Then they will stand approved as distributed.

0:43

Mr.

0:43

Johnson, do we have anyone signed up for public comments germane to today's agenda?

0:48

No, Chair.

0:49

Thank you.

0:53

Seeing no one signed up.

0:55

Reports of officers.

0:56

I don't have one.

0:57

I still have training wheels on.

1:01

Officer Presley.

1:03

Back to you in a minute.

1:04

Uh yes, since the last beer board meeting, uh TABC has conducted four actually alcohol compliance checks here in the city that have uh beer permitted businesses in those.

1:18

Uh the first one was on February 26th.

1:21

Uh that one.

1:24

See the businesses that actually sold alcohol to a minor on that day was Palancho's Mexican.

1:31

Hilton Garden Inn, Knoxville, Chesapeake's, Kroger on Broadway, uh, the Marriott Knoxville downtown, Balter Beer Works, and Cumberland House, Knoxville.

1:45

Uh the next one was on March 3rd.

1:50

That day, the businesses that sold alcohol to a minor was Tokyo Sushi and Steakhouse and Aubrey's and Powell.

2:00

Uh there was one on March 11th.

2:03

Uh we had some sales on that day.

2:05

That was true by Hilton, Knoxville North, the Holiday Inn at Merchant Center Boulevard, and Zelante Taquiera.

2:14

And then the last one would have been on March 12th.

2:17

Believe there was only one sale on that day, and that was La Pinata Mexican Restaurant.

2:25

Did we do anything about that?

2:28

Mr.

2:28

Johnson.

2:30

Thank you, Chair.

2:32

Uh in front of your seats, council, you have a copy of uh the report uh from the the clerk.

2:39

Uh there is one act of suspension revocation hearing that is for union jacks.

2:43

They're also on your agenda for this evening for an administrative hearing.

2:47

They did not file their revised remedial plan or pay their fine by the deadline, which was last Tuesday.

2:54

So the law department has filed a non-compliance complaint in that matter.

2:59

It's scheduled to be heard for a preliminary hearing in April.

3:04

Uh below that there is an overview of the beer fund.

3:07

The beer fund sits at 268,000 when we are at um 169% of fines uh versus the budget for fines.

3:18

Budgeted 10,000 for fines, and we're at about 17,000 received in fines thus far.

3:26

Are there questions?

3:30

That's all I have.

3:31

Thank you.

3:35

The next matters of business or items to be postponed or withdrawn.

3:39

Mr.

3:39

Byrd, are there any applicants requesting a postponement?

3:42

Uh yes, ma'am.

3:43

There are four items 8C and 8D, Crafty Bastard Brewery, as well as 8G Petros and 8H plugged in.

3:55

They would all uh need to be postponed to April 28th if possible.

4:00

Okay, without objections, items 8C, 8D, 8G, and 8H are postponed as requested.

4:07

Are there any applicants requesting a withdrawal?

4:10

No, ma'am.

4:11

Okay, thank you so much.

4:14

Before we get started, we've got a few announcements to make.

4:16

When I call the names of the businesses applying for the permit, please come to the podium, state your name and address clearly for the record.

4:25

Applicants who are approved pending final documentation need to bring their completed documents to the business tax office during regular business hours.

4:32

Applicants that have their permit approved tonight can pick up their permit at the end of this meeting.

4:37

Approved pending final documentation means one or more requirements are incomplete for a beer permit.

4:43

In order to get your certificate of occupancy, an applicant may need to apply for zoning changes, meet parking requirements, submit architectural drawings to plans, review, and inspections, and make modifications for building and codes compliance.

4:55

This may entail hiring an architect and or contractor and submitting plans of your site for review.

5:02

5:03

Byrd, business office.

5:06

5:11

5:13

Any clue on how much time you may need.

19:00

I'm another couple months.

19:03

So we got pretty probably a couple months after permit in hand, still for build out.

19:08

Still waiting on permit.

19:10

What does that look like?

19:11

A couple months after district, buddy.

19:16

So I can make a motion to postpone.

19:18

You can.

19:19

Yeah.

19:20

So I mean that's what I'm asking.

19:23

So what's the first one?

19:23

Stand to extend.

19:25

For 120 days.

19:26

Yeah.

19:27

For up to 120 days.

19:29

Or 120 days.

19:31

Well, if he gets everything completed before 120 days, he sees Mr.

19:35

Byrd and he doesn't come back.

19:37

Okay.

19:37

That's the hope.

19:38

I would like to make a motion to extend.

19:40

Put it out four months to the beer board meeting for four months.

19:43

So that'd be April, May, June, July.

19:46

To July.

19:47

Okay.

19:48

Second.

19:49

All in favor.

19:50

Aye.

19:51

Post.

19:52

Okay.

19:52

You have to July, but whenever you get done, you just go see Mr.

19:55

Bird.

19:55

You'd be good to go.

19:56

Thank you so much.

20:01

Beer Board Administrative Hearings for Flip Side Pub on North Shore Drive.

20:07

And Mr.

20:09

Frost.

20:12

Thank you, Chair.

20:13

Uh as it was explained earlier, this permittee had two underage sales in less than a two-year period.

20:23

The city ordinance requires that by a certain date they file a remedial plan, which is to lay out how they are going to uh fix the issue that uh caused the underage sale and to pay their fine.

20:37

Uh there's a deadline to do both.

20:39

Uh it is my understanding uh that this permittee did neither.

20:43

Uh the ordinance automatically uh says that uh if they are late automatically, the law department files a non-compliance complaint.

