15:06 I'll keep losing Otto and Pratt.
15:11 Welcome to Judiciary and Legislation.
15:13 I am Artoman DeAndre Jackson to my right, Otterman Westmoreland to his right.
15:18 Otherman Baumbaum, Ottawman Pratt and Ottoman Perez will be joining us shortly.
15:25 So let's get underway.
15:27 Two five one six three three resolution related to the claim of Cooper Horn.
15:44 Horn, um, contacted us.
15:50 And I believe this item can be placed on file.
15:52 That's no longer needed.
15:55 Alright, Ottawa moves a place on file.
15:57 Hearing no objections, so ordered.
15:59 We've been joined by Audible Man Pratt.
16:01 How you doing this morning?
16:08 All right, that's good.
16:08 That's always good to hear.
16:10 All right, item two, two five one nine one five.
16:13 Resolution related to the appeal of Mayola Eris for property damage.
16:21 Adias contacted us after we received the hearing notice, and he said that he had an emergency treatment out of the country that he was unable to work on.
16:28 Now is this the first?
16:29 This is the second time to go sketch on it.
16:34 Alright, move to hold for the second time, not appearance.
16:36 Hearing no objections by Ottawa Westmoreland.
16:39 Hearing no objections, so ordered item three, two five one six two eight.
16:43 Resolution related to the claim of Silva Jax.
17:07 Knox uh brings us claim uh in relation to an alleged wrongful arrest and police misconduct, uh in relation to a domestic violence incident at 4649, North Twenty Ninth Street on September 14th, 2025.
17:21 Knox is requesting a million dollars in damages.
17:23 Uh police reports show that a domestic incident arose uh at that location uh involving uh his child's mother and himself.
17:32 Uh the child's mother called nine one one and MPD responded and conducted an investigation, ultimately arresting Mr.
17:39 Knox for disorderly conduct.
17:41 Uh the city attorney's office has recommended denial because MPD was not negligent and acted within the scope of their duties.
17:52 Um don't disagree with anything that the city attorney's office said, I do want to just remind this committee though.
17:56 Um I did do a record search.
17:58 Um it appears that this case is pending in circuit court with a final pretrial on August 27th, 2026.
18:06 Um given that pending litigation um and Mr.
18:09 Knox's Fifth Amendment rights, um, we're not compelling him to speak here today.
18:14 The police department.
18:15 Anything to do today at the office?
18:18 I'll be bottom, what you think.
18:20 Well, I think we deny it.
18:21 He's got a lawsuit pending in circuit court.
18:23 That's where he can get before a jury, hopefully, and make his claim, and we have no ability to hand out a million dollars, so absolutely.
18:32 So that's the motion, bro.
18:36 Uh motion from Brother Knox.
18:29 Um, since it's a pending in court, we will be violating your fifth amendment rights by asking you questions and hearing your case out.
18:44 Um, I do have a question though.
18:47 Um, so after the hearing, am I able to appeal it or how would that work?
18:51 What you already go into circuit court.
18:53 So here is this your first step.
18:54 You you'll be going to circuit court anyway.
18:56 But since you already go on a circuit court for your regular case, that'd be the best place for presenting evidence and do all your legal.
19:02 Yeah, no, I'm I'm saying after I handle that, will I be able to come back to here?
19:09 Or it's just all handled at that level.
19:12 Because this will just be your first step.
19:13 Um you have to get a denial letter for us to sue us, I guess, properly, or sue us.
19:17 Um that's the right term.
19:19 Yeah, you you need a denial at this committee in order to sue us in circuit court.
19:23 So that city inserted court.
19:24 So I'm just I'm just curious, do you have an attorney?
19:30 Well then your attorney should be able to explain this process to you.
19:35 And so just so you're aware, uh, like uh the chair said, this is not the last step.
19:40 What happens next is that this uh file that the recommendation of denial will be referred to the full common counsel on July 14th, and then if that full common counsel uh adopts this com this committee's recommendation of denial, uh you will receive a formal notice of denial by mail.
19:55 And then once you've received that formal notice of denial, then you're you're free to file student circuit court.
20:01 Appreciate it, I'm gonna give you a paper that just says what I basically decided.
20:07 All right, item four, two five one six three zero resolution where it's a claim of Lawrence Howard.
20:16 Uh we did receive back that return the hearing notice sent out.
20:22 Um, I'm afraid to currently not sure why.
20:26 Yeah, he has a final pretrial on 7-9 of 26.
20:29 I'm not sure if he's in custody or not, but he has a felony case.
20:33 Maybe the same thing.
20:37 Well, so Autumn West Morland moves denial.
20:42 You have any questions or anything?
20:44 You just don't want to move denial?
20:48 Well, I'll move denial.
