0:20
Oh, it's just unplugged the HDM.
0:28
It's been oh you're gonna give it to Roxanne.
0:32
I just have a question.
0:33
Do you have any voting on approving tests or just investigating that today?
0:36
Uh there's a forwarded recommendation to the city council that will happen today.
0:40
So it's not a vote yet too.
0:42
Uh the city council, you'll hear about that.
0:45
I'll mention all of that in my presentation if you want to give um Roxanne your cards.
0:54
If you if you want to speak though, um just give her the case I do, but I think what I'm going to do is save it for another time.
1:02
You don't want to speak today then.
1:03
Uh yes, that's correct.
1:06
This is all public record, so it doesn't matter.
1:11
I mean, I wanna make a we are making a decision, but it's a recommendation.
1:18
So if you want to speak, you should you should if you want to.
1:25
You can do it twice.
1:26
You can do it right now.
1:27
Right, you can do it at the council meeting too.
1:29
He agrees with me that it shouldn't happen now that we'll probably go through the lawyer.
1:33
And then that'll be okay.
1:36
Um, okay, we're live, so I'm gonna get started.
1:39
Uh so good afternoon, and welcome to the administrative zoning and subdivision committee hearing of August 13th, 2025.
1:46
My name is Amber Blazinski.
1:48
I'm presiding over the hearing today as the zoning administrator.
1:51
Um, and I'll call the meeting to order.
1:52
I have no clock at 4 02 p.m.
1:55
Um, so section two of the agenda is roll call.
1:58
I have with me Quinn Breyer, principal civil engineer, and together we um comprise the subdivision committee for today's hearing.
2:05
Diana Fazelli, assistant city attorney is not present today, um, but we have a quorum with two of the three subdivision committee members present.
2:13
Um, today's hearing will operate in a hybrid format.
2:16
Staff, the applicants, and some community members are in person.
2:20
However, we'll also ask if community members joining us virtually uh want to speak on an item at certain points in the meeting when those opportunities arise, typically during the public comment portion of each agenda item.
2:32
Members of the public wishing to comment may do so by clicking the raised hand feature in Zoom when I announce the item on which you wish to speak.
2:40
Speakers will be notified of their turn shortly before they are called on to speak.
2:44
If you have phoned in today, then please dial star nine to raise your hand at that time.
2:48
Uh when if you dialed in by phone, if you are called on to speak, please press star six to unmute yourself.
2:54
And all speakers virtual or in person have three minutes to provide comments.
2:59
We don't want to share that way because it doesn't go into the zoom link.
3:02
You have to be in Zoom.
3:07
So I'm sorry, we're having a little technical difficulty.
3:10
So let me just sort this out.
3:14
So can you connect in the Zoom?
3:16
And then she can just see.
3:19
Um because I don't think it shows otherwise.
3:22
Um, so uh all speakers virtual or in person, we'll have um two to three minutes.
3:28
It'll depend on how many speakers there are to provide comments.
3:32
If you're in person, wish to comment on either of the items, please fill out a yellow speaker card for us so we're able to accurately spell your name for the meeting minutes.
3:45
Okay, you can join the panel.
3:51
Okay, so the next portion of the meeting is oral communications from the public.
3:55
This is the time set aside for persons wishing to address uh the zoning administrator on any items that are not on the agenda.
4:02
Um speakers are limited to three minutes, and state law prohibits any action on any item which is not on the agenda.
4:08
So is there anyone uh who'd like to speak on any items that are not on the agenda?
4:14
I don't see anyone in the room.
4:16
Is there anybody online, Roxanne?
4:20
So do you guys need me to take to the pause?
4:27
We're just gonna take a quick break while we get this presentation ready.
4:32
I can't again I'm by the one.
4:38
Are you hearing because it's a bad thing?
4:43
Because the HDMI is not good.
4:45
Because it shows okay.
4:47
All right, you're in there now?
4:48
Okay, so um we'll now move on to section four of the agenda, which is the joint administrative zoning and subdivision committee portion of this public hearing, and we have one item to discuss.
4:59
Item 4.1 is 266 to 272 Tyrella Avenue with a request for a development review permit to construct a four-story 47 unit residential condominium development, utilizing state density bonus law, a heritage tree removal permit to remove eight heritage trees and a tentative map for condominium purposes to create one common lot and 47 residential condominium units on a 1.0 acre project site.
5:25
And a recommended determination that the project is categorically exempt pursuant to section 15332 of the CEQA guidelines.
5:33
It's important to note that the decisions made on this item will be in the form of a recommendation to the city council who will make the final decision on this project at a public hearing that is tentatively scheduled for September 23rd, 2025.
