Um we uh held a community meeting a couple weeks ago um for this establishment.
So um Rom and um business partners, you know, purchased uh Capella's full Billy Delhi just a little over a year ago and began operation, and we have received our office, received nothing but positive feedback from the community about how there's more selection, a cleaner facility, the place looks better.
Um, so there's been a lot of appreciation from constituents and neighbors about the operations uh so far.
So what this application um is gonna be doing uh this morning is going to be allowed during their um um when they're serving food uh to be for them to be allowed to also serve um um uh beer and wine and other things um with that as well.
So we held a community meeting.
We noticed the neighbors and held a community meeting.
I think we had uh around a dozen people show up to that community meeting.
Every single person there either had a uh was just you know had a question about the process um and everyone there, no one objected at the community meeting, and everybody's excited and uh appreciative of this business owner taking over and excited for this opportunity.
So I'd like to move approval.

Uh I've been uh in the restaurant business for 27 years, uh, mostly in Chicago land, and then I came up here about nine years ago, and I opened the original uh the former concept at the same address uh and operated that with my brother for nine years or eight and a half years.
Uh, and then he decided he wanted to move out of it, and I decided I wanted to keep going with something.
So we developed a uh a lesser or you know, uh more casual concept with the OG Pub and Grill.
Um so I wanted to get back to the neighborhood a little bit and give people what they were kind of asking for for uh a number of years, especially since COVID.
Um and you know, burgers, you know, you know, or burgers, beers, you know, cocktails, um, you know, just trying to again get back to the neighborhood and give them what they're they're looking for in that neighborhood.

We held a community meeting a few weeks ago.
We actually had uh 48 people at the community meeting, which was the largest community meeting I'd ever, not not uh that we've held larger town halls, but the largest community meeting we had for an establishment for a license business.
Yeah, no, there was actually no free food there anyway.
I did donuts.
You did have donuts, but donuts there.
No, no, it wasn't it wasn't the draw free food.
It was the you know, it's a very tight-knit neighborhood over there on uh Bartlett, and so people came out um and every single person there present supported this application um and wanted to see this business licensed.
Um so we're you know we're intending to support today the you know the can some of the concerns and the objection about noise were ameliorated at the at the meeting where the you know the um Craig is gonna put up some signs on the patio and um, so that you know there's and I know their employees are gonna work to make sure there's not a lot of noise coming from the patio as well, which is one of the things that was brought up.

The officer noted that the business was advised on prior occasions to obtain proper licenses and observe the business operating after 12 a.m.
and as late as 3 a.m.
on some evenings on 4 8 26.
The business did obtain a tobacco license.

Um, we wasn't aware that we needed a tobacco license to operate hookah, and we also uh just found out that we needed an entertainment license now on the operate hookah.
So we was we're actually unaware, and uh 3 a.m., I don't know about that.

Uh please uh attorney Gresham.
Yeah, the committee can't uh authorize indoor smoking.
Um that's provided for in state law.
It's uh a grandfather clause or a um uh I guess existing business clause that's inside of the indoor smoking ban.
So permission for indoor smoking um of nicotine or tobacco um is not provided by state law and cannot be provided by this committee.
So this committee does not have the right to provide that license or permit.
What permits we can provide are the hookah non the non tobacco hookah service entertainment permit.
So again, this committee cannot provide indoor smoking for tobacco or nicotine.
It can only provide non tobacco, non-nicotine, uh hookah product.
Um again, smoking inside.

I just wanted to please the record, the police report to be read in.

at certain times kind of concerns me and given the history of this location.

On 7 21 25 at 1 35 a.m.
Walking police were dispatched to a subject with weapon.
The business called regarding the subject who was locked in the store after attempting to steal ice cream.
The subject pulled out a firearm and fired one round at the wall above the register, at which time the cashier unlocked the door and the subject ran out.
One casing was located and video surveillance depicts the incident as it was relayed by the employee.
On 8 18 25 at 11 a.m.
police were dispatched to a subject with weapon.
The business called regarding the subject who frequently steals and made threats to come back and shoot the employee who locked them in the store to tell them they were no longer welcome.
The employee stated the subject eventually left, but was seen pointing a firearm at them from their vehicle.
The business was cooperative with the investigation and allowed officers to view video surveillance of the incident on 11-1225 at 2 a.m.
to 2 0 2 a.m.
Monkey police were dispatched to a shot spotter.
On arrival, the business already had video surveillance ready for officers.
The video depict subjects at the end of the lap firing three to four rounds towards Titonia, then flee the scene.
Investigation revealed the driver hit the business fence causing damage, then fled the scene.
The business was cooperative with the investigation and allowed officers to view video surveillance of the incident.

The very first incident was a teenager.
He was trying to steal a basket of ice cream.
The cashier tried to stop him and lock locked the door.
In the meantime, he pulled out a firearm.
He unlocked the door while he was leaving at the door.
He fired a shot towards the ceiling.
And then we called the police.
And the second incident was a panhandler.
He was stealing shoplifting multiple times.
And whenever the cashier tried to talk to him, he disappears.
One day I was over there.
He came inside, nobody inside the store.
I tr uh told the cashier to lock the door so that I can talk to him if he has any kind of like family needs any problems so that we can help him and he stops.
He was quiet, but it looks to me it was he was habitual.
We unlock the door, he's gone.
I tried to leave, he showed me a gun from the other side of the street.
Then we called the police and after that day we have never seen him.
The third incident, my address was used, and the fourth one was a traffic-related somebody ran into my friends.
And after that, I contacted CPU, Officer Nelson and Romo.
They guided me to double the employees.
We double the employees in each shift.
Now there are two employees.
So if there's a problem, one employee can handle the customers, the second one called the police.
And then we replaced the signage outside with the no loitering.
With the new ones, like like the existing signs were old.
Fifteen minutes customer parking and no loud music.
And the all the outside cameras were changed with the high resolution ones.
So in case even if it's night time, they have a better picture quality for the police.

Anderson did you find an answer yet yeah so monthly there's a reconcilation period um they have time to show the proof of any credits vehicles that have been scrapped or sold um the amount of vehicles that we have on record is sent to them again reconciliation if 90 days to show if the vehicles are scrapped or sold and then um after 90 days if there's no payment it's sent to collections all right so well we just heard from Mr.
Smith that he's unaware of any emails invoices being sent from the city to his email um how does the city deal with that because if we're if we're this this applicant's license is under scrutiny right now and if we're going to penalize him or uh renew or non-renew his license based on him not getting and not paying what's due the city he's now claiming that he has not received an invoice by email on a regular cadence and he only receives the pink slip mailed in uh past due invoices.
I would have to refer back to the um the accounting team that handles this um I can get back to you on this.
To my understanding, he's received invoices.
I don't know if there's been a response on his end.

Sure, so we had received a notice uh regarding uh so what had happened was we uh the hotel never had a food license when we purchased the place we never had a food license early before that uh for a couple years and uh we are serving big force which is individually wrapped and uh cereals and milk and juice and coffee for the uh which is all complimentary for the guest.
So we were told this December that we need a license for uh serving milk over there, and uh so we were given a citation in January for that, and then we applied for the license, and we were denied the license saying the there was a lot of litter outside since then.
We have done our best to satisfy all the concerns raised by the city.
So we have extra dumping process now, and then we have been cleaning up the place.
And I also explained to them that I am personally regularly there now before I was not coming regularly in Milwaukee, and we also put up a fence on all four sides now because a lot our place is surrounded by another eight restaurants and a mall, and it is the backside of all those places, so a lot of it later is flying from there.
But we do clean it up twice a day now, before we are doing it once a day, and we have installed fences uh and new landscaping to make sure that it uh nothing from across the street gets into our property, and we have made some other improvements related to the buildings like painting and all that things.