20:49 I mean, this is clearly a federal court type of case anyway, so let the Feds deal with it.
20:57 So, motion for denial is here by Ottoman Bauman.
21:00 Are you objecting to the motion of?
21:04 I mean, correct me if I'm wrong, because the city attorney's civil rights violations do not require this notice of claim.
21:12 Any civil rights violation can go straight to federal court.
21:14 So coming here is truly superfluous and almost a waste of time.
21:20 So Autumn Bomb denial, hearing no objections.
21:30 Maybe you mentioned my thing.
21:32 I thought you was naked, man.
21:34 Resolution resident.
21:39 Resolution relates to the claim.
21:41 Anthony Phillips, George, on behalf of LaShawn Johnson.
21:58 Uh, this uh case involves uh, well, Mr.
22:01 Johnson alleges that he sustained personal injuries on August 19th, 2025, while he was a passenger in a vehicle driven by Arthur Sikiski, who was being pursued by Milwaukee police at a high rate of speed and lost control and struck a legally parked vehicle near West Mineral Street and South Fourth Street.
22:20 Uh he seeks the 250,000 dollar cabin damages.
22:24 Um I should note that this case is already in suit as it has been over 120 days since the uh claim was filed.
22:33 Um but our investigation showed that the um the the actions of uh MPD in pursuing this vehicle uh were not negligent and uh were within the uh uh their their duties.
22:49 Yeah, James Lewis police risk manager, given the cases in litigation and the amount claimed here.
22:54 We uh don't want to comment on it um other than what the city attorney's office has provided.
23:00 And attorney, you just hear for a denial letter, yeah.
23:02 Attorney Jonathan Major, I present Sean Johnson.
23:05 Attorney Georges is not here.
22:59 I know that it did say that he was going to appear, but our position is that we disagree.
23:11 Um, but you know, ultimately we'd want to get this resolved through um court proceedings here, so denial.
23:16 All right, we've denial, yeah.
23:18 Alright, all my bottom moves denial.
23:20 Hearing no objections to order.
23:22 Uh so the recommendation of this committee uh denial will be uh transferred to the uh full common council uh the full common council uh adopts the this committee's recommendation of denial, you receive a formal notice of denial by mail uh in which you have satisfied the statute of prerequisites to file suit in circuit court.
23:44 All right, thank you.
23:46 Have a good one, thank you.
23:47 Item six two five one eight three five resolution related to the appeal of Ivan Krushlin for bodily injury sustained.
24:01 Oh we got Peter Pigellas on the board.
24:07 This is the first time.
24:10 I believe this is the first time.
24:12 I believe it is, but I moved to Well, this one is a jurisdictional objection, correct?
24:21 Notice the claim was not filed within 120 days.
24:25 How far away from 120 days were they?
24:28 Uh about six months.
24:34 Or you gotta withdraw your motion.
24:36 I will draw my motion.
24:42 Hearing no objections, so ordered.
24:46 Item seven, two five one nine three two resolution related to the claim of Kenyatta Brumfield.
25:01 Okay, Miss Brunfield.
25:06 I have not heard from those individuals.
25:10 This is the first time.
25:13 Move to hold item seven for non-appearance.
25:16 The non-appearance will be recorded moving forward.
25:21 So move to hold by Otterman Westmoreland.
25:24 Hearing no objections, so ordered.
25:26 Item eight two five one eight five two resolution relates to the claim of Logan.
25:31 Henrich, and Thomas Robert.
25:38 I'm not a Logan, I uh we had requested uh to be put out at a different meeting.
25:43 I showed up just in case that message wasn't received.
25:46 So I'm prepared to present if uh if it's efficient, but um I mean I was gonna move the whole, but if you hear if you feel like it, you know, it's up to you.
25:54 Uh, you miss your hand right?
25:56 And my colleague Tom had contacted to schedule, I think, for the next meeting.
26:00 If that's possible.
26:01 I mean, you prepared today.
26:03 I want to push you into going forward and you know we have problems.
26:05 I mean, are you okay?
26:11 I don't have my file.
26:12 I was told this was moved, so I didn't bring my file.
26:15 I I was not expecting us to hear this case.
26:18 So if if we want to move, some of you want to temporary hold to go get it, and we'll just I can if you give me five minutes, I can run to my office to unpack.
26:24 We just we hadn't prepped for since we were told that it was moved.
26:28 So um we'll we'll hold this.
26:30 Just give us about 20 minutes and we'll hear you again.
26:33 Alright, thank you.
26:43 Resolution related to the claim.
26:44 Oh, Charlie Mickle.
26:48 Just another one that's moved to hold.
26:50 Chair, we got a phone call over the weekend that they were unable to appear at this morning hearings.
26:59 And he's the first time.
27:00 Arnold Perez moves to hold.
27:02 First time non-appearance will be recorded here.
