Okay, we're gonna call this workshop of the Planning and Zoning Commission to order.

1:02

Um, just for the record as a moment we do not have a chair or vice chair for this commission uh per the rules and procedures for the for this commission, the executive director of envelopment services is supposed to chair.

1:15

Unfortunately, she is also not here, so um I am the deputy city attorney, and she has asked me to open this meeting.

1:22

So we're gonna get it just far enough to get a chair elected today.

1:26

So Maria, ready?

1:29

Okay, we're gonna turn it over to staff.

1:36

Good afternoon, commissioners.

1:39

So the first case we have is uh variance for Cosper Heights estates.

1:47

This is to consider a request submitted by TCG Engineering on behalf of GWC Holdings and McLean Construction case number SV 25-01 for approval of a subdivision variance to allow the length of multiple street segments to exceed the maximum length of 800 feet as prescribed in the clean code of ordinances, Section 26-101H for the preliminary plat of Cosper Heights in Clean.

2:17

Section 26-101H of the clean code of ordinances defines a street section as the length of a street between two intersections of any type of type or the length between an intersection and a cul-de-sac.

2:33

The maximum allowable length of any such street section is 800 feet.

2:38

So variations from this requirement may be considered in accordance with the provisions outlined in section 26-25.

2:48

The following street segments exceed the maximum allowed length and therefore require a variance.

2:56

So it's a total of 13 streets.

4:05

Um are preserved.

4:07

A variance to the provisions of this chapter shall be considered an exception to the regulations rather than a right.

4:39

No subdivision variants shall be granted unless the commission finds that the that due to the special circumstances or conditions inherent to the property, the strict application of the provisions of this chapter would result in an unnecessary hardship to deprive the applicant of the reasonable use of this of his land, that the variance is necessary for this preservation and enjoyment of a substantial property right of the right of the applicant, that the granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter.

5:00

No subdivision, no subdivision variants shall be granted unless the commission finds that the that due to the special circumstances or conditions inherited to the property, the strict application of the provisions of this chapter would result in an unnecessary hardship to deprive the applicant of the reasonable use of this of his land, that the variance is necessary for this preservation and enjoyment of a substantial property right of the right of the applicant, that the granting of the variants will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter, that the appropriate use of the surrounding property will not be substantially or permanently impaired or diminished, that the hardship from the relief relief is sought as not solely of an economic nature, and that the applicant has not created the hardship from which relief is sought, that in granting the variance of public convenience and welfare will be substantially served, and that in granting the variance, the spirit of the ordinance is observed and substantial justice is done.

5:50

This is the location of where the subject subdivision is at of a feather line road, and this is the um aerial of the sub where the subject subdivision will be.

6:06

Staff recommends approval of the applicant's request for a subdivision variance to the killing code of ordinances, section 26-101 H for the proposed preliminary plat of the Cosper Heights estates to allow the length of the streets and list state to exceed the 800 max foot maximum.

6:28

Do you have any questions?

6:34

Do we know what the maximum is or the length of the for the streets?

6:38

Yes.

6:38

So I can go back to the right here.

6:54

Thank you.

6:55

Okay.

7:02

Okay, now go to the next one.

7:04

Um, so herring legacy estates, and this is the same as the previous case.

7:11

Um this is for two streets.

7:16

And it's everything's the same.

7:19

So would you like me to go over or I okay?

7:22

So this are the streets that um they're asking for.

7:28

Okay, and I'm just gonna skip through because it's the same, the same thing.

7:33

And this is the location is off of Chaparral Road and East Tremere Road, and this is the aerial of where the subdivision is going to be located at.

7:46

Staff recommends approval of the applicant's request for a subdivision variance to the killing code of ordinances, section 26-1018 for the proposed preliminary plot of the herring legacy estates phase three to six to allow the length of the streets and list A to exceed the 800-foot maximum.

8:08

Okay, and I'll continue to the next or any questions.

8:13

Okay.

8:13

So this is um zoning case 25-18, and it's M1 to R3A.

8:20

This is hold a public hearing and consider a city initiator request.

8:24

Case number Z25-18 to rezone approximately 1.39 acres, B in Law 3, block 2 out of the Julius Alexander Industrial Subdivision from M1 manufacturing district to R3A, multifamily apartment residential district.

8:41

The subject properties locally addressed as 400 Liberty Street.

8:47

This is a city initiated request to rezone the property at 400 Liberty Street from M1 to R3A to allow multifamily apartment residential by right.

8:58

This request aims to amend the property's current zoning to make it consistent with the existing multifamily residential land use.

9:06

The existing structures are considered legal nonconforming.

9:11

So Section 31-54 states that the nonconforming structure cannot be rebuilt in case of total destruction.

9:18

The property owner plans to rebuild the apartment building that was destroyed in the 2025 Atkinson Avenue fire, rezoning the property to R3A will allow the property owner to submit permits to rebuild the building.

10:00

This is the location map of where it's at.

10:04

And this is the aerial.

10:05

There's already two existing structures there.

10:11

And this is the view of the subject property facing east from Liberty Street.

10:18

This is the view of the subject property facing south towards the existing multifamily residential.

10:25

And this is view of the subject proper or view from the subject property facing west from Liberty Street.

10:33

And there are no surface waters or wetlands listed on the national wetlands inventory maps for these properties and no visual evidence of other environment environmental impediments is apparent on the properties at this time.

10:46

Staff did notify 17 surrounding property owners regarding this request, and today we have not received any responses.

10:56

And this is the notification map.

11:00

Staff recommends approval of the city initiator request to rezone the property from M1 to R3A multifamily residential apartment district as presented.

11:12

All right, go to the next.

11:14

Any questions?

11:15

Oh Z25-30, and it's agricultural or A to B3.

11:24

So hold a public hearing and consider a request submitted by Peter J.