Uh there's a shed in the back of the place that's uh falling apart.
There's tires dumps, there's um collapsing uh retaining walls.
So I know the applicant mentioned litter.
This is not uh just about litter, this is about the overall appearance and lack of maintenance to the property.
And it's been a growing frustration of mine when you have property owners that own property, not just in my district but throughout the city of Milwaukee.
Um and they're elsewhere, as the applicant just mentioned, he has not been in Milwaukee.
Um, which is frustrating because you know I'm the one who filled the complaints.
I'm the one who, you know, I drive through the district, I report these issues.
I have neighboring businesses that report these issues.
So what it appears to me is this is not really a hotel.
Of course, you know, people can come through and rent a hotel room, but it appears that people are living here.
It's uh it's a apartment building.
Um there's lots of uh reported prostitution, lots of reported drug dealing.
Um lot of vehicles that are broken down on flat tires, broken windows.
Um so that's a concern.
Um another concern was uh I've got reports that you know they were serving food without a valid license.
Um so health department they go in.
They did uh observe that and they did issue the citation, which was just mentioned, and that has been paid in full.
So um what I'm recommending is that we hold this um pending health going back in there and considering what the outside looks like, making sure it's clean and safe on the inside uh to serve that food.

So I am uh very excited to bring this new uh food and wine festival to Henry Mayer Festival Park.
Uh, a little bit about me.
I have 20 years of hospitality experience working with basically all Milwaukee private business um businesses in um restaurants, bars, uh nightlife hotels, etc.
And uh I'm a huge advocate for Henry Mayor Festival Park.
I believe uh so much in its impact on our city and our social fabric.
After 10 years of serving as president of Milwaukee Pride, I felt um just compelled to bring the other part of my professional and personal career and passions to the lakefront.
And so I presented a business plan to the Milwaukee World Festival's team to create a new festival that celebrates our local restaurant and hospitality industries by curating around 20 um opportunities for 20 to 25 local restaurants to have space at Henry Mayer Festival Park, along with celebrating um seven international regions of wine to bring a global wine experience to Milwaukee.
Um bringing the vintners, the winemakers, and the experts from across the world to the festival park to engage with our local audience, hopefully regional audience, if we want to bring tourism and you know, uh drive folks to stay in our wonderful hotels and make a weekend of it.
So um it's a it's a festival that celebrates our warm hospitality, our our culture of inclusion, while still bringing something extremely new and exciting to the city with this with this global influence.
Um, and so far the the planning has been going has been going great, and we have seen um much interest and engagement with our um citywide local businesses to participate.

I would like to share just a few reasons why we uh feel so strongly in opposition about scoreboard uh scoreboard coming into our area.
So over the years, residents and community organis organizations, businesses, and the public partners have worked diligently to address and reduce many of the challenges challenging behaviors we have neglect that we have neglectedly impacted the neighborhood significant.
Significantly time, resources, and collaborations have been invested to improve the safety and quality of the life in the community and the well-being of the neighborhood.
We are concerned that the additions of the standalone liquor license could undermine the progress by potential contributions to increase loadering, public intoxication, disorderly conduct, and other behaviors that the community has worked very hard to decrease.
Our position is not intended to oppose to oppose economic economic development, but rather to ensure that the future development aligns with the community goals.
Um and maintaining a safe safe and a healthy community for us to work and live work live work and play in.
So that's why we feel so strongly in opposition.

Um, we have not had any conversation with the business owner, and as he just mentioned, he's looking to bring a bar back to an entertainment back to the Marquette district, and so um, you know, at a minimum we would want to continue to have conversation moving forward with the business owner, um, in order to ensure that it is a um safe establishment and better understand what the nature of uh just engagement within the neighborhood will be.
We work closely with near west side partners, and so um want to also support the position of near west side Partners in this and then the last thing I'll I'll mention is the uh license is for a um seventy-one percent liquor is the assumed um sales numbers at this point, and um we we um for uh establishments that are coming into the neighborhood would like to see options where there's food and just diversification of other revenue streams.

Uh my my client was working with everybody uh in the neighborhood and other folks and wanted to reach out to you and I'm looking at an email um your name is Kelsey right?

Uh from uh Maria Gonclavis Ramos uh reaching out to you uh about working with Mr.
Lock and sitting down with him to talk about the the uh his proposed bar did you not get that email it was sent uh they're from the near west side partners it was march tw March twenty fifth do you recall getting that no I do not it is possible that I did but there was no follow-up after that right but you were sending an email right from the near west side organization and you're saying you didn't see it correct okay well I'm looking at it right here may I approach the witness and show her madam chair this is irrelevant there are position to the license that's fine no I what about three months ago is totally irrelevant well no it does because her testimony said it would be nice if we had come and approached the university in in before the end and to to try to like work this out like my client has done with everybody and we tried and I mean it shows it right here.
So okay we tried uh are you still willing to sit down and talk to us.

Alright so uh in addition to uh Kelsey's testimony I'd like to add that within our patrol zone so Marquette University has our own police department our own law enforcement agency and we have a designated patrol area within that area area there are 14 either liquor tavern or some uh entertainment type establishment that are there we feel that that is sufficient for our students we don't feel that an additional uh building or uh business with entertainment and a class B tavern license is needed um within close proximity to our campus and this would be just a little bit outside of the patrol zone by by feet but um it would be something that we would stand in opposition to because of the staturation of liquor tavern or other entertainment establishments within the patrol zone that our students already patronize thank you you're welcome any questions from committee for sweetness on burnellas thank you um so your patrol zone ends at what it is roughly um between canal to state street from maybe the freeway 10th ninth street to about 21st or 23rd 24th street depending on which area uh within the patrol area it kind of jogs in and outside a perfect square patrol zone is east of 21st street on wells it ends at 20 yes patrol zone ends at 21st street and what so this is 50 feet outside of your patrol zone.
Yes.
Are you aware of uh having calls for service or uh dealing with problems at this location when it was a bar previously there were some calls for service, yeah.
At that time um prior to June 1st of twenty twenty four it was Conway's tavern it was in our patrol zone.
And we did have calls for service there.
Nothing significant.
So your patrol zone changed after the Conway's closed.
I don't know if it was after or if it was before.
All I can tell you is that June 1st of 2024 is when our patrol zone changed.
And how does Marquette University determine their patrol zone?
It is um I mean it it seems like it's changed.
It yes, we petition uh the state, the attorney general's office when we want to make adjustments to our patrol zone, and that was granted for us through the attorney general's office, and we made accommodations and made changes, and if they were effective June 1st of 2024.
So if Marquette University is concerned about this particular business, they have the opportunity to modify their patrol zone again.
Well, of course, it would be something that could be considered, but our patrol zone is dependent upon where our students live and where our students spend their time, but primarily where our students live.
So if there's another business that's feet outside of your current patrol zone in an area that used to be part of your patrol zone, it's likely that the attorney general would allow you to expand your borders again.
Well, we would have to determine whether or not it was something that Marquette University is willing to do.
So, and I I apologize for taking the time of the committee for this, but so are you concerned about this block on Well Street or not?
Because if you are, then you would want to include it in your patrol zone.
If you're not, then I'm curious why you have an objection to this business license application.
You can't have it both ways, right?
Well, we have an objection because of the concentration of businesses that are in the area.
This is just outside of the patrol zone that is serviced by uh the Milwaukee Police Department who's fully capable of handling any concerns that happen in that area.
We again we're concerned about the concentration.
We're concerned about yet another uh establishment where our students can go and drink and um as you know, sometimes students who are college age don't make the best decisions when it comes to their consumption of alcohol, and we're trying to um, and that's no inflection on anyone any particular member of this committee.
Absolutely not.
But they yes, yes, I'm sure.
But it's just a concern that the university has, and we would not be, I think, doing our due diligence if we did not bring our concern before this committee as you make your determination about whether or not the license should be granted or not.

