map uh amendment, the residential mix designation to a regional commercial was approved uh by city council. This was case number 2503 on August 19th, 2025, and the applicant is now requesting to rezone the property from R1 to B4 to allow for the development of a vocational trade school. The subject property is located within the intended growth area on the growth sector map and designated as residential mix on the future land use map. The case number 25. This is the approximate location. This is the aerial showing the layout of the entire property. So this is a view of the subject property. We're facing south looking from Elms Road. This is a view of the subject of the surrounding property across the street. And this is a view facing west towards South Fort Hood Street. And now we're facing towards Ellison High School looking towards the east. This shows you the notification map. Staff finds that the applicant's request to rezone the property from R1 single family residential district to B4 business district as presented. Staff recommends approval of the applicants' request to rezone from R1 to B4. Do I have any other questions? All right. Thank you. That is everything that we have on the public meetings. So on uh during their meeting on September 16th, the city council uh voted on three items. The first was case Z 2526, which was a request to change uh the zoning of uh a piece of property on old FM440 from R1 to B5. That request was approved. Second was a thoroughfare plan amendment uh to amend the the east-west collector through uh the green property that request was also approved, and lastly, the city council approved an ordinance uh adopting a site development permit. Which was an amendment to chapter 31 that was also approved. Okay. Well, that is uh any questions for staff.