5:48
So we'll now have one staff presentation, one applicant presentation, and one opportunity for public comment on the item, but then we'll break up the decision on the development permits and the vesting tentative map when making actions at the end of the public comment portion of this hearing.
6:03
I will act as a zoning administrator on the request as it relates to the development permits first, and then the subdivision committee will act on the request for the vesting tenative map.
6:13
Krisha Penolar is the project planner.
6:15
Krisha, do you have a presentation for the committee?
6:20
My name's Krisha Pinoliar, Senior Planner, and I'm here to present the proposed project at 266 and 272 Tyrella Avenue.
6:29
So the project's site is located on the west side of Tyrella Avenue across Kito Drive.
6:34
It consists of two parcels totaling in 1.01 acre size.
6:39
And the site is primarily surrounded by two-story apartments and condos as well as one-story single family residential.
6:49
The proposed project scope includes a development review permit, heritage tree removal permit, and a tentative map.
6:55
The proposals to construct a 47-unit four-story condo building above one level of underground parking, uh removal of eight heritage trees, and combining the one two parcels to one common parcel and 47 residential condominium units.
7:14
The proposed project is utilizing a state density bonus request.
7:18
This project is eligible for a 42.5% state density bonus, which could qualify it for a 52 total units, but the project is only proposing 11 density bonus units for a total of 47.
7:32
No incentives or concessions are proposed, but the project is requesting four waivers, and those are to the maximum height.
7:40
The minimum setbacks for floors two through four, maximum floor area ratios proposed to increase, as well as the maximum site coverage.
7:51
Staff has reviewed the project and finds it consistent with the general plan and zoning.
7:56
Staff also recommends that the project qualifies for a categorical exemption under section 15332 and recommends zoning administrator and subdivision committee approval of the project as well as the map.
8:10
And staff is also available for any questions.
8:15
So it's now the applicant's turn to make a presentation.
8:18
We don't have our podium today, so I think if you can just stand and face us, yeah.
8:23
I just introduced myself, Bill Maston, architect for the project.
8:28
We've been uh working on this project for a number of years and interacting with staff on many levels to make sure that we have the project that we have today.
8:39
Um believe it or not, though the um site seems simple, it's actually complex when you uh address issues as far as access um uh fire, um, life safety, um, and even um taking advantage of as many of the existing trees on the property as possible.
9:02
So in general, um, we believe we've done a um a good job working with staff to come up with a project that uh it seems to be um liked by most that I've talked to.
9:16
Um, really I'm just here to answer any questions, either of staff or those in the audience with.
9:26
Nope, uh that it doesn't happen.
9:28
Yeah, we'll we'll let you speak though.
9:30
Um we'll now open the item up for public comment.
9:29
So I'm just getting a show of hands.
9:39
Are people in the room speaking on the item?
9:42
If you can raise your hand, and and if when you're finished speaking, you can fill out a yellow speaker card over there for Roxanne, so we accurately spell your name.
9:51
Uh so two in the room, and then um Roxanne, are there people online who have their hands raised?
9:59
Okay, so um, I'm guessing they're okay.
10:03
Let me just give them a minute.
10:04
So people online, if you're if you're wishing to speak on this item, please raise your hand.
10:09
Um I think you'd are a star nine if you called in.
10:13
Okay, so I'm just seeing a couple.
10:15
So whoever wants to go first, can you please uh come on up and stand up here and just directly just face us?
10:22
It's and you have uh three minutes.
10:26
Yeah, just face us.
10:27
This is gonna be very uh quick.
10:30
Uh I'm Len Abrams and uh I live on ADA, and I wanted to ask Bill uh how many uh uh just ask us and it will direct questions.
10:44
Spaces underground are there going to be per unit because on Torella, there's a lot of double parking already, and uh actually I had to divert my route uh once because of an accident at Torella and Middlefield that you probably know about, uh about what two months ago, something like that.
11:09
So I wanted to make sure that there was enough underground parking so it didn't further aggravate the uh situation on Torella.
11:23
Yeah, anyway, sorry.
11:28
Is it possible to put the map back on there?
11:30
Uh, yeah, I think we can put the map up there.
11:33
Everybody can you want the site plan or the map?
11:39
The site planning the thing that you just that we were looking at.
11:42
See the whole building.
11:43
Okay, yeah, and then you have three minutes.
12:00
Okay, so um I'm living in one of the units right on the side here on Easy Street on 227 AZ Street and 2 to 9 Easy Street belong together.
12:11
So we are actually right on the other side of the fence.
12:14
Um, we have a few questions because I talked to two to one easy street is is right here on this side right there.