Well then if if you want it to, you could Bill Conway's bar is not on trial here.
Conway's bar is irrelevant to a new license.
A new license.

But you're stating that they object because of the crime and the problems from the prior establishment.
So why can't I ask questions?
So they can say whatever they want, and I can't ask them to support it with any anything.

I mean, let them say that it's been bad in the past, lots of problems, and when I asked what the problems are, I can't they they they don't have the answer.

But we're we're speaking to this license as before us.
I think that's why the objective.
But she's objecting because of past problems at this establishment.
That's objecting because it is outside of the they've had previous calls, but it was outside of their border where they monitor.

But I'd like to know what the past calls were.
I mean, using it as a basis.
If let's just say there were no problems in the past with this place.

Does the Marquette police department have a relationship with those business owners?
We do have a relationship with the majority of those business owners, yes.
And so there's a voluntary uh connection or um communication between the department and the business owners in most?
It it's primarily through the university, but our police department and you know, I would have to look through the list of the 14 to tell you which ones we regularly communicate with and which ones we don't.
Does the department stop by and do license checks or um neighborhood uh visits?
We we do.
Uh would the department be willing to do the exact same thing with this new business, should the license be granted, even though it's fifty feet outside of the scope of your patrol territory.
That would not be something that we would do as far as doing a license check because it's in the city of Milwaukee and MPD that's in their patrol area.
Right, but I'm but you have a objection to the license.
Would you treat this would you should the license be granted?
Would you treat this just like your other uh 14 establishments in your purview and be a neighborly uh communicator with the business with the business owners?
The state doesn't give us the authority to do that because it's outside of our patrol area.
There are some things that we can do in assistance to Milwaukee's police department, but enforcement uh laws and other things, uh, that would be something that the Milwaukee Police Department would be responsible for.
Unless you were to change your borders again and expand to cover this block once more.
That that could be an option, yes.
But you're not ready to say that you would recommend or ask for that expansion.
That would not be something that I would look at right now.
Again, the driver for our boundaries are where our students live and Marquette University's property that they own.
And where your students go.
That's what you said earlier.

My address is 3613 West 66 Place, Chicago, Illinois, 60629.
My relation to the address.
I own the building.
I was a Marquette student.
I lived on the corner of 22nd in Wells.
Back in 2016, and I lived on that street.
This is what I was I could afford as a student, right?
Um cheaper than being on the campus.
So we bought the building because I had a vested interest in the neighborhood.
I was also part of the acre program.
Um long-term commitment to the neighborhood.
When we had bought the building, we understood that we were going to have a couple challenges, right, because of the liquor license, but we said we we know that um it was gonna be a challenge, but we'll we'll be willing to take it for our vetting process to rent out the space.
Like multiple people trying to open up a bar and club, and we clearly stated that we did not want to have a club in the area.
One, because we don't want to be a nuisance to the neighborhood, and two, we also have tenants that live upstairs.
So we found what we believe is gonna be the best tenant for the space.
Even throughout that entire process, we were meeting with Marquette, we are meeting with near west side, we also met with the aldermen.
We were very active since the beginning, and and I'm just not really understanding what the opposition is.

We that's that's not what we're looking for, and tally or the the applicant right, our retirement was amendable to that, and that that answers that.

I agree with Marquette University in terms of this being a situation of over concentration.
This is a high crime neighborhood.
I know I've I live several blocks to the west.
I've been familiar with this neighborhood going on 35 years.
One week ago when there was a shootout at 18th in Wells, just two blocks from this location involving multiple incidents of gunfire and damage to buildings and structures.
No one was hit.
Fortunately, but that did originate with a licensed premises at uh 17th and Wells.
So yes, there are issues in this neighborhood.
Uh this business about calling something a sports bar and that immunizes it from trouble.
Uh the original concept of this bar was as you say dancing bands, karaoke.
Uh that's not sports bar material.
Number one.
Number two, uh, I do question the applicant's frankly experience in the bar business.
His original application, and I'm not sure it's still in this particular uh ebook that was submitted to committee, is that as part of his security plan, he was going to lock the front door, and people could only get in on a basically ringing up bell to come in.
Well, that's illegal in the city of Milwaukee under current licensing arrangement.
Anyone experienced in the business would know that.
So for a variety of reasons, I mean, I I support my stakeholders, I support universities' position and their right to protect their neighborhood, protect their students, protect their staff and fat faculty.
Uh I certainly support the near-west side partners, which are a major force for good and positive activity on the nearwest side of Milwaukee.
And I think this is just one bar that we do not need.
I also mentioned this is one block from the rescue mission.
So in terms of the potential for loitering and people hanging around if anyone travels down Well Street at various times of the day or night, you will see folks sitting on the corners, sitting on the stoops, hanging out in front of buildings.
And I'm very fearful that's exactly what will happen with this establishment.
Uh, it is a new license.
There is no property right.
Uh due process is being given by this very hearing today.
We've heard from two major stakeholders in opposition.
I think their arguments are very valid, so I would ask the committee to reject the application.

Well, current to become previous owner of this business.
Um, I have been a part of the industry of Milwaukee since 2008, owned, um, operated, and consulted with um hospitality businesses since 2016.
I'm a huge proponent of what's going on on the street, and I was and currently technically am, uh, as we go through this process, the owner of local pub.
So to start the hold from the distributors would be my responsibility.
So I want to make sure that's clear that that is not anything on their end.
But for me, as I am transitioning out of the service industry after being involved in it for so long, it was important for me and my team uh to find people that would honor the financial.
We put a huge amount of money into that space, as anyone that saw it from the previous business to what it looks like today.
We put a huge amount of money into it, a lot of time, a lot of our resources into it.
So as we were making decisions on what to do next, um, it was important for me to find people and partners who would not let that go to waste and to be a good fit for the street.
So after having conversations with multiple multiple different business owners uh working with um Aaron and Tom and their team.
Um I was excited for the vision that they had for the space and was happy to work with them uh to eventually take over the space so all of our hard work would not just be in vain and and go to waste.

Upon arrival, Milwaukee Fire Department was attending to a subject that was sleeping in the paddock area of the business.
The subject left with no additional services needed.

Milwaukee police received a trouble with subject complaint.
Employees did not call the police and no additional services were needed.

The manager reported a subject was uh who went behind the counter, took a cup, and became aggressive after being confronted.
The subject threw a drink in the manager's face and attempted to punch them.
The subject was located and cited for disorderly conduct.