20:52

Uh the law department has done so as referenced at the beginning of the meeting.

20:57

Uh nevertheless the permittee is here tonight to explain the situation and answer any questions that uh the members of the beer board may have uh at the end of the uh explanation uh and question and answer uh time.

21:16

Uh it'll be up to the members of the beer board to uh accept the explanation and take no further action, or if the beer board determines that further action is needed, uh they there needs to be a motion second and passing uh to refer the permittee uh to the uh hearing officer.

21:40

Uh yes, uh I sincerely apologize.

21:42

Uh when I met with uh Officer Presley at the task.

21:46

Excuse me, I need your name and address for that.

21:48

I'm sorry, Aaron Nelson 124 South North Shore Drive.

21:51

Thank you.

21:52

Uh when I I met with uh Officer Presley about this incident uh at the task class, and um I I misunderstood the instructions and uh apparently did not get the mail at my address uh either.

22:08

We are taking this very seriously, and uh I I apologize for wasting your time.

22:13

Uh we are 100% behind this and taking it very seriously.

22:18

I um I it's complete misunderstanding on my part.

22:24

Am I any questions for him?

22:28

I I just want to confirm that everything that was supposed to be done by the certain date has been done.

22:35

The permittee has paid the fine as of yesterday and filed a revised remedial plan that has happened, it's a copy of that's in front of your seats.

22:44

Okay.

22:44

So uh Mr.

22:47

Frost.

22:50

If he went to a hearing office, if if it went to a hearing, he would have to produce nothing more than he has already produced, correct?

23:02

Well, let me parse that a little closer.

23:04

He is already going to a hearing because he didn't comply right uh with getting things done in a timely uh manner.

23:11

That's happening no matter what you all do to decide tonight.

23:15

But uh if he if you all refer him on to the hearing officer for the underage sale, which is what is before you tonight, then you would uh then he would also have to explain the situation uh there to uh a hearing officer.

23:31

Okay, thank you.

23:33

Uh I'm sorry, I I I did pay my fines to the state, and I I want to make this very clear that uh by no means did I intend to uh lapse on this.

23:49

I I just made a uh a mistake and and I apologize wholeheartedly.

23:56

Um I we have every intention to take care of this.

24:01

Uh I have uh ID scanners, I've I've talked to my entire staff, we're taking this very seriously.

24:08

I wholeheartedly apologize.

24:14

Yeah, I mean, I I just want to make a comment.

24:16

I've actually been to Union Jacks establishment.

24:19

I think it's a great establishment um friendly environment.

24:23

Um this is uh no my my first time up here on beer board.

24:27

Um and I'm a firm believer in giving people that opportunity uh to make things right.

24:33

Um so I just you know you being a man of your word, um I want to give you that opportunity.

24:38

Thank you.

24:39

So I just wanted to make that a note.

24:42

Thank you very much.

24:44

Yeah, I'll I'll agree, but you know, you do have a couple strikes against you, so you know obviously you know you do take it seriously and and clean up the process because and and when you are asked to provide the information, part of the reason you're asked to provide it in a timely manner so that we have chance to review it prior to this meeting.

25:01

So um, but that being said, I agree with councilman Grant and everyone.

25:05

So I've read the report and of course listened to your testimony.

25:09

So I do not intend to make a motion to send them to the hearing office for further action.

25:17

Councilwoman Parker.

25:25

Um, no, I didn't have anything on this item.

25:29

Oh, okay.

25:29

Your lot was on.

25:30

Okay, thanks.

25:31

Um it's been on for a while.

25:33

There well.

25:36

So I guess you know, do I formally make a motion to approve?

25:40

Because we do not make a motion to basically dead.

25:46

Yeah, rule it dead.

25:47

I'll do that to people.

25:48

I'm kidding.

25:49

I'm supposed to rule this dead.

25:50

That's what I'm just quoted from the lawyer.

25:52

Yeah.

25:54

So we take a look at the we're taking no action, so it's a good thing for you.

26:00

Yeah.

26:00

Wonderful.

26:01

Thank you very much.

26:02

I I appreciate your time.

26:04

Yeah, I just have a question for clarity because uh council frost said that they're going to a hearing regardless.

26:11

And then um Councilman Honeycutt just said he was not referring them to a hearing.

26:17

So they are going to a hearing because they failed to comply with the timeline for the uh remedial plan and the fine.

26:28

Uh there was the opportunity.

26:30

This is probably not the best legal terminology for a double dip at the hearing if you all did not like what this gentleman had to say, or if the uh situation was very egregious.

26:44

Uh so what would have happened had you all sent it to the hearing officer, they would would have amended their non-compliance.

26:52

Uh law department would have amended the non-compliance complaint to add uh the underage sale issue.

26:59

But if you all take no action, uh it will only be uh heard in terms of not doing things in a timely manner.

27:06

Okay, thanks for clarifying.

27:07

You're welcome.

27:08

Can I clarify that about that service?

27:11

You want to get that?

27:14

Could we make sure that we get a good address on file?

27:17

Because they're probably gonna send some more certified mail to you certainly that you can get, make sure you're getting everything.

27:23

And I just also want everybody to know there was another part to this y'all saw where he was or where his business was issued a citation about caste.

27:31

He took care of that immediately as soon as they were issued that citation.

27:34

He came to class like the next week and took care of that.

27:37

So that was that's null and void, that issue's dead.

27:40

I actually had that uh taken care of in court.

27:42

They didn't have to appear on that.