27:04 Hearing no objections, so order.
27:07 Item 10, 260203, resolution related to the appeal of Julie Kaufman for property damage.
27:25 Alright, city Sorry.
27:27 Kaufman alleges that a city snow plow uh slid into her yard located at 360 North Gordon's Circle on March 16th, 2026, uh causing damage to their landscaping.
27:29 Uh she requests uh $1,300 uh in damages for uh land further landscaping to to remediate the damage.
27:46 Um our uh investigation showed that uh fleet records indicated no snow plow or rear end loader was in the area during the date and time of the accident, uh so we cannot confirm uh the allegations of Miss Kaufman.
28:02 Uh the city attorney's office has recommended denial uh because the city is not liable for damages, which cannot be cooperated, corroborated by evidence.
28:12 All right, departments.
28:14 Um it's fleet operation training supervisor.
28:18 Um, our findings are consistent with the city attorney.
28:26 Oh, you have anything?
28:28 So um, so um, I guess I'll just jump right into it.
28:35 Do we have any um proof, any video, anything that we could use to, you know?
28:40 Um, do I have I took pictures?
28:43 I mean, I can't what I have is what I submitted in my letter.
28:46 I mean, I I'm compelled to show up just because basically the denial is I fabricated the story, I guess.
28:52 Like that's the only you're not saying it you weren't you were just saying you weren't there.
28:56 It was an epic snowstorm.
28:58 Um, if you're not familiar, I think it's worth understanding this block that I live on.
29:03 It's actually a very unique city area.
29:05 It's a small circle.
29:07 Um the only way to get there is at the terminus of Burleigh Street in River West.
29:11 You have to take burlay, it's a dead end.
29:13 And then there's a tiny little circle at the end of that.
29:16 That's the only way to access my street.
29:18 There are no there's very little setback.
29:21 The houses, there's seven tiny houses that sit almost right on the street in that little area.
29:26 So what happened is this snow plow came, it was epic snowstorm.
29:30 There's a school right there, and they were trying to turn around, and I'm kind of at the bottom of a hill, and we heard it because we were home because it was a snowstorm, and I ran outside, and the plow was straight, like almost at my house, almost hitting the gas meter.
29:44 It was frightening, so we assisted.
29:48 I mean, you can't really push a truck out.
29:50 So my husband was like trying to shovel.
29:51 Anyways, it took a long time, and we assisted the driver to extricate themselves.
29:57 And then he got away, and we were just happy he was okay.
30:00 He was very upset, and we were upset, and then by the time he was gone, and it was the middle of snowstorm, we're like, oh, our it's try it was trash.
30:09 You know, we didn't think to like in the moment ask him for his name or get anything.
30:12 So, anyways, I filed a report right away.
30:14 We had just done this landscaping.
30:16 I haven't lived here that long.
30:18 And um, somebody came out the next day, which I was really surprised from the fleet department, I think, or DPW.
30:24 And um, I talked to him and filed the report.
30:27 He never said anything about we weren't there.
30:29 So the only thing I suggested going back when it was denied is that maybe the route that they say there wasn't a route scheduled on that street in the middle of the storm.
30:39 Maybe there was somebody scheduled for Burleigh.
30:43 The only way for that truck to get out of there is to turn around on my street.
30:46 So maybe that's the reason they said there was nobody there.
30:49 I mean the truck was there, that's all I can say.
30:56 I feel bad for the driver.
30:59 Is it thousand a hundred?
31:05 Chair, I just have a quick question for DPW.
31:08 The trucks, the plot trucks don't have GPS on them?
31:11 Yes, they do, and uh our GPS shows no truck within 25 meters of Gordon Circle.
31:20 The earliest we were in the vicinity was 11 a.m.
31:26 on that day, and uh take a look at that.
31:32 Oh, that's interesting.
31:33 The dot is Gordon Circle, and the blue lines are showing the route travel.
31:41 And as as you can see, the truck did not go inside Gordon's circle.
31:50 Do all the trucks have GPS?
31:54 So these photographs were you you took showing big heavy tire tracks and showing where plow stopped.
31:59 Yeah, I don't know what to tell you.
32:00 I mean, that is fascinating to me that you have GPS, but.
32:04 Maybe it wasn't functioning.
32:05 I mean, bottom line is uh I think your story is credible.
31:59 Uh you have photographs you physically witnessed this.
31:59 Uh yeah, we participated.
32:16 Any other questions about committee?
32:18 Move pro bottom movement approval by autumn and bomb and it's on the floor.
32:24 Hearing announced order.
32:26 Thank you for the other question.
32:27 So uh the city attorney's office will be in touch regarding payment.
32:39 A substitute ordinance related to the revision or various provisions of the code for purposes of correcting errors, clarifying language, eliminating obsolete provisions, and updating references.
