Yes, thank you, Mr.

1:24

Chair and members of the Commission.

1:34

And without further ado, I'm going to pass it over to Christopher Davis, our senior planner.

1:41

Thank you, Mr.

1:42

1:43

Good evening, Mr.

1:44

Chair and members of the Commission.

Christopher Davis with Community Planning and Development Services Department.

1:48

As Mr.

1:49

Rossleck indicated, this is a project plan amendment, PJT 2025 00023 for 41 and 44 Maryland Avenue.

1:59

This represents the momentum at Rockville Station Project.

2:19

As you'll see, the project will come back to you at a later stage for recommendation.

2:27

So the project site is outlined in red on the screen.

2:30

It is 41 Maryland Avenue.

2:33

It is located in planning area one corresponding to the town center, and it's approximately 0.42 acres.

2:41

It has a land use designation of commercial and residential mix and a zoning classification of PDRCI corresponding with the plan development for Rockville Center Inc.

2:52

and an equivalent zone for the mixed use transit district.

2:56

As you can see, the property is currently developed with an on-sur a surface parking lot at the corner of East Middle Lane and Maryland Avenue.

3:06

As you can see, this area is further developed with properties surrounding mixed uses.

3:22

So the specific proposal by the applicant is to replace the existing surface parking lot with a 12-story multifamily building that would include 147 affordable housing units.

3:59

And to further uh implement that change, uh the proposal is to amend the plan development for certain use and site standards.

4:09

In addition, the applicant proposes to replace certain MPDU units uh classified for the confronting 44 Maryland Avenue property with MPDU units in the subject project.

4:26

So to outline the review process, uh the applicant has completed their pre-application requirements, including an area meeting on January 21st, 2025.

4:38

Uh, following the pre-application stage, the applicant has submitted their project plan amendment application and completed their post-application area meeting, which was completed on April 29th, 2025.

4:50

Uh further steps include uh the applicant DRC meeting, where staff will provide comments on the proposed project that is scheduled for May 29th, and the mayor and council will receive their briefing next Monday on May 19th.

5:09

So the next steps include the applicant finalizing review of the project plan amendment application taking into account comments received by the planning commission and mayor and council in addition to public comments at the area meetings, and we'll revise the application as needed.

5:26

The application will then come to you for your recommendation at a future planning commission date before proceeding to Mayor and Council for their consideration to include a public hearing and possible adoption.

5:55

The applicant has a presentation to follow.

5:59

Do any of my commissioners have any questions of staff at this time before we hear from the applicant?

6:04

Nope, hearing none.

6:06

Please come forward, ma'am.

6:07

And I think Mr.

6:08

Wassock has to put you under oath.

6:13

So good evening, Nancy Reglin from the law firm of Shulman Rogers here on behalf of SEG Development, which is one of the applicants that is the affordable housing developer, Comstock 41, which is the owner of the surface parking lot, and Compstock 44, which is the owner of Boulevard 44 confronting the property.

6:35

The presentation tonight is going to be presented by Kirk Salpini of SCG Development.

6:41

And then he and I will be happy to field your questions.

6:45

And we do have a lot of our project consultants in the audience today.

6:49

Should any questions we need to go to them for referral?

6:53

So at this time, I'd like to pass this over to Mr.

6:56

Summary of Proceedings

Rockville Planning Commission Meeting - May 14, 2025

The Rockville Planning Commission held a briefing on a project plan amendment (PJT 2025-00023) to permit a 12-story, 147-unit affordable housing building at 41 Maryland Avenue with zero on-site parking. Commissioners also approved three sets of minutes and received a staff liaison report on upcoming meetings.

Project Plan Amendment Briefing (PJT 2025-00023)

  • Applicant Proposal: SCG Development and Comstock Companies propose replacing a surface parking lot at 41 Maryland Avenue (0.42 acres) with a 12-story multifamily building containing 147 affordable housing units (50-80% AMI). The amendment seeks to modify the existing plan development for Rockville Center Incorporated to allow the building and a parking waiver (zero on-site parking).
  • Affordable Housing Benefits: The project delivers approximately 90 more affordable units than a market-rate project would require under MPDU rules. It also transfers 40 existing MPDU units from 44 Maryland Avenue (Boulevard 44) into a 99-year affordability covenant—extending the current 30-year covenant (20 years remaining) by about 83 years.
  • Parking and Transportation: No on-site parking is proposed due to the site’s narrow width (82 feet) making structured parking economically infeasible. The applicant cited the site’s transit-oriented location (near Metro, bus rapid transit, walk score of 93) and abundant nearby public parking garages. Two street-level parking spaces will be provided: one drop-off/pickup zone and one fully accessible ADA space on Maryland Avenue. The city will lose one metered street parking space (net change from 8 to 7).
  • Design and Height: The building is proposed at 120 feet above elevation 448 (well under the 200-foot MXTD zone maximum). The requested height provides flexibility to use alternative structural systems (e.g., cold-formed steel vs. concrete) as a hedge against tariff impacts on material costs, while still achieving 9-foot finished ceiling heights. The first floor includes lobby, club room, leasing area, mailroom, fitness, bike storage, and an internal loading dock to address community concerns about truck maneuvering.
  • Neighbor Impacts: The applicant modified balcony locations on the west side to avoid directly facing the adjacent Victoria Condominium. Building-to-building separation meets 30-foot fire window requirements. Only end units of the Victoria tower along Middle Lane will be affected—two units per floor. A second-level terrace is set 12 feet below the Victoria’s first-level patio.
  • Commissioner Questions: Commissioners asked about the tariff/height rationale, the number of impacted units in Victoria Condominium, and the location and net change of on-street parking. Staff clarified that the site has been approved for similar massing since 1994. Commissioner Fulton sought and received confirmation that the building would lose one metered space (8 existing, 7 after).

Staff Liaison Report

  • The next regular meeting is May 28, 2025, with a final record plat for Tower Oaks and a work session on the zoning ordinance rewrite (ZOR). A follow-up ZOR work session is scheduled for June 11, 2025, along with a final record plat and review of the development review process. The commission’s annual report will be provided at the May 28 meeting.
  • Chair Espinosa requested redistribution of meeting dates for the remainder of the calendar year to accommodate summer travel.

Key Outcomes

  • Minutes Approved Unanimously:
    • Meeting 18-2024 (November 13, 2024) – approved.
    • Meeting 19-2024 (December 11, 2024) – approved.
    • Meeting 2-2025 (February 26, 2025) – approved with a correction: the header changed from "2024" to "2025".
  • No correspondence was received.
  • The meeting adjourned without further business.