I did review the police report, the five-year police report.
I noted that there were five false alarms.
I would hope that the restaurant was fined for it because I can discipline much more effectively if there's a fine as opposed to no fine.
Of the 26 calls, two are not from us.
Seven were the subjects had already left the restaurant by the time the police did report.
That video was reviewed by the community affairs officer, and he disputes that conclusion.
Basically, uh this is a Saturday night where there was a shooting in the parking lot between a car and an individual walking a dog, and the person ran into the restaurant bloody, and then eventually apparently hopped in that car and drove off to the hospital.
We never found out any details about it, but the person running the shift isn't capable of taking flash drives off the video camera.
And the two people that are in my company of 16 restaurants that is capable of it, you know.
Well, one lives in Pleasant Prairie and and the other lives on East Howard.
You know, in east in Milwaukee.
Within before the night was over, they were able to get the manager who lives in Oak Creek to the restaurant back to the restaurant, and uh over the phone was instructed and apparently successfully did get a flash drive before the night was over.
But it was just not not unwillingness, it was inability.

Uh yeah, just a few questions.
So I noticed there was a pretty substantial uptake up tick in the number of um incidents involving troubles with subjects.
Um looks like there's a bunch of issues relating to panhandlers and maybe people having a mental health crisis.
So just wondering if you have security on its staff and if you don't, what um what steps you might be taking?
It would be advantageous to have a meeting, for example, with the community liaison officers, they can offer you advice about how you can uh have your staff trained to deal with that situation.
I know 27th and Ramsey's is the intersection, but uh was a little concerned with the uptick and number of complaints, and just wanted to make sure that you were reaching out to the police to get the help you needed.
Okay, actually I have a meeting scheduled tomorrow with the bid director and with the community service off or liaison officer at the restaurant at 10 tomorrow.
Uh I do have a willingness to bring guards in where I can have a a pattern.
I operate the McDonald's on north and new hall, uh east north and new hall on the east side.
I have security there probably twelve out ten to twelve hours a day most days of the week.
There I have a lot more people on the street or people that think that my restaurant's comfortable enough to sleep in.
And you know, we do try to keep keep them moving out of that restaurant.
I also have security near tech high school, you know, when the students are around, because it when you have 30 students to send on a store before or after school, you know, after being well behaved all day, they tend to be a guess full of energy.
I guess it would be a polite way to phrase it.
After school, and so I understand um this was a one-year uptick.
I if we've tend to look if there's a pattern, yeah.
If we do see it moving forward, then I would want that taken more seriously.
I understand this isn't.
I always do.
I I have security like I said in three restaurants, four restaurants.
If I can find them, let's say if it was a set time of day, I would have security there or a set day of the week, absolutely.
And then with respect to camera access, I know you were saying that somebody was able to obtain access that same night, which is good.
Very serious incident.
Um, do you have any plans or steps to train anybody on staff to access the video in case timeliness is of great importance to the police?
Typically I haven't.
In some restaurants, the people tend to be a little better than others, you know, as far as being techies.
You know, the one that sat particularly Saturday night apparently was I guess nervous enough of s of seeing someone come in and but he wasn't that able to use the machine.
So someone did what did come to the store and was instructed how to do it over the phone.
Yeah, and again, they were able to do it in the same night, so there wasn't a huge delay there, but we want to make sure the police can get access to video as as quickly as possible.
McDonald's nationally is uh actually review reviewing the whole issue as of next year.
They want sixteen cameras in every restaurant in the in the United States.
So I mean they they're taking cameras.
Yep, we just need to make sure they have access to them if the police need that information.
And then uh lastly, I think I was provided with the same information you were, Mr.
Steering, about um Officer Ward, the community liaison officer reviewing the video.
The shooting obviously is is kind of why we're here.
Um, again, the testimony I was supplied with was that the employees gave the police their names, personnel cell phone numbers, and their general manager's phone number to get any camera footage.
They were cooperative, um, even though they were a little shaken and they rendered aid to until the police arrived.
So given that information which I just received yesterday, um, yeah, I I don't have a deep concern uh about that incident being tied to the store.
And it looks like from reading the PA thirty-three, it sounds like the uh detectives may have been a little frustrated with um the ability to get access to the camera footage, so maybe that accounts for the discrepancy.

The manager reported a subject causing a disturbance and refusing to leave.
Officers requested that the subject leave the business.
The subject was no longer on scene, and the employee was advised on how to get a restraint order.

officers were dispatched a subject with weapon complaint.
Upon officer's arrival, it was discovered that the caller was at a local hospital being treated for injuries.
A security guard and employee stated that they did not witness a fight at the business.
Security camera was not available during the investigation, and an employee refused to give the manager's name to officers.
The investigation revealed that subjects known to each other engaged in an argument at the business, which escalated to a physical fight.
The victim at the hospital was being treated for knife wounds.
An employee reported four subjects that left the business without paying for their meals.
The officer was able to contact one of the subjects and advise them that the business was uh a business did not want them back on the property.
The subject stated that someone uh some of the food was raw, and a friend decided they would not pay for the meals.
But he would uh go back and pay the bill.

The one on 12.7 that was sent um as requested on 12 15, the one on um February 1st that was sent on February 1st, and the one on um April 24th that was also sent on April 24th, and um the manager refusing to give name she um for some reason which I already spoke to her about, um, did not want to give out my name and information, but um they are directed at all times that my name and or contact information, and I am available twenty-four hours a day, 365 days of the year because we run businesses twenty-four hours a day.
Um, six minutes a day, you know, they're able to contact me if any need arises with the police department or anybody else that would need anything with an emergency.

