Lake County Plan Commission Meeting - August 20, 2025
The Lake County Plan Commission met on August 20, 2025, to consider a subdivision waiver, two study sessions, and staff-approved site development plans. The commission also discussed enforcement of a 2013 mediated settlement agreement and a proposed end-of-meeting public comment period.
Routine Approvals
- The commission approved the June meeting minutes by unanimous consent (motion, second, all in favor).
- Staff-reported site development plan approvals, SDP-11 (Cromcastle USA, co-location antenna replacement at 173rd and I-65) and SDP-12 (Molder Real Estate, landscape maintenance and material storage on US 231/State Road 8), were noted with no questions. Permits had already been issued.

- At the end of the meeting, a visitor (Mr. Hines) was allowed to comment on the public comment proposal. He supported adding an end-of-meeting public comment period, citing other meetings where comments are limited to general issues and do not drag on about earlier agenda items.
Discussion Items
- Mediated Settlement Agreement Enforcement: Commissioner Miller reported complaints about the property at 2020 State Line Road repeatedly violating a mediated settlement agreement from 2013. Councilman Nemeyer said the owner is violating almost every stipulation, including obtaining alcohol permits under a different address and charging gate fees. The owner was advised to apply for a special exception. The state has rescinded the alcohol permits, and county sheriff cannot provide security for upcoming events. The matter will be scheduled for a future study session and public hearing.
- Deferrals: Study session petitions 25-SS-02 (Cross Creek Ranch) and 25-SS-03 (Aaron Hacker) were deferred to next month at the request of attorney Timothy Keiper, who was out of town. Both motions carried.
- Subdivision Waiver 25-W-06: Shirley Ogodowski (owner) and Andrew Moore (petitioner) requested a waiver to resubdivide a portion of lot three in St. John Township. Staff attorney Bartholomew and staff member Dwayne expressed concerns about access via a private road easement, maintenance burdens on Illinois property owners, and substandard road width. Several commissioners noted the importance of legal access, but the easement runs with the land. Moore argued he has rights under the existing easement. After discussion, the commission approved the waiver in a roll-call vote of 8-1.
- Backyard Cottage Study Session (25-SS-04): Mike Vilka (owner) and Doug Reddick (DVG) presented a proposal to convert part of an existing 4,000-square-foot pole barn (about 2,100 square feet) into a detached accessory dwelling unit (backyard cottage) on a 10-acre A-1 zoned property. The request exceeds the UDO's 580-square-foot limit and would require variances. Discussion covered the potential for future rentals, deed restrictions, and owner-occupancy requirements. No vote was taken; the session was for preliminary evaluation.
- Public Comment Policy Discussion: The commission considered whether to add a public comment period at the end of meetings. Members suggested a 3-minute per-speaker limit and a total cap (e.g., 30 minutes) to avoid delaying the BZA meeting. Some voiced concerns about repetition of case-specific comments. No formal decision was made; it was proposed to revisit as a rules change.

I have an additional communication. Oh, okay. If it's okay. Sure. In 2012 or so, we had a summary rule. Frank was definitely going to remember. We had an issue with a rodeo that was going on 2020 state-line road. We ended up in and we ended up in a lawsuit with them, and we came to a mediated settlement agreement. Everything was trying for several years. Okay. Several complaints about them exceeding the terms of that agreement. So we met with them yesterday. Councilman Nemeyer was good enough to come and sit in on the meeting too. And I would like to refer to him to speak to our about our conversation. Thanks, Ned. Yeah, it was it was good conversation. It was not adversarial by any means, but it's clear that this property owner is violating almost every stipulation of the uh court mediation settlement agreement back in 2013. So the complaint was brought to me. I brought it to Ned. We did a little research on it.