27:44

So he he was very timely about that.

27:46

But we want to make sure that with Mr.

27:48

Byrd and with uh Mr.

27:49

Johnson here and everybody that we've got a good address that we can get that to.

27:53

I do need to change my mailing address because uh that is that is not my main office.

27:57

So that that's I think that's a big reason why I haven't been receiving mail.

28:01

You took care of all that, but you wanted to provide the address now.

28:04

No, just the job.

28:05

We have it.

28:06

Okay, sir.

28:07

Thank you.

28:07

I can email you um the new certified address form and and thank you, Mark.

28:13

Yes, sir.

28:14

Thank you very much.

28:16

Okay.

28:17

You're good to go.

28:18

All right, thank you.

28:19

I appreciate your time.

28:20

Thank you.

28:21

So I like that sheriff.

28:24

Amelia Parker, Ms.

28:26

Parker.

28:26

Yeah, yes.

28:27

Now you have your lobby for writing.

28:29

Yes.

28:29

Well, um, it's really for I guess maybe the end of the meeting.

28:32

I turned it on wanting to hear more about Hollaroo.

28:36

We went through that section.

28:37

So I was hoping maybe at the end of the meeting we could get an update on Hollaroo, since Hollaroo is still in the house.

28:43

We can do oh, he's still here, we can do that.

28:46

Absolutely.

28:47

Amazing, thank you.

28:51

So the only thing left we have is the cast compliance and track cloud.

28:58

Oh, we're gonna go back.

28:59

Knoxville track cloud list back up here.

29:01

Okay here.

29:01

Did somebody come in?

29:08

Is it Knoxville track and field?

29:20

Oh, here you go.

29:22

She's actually been voting, looks like your name and address for the record.

29:31

Jessica Mead, it's P.O.

29:32

Box 5226, Knoxville, Tennessee, 37950.

29:37

Thank you.

29:38

Officer Priscill.

29:40

No record, Mr.

29:41

Bird.

29:42

That's complete.

29:43

Move to approve.

29:46

All in favor.

29:49

You're good to go too.

29:50

Thank you.

29:51

Thank you so much.

29:53

Now we can do the casting.

29:58

So what does this really look like?

30:09

Mr.

30:10

Frost.

30:10

So now you can explain this explain all the cast stuff here, please, sir.

30:19

All right.

30:19

So members of the beer board, we're under item 12 of your agenda, other business hearings on permittee compliance with CAST class requirements.

30:31

As called for in the beer code, uh, you know, when new people, new permittees are getting uh their permits, they have to go through the task class, and that's noted uh in the paperwork, and Mr.

30:44

Byrd will say if they've done that or not.

30:46

But there's also an uh requirement that a person on the permit must do that on an annual basis.

30:54

And uh thanks to um the audit committee and beer board chair writer uh and the city internal auditor uh and officer Presley, they looked at and we have a number of uh permittees that have not been complying with their annual task class requirement.

31:15

So before she left office, beer board chair writer uh sent out a letter to uh the people that were the um most delinquent, and uh if they hadn't gotten their uh class up to date, they were to have been at the February beer board meeting.

31:37

But the good news was all of those uh permittees did get the task class uh taken care of, and so that was not on your February agenda.

31:47

Uh unfortunately, uh you know there's a list of people that uh are on the agenda for tonight uh because they are out of uh compliance with the annual requirement.

32:02

Uh Officer Presley will tell you that uh the class is uh given on a probably 50 times a year every Thursday, uh all of the people uh not in compliance uh received a letter.

32:18

Uh uh Mr.

32:19

Johnson provided me a copy of letters that went out on January 28th, uh explaining the situation and about how they needed to come into compliance, and then if they did not come into compliance, a second letter uh I believe was hand delivery uh that was dated March 12th.

32:38

And if those businesses have uh not come into compliance, they're supposed to be here tonight, uh, where they need to be able to explain why uh they have not uh gotten this done in however many years uh Officer Presley might have that uh uh have that information to share.

33:00

And uh they're out of compliance.

33:04

Uh they you know you all could decide to send them uh to a hearing officer uh to help get them uh back into uh compliance and uh there could be fines associated with that.

33:20

So I would still go through them one by one.

33:24

I have a question.

33:26

Yes, ma'am.

33:27

So if people are out of compliance, are they in effect operating without a permit?

33:37

I don't know.

33:37

Uh that would be a determination for the law department.

33:40

I don't make those decisions.

33:42

All right, so that was my question.

33:43

So it's like if they go to a hearing, is that what they determine?

33:48

Or is that just fine?

33:49

They could have no, that could be a suspension or uh revocation of their beer permit.

33:55

Okay, but we wouldn't necessarily do that.

33:57

That goes to the hearing.

33:58

That's done by a hearing officer.

34:00

Good.

34:00

Thank you.

34:01

Councilman Parker is that um well, I do remember discussion perhaps at the audit committee or perhaps previous beer board meeting about um their annual process for renewing their permit, they have to pay a fee every year or something like that.

34:20

And there was we are wondering when they go through that process why they couldn't check to see if they had taken the the class at that point.

34:29

Um and that seemed to be not a good not a process that we could move forward with.

34:37

Um so it seems like they're able to continue to operate under that permit and believe that their permit uh um is still good even if they haven't taken the class.

34:56

I understand what you're saying, uh, council member Parker.

35:00

I understand what you're saying, Councilmember Parker, but the as a permit holder, you're charged with being responsible for knowing the law that applies to the running of your business, whether it's a beer permit or another situation.