12:24
I hope I'm correct.
12:25
Yeah, I think that is right.
12:27
Um, question is the timeline.
12:31
When are you guys starting?
12:32
How long will it take?
12:34
How much of dirt, how much of noise?
12:38
Um, will this all be you know um creating for us?
12:44
Second question is, is there an easement between these condominiums right here and here on that fence line?
12:57
Third question is what trees will stay?
13:00
Because most of the trees I would say get rid of them.
13:04
They are a huge mess on our side, and they don't even belong on our side, and that is really annoying.
13:12
And we have to clean it up and also nobody is attending to these trees.
13:17
They're just growing all over the place, and nobody cares.
13:22
Um I can think of anything else I had them all in my head.
13:28
Um I don't think anything changed from the last time.
13:33
I believe it's one uh parking space underneath pair units, correct?
13:39
Um we just have to learn to have less cars, like in Europe.
13:44
So just uh commenting on that, I think that would be great because I'll have my neighbor across from me has six cars and two adults, which is uh unbelievable.
13:57
Just to say that as well.
13:58
It's not necessary.
14:00
Um I think that's it for me right now.
14:07
Um, okay, so uh anyone online, Roxanne?
14:13
Um, okay, so I'm going to um go ahead and close the public hearing.
14:20
Um, Bill, can I ask you, please, um, to if you have any indication on timeline, if you want to maybe answer that question.
14:28
Uh, timeline at this point is probably a minimum of two years, the way things are going with the approval process um before we would see construction start, uh we'd be then looking at two years of construction time from start and finish.
14:47
Um, and then um, I think uh Krisha, do you want to confirm parking spaces per unit?
14:56
Yes, so the number of parking spaces per unit is correct, it's one per unit for a total of 47.
15:04
Okay, um, and this uh project is within a half mile of transit, so there actually is no parking.
15:11
You we we can't do that.
15:12
Uh, there's no um parking requirement.
15:15
So um, you know, 47 spaces, um one per unit is is all we can require.
15:24
I mean, we can't require it, but is what we're we're getting from this project.
15:28
Um the easement question, I'm not certain.
15:35
Um, so I'm not aware that the project will be dedicating any easements very quickly.
15:40
I was trying to check if there are any existing.
15:42
Um, it does not appear like it, but um, we can definitely confirm that.
15:47
And then um, I think on the tree question that you had, um, I think maybe you and Krisha can just talk maybe after the meeting and she can show you their landscaping plan if that's okay with you.
16:02
Um, okay, so uh with that being said, um, so as the zoning administrator, um, I will act on the permit requests for the development review permit and the heritage tree removal permit, and also make the recommended determination that the project is categorically exempt pursuant to section 15332 of the CEQA guidelines.
16:26
Um, and so I move to approve item 4.1 based on the findings and conditions posted online and the application materials reviewed um by city staff, including all public comments submitted prior to and at the hearing, with the reminder that my decision is a recommendation to the city council who will take the final action on the development permit requests.
16:50
Um and now I'll bring the item back to the subdivision committee to discuss the tentative map.
16:55
Um, do you have any questions, comments, or want to make a motion?
16:59
Um I'm right here to make a motion.
17:02
So I make a motion to recommend to the city council to approve the tentative map subject to the conditions of approval and in conformance with the general plan and zoning code.
17:12
And I'll second that motion.
17:13
Um and I'll ask Miss Rutherford to do a roll call vote.
17:20
All right, so a motion of approval for item 4.1 was made and passed unanimously by the subdivision committee.
17:26
Again, with the reminder that our decision is a recommendation to the city council who will take the final action on the map request, and that's tentatively scheduled for September 23rd, 2025.
17:36
Um, so this concludes our public hearing today at 417 p.m.
17:40
And if anyone has any follow-up questions on any of the items, then you can contact the project planner.
17:54
Do you have a question about the distance between the trains?
17:57
Yeah, we have a map actually.
17:58
It's it is unfortunately it is.
18:00
Unfortunately, it's not available.
18:02
It's not gonna be a level one.
18:04
But you said we need to be true.
18:08
Yeah, so um what we go by is what does it as a bird flies?
18:13
Yeah, but from the parcel.
18:07
Yeah, the bird flies, so I think it's a requirement.
18:18
The bird, we have to listen to the bird.
18:20
The birds are going to be flying from the apartment complex over too.
18:24
Well, then just if we just have birds in that unit, it should be a little bit of stars.
18:27
Yeah, so we have to have any cars.
18:31
So I think a lot of it is being stopped for the world.
18:34
So I can send you what they're letters.