Uh so I noticed there's three incidents.
One item 39 on 1122 takes place at 438 a.m.
That's the battery.
Item 41 takes place February 1st.
A bunch of these take place in April and uh this year.
Um, that one number 41 took place at 3 37 a.m.
That was when there was the shots fired complaint, where the large group came into Denny's and engaged in a physical fight, went out in the parking lot, and then shots were fired.
And there were nine or five nine millimeter casings taken from the parking lot.
They didn't have access to the video there.
I believe it was later provided.
But I guess the most disturbing incident to my mind happens item 45, and that's the one I guess I have a few questions about.
Takes place on April 24th at 4 50 a.m.
So another extended hours period time.
That's where the person gets knifed after a fight.
So my question is this.
It says in the detailed report, the PA 33, that the Denny's security guard that police spoke with on scene after the incident stated he didn't witness the incident.
However, security cameras show him on scene at the time of the incident.
It also says in the last paragraph, I asked if I could have contact information for the head manager.
However, she refused.
Should be noted, however, in later camera footage, the security guard appeared to pick up an item from the parking lot close to the incident location.
That leads me to think there isn't uh cooperation there, and there's an attempt to cover things up.
Um the same manager, neither of which are one of these two said she didn't know what happened in the first incident and kind of repeated that story in the second incident when it seemed like there were um circumstances indicating that maybe she did.
So all that is cause for concern.
Do you have security on site and have um for the security you do?
Um, what steps are you taking to make sure they're cooperating with the police?
Because it certainly sounds like in incident 45, they weren't only not cooperating but were trying to hide something.
Um I will speak about the one 41 first.
Um, when it that group entered the building, they did to get real far, they were asked to leave because they were very loud and destructive already.
Um so they were, you know, asked to leave, and when they got outside is when they started to um, you know, get visible between the two doors, and then they were um, you know, by security directed to go outside, and then um that's when the I I guess the shots were fired as the visit as the vehicles were leaving.
Um the police, you know, were called obviously dispatched prior.
Um when they started getting disruptive as security was trying to remove them from the building.
Um so you know, and when they asked for footage, you know, that was that was given.
Can I ask a quick question?
We didn't know until uh we know we didn't know that they had guns and such.
Yeah, it says in the police report that um uh as more people came in uh to join the group at 3 a.m.
a fight amongst the group occurred.
At this time the manager uh Kindle's manager identified as April Gutierrez, instructed Kindle to call the police, and then it said Kindle then observed the group move into the parking lot and continue fighting.
That makes it sound like the fight was already taking place in the restaurant.
It was taking place between the vestibule.
So we have three doors.
There's two doors, a vestibule area, and then the another door there then you come into the restaurant itself.
The um altercation happened between the two doors in the vestival.
Um, and I can speak for that because I, you know, I did watch the video before I had to uh send it to the police.
Um I did follow it up with the security company.
Um I felt that you know that the guard probably should have um been the one to um you know handle a little bit better about getting them outside and andor call for help because he can call for backup.
And um, so I did speak to the owner, and that guard was um that was the last time he was on premise.
We then we're given another security guard.
And then with respect to 45.
45, that was um, you know, very interesting.
There was four women.
They came in, um, they ordered to go.
Um two of the females left when they got their to-go bags the other two left you know shortly later they got out to the car and um that's when they got to an altercation with each other and I guess a you know from my understanding a knife was pulled um and then they all got in the car and left together so um nobody knew it was going on until after the fact because a customer came in who was um coming or I guess he was he was either leaving or coming I can't remember honest but he was out in his car and he came in to let them know after the car left that he had seen the altercation happen on that we that's what the security guard went outside.
Um and what about what I pointed out in the police report that it said the security guard stated he didn't witness the incident however security camera shows him on the scene during the incident and also shows him appear to pick up an item from the parking lot close to the incident location.
From my understanding you know we didn't witness it because we weren't we didn't know it was happening outside.
So he didn't witness the altercation happen.
When he went outside and you know again I you know contacted the owner's security company and um you know he we discussed the after we got the police report that um his officer may have or picked up something um he said he was going to um talk to them um the police department investigator of it and so and and handle it from there with his um security guard and he if I'm not mistaken he then was not back with us um after that.
So in your opinion the security guard may have exercised poor judgment picked up something from the lot not immediately given it to police but I think yeah I'm not I can't speak a hundred percent but I believe yes it was done poor judgment and you know if there is any situation with the security guard I mean I I have no problem calling the owner and he's works very well with me and or even my manager if we have any situations we don't feel that we're getting the security that we should be getting um and he either comes in himself then and does a few shifts and or he will send somebody else and then do follow-up.
He has things into place and if his people don't follow you know his protocol of if there are altercate situations or there's police contact you know they are supposed to um you know let him know um if he needs backup or they need backup they're supposed to call um you know that that protocol's all set into place but again you know if they don't just like you know if my employees don't do the right thing it's you know we then handle it from there.
Yeah and I'll just note that it's it's very uncommon to have shots fired and people knifed on 27th Street there.
So um this definitely stands out as some incidents that cause great concern especially the securities reaction to the thank you it was interesting to see both of them because I think I said the the um the weapon one was um interesting that they all seem fine inside and then I guess they you know weren't so okay do you have any other questions on respect?

So OWI is a really ruined my reputation and everything goes well in my life, and then that one night I had I had a biggest mistake, and also this almost full responsibility is going through towards me, and then I still feel bad about what happened.
Uh but so far um I found this place and then I feel really good about and very confident about everything that I is fit perfect to the restaurant.
So I starts um I I wanna open really like heartfelt, really need to be there.
I really wanna do it.
So um yeah.
And so far, yeah.

Investigation revealed a patron's vehicle was towed due to parking on the employee parking lot.

Could I just briefly give a little bit of history?
Of course.
Okay, this um established that there was a bar there before that had a number of issues.
Uh revocation hearing was brought last year before you and um I represented the the owner at that time.
There was um significant problems, and uh they received a 90 day suspension.
Um after that 90 day suspension was over, the bar reopened in December of last year.
Um, and my client was working there bartending kind of overstream because she wanted to take it over, uh, eventually purchase it.
So she was there.
Um you were there from December till it closed in May of this year.
And as the sergeant said, there's been no police reports whatsoever since uh it reopened after the 90 day suspension.
And ironically, my client was there the whole time, working as an employee, not as the owner.
So, the uh the the uh measures that the uh prior owner put into place that allowed you to not revoke it but gave them a 90 day suspension worked and there were no problems, and on top of that, my client was there the whole time.
So I just I just want everybody to kind of have an idea um that she's just not walking in there to a brand new uh venue that she's actually been working there as an employee since since December.
Okay, um, and so that's part of her experience obviously, has been working at this establishment um for a period of time, and also you worked at another uh you have another bar?
Yes, I do I have in another bar in a Dortin and Yucca and they're running for two years.
Also, I have a 30 years and uh working in a hair salon in the south side in the six of Mitchell.
So when I still open, even in the screen, and it's excuse me.
And also I have an experience uh running uh stand, like a food, a little food also.

And it's the only part where you can get a haircut and a drink.

My address is 1579 South 38th Street, Milwaukee.
Okay, uh, I represent the ownership group for the apartment building Schuster Lofts, which is directly across 11th Street from the premises in question.
Uh and as a property owner there, this location has been uh proven track record for decreased safety and increased uh problems for the neighborhood, including automatic weapon fire that happened last summer uh that led to the revocation.
Um the applicant here, I understand owns the property and has owned the property for uh five plus years, I think, and during that time there's been numerous uh tavern license assigned and granted for this premises that we've when it's in operation, we always run into issue.
Uh and that is broken glass on the street.
That's bullets flying through apartment windows.
Um I have an invoice here dated from uh June of july 2nd for eight windows that had to be replaced due to bullet uh bullets flying into residents' windows.
Is that July 2nd of which yeah?
2025.
Right.
So before we don't, you know, I prefer to hear the testimony.
You're cutting into his two and a half minutes.
Um after that incident, which occurred on June 23rd, uh in the early early mornings.
Um the police conducted wellness checks on the residents after, and I'm quoting here 30 automatic rapid gunshots followed by more.
Uh the witnesses stated they observe suspect suspects exit the business, appearing pickup casings, one was armed with a firearm with a drum style magazine.
Uh so I believe the committee is supposed to review if this diminishes the safety or the value of the properties in the area.
Um it's hard to argue that it would it it does not do that.
Uh or that it does diminish the value and the safety.
And I have petition here with 30 residents that live within 65 feet, which is from that oppose this because they don't want bullets flying through their window, they don't want noise at night, they don't want broken glass, and they don't want cat calling when they're trying to come home from work and conduct you know live their lives.

Do you think there's an opportunity to work with her?
I can't speak for the 30 people that signed the petition in opposition of any sort of tavern license being granted.
Uh while it's an improvement, I think we're starting from such a place of life safety concerns where I mean, bullets flying through windows when people are sleeping.
Broken glass strewn about to the point where we had to invest close to ten thousand dollars to improve our camera systems that are just pointed directly across the street so that we could document what is happening here.
Um and thank goodness we did because we were able to provide video to the police.
Um there's a proven track record of issues anytime this bar is operating going back to prior to that.