35:18

In my opinion, the current beer board chair and the former beer board chair gave plenty of notice encouraging these places to come up into compliance.

35:34

And with two different letters, and for whatever uh reason uh they did not, if they're here tonight, they have the opportunity to try to explain uh the circumstances and are you recommending a certain action?

35:56

Well uh no, I'm not.

35:58

Um I think you know you could uh depending on what you hear from people, uh you could take uh no further action uh or you could uh send them to a hearing officer for a suspension revocation hearing.

36:14

I would anticipate that if someone is sent to a suspension revocation hearing, that there's a pretty good chance that they'll go to the task class real soon to try to uh avoid uh the situation, just like the gentleman that was here from uh Union Jacks I'm not sure she's there or not she's three, okay.

36:41

So who might call it?

36:46

Quality restaurant concepts doing business as Applebee's.

36:50

There you go.

36:51

Yeah, Mrs.

36:54

Jared Hickson, 2912 Knoxville Center Drive.

36:58

Thank you, Officer Presley.

37:00

Can you give us uh yes?

37:03

I I can tell you uh that this business has not attended since April 13th of 2023, so that would mean that they would have expired in the following year, April 13th of 2024.

37:15

I have uh sent them letters from my office.

37:18

I have actually personally served someone myself out there with a letter prior to this process starting to try to encourage them to come, uh, but we've not had anybody come and attend.

37:29

We've been unsuccessful with that.

37:39

Um I'm I move we send this person to a hearing officer.

37:45

Second.

37:46

I'd suggest let them call.

37:48

Okay.

37:48

Excuse me.

37:49

Go ahead and give us an explanation, please.

37:53

Um midway through the year of 2024, human resources came in and either fired or transferred three out of the four managers for my restaurant.

38:02

Um so I was left to run my business by myself and due to time management, wasn't able to make it to the class.

38:09

Okay, I still move that this go to a hearing officer.

38:14

I'll second that in discussion.

38:18

I I do have a question.

38:20

Uh is he already enrolled for the task class?

38:23

Have you already enrolled for the two years previous?

38:25

I kept up with it, yes, sir.

38:26

Okay, so two years previously.

38:28

Okay, thank you.

38:29

Yes, sir.

38:30

Any further discussion?

38:32

Who what two years?

38:35

Sorry.

38:35

For 21 and 22 since you took it in 23.

38:39

Right, up and then restaurant for three years, I went forward.

38:47

And have gotten letters and served and haven't been able to find the time to go.

38:54

So I think that deserves letting a hearing officer decide what to do rather than us.

39:00

I think what councilman Grant was trying to ask is are you already listed on the beer permit as someone who can actually attend the class, or do you need to go through the process of getting listed on the permit?

39:10

No, ma'am, I'm already on the beer.

39:11

You're already on there.

39:12

Okay, just verify.

39:13

Thank you.

39:13

Thank you.

39:13

Thank you.

39:14

I'll I'll add a distinction that the person taking the task class has to already be on the beer permit.

39:22

So it, I mean, I if I'm not on the for example, if I'm not on the beer permit for you know, whatever, not Watson's, it doesn't matter if I take the task class.

39:32

Uh that doesn't count.

39:36

Oh, you didn't have you there, okay.

39:38

Councilman Parker.

39:40

Um for me, since this is a new uh process, a new attempt to ensure um businesses are complying with you know long established policies.

40:00

For me, it would be reasonable once the letters are sent out and they appear on our agenda.

40:07

If they attend this meeting, this is our opportunity to hear from them.

40:13

Um at that point reiterate that the annual task class is uh um must be you know complied with.

40:27

And then if that is not complied with once they appear on our agenda, then we send them to a hearing.

40:34

But I do like the opportunity for individuals to come forward, explain why they haven't complied, us to be able to uh have a conversation, uh emphasize the importance that they do comply, and then at that point, if they don't send them to a revocation hearing.

40:54

That would be my um suggestions in and acknowledging that that we are um after many many years of having this policy in place, we are now taking steps to ensure that the policy is followed.

41:12

Maybe we can take a few steps before sending folks to revocation hearing.

41:19

We have a motion on the floor and a second.

41:22

I'm I'm gonna speak to my motion.

41:24

Okay, go ahead.

41:25

So um the reason I made my motion is I I don't think it's due to a lack of trying on people to get people into compliance.

41:35

And if this had just been missing it for one year, maybe, but this is missing it two full years, and here we are, it's 2026.

41:45

So I I just respectfully disagree, and I tend to um vote in favor of sending this to a hearing because I think until we start holding people accountable, um we're gonna continue to deal with this.

42:06

Yeah, I mean, I agree.

42:07

Officer Presley says she made a number of attempts.

42:10

They use mail, she went out there physically herself.

42:14

Um I don't think this is you know an attack on this gentleman.

42:17

I think it actually caused him to say, you know what?

42:19

Let me go ahead and get you know this task certification.

42:22

So and I hope that's you know um how you take it.

42:25

So again, I'm gonna support Vice Mayor if you get on this.

42:29

Um I'm more than happy to attend the class regardless of what the outcome is.

42:34

Thank you, sir.

42:34

Appreciate it.

42:35

Thank you.

42:37

Is that it?

42:38

Nobody was gonna think okay.

42:40

So let's take a vote.

42:41

All in favor of the motion.

42:43

Aye.

42:44

Aye.

42:44

Opposed.

42:45

Okay.

42:46

No.