32:55 Good morning, members of the committee.
32:56 Uh Christopher Hillard, legislative reference bureau.
32:59 Um so I'm sure you're all familiar with these.
33:01 We do them periodically just to sort of clean up the code.
33:04 Um so if you have any questions, I'm more than happy to answer them, but otherwise it's just no substantive changes, just making sure that everything is accurate when we come across errors.
33:15 So let's see, why don't we uh look at the first one here?
33:18 Uh well the first one actually is um uh for the definition of uh uh uh commissioner um in chapter 79.
33:27 Uh we uh we added or her um to make sure that that reflects um something that is gender neutral.
33:32 Um before it just said him, yeah.
33:35 So we we can have women commissioners?
33:37 Yeah, technically now it is permitted.
33:39 Um so that that's one of the ones we come across.
33:42 Um the uh part three here, um change of uh license clarific uh classification.
33:48 Um there we noticed that the um the reference to the code just wasn't correct, so we updated it to make sure that it's correct, so it was um eighty-one forty-four point seven-seven, and it's actually supposed to be dash five.
34:00 Um so it's it's mostly things like that um that are in here.
34:04 Um the next one was one for um uh loitering of uh sex offenders.
34:10 Um that one it was um the way it was written was not completely clear.
34:16 Um what um so it says a section shall not apply uh where the actor was by his or her parent, um which is kind of Milwaukee speak, um having them buy someone, so we yeah, included accompanied um to make sure that that was more clear.
34:32 Um so it's it's uh it's all things like that.
34:36 But we go through the ordinances to take out sort of obsolete and historical language that no longer applies.
34:44 For example, mashing is still illegal in Milwaukee.
34:50 Okay, I'll take a look at that one.
34:52 We can add that to the next revisor spell.
34:56 Do you go back and clean up like, you know, where a sleeveless shirts was illegal like in 1910 or something like that?
35:01 Yeah, um I mean if we come across that sort of thing, certainly.
35:04 Although some of that is is um would have to be a policy change.
35:07 Yeah, so that would have to come from the council.
35:09 Um so most of the things that we try to deal with with these are all non-substantive, it's just making sure that it is accurate.
35:21 Any other questions?
35:21 I'll look up mashing though.
35:23 All right, Otum Westmola moves uh.
35:41 Autumn West Mola moves adoption.
35:43 Hear no objections?
35:48 City attorney, update on that one case.
35:51 I think we we hit into closed session next.
35:53 So uh yeah, I don't know where Gori is.
36:01 Five minute recess.
36:02 Alright, this is warp speed.
38:36 I think I didn't think that we've got a little bit of a little bit of a one at the end.
40:10 It wasn't until it was like where's our second person?
40:18 Oh, the usual item.
40:22 So we'll reconsider order Westmoreland move to reconsider item eight, two, five, one, eight, five, two.
40:31 Resolution related to the claim of Logan Henrich and Thomas Reverend.
40:35 Otherwise, one of moves to hold.
40:38 Hearing objections, so order.
40:49 We are joined in person by Auto Woman Prep.
40:52 Auto one prep moves us into closed session.
40:56 The Judiciary and Legislation Committee may convene into closed session on Monday, July sixth, twenty twenty six in room three or one B City Hall.
41:04 Two hundred East Well Street, Milwaukee, Wisconsin.
41:06 Pursuant to section nineteen point eight five one G, Wisconsin statute for the purpose of conferring with the city attorney who will render or written advice which represents to litigation in which the city is or is likely to become involved, and then may go into open session for regular agenda items.
2:39:02 Item twelve, two six zero three one six.
2:39:06 Resolution related to the first amendment to agreement with Alsa Council to the matter of Anton Young versus City Milwaukee.
2:39:15 Yes, for the reasons stated uh in closed session, the city attorney's office recommends approval.
2:39:24 Hearing objections, so order.
2:39:27 Thirteen, two six zero three three eight.
2:39:30 Resolution authorizing settlement of the claim and the lawsuit entitled Metropolitan Associates versus City Milwaukee.
2:39:36 Yes, for the reasons stated in closed session, the city attorney's office recommends approval.
2:39:55 Yes, for the reasons stated in closed session, the city attorney's office recommends approval.
2:40:00 Um, Auto Most Motor moves approval, hearing no objections, so order.
2:40:04 That concludes the judiciary and legislation.
2:40:37 I didn't know it would be this addictive.
2:40:40 I didn't know how far I'd go to get more.
2:41:49 I couldn't hear anything.
2:41:52 I was completely stunned because I had uh such a bad concussion.
2:41:57 It was literally like uh house gate.
2:42:00 I am very lucky that I could walk away from that, but a lot of people aren't speeding.
2:42:06 We can live without it.