I think the question was is now that you've seen the improvement, do you support it?

And I just wanted to basically reiterate what Alex Costner, the building owner stated.
The history of the previous entities that have occupied that space have proven that they cannot control the actions of their pedestrians that go to drink or to have a good time.
There's just been continuous nuisance, a lot of safety concerns with the residents.
I was also the property manager for almost seven years, and personally witnessed a lot of just bad things going on in that bar across the street.
Um there's always glass broken in our side of the street, specifically from pedestrians leaving the bar, breaking bottles, getting into fights.
Not too long ago, I would say last year there was a homicide involving a neighbor that lived in the house next door, and someone that was in the bar drinking.
Um I don't think, though she she may be a great person and she's looking to run her business differently.
I don't think we would benefit as residents directly across the street.
We will not benefit from any sort of class B tavern, a bar, anything with alcohol related in that space specifically.
It's just raised way too many safety concerns.
And as Alex stated, when I was a property manager, we were replacing our lobby doors, our apartment windows almost on a monthly basis from bullets and from bottles being tossed at our windows.
It's just been a nuisance with absolutely every entity that has occupied the space.

Um, I had a brief opportunity to talk to the applicant, and although um I'm critical of uh her property ownership or managing the property per se as an owner with a different um applicant there.
Um I express my disappointment in that process.
Uh, the revocation um that the neighbors bought took a lot of energy, and they spent a lot of time doing that and preparing for that, although it didn't um go the way the the community wanted.
Um it's a difficult process to do on your own.
Since um that happened, I think it was a wake-up call for the owner who said that she didn't want anyone else taking a risk with doing uh occupying the space in a light with a license.
Um with that said, um I I did frequently um briefly speak to her, and she is willing to amend her license to um close earlier.
If that is still the case, I'm willing to um support it if if she closes every day at midnight.
Um, there was also talk about uh a food truck being close by.
I mentioned to her because of the proximity of the other restaurant being within 50 feet.
That would be difficult to do there on and Mitchell Street has a ban for second-hand dealer license to begin with within the bid.
So I told her that the one um thing of closing early, um, she understands the magnitude of uh running her business much better than her tenant did in the past.
We do have some positive things coming um soon to uh the alley where the where the business is because your move MKE got a grant they're gonna beautify um the alley there and the parking, the city lot behind there and add some additional lighting uh for people to feel safe to utilize public parking, um, not not just for her business, but during the day and in the early evening, and so there is going to be some efforts uh to keep eyes on the street with the art there.
Uh so with that said, if she's willing to amend your license to close at midnight, I could make a recommendation for the license to consider uh approval as amended.

Um I believe, and maybe uh licensing of the city attorney can't correct me with uh if I'm wrong, but I'd like to read into the record a kind of a chronological order of how I understand where we're at today, but usually this can be an administrative function to approve it, but because um there was some information on the application that we didn't was was brought to my attention that wasn't true, then we said, you know, applying and putting on the application, the reason for not opening after you've been granted the license after a year should mean something.
So we just wanted to get it on the record.
Um what was put on the application, the the reason for not opening and moving forward um what's the plan if it's still the same.
Very good.
Um thank you for that context.
So if if I could just just read a couple things into the record as I understand them, go ahead.
Because the Class B tavern and public entertainment application was granted by the common council on 924 uh 24, 2024, and then the waiver was uh filed on 109 of 25, listing the city schedule on plumbing construction count conflicts steam line in front of the property as the reason for the raver waiver request.
Um licensing reached out to commissioner of DNS to inquire whether DNS could cooperate the reasons for the applicant filing for the waiver was legitimate.
Um then the commissioner sent back that on 1029, the business construction permit from 2023 had no inspection, had been requested or recorded along with no follow-up from the applicant.
And per the Milwaukee code of ordinances, the permit expires six months with no activity.
Uh, she also confirmed that the same time, but the same with the occupancy, the permit being filed in 2024, no action client communication to the department regarding the permit, thus the permit had expired.
The commission also confirmed that plumbing and water services were also started in 1124 but were pending because of applicant inactivity.
So they had expired and had been there uh for more than no activity without any permit, and total four permits have been applied for from 2023 to 24, but as of 1029 25, none of the permit applications were active or valid due to applicant inactivity that caused the applications to lapse.
Uh the commissioner was communicated on 527 to confirm if any request or activity had occurred for the premise since the commissioner's last update on 1029 25, and she confirmed that on 528 of 2026, there were no major changes or requests for activity for the property.
She did know that the water service uh permit had been uh filed on 317 26, but still had a pending fee of 3,100, an interior plumbing permit had been filed on 325 of 26.
It passed inspection 520 of 26 and was issued 521 and the interior plumbing permit is uh current and active permit at this time.

Well, according to the the waiver, it was the reason that it wasn't open in the year was because of conflicts with um plumbing inspections, thream line in front of property, okay.
And I guess it raised the red flag that if you put on an application, the reason and DNS can't cooperate or confirm that those were the reasons that it's not open, then it it just shouldn't be granted administratively.

And I did appreciate the opportunity.
That that does sound like the correct recitation, but that it this is a tremendously complicated uh situation, and Mr.
Martinez can explain some.
But that we've gone through two architects and two plumbers that the um the property has been leased and then um what happened was that there's so there's two plumbers.
There's an interior plumber and an exterior plumber, and then there was the negotiation to buy the property.
The problem is so we didn't we couldn't get occupancy without the plumbing being done, but then the plumbing required work in the right-of-way outside, and this required like some ninety degree elbows that it was very complicated and very expensive, and so that delay uh cause so now we've got actually two plumbers on the job, and it's all everything is proceeding.
Um we did talk about the payment and it is the the plumber has been paid and part of his payment is to pay for the permit.
So that should be done forthwith.
Um but otherwise um we would hope to be on schedule to complete all the work by the end of the month.
Um I'm I'm hesitant to ask for an extension till the end of the month, so maybe uh forty-five days beyond that, but I do believe that what has been a unexpected complication and again Mr.
Partines could give you a little more detail, but it's now finally moving along and will be uh ready to go shortly.

Um to uh revert back on the initial problem.
Uh the first plumber that I did hire uh couldn't do the job completely uh in regards that's when I was notified about the steam line in front of the property.
So that was the first issue.
I had a retain a different attorney to go after the first contractor of the plumber because uh he couldn't fulfill the job.
So we were under contracting and whatnot.
So after um retaining the attorney for that to delegate uh payment and uh getting my getting reimbursed for the situation.
Uh once we found out what uh actual job entailed, it took another six months to uh negotiate the deal, excuse me, um engineering plans and whatnot for in regards to the steam line.
So the main issue was um hiring a new contractor and resubmitting plans for the outside plumbing because the plumbing needed to be upgraded for internals.
So that was the first issue.
So then that the first guy that I hired um was September of uh or October of twenty-four, right after we got approved, um, and then I decided to move forward with the construction, and that guy the initial plumber walked off the job um end of December, and then I retained the other attorney um somewhere in in January.
Um that took about six months um in going back and forth with the the contractor again reimbursement for the payment and then looking for a new contractor, which I did hire um in uh the end of October in 25 and for any plans, construction, architect, and engineering when they're involved it takes um three to six weeks for plans, then submitted um and and for approval and uh outside plumbing was the main issue.
Um something uh technical terms, uh I think uh a variance was approved almost like um with Bozo and other construction stuff you have to uh get special approval for in regards to plans that takes another three to six months, but everything got approved I believe sometime in February of this year, and as he mentioned, um the plumbing, the rough and all that stuff already's been approved, so now moving on to construction, which uh should be done by the end of the month.
And um do you own the building?
Uh in the process of closing, yes.
But it's the I mean, there's so there's a plumber for the inside, which is pretty perfunctory, just do the plumbing to get the occupancy.
But the plumbing outside was beyond anything we imagined at the time uh when we came here.
And that's what that's what all of this delay has been about.
And so the the building could not get occupancy without doing the outside work and and so now that should be completed forthwith.
So you're here today can to continue to ask for a waiver.