42:47

So it will go, but you can do that cast class any Thursday before.

42:51

It'll be this Thursday, ma'am.

42:53

There you go.

42:53

Thank you so much.

42:54

Um will I need to follow up with anybody or does he get notice on the hearing?

42:59

I'm not sure that would be the law department.

43:02

Well, you will will be in contact with you, I'll assume a letter, right?

43:05

I don't know.

43:05

Yes, letter.

43:06

A letter.

43:07

Okay.

43:08

Thank you.

43:08

Yes, thank you.

43:14

Is anybody here from Dollar General store at all?

43:17

No.

43:18

Okay.

43:22

Which one?

43:23

Uh 205, which is fine in South Rage.

43:28

South Ridge Road.

43:30

Okay, you can come up.

43:32

We need to dispose of this one first.

43:33

Let's talk about so on.

43:35

What now?

43:39

We have to get rid of it.

43:39

Okay, because I just figured my name is Megan Inman.

43:43

Uh, one 10 South Rich Road, 37924 in Knoxville.

43:47

Okay, one second.

43:48

Shall we finish with her and then because they're all together?

43:50

Okay.

43:52

Just sit right there at the front.

43:53

We have to do the further the first ones first, I'm told.

43:56

That was my bad.

43:58

So this is the one on Sutherland Avenue, and there's no one here for that.

44:06

So Mr.

44:08

Frost, what do we do?

44:10

Yes.

44:11

I move approval.

44:12

I move to send them to a hearing officer.

44:16

Second.

44:17

Second.

44:17

Any discussion?

44:19

Well, officer Presley, how far out of date is this location?

44:23

So this location is uh about the same as the other.

44:27

It was 720 of 23 when it attended.

44:30

Uh they have a little bit of what I would call kind of a special situation in the fact that the gentleman I spoke to there, he just became the manager there, and he is not on the permit at this time, but he had actually attended CAS within the past year for a business he prior worked at.

44:44

So if he would go down and get on the permit, that would be a real simple quick resolve for this for this business.

44:50

If he just goes down and gets on the permit, and we talked about it, um, he seemed open to doing that.

44:56

He just wanted to talk with the district manager first before he did so.

45:00

I've not heard back from him.

45:00

That was Friday when I served that notice to him, but I would like to see them uh take care of that easily that way.

45:09

I I'm sorry, I'm just so confused because by the time I mean these the business owners, the people who know about this have been getting notified for a couple of years, and that is what bothers me the most that that people have been notified.

45:26

It's not like nobody told them their beer it was time to do their task class, they just didn't do it and nothing had ever happened to them.

45:34

And um the beer board has decided to take its obligation seriously, which is if you're out of compliance, you're out of compliance, and there's a consequence.

45:44

Um a rule not enforced is not a rule.

45:48

So I you know, I don't want to I don't want to unduly punish someone, but if corporate headquarters isn't paying attention, that's my concern.

46:06

So I have a motion if y'all disagree, we can vote that down.

46:10

I'll second.

46:11

Okay, thank you.

46:17

And do any further discussion?

46:19

Charlie.

46:19

Yeah, I would agree, and there's like four from Dollar General and on this thing, and I I think it does, it's probably not as uh negative toward the people that are showing here, but it's a corporate thing, and I think until we start enforcing it, uh this is gonna keep going on.

46:35

So I agree with the motion.

46:39

So sorry.

46:43

Okay, all in favor?

46:45

Opposed.

46:46

I have it.

46:48

So the one uh Southern will be sent to a hearing officer.

46:55

Amherst Road is the other one, and I don't think there was anybody here either.

47:00

So nobody here for that.

47:06

It's like I'm on one second here with my move that we that we call it out one more time.

47:11

Amherst Road, uh Dollar General.

47:15

I think there was only one person here.

47:17

All right, sorry.

47:17

I I move that we send this to a hearing officer as well.

47:21

Second, and just for giggles one, what was their date?

47:33

Uh they attended the same date as Sutherland Avenue, 720 of 23.

47:38

Okay, okay, okay.

47:41

Thank you.

47:42

Thank you.

47:42

Any discussion?

47:45

All in favor?

47:46

I opposed.

47:49

That one will be sent to a hearing officer as well.

47:52

Now, South Rich Road, we have somebody here to talk about.

47:57

Uh hi, my name is Megan Inman.

47:59

Uh 110 South Rich Road, 37924.

48:03

Um, to speak on why my store hasn't is basically turnover.

48:08

I don't know if you guys go into Dollar General's, but it's mostly one employee, and it's you try to do the most you can.

48:14

And my particular I've been in this store since 2024, but I just become into management.

48:20

My district manager keeps changing.

48:21

So since October, we've had a district manager that's kind of given us guidelines and what we're supposed to do.

48:27

I did receive a letter in February, I believe I showed up to the class, but didn't really have much direction from my district manager, so I didn't know that you had to do cash, so I had the cards, so I left.

48:38

Um I haven't had the opportunity to get back in there.

48:42

I'm the only manager on duty in my store, and even today I worked till I came here, so it's just hard to get both.

48:49

But I have intentions on going to the class.

48:51

I just that's that's the reason that location.

48:55

I can't speak for the other locations, but turnover and just not having help is the reason my location is delayed.

49:01

I don't even know when the last time they were there.

49:05

In the class uh this one was actually five, four of twenty-three.

49:12

Are you listed on the permit for this business?

49:14

Have you been through background checking and everything?

49:16

I haven't done the background check.

