The Planning and Zoning Commission held a workshop at 4:30 PM and a regular meeting at 4:50 PM on July 13, 2026, in the Utility Collections Large Conference Room. Commissioners present included Vice Chairman Giacomozzi, Alvarez, Cooper, Jones, Moss, Rowe, and Sabree; Chairman Purifoy and Commissioner O'Brien were absent. The meeting addressed two city-initiated rezoning requests and received an update from staff on a recent City Council action.
Discussion Items
- PH1 (Case Z26-11): A city-initiated request to rezone part of Lots 1 & 5, Block 6, North Side Addition and Lot 1, Block 5, Replat of Lots 1 & 2, Block 5, North Side Addition (312 and 313 East Texas Avenue) from B-3 (Local Business District) to R-1 (Single-Family Residential District). Staff noted both properties contain existing single-family homes that are legal non-conforming under the city code. Rezoning would bring the current use into compliance and allow for permits, sale, or refinancing. The properties lie in the infill and enhanced area (designated traditional neighborhood in the 2040 comprehensive plan). Staff sent consent forms to the two property owners and notified 63 surrounding property owners; no responses were received. Staff recommended approval.
- PH2 (Case Z26-12): A city-initiated request to rezone approximately 0.144 acres (H O’Neal Survey, Abstract 645) from B-3 to R-2 (Two-Family Residential District) and Lot 1, Block 1, Mulford Addition from B-3 to R-1 (Single-Family Residential District) – properties at 1401 and 1411 Mulford Street. 1401 is a single-family home; 1411 is a duplex. Similar to PH1, rezoning would resolve legal non-conforming status. Staff sent consent forms to the two property owners and notified 70 surrounding property owners; no responses were received. Staff recommended approval.
- Staff Update: Executive Director of Development Services Wallis Meshier reported that at a recent City Council meeting, a petition for disannexation of a property on South Fort Hood Street (the 195 used auto parts property) was disapproved. Council directed staff to bring forward a city-initiated item to rezone that property to make it conforming, which will appear at a future commission meeting.
- New Staff Introduction: Planner Maya Hannon was introduced as a new planning technician, her first day on the job, with experience in New Braunfels utilities and engineering and planning study.

All right, I call the workshop planning and zoning commission to order at four thirty-two PM. Uh first agenda item to discuss PH one. Um hold a public hearing and consider a request submitted by Republic Engineering and Development Services on behalf of Michael Rinehart. Sorry, that's many minutes. And Ivan Arios case Z twenty six dash eleven to rezone part of lots one and five, block six, north side edition, and lot one block five out of the replat of lots one and two, block five. North side edition from B three local business district to R one single family residential district. The subject properties are locally addressed as three twelve and three thirteen East Texas Avenue, Clean Texas, with that turnover staff. Both properties have an existing single family home. The existing homes are considered legal non-conforming and are therefore subject to clean code of ordinances, section thirty-one fifty-four AG, which states that a nonconforming structure cannot be rebuilt in case of total destruction or expanded. If approved, this request to rezone the properties will bring the current use of the properties into compliance with zoning ordinance. There's mostly single family and multifamily zonings. Two of the easters duplexes, some commercial, and to the south, there is more high-intensity commercial B5s, B4s, and B3s. This is the area of the property. As you can see, that these are the two properties being rezoned. There are some vacant lots splattered around, but there's mostly residential homes here. This is a view of the face view facing the subject property at 312 East Texas Avenue. There is a home behind the trees. So this is the clearest picture we could get on that. This is view facing the subject property at 313 East Texas Avenue. This is the view facing east along East Texas Avenue towards North 8th Street. And this is a view facing west along East Texas Avenue towards North Gray Street. These properties are located within the infill and enhanced area on the Grove Sector map and designated as traditional neighborhood on the future land use map of a 2040 comprehensive plan. But two property owners were provided a consent form to authorize the request. We sent it before the surrounding property owner letters. We have not received any response back up by the two property owners. And then staff notified but owners of 63 surrounding property owners regarding this request. For or against requests. Staff recommends approval of the city initiated request to rezone the subject properties from B3 Local Business District to R1 single family residential district. And I'm ready for any questions that you may have. Seeing none, move to second item. PH2, hold a public hearing and consider a city initiated request on behalf of projects limited liability company 1401 Mulford Street Series and Berta Pete and Alaska case Z26-12 to rezone approximately 0.144 of an acre out of H O'Neill survey, abstract 645. From B3 local business district to R2, two family residential district and lot one block one of Mulford addition from B3 local business district to R1 single family residential district. The subject properties are locally addressed as 1401 and 1411 Mulford Street, Colleen, Texas, without turning over staff. These are slightly different, but basically the same as the previous public hearing. 1401 is a single family home, 1411 is a duplex, but otherwise, we're in the same situation. This is a city initiated process to bring legal non-conforming homes into compliance in the case of total destruction or needing to be expanded or repaired. There'll be a compliance with zoning permits can be approved. Um that brings them to compliance with the zoning ordinance. Also gives them the option to sell or refinance their property. A lot of lenders won't approve it if the zoning doesn't match the use. So this is also located up in the same neighborhood in the northernmost part of the city, uh, just to the east of the other project north of Rancyer near 10th. Uh, you see here on the zoning map, uh, the two properties. So it's surrounded on both sides by residential R1, R3. There's R2 in between the two properties. Uh and you see on the aerial what project what properties have been developed for residential, and the answer is most of them. There's some commercial to the south. Uh so this is the single family home on the corner. This is the duplex directly across the street from that single family home. This is the duplex on 1411, and this is the view looking across the street from that home. And then we've got one view looking south towards Dean Avenue, and you see the fence and the commercial properties uh across the street, and then looking back north where you see all the homes on Mulford Street.