No I just um I just want to be clear that um when you when someone puts in there the reason I guess the city schedule and the permitting process I want to make sure that we're not in the way of getting that done and um it just it seems like it's we always tell people to take care of your licenses before you do all your construction and what and do and and not waste your resources in case you don't get it.
He got the license in this thing and it seems like it's taking a really long time and want to make sure that the process is clean that way moving forward.
Okay we didn't know so yeah he's we I agree with the president the problem is we didn't know about the outside work at the time.
Uh excuse me so the there's nothing inside the property it had one restroom and um I believe a a utility closet.
So in regards to the plumbing uh upgrade sizing needed to be done to expand and have multiple restrooms bar built out and whatnot so then you have to upsize from the city street and outside and then that's when the first construction guy, the plumber, was aware of the steam lines and he couldn't fulfill that job.
So that was the that is the issue and the delay.
Yes I think the um the thing that the com that the local elders pointed out and um I would take umbrage with too is if you say it's because the city because of permitting issues with the city and that's not the case well then that's upsetting for us to hear because it wasn't it sounds like from the from the written documentation from the commissioner of DNS that was not the case.
It wasn't permits that were holding you up.
Um well in addition to that and what is re what he's saying uh that was the case prior right so then if uh the building across the street which is the apartment complex I'm not sure on the dates but they were the street was closed off one side so that uh at that time the construction the plumber was that's what he mentioned that's what the case was and that that was December so then or October excuse me the plumber didn't walk off the job to December.
So that was my understanding.
Then I just got a question so when you plan on opening then um I should be able to pull get occupancy by you know within the the next 30 to 45 days and we'll be ready to go.

Um I do see Commissioner Adoyovega is in the audience.
Did you were you looking to provide test some testimony Commissioner to clarify anything about what is needed for the Alderman Betis you want to hear some testimony from her on the record?
I think I I think I'm pretty clear on where we're at I mean her email was very detailed we appreciate what she did.
I just want to make sure that when we do these waivers that when they're not administrative like that that we have some clarity and they mean something moving forward so very good.
And then I'm sure are there any can I just ask for neighbors are there any neighbors present that wish to testify on this item today okay let the record reflect there are no neighbors present to testify attorney Gresham yeah and I do want to I guess mention for posterity or maybe for the committee as well that um you know we did pass an ordinance recently 85 184 uh which uh no person may receive more than one waiver under sub two for each license or permit granted or approved so this is known to the committee these kind of perpetual waivers are something that the committee saw fit to regulate against as a waiver is effectively entirely voluntary by this committee.
It's a creation of the common council um and not something that's done in other municipalities.
So this is a convenience that was created um and I believe that the common council in and this committee um endeavored to kind of limit the extensions of these um in this instance.
Obviously, I think that there is, you know, exterminating circumstances, but we need to understand that there is a past ordinance um that stands in the way of future things, and yes, this one um I'll pass it to licensing.
Um, Attorney gresham is correct.
So you guys did pass that limit to only one waiver.
This is his first waiver on this application.
So if he's not able to get the licenses within the year, if this gets approved, then he would have to apply new.
And it doesn't prohibit new application, it just prohibits the perpetuation of waiver because we have seen applicants sit on licenses for five years, never open, and that denies other applicants the ability to get licensed in a speedy fashion.
So and why is this his first this is his first I mean he got a waiver, he was approved in 2024.
Yeah, so from an application is valid for a year from date of um approval or when it from approval, it was approved in 2024, so it expired in 2025.
That's when they submitted the waiver.
So this is a sm multiple this is another waiver.
No, the waiver this one that we are considering or that you're considering was in 2025.

Sure.
Um we the parklets in in the city of Milwaukee were approved um, have been approved by DPW, and it was um a measure that was taken during the COVID crisis and getting people outside using public space.
We know people weren't utilized there was very little economic development and activity, so this was uh way to do that.
Every year, DPW had requested that we go a year renew it every year for them to be able to approve the parklets.
Since then, every block is different.
People have had questions about some parklets, concerns, maybe some objections, and in um handling some of the complaints of my district.
We realized that the for me, one of the suggestions that we want to make this communication as we fill the file and move it forward, is that um the parklet should be part of the licensing project uh process and an extension of premise for them.
So for the union public, we are not eliminating parklets.
We're just moving it from the sole discretion of DPW deciding to now they're they're being attached and being a part of the licensing project uh process so that every applicant can put it on their license, come before committee, neighbors are noticed.
It's a very democratic process.
Someone has a question, a concern, they can either address it at committee as uh providing the testimony directly to the applicant, and we feel it's a much more um inclusive and uh more transparent process for the community to weigh in on parklets through the licensing.

Um, so up on the screen here is sort of the workflow of what this permit process will look like.
It's going to use the established administrative approval track that we use for license applications like food dealers and filling stations with one additional uh add-in, and that's notice to neighbors.
So uh we are combining parklets, sidewalk dining cafes, and active streets for businesses, which are also sometimes called streeteries, into a single permit that's administered by the license division.
Uh, the lifecycle of this permit will start with an application that's filed with our office.
We're gonna send notice to um all addresses within a 250 foot radius.
I do just for all new ones, and I do just want to state that there's gonna be a de minimis fiscal impact for this, because most of these come in with an alcohol license and we're already sending notice, so uh it's something like eight percent of uh applications for sidewalk cafe come in without that.
Uh, we're talking like three or four a year.
Uh we are also referring the application to um the three departments that we currently refer the sidewalk cafes to.
That's DPW for their expertise, and I think we have James Washington here, can answer any questions about that, as well as DNS in the health department for quick checks of other um permit and health related things.
Once we get feedback from the departments, uh it is returned to us.
Uh, we're gonna confer with the local alder person to see if they've received any objections as a result of the mailing that we've went out.
We'll also advise if we've received any objections, and that will, if there are objections, trigger a hearing before this committee.
Um, if there aren't objections, then we could issue the permit administratively.
This will be a 14-day waiting period uh to allow some time for those mailings to go out and um communication to come back to us or to the local alder, and then after that we will issue it.
If it comes in with a liquor license, uh, it'll follow the path through this committee.
Just how you see taverns with uh public entertainment food dealers, sidewalk cafe currently.

And we'll add um I know you can't see them now, but James Washington is up on the board, and we wanted to be very clear.
So, for instance, uh, as the bus started publicly about um moving the parklets from uh DPW into licensing, uh independence first reached out to us and wanted to reassure that uh they were all you know accessible for anyone who has physical challenges.
DPW is gonna continue.
They've been doing that.
They're gonna continue to ensure that these parklets accommodate everyone.
Also things like with you know um some of the snow plowing access, cleaning, all of that now.
There's a complaint about one of them.
They could be put in the license, and then a license has to come up about maintenance with their park light.