49:18

I went to the city county building and filled out an application.

49:21

I didn't do the background, I haven't done the fingerprints or the background.

49:25

Um, I literally got an application from my district manager, met me today because she knew I was coming here and gave me an application to fill out and said she was sending a bunch of us to the class next Thursday.

49:35

Um, but every time that I've gotten something I've tried to go forward with it, I just didn't know the direction.

49:41

There's really no information being shared in those stores.

49:48

Okay, so I think I've met with you before at the class, and then you told me to follow back up with yeah, you look familiar.

50:00

I think we talked maybe about the process there or something or something.

50:04

Yeah.

50:04

So again, my my issue is not with you.

50:09

Oh, I know.

50:10

Um, but I think we need to get district management's attention that this is a big deal if they're gonna sell beer in their stores that they find time for y'all to go.

50:24

Yeah, no, I agree completely.

50:26

And so because you shouldn't be this stressed out about trying to manage and still get their own.

50:31

Honestly, I didn't even know anything about it.

50:33

Like, I didn't know about the meeting.

50:34

I didn't this is a lot.

50:36

So I who comes.

50:40

Does the owner come to the hearing?

50:44

One time it was the district manager that came.

50:46

Okay, but it's not in the manager, it has been the manager with the district manager, I think, one time is best I recall.

50:53

Since I've been on council.

50:57

I'm gonna make a motion that we send it to a hearing officer, and it's not you, but I just think district management needs to get the idea that this is you can't let stores go for two years without making sure they're in compliance.

51:17

Oh, that okay.

51:17

Any discussion?

51:18

Yes, yes, thank you.

51:22

Um if this is the the process that the beer board wants to continue to take.

51:30

I just want us to question why we ask that individuals appear before us for this meeting.

51:39

If we know we're automatically going to send them to a revocation hearing.

51:43

Um I'm I'm satisfied with individuals who appear at the revocation hearing being given that chance to take the class because as you've pointed out, it we may not be sending the message to the people that we need to send the message to, but we are making the working class kind of run around a little bit more.

52:10

Um and I think that we can resolve it here in this meeting.

52:14

But if we're not gonna do that, let's think about how we are using this meeting time if they're automatically going to be sent to the hearing.

52:25

It seems to me like some of that would be dependent on how far out of date they actually were.

52:30

It just so happens that Dollar General doesn't seem to their management from wherever they live, and I don't know where that is, it's not very communicative.

52:41

Yeah, that doesn't seem to be the standard.

52:45

I think I think the standard we're setting tonight is everybody goes to the hearing.

52:50

I don't think that's true because we'll have different dates.

52:53

Like, I don't like I don't know what date she's got on here.

52:56

I also think different situations tonight.

53:02

They've already taken the class, then they will comply.

53:05

So it seems all situations, at least for tonight, we are sending to a hearing.

53:12

Well we don't know you have because there's some on here that have different situations besides the ones we've heard so far.

53:19

So I'm going to speak because my lights been on and everyone else seems to just jump in, so I'm going to uh I I do see a difference thinking about the dollar generals that we've just seen a cascade of um that this individual is speaking about really not having any communication, not being in the info um stream, and a willingness to be here, and I do think it's we're trying to get to the district person who can make a change here, but I think there's a good faith in in her being here and and doing the right thing and trying to.

53:51

So for this one, I would not want to send them on, but to provide some other uh another month or something so that the person gets here to do what we need to have done.

54:04

Okay.

54:04

Um I'd like to amend my motion.

54:07

Okay, to postpone this for one month to give them time since she's here to get in compliance.

54:14

I will second that motion.

54:16

Yeah, I've and I so I'm sorry if I might agree with you.

54:20

I think this is a great compromise on this particular situation.

54:23

Miss Admin is your last name?

54:25

Admin?

54:26

Uh, first of all, I hope your managers give you a raise and understand.

54:30

Yeah, but yeah, let's all give her a round of applause, seriously.

54:34

Uh you know, out of all of the people, all of the dollar generals on here, you showed up, you you know, you were here tonight.

54:41

We're trying to send a message to your bosses that they need to support you.

54:46

Uh, and they're not doing that currently.

54:48

So uh that's the reason for what we're trying to do.

54:51

And so uh, but you being here tonight, thank you.

54:54

Thank you for uh speaking on behalf of your store.

54:57

I hope your management uh understands that and appreciates it.

55:00

Um and I'm happy to support the motion to give you another 30 days to work with management before we have to deliver that message.

55:08

So thank you.

55:08

Thank you.

55:10

All in favor.

55:13

Opposed.

55:14

Okay, you win the trooper award.

55:15

Okay, so you no, no, I'm not done yet.

55:18

I'm not done.

55:18

No, you don't have to walk back, so but you get the trooper award, so but you need to make sure that you get your name on the beer permit.

55:24

You need to talk to Mr.

55:25

Byrd, and then take the cast class some Thursday before next month, and then you'll like be just I don't know.

55:31

Yeah, she literally showed up today and told me it was 35 for the background and 50 for the class and all this stuff.

55:37

So I have all the papers that I have to fill out to take that now.

55:40

I just I just got them today as before I came here.

55:46

Okay, sounds like she's on track.

55:48

Yes.

55:48

Thank you so much.

55:54

Star Plains Pike, is that where we are?

55:56

Strawberry Plains Pike, Dollar General.

56:00

Maybe they should hire her.

56:01

Okay.

56:03

Can you do two stores?

56:05

So nobody's here, Lynn.

