Under Arizona law, the Board of Adjustment is considered a quasi-judicial body.

You are a set of judges.

You're not a city council, you're not a legislative branch, you're not a zoning administrator who who's an administrator.

You are considered a judicial branch.

You are charged with and entitled to rule on legal arguments.

Our courts have said that, and our courts have said to people in my position, if you want to go to court, you are required to go to thrust to the Board of Adjustment and make your arguments even though they're legal in nature, even though they might be constitutionally based, they might be statutory based.

That is within the province of the Board of Adjustment as a quasi-judicial body.

That's why we're here today, and that's why we believe not only are you empowered to rule on those legal arguments, but as a quasi-judicial body, as the Board of Adjustment, that you are obligated to rule on them.