Um someone shooting my son, us, um, and uh just uh I mean like I said, I found uh casings, eight caseings a total big outside of my um on my door.
So this has been and like I said, and after that they killed the gentleman.
I wanna say like um a month later.
So um that's basically it.
Um uh it's not changing, and I don't foresee it changing, it's gonna get worse um moving forward with um, you know, uh summer coming.
So um and the music is ridiculously loud.
Uh that day I had called the day that the man got murdered, the the young man got murdered.
I called the police about an hour prior saying that the music was extremely loud.
Um, and uh I know that there's that you know that there's uh certain rules about that.
Um, so uh with that being said, I I am against it and it has affected us.
It has um the parking is ridiculous.
It's just it hasn't changed.

Uh there have been uh some developments, uh, some positive developments in the last few months.
Um, but uh I'm uh glad to see that a neighbor did uh join us and uh I think we should hear from the neighbor first.

Um, I live across the street from the tattoo shop, and last summer into fall, we had numerous instances where the parking lot was filled um with a gathering, almost like a car show gathering type thing um that was organized by the tattoo shop where we ended up having lots of issues with noise, loud stereos going, um, reckless driving, uh strong police presence, which I'm surprised that there's no police reports.
Um, this happened at least three times, which caused a lot of disruption to the neighborhood, um, not only to the houses that are on 76th Street, but to the apartment complex that's next to it, and just the surrounding residences in general.
Um there was uh, like I've mentioned reckless driving, lots of peeling out of the parking lot.
Uh there was wrong way driving on 76th Street that I observed, high rates of speeds, um, people on motorcycles and street bikes doing wheelies on 76th Street, um, just a lot of reckless and unsafe behavior for residential area.
Um, the people that were there were very harassing and taunting to the residents who were trying to document what was going on, just for the welfare of their residents, because we didn't know with this large um influx, quick influx of people what was going on in our neighborhood.
So we were trying to just document what was going on.
Um they continued to hold events multiple times throughout the summer.
There were at least three, and I believe up to five times that this happened each time the police were called.
Um there was potential drug use, um, serving food potentially without a license, um, like I said, police repress presence each time there were some arrests and cars being towed in front of our house in particular, and an impact to other businesses in that strip mall too, where the parking lot was completely full, people parking on the streets, um, a lot of foot traffic around that those other businesses couldn't even have their customers come in because the parking lot was filled with people for this business just gathering um to my knowledge without a permit.
Um, so just a lot of concerns to the negative impact on the surrounding residents around them.

Um, when these uh concerns were reported to my office to MP MPD last uh fall in September.
Um, have you what has the neighborhood situation been like since then?
Um in September things continued.
Um there well there I think there were two events in September.
Things settled down after that once the weather got colder.
We didn't have any further events after that.
Anything this spring.
There was there was no events this spring.
There was a car accident on our road, um, that a lot of the neighbors responded to in spring.
Um, and one of the residents I spoke to, her daughter had a piercing at the shop in which the daughter noted that there were events being organized, and which I reached out to the alderman for some help with that, and he reached out to the police department.
Um, and I know they contacted the tattoo shop owners, and there have been no events, um, but I suspect that there would have been had there not been some communication and intervention.
In noise levels and traffic seems to be normal.
That has been okay.
Um they have been allowing motorcycles to park up on the sidewalk for their shop, um, which for me is a concern for individuals with potential disabilities and impacting safe travel um on a sidewalk versus having to travel through the parking lot for that strip mall.
Um so that is a concern for me just as part of like Americans with Disabilities Act.
Um, but that's just a side note.

I was actually having a conversation with people from the tattoo shop in the presence of the police department on the second occasion that this happened.
And um people from the tattoo shop were very resistant to the concerns.
There was myself and another um neighbor there.
There was a lot of resistance to the concerns of the neighbors during that conversation in the parking lot with police present.
Do you have any other questions?
In the future, would it be easier for you to have your issues addressed if you had a direct contact for the owner?

And perhaps you guys can exchange information in the hallway afterwards.

Uh, and you know, after numerous events last fall, uh district six has engaged uh had a uh personal direct meeting with the owners of the business and uh come to uh a number of uh good conclusions for neighborhood cohesion and peace.
Uh I have seen uh or heard of no incidents since uh last fall, uh which is encouraging.
And um I don't know if um Lieutenant Velasquez had looked something up why incidents weren't reported under this address or was it a different address in the same strip mall?
Yeah, so we I check when we check a license we review the our call for service log uh with the address and there's nothing in there as well as our tableau system and there's no calls related to the events.
My suspicion is when they're calling, they're not giving the actual tattoo shop.
Like you said, it is a strip, so unless it's specific to in the CAD notes that it's a tattoo, there's really no way for us to verify if the district would have filed any licensed premises reports.
Maybe we'll need to um ensure that the new District 6 for early shift cap uh lieutenant uh keeps uh keeps tabs.

I have been in talks with both um the applicant's husband as well as um their attorney, and so I'm um eager to hear their comments today on how we're going to rectify the matter at hand.

Um yeah, the the objection here is about uh parking of delivery trucks on on the street, 25th Street adjacent to the property.
So there's a number of issues that m have made it difficult for these trucks to get into the parking lot.
Um and I've had this conversation with all the persons on Maripa, at least in part, but I want to explain kind of what they're doing to address it and what those concerns are.
So the the first issue is that this used to be a Walgreens, and my understanding is the Walgreens was able to get smaller truck deliveries, whereas the grocery store not all of their trucks are are the large semis, but um uh about half of them or a good majority of them are very large semis that it's harder to get to pack into the the lot itself.
So Jose and um the business, they're gonna contact their vendors and delivery drivers to see if they can request smaller trucks.
I understand that they've brought this up in the past and that they were told that these larger trucks are delivering to multiple locations.
Um so while the uh hacienda's grocery store isn't receiving the full truck, uh, they may only have half the truck.
That's that truck is going to the next location nearby.
Um so they are gonna request that they can have their solo truck delivered, but that's a little bit out of their hands, um, but they are making that request uh to all of their vendors.
The second issue is just the number of cars in the parking lot.
Uh again when this was a Walgreens, they had uh I mean my my guess is that they had a lot fewer employees and customers in there than a full service grocery store.
Um they have forty employees on staff and they've been using the back lot for their employee parking.
Um should I pause?
So that part of the employee parking is where this loading zone, the loading zone within the parking lot is.
So they're gonna have you know, today they've already notified their managers to have employees park elsewhere so that there's more space for the trucks to get into the actual lot so that there's no need for the trucks to park in the street itself.
Um management is also contacting the vendors to notify them that they have to park in the lot and they're getting schedules of when they're set to appear, and employee or staff will be outside notifying the drivers uh upon delivery that they need to pull into the parking lot itself.
Yeah, that's the order we have given them.
And then, you know, hopefully with the the open or more open space with employees parking elsewhere, they'll have an easier time getting in that lot.
But in addition, that's that's the immediate steps that they're taking, but they have also applied for a loading zone permit on 25th street um for 90 feet.
I did confirm that was received and it's in the process I believe of getting approval from DPW uh before it advances to the alder person.