56:07

Go for it.

56:08

I guess.

56:13

Oh, oh, we have somebody.

56:15

Are you from Straw Plains?

56:16

Yes.

56:17

Oh, great.

56:18

Okay.

56:18

Here you go.

56:19

7575 Strawberry Plains Pike.

56:22

State your name and address for the record, please.

56:24

Stacey Murray.

56:26

Address.

56:27

7575 Strawberry Plains Pike.

56:33

Okay.

56:33

Officer Presley.

56:35

Uh they have not attended, let's see, Straw Planes since 427 of 23.

56:40

I think you have an application lane in my office that we've been trying to contact you about background and can't get you to come.

56:47

Because we've been through just like her, two district managers.

56:50

I don't even have an assistant manager right now.

56:51

I'm scheduled like 77 hours a week right now, doing everything.

56:55

So it's just not her dollar general, it's every dollar general.

56:59

But I just I've not even been there a year yet, so I did fill out the application and I was going to come, then we lost the district manager, and then they didn't know what it was or how to get it or how to pay for it.

57:10

And I just got that information probably like a week ago.

57:15

Debbie.

57:16

So you need to give me a call and get scheduled to come in and do your background so what we can make sure you can get you on the uh permit and then come to class.

57:25

I I make a motion we postpone this one for a month as well.

57:29

Second discussion.

57:34

All in favor.

57:35

Aye.

57:37

Posed.

57:38

Eyes have it.

57:39

Okay, you got a month to do those two things, okay?

57:41

Thank you.

57:42

And come back.

57:42

Thank you.

57:44

Now we got two heroes today.

57:47

Wish huh?

57:48

Galaxy Smoke.

57:51

Please state your name and address for the record, please.

57:53

Uh Hitash Petadar, 6017, Chapin Highway, Knoxville, Tennessee.

58:00

Okay.

58:01

Officer Preston.

58:02

Uh this business last attended February 2nd of 2023.

58:07

I've not uh had any other contact with him other than just the letters we've sent out.

58:12

So you've sent how many letters?

58:14

Uh I would have to look back.

58:16

We usually send two letters actually.

58:18

Uh we send one about every six months, and then at that point we actually stop after the second letter, and then what you guys have sent out.

58:25

Okay.

58:28

So it's up to y'all.

58:32

You got if you can make your case while you haven't been.

58:36

First of all, I want to let us the committee members uh, like I said, uh due to my trial partner he was talking abroad, so I couldn't make it to the class, and uh I really want to get to the class and get it done by this Thursday and get back on compliance, and we'll make sure we stay in compliance.

58:51

And this is my first offense, Mr.

58:52

Bars knows that I'm very uh acting on getting things done on time, and this is my first time.

58:58

So I make a motion that we postpone this for one month.

59:03

Second to let you, I'm sorry, Karen.

59:05

Go ahead.

59:05

You can ask questions.

59:07

Well, I I just wanted to ask because I did speak to um Mr.

59:12

Frost, and I thought that uh this application had been um already addressed, but it seems like you have some experience with this individual and that they've been very communicative.

59:27

Well, well, ma'am, with with other matters, you know, other permits or other not specifically with the caste class, but yes, mate.

59:35

Okay.

59:36

I second that's why I'm postponing for a month.

59:39

Any further discussion?

59:42

All in favor?

59:44

Posed.

59:45

So you have a month to get that done.

59:47

Okay.

59:48

I'll see you this Thursday.

59:50

Thank you.

59:50

Thank you.

59:51

You're gonna have a busy class this Thursday.

59:54

Hampton and sweets, Northwise Garber.

1:00:00

Hi there, Matthew Doyle, 601 Northwise Garber Road.

1:00:04

Thank you.

1:00:06

What you got?

1:00:07

Uh the last time anyone on this permit attended was actually March 23rd of 23.

1:00:12

This gentleman here came uh earlier this month and attended, but he was not listed on the permit.

1:00:19

I've discussed that with him that he's got to be on the permit.

1:00:22

He also has to come in and do a background check.

1:00:24

My understanding is he came to Mr.

1:00:26

Byrd's office and did the application, but he has not scheduled any background checking with our office to complete the process.

1:00:33

That is the last thing that I need to do.

1:00:36

Yeah.

1:00:36

So you're gonna do that.

1:00:37

Yes, ma'am.

1:00:38

Yep.

1:00:38

Okay.

1:00:39

Yeah.

1:00:39

I move that we postpone this one month.

1:00:42

Second discussion.

1:00:45

How long does a background check usually take?

1:00:48

Uh once he comes in and schedules, it's pretty quick.

1:00:51

I have the results back in a few days once he goes to the TBI person with that.

1:00:55

That it doesn't take long at all.

1:00:58

All in favor?

1:01:00

Opposed.

1:01:01

Okay, you got a month.

1:01:02

Yes, ma'am.

1:01:03

Thank you.

1:01:07

The melting pot.

1:01:10

I think this might be the same.

1:01:16

Sure.

1:01:20

Tristan Band 11 North Central Suite, Suite B or Suite Three.

1:01:28

Tristan, right?

1:01:29

Yes, ma'am.

1:01:30

Because I talked to you on the phone, right?

1:01:31

Okay.

1:01:31

Also Presley.

1:01:33

Uh the last attendance for this business was uh July 20th of 2023.

1:01:44

So I I understand I think you're new, but if you can explain why it hasn't been done or why you haven't done that, of course.

1:01:53

Um I've been in this position for just slightly over a year.

