The Tempe Board of Adjustment met on November 20, 2019, to consider acceptance of the 2019 Annual Report and a variance request for a Del Taco restaurant at 1331 North Scottsdale Road. The applicant sought a reduction in required parking from 27 to 24 spaces (later corrected to 26 required, 24 provided). She argued the strict application of the code would deprive the property of privileges enjoyed by other similar properties, many of which are grandfathered or part of larger shopping centers. The variance request was reduced from 3 to 2 spaces after correcting floor area measurement from gross to net (building is 1,998 sq ft). She cited a recent Arizona Supreme Court case (Pond First) supporting area variances when special circumstances are not self-imposed. Staff questioned whether the applicant could reduce building size further, but Sender said it is at minimum size for operations.
- Staff Report (Diana Kaminski, Senior Planner): Staff recommended approval with conditions, including that the applicant provide a certified floor plan diagram and a pedestrian connection from Weber Drive. Kaminski noted the site has been vacant 24 years, and the combination of constraints makes development challenging. She compared the site to neighboring commercial properties that are grandfathered with larger buildings and less parking. She suggested that an alternative floor plan converting indoor seating to outdoor patio could reduce parking demand, but the applicant did not adopt that. She addressed safety concerns by noting that raised pedestrian tables (speed tables) could be considered at the Development Review Commission (DRC).

Is it every time you need to speak or just not sure something? Okay. Ladies and gentlemen, welcome to Board of Adjustments for November twentieth, twenty nineteen. Um I have a little preamble here. The City of Tempe Board of Adjustment is authorized by the Arizona revised statutes and the City of Tempe zoning ordinance. Its function is to grant relief where literal enforcement of the zoning ordinance would result in an unnecessary property hardship, to interpret provisions of the zoning ordinance for variances, and to hear appeals from any person or city official aggrieved uh by the decision of a person responsible for the enforcement of the zoning ordinance, uh such as a zoning administrator or hearing officer. Uh this is where it is odd. I think we need to adjust that. The board has the City of Tempe community development staff summary reports on the items being considered at this meeting, and we'll use their reports in their deliberations. All applicants and interested citizens, when your request is called, or when you wish to address the board, please make sure you have filled out one of the citizens' request forms located on the table by the doors. And please submit the form to a staff member before you begin speaking at the microphone. I'm gonna take another stab at that, because I'm not I want to use my own words. Um if you wish to speak on a case tonight, we can accommodate you. We have some forms over on that table. Sorry, I said uh sorry, it's Brittany Nelson, not Jonah Perry. You know, every meeting I get one. I space one. My apologies, Brittany. All right, so our first item of business is the uh consideration of the your report. Um I am I am led to understand that this has been reviewed and there have not been any edits or comments made to that. Is that correct? There are there are uh two airs that I see. But she might have already got them actually, because you mentioned that one of the attendance things was corrected for me. My date that I started was not 2014, it was the exact same date as Mr. Watson, 228, 2018. Okay. Any other corrections? Uh just how many how many absents do you have from me for it? Okay.