1:01:56

Um we're also going through the process of selling and transitioning ownership of the business.

1:02:02

So there's been a lot of permitting and things I've been learning about.

1:02:07

Um this was originally tasked to the bar manager.

1:02:10

She resigned when she was supposed to do it, so it kind of fell on my by la spina um about three weeks ago.

1:02:17

Um I did communicate with Ms.

1:02:21

Hensley.

1:02:22

Um that we were having some issues, and um, that's when I was told to come here about 520.

1:02:30

True.

1:02:31

Okay, so you you're not on the beer permit, right?

1:02:38

Right.

1:02:39

So as a manager, so I know you're buying the business, but this is this is accountability goes back to the current owner, not you as a future owner.

1:02:51

But you can't go do the cash class unless you're on the beer permit.

1:02:54

So do you have any recommendations, Mr.

1:02:56

Byrne?

1:02:56

Uh yes, ma'am.

1:02:57

Yeah, if um the the owner manager application form I emailed you, if you bring that back to the business tax office, I can get you added on there, and then you could proceed with Officer Presley for your background check and stuff, and then we'd be rolling along.

1:03:11

So yeah, his cast class would be good for a year.

1:03:15

So if he buys that business within a year, that CAS class follows him, even if he went to another business, so he would not need to attend again in the purchase.

1:03:23

So that would just be something he would have already completed for his purchase.

1:03:26

Okay, okay.

1:03:28

Well, we're looking on closing that or closing on that in about June.

1:03:31

So it would transfer over.

1:03:36

Okay.

1:03:38

So as I understand this, Mr.

1:03:40

Bird, if he goes, if he brings that to you, then he's on the license, which means as the manager, not the owner yet, then he could take the CAS class, be in compliance, and when the cell goes through, he would still be compliant.

1:03:56

Uh yes, ma'am, with the added step of completing his background project.

1:04:00

Right.

1:04:00

So um is that doable in one month?

1:04:06

Okay, I move that we postpone this for a month as well.

1:04:12

Any discussion?

1:04:14

All in favor, let it minima say aye.

1:04:16

Opposed?

1:04:18

Eyes have it.

1:04:19

So you got work to do too.

1:04:20

Thanks, Tristan.

1:04:23

I think we're to the end.

1:04:24

Are we really?

1:04:26

Last one.

1:04:27

Huh?

1:04:27

Western.

1:04:29

Why am I writing here?

1:04:31

Top Delhi and Market.

1:04:32

No, which one?

1:04:34

They're on a business.

1:04:35

That was postponed.

1:04:37

Which one?

1:04:38

What?

1:04:39

They are on the box.

1:04:40

We seem to announce that.

1:04:41

Okay, so top uh top deli and market was on here, but they are closed, so I guess they're not gonna be here.

1:04:49

So with we can't see them.

1:04:51

So with that, we'll adjourn the beer board.

Summary of Proceedings

Knoxville Beer Board Meeting - March 17, 2026

The Knoxville Beer Board met on March 17, 2026, with eight members present. The meeting covered routine beer permit approvals, compliance reports, an administrative hearing for Union Jacks, and enforcement of annual CAST class requirements. Many permit applications were approved, and several businesses were addressed for failing to complete CAST training, with outcomes ranging from hearing referrals to one-month postponements.

Consent Calendar

  • Minutes of the previous meeting approved as distributed.
  • Unanimous approval of special event beer permits: Dogwood Arts (three events), Evape Lounge, Happy Holler Project, Hayes Historical Museum (two events), Knoxville Track and Field Club.
  • Unanimous approval of new or renewed permits (some pending final documentation): Evape Lounge, Casa Don Gallo (pending certificate of occupancy), Beard and Hearle Fieldhouse (pending CO, health dept, surrender), Southern Grid LLC (pending CO, health dept), Iron Forge Brewing (pending CO, health dept), Rosaritas Mexican Cantina, Sunrise Market (pending CAST class), Volunteer Landing Marina, Yeehaw Brewing (four permits pending surrender of existing permit), and others.

  • Unanimous consent to extend the compliance deadline for Pizza (Matt Ford) by 120 days to July 2026.

Public Comments & Testimony

  • No members of the public signed up to speak.

Reports & Discussion Items

  • Alcohol Compliance Checks: Officer Presley reported four recent TABC compliance checks where multiple businesses sold alcohol to minors. Businesses cited included Palancho's Mexican, Hilton Garden Inn, Chesapeake's, Kroger on Broadway, Marriott Knoxville downtown, Balter Beer Works, Cumberland House, Tokyo Sushi and Steakhouse, Aubrey's in Powell, Tru by Hilton Knoxville North, Holiday Inn at Merchant Center, Zelante Taquiera, and La Pinata Mexican Restaurant.
  • Beer Fund Report: Mr. Johnson reported the beer fund balance at $268,000 with fines collected at $17,000 (169% of the $10,000 budget).
  • Administrative Hearing – Union Jacks (Flip Side Pub): The permittee, Aaron Nelson, failed to file a remedial plan and pay a fine by the deadline after two underage sales. He later paid and filed a plan. The board took no further action on the underage sales (no referral to hearing), but the matter of non-compliance with deadlines will proceed to a hearing as filed by the law department. Board members noted Mr. Nelson’s prior compliance with a CAST citation and urged updating his mailing address.
  • CAST Class Compliance: Mr. Frost explained that many permittees failed to complete annual CAST class requirements. The board addressed multiple businesses delinquent by years.
