2:47Members of the public may also attend the meeting virtually through Microsoft Teams.
2:51If you have signed up to speak on items on later on in the agenda, please know that as the presiding officer, I have the discretion to introduce items out of their regular order as listed on the agenda.
3:13If you wish to speak on an agenda item and you haven't filled out a speaker card yet, please make sure to fill out and submit your completed card to the city clerk prior to the item coming forward for council discussion.
3:22I will call your name when it is your turn for public comment.
3:25I would now like to invite everyone who's able and willing to stand to join us in a moment of silence followed by the Pledge of Allegiance.
4:27Continued disruptive behavior will lead to removal from the council chambers.
4:34Behavior that disrupts, disturbs, or otherwise impedes the orderly conduct of any city council meeting is not helpful and is not permitted.
4:46Should individuals inside the council chambers become disruptive so that city business is not able to be conducted.
5:00If no cooperation, the mayor will issue a verbal warning and let them know that the continued disruptive behavior will lead to removal from the council chambers.
5:07If there is still no cooperation, the mayor will issue a second verbal warning and let them know that the continued disruptive behavior will lead to removal from the council chambers.
5:16If there is no cooperation after asking and two verbal warnings, then the mayor will ask security officers to remove only those individuals who were causing the disruption.
5:24Security personnel should not engage in any way, but only escort them from the council chambers.
5:30If individuals refuse to leave, security personnel shall warn them that they are trespassing and that the next step will be arrest by a Tempe police officer.
5:38Tempe officers may have to arrest if individuals refuse to leave.
5:42Charges for trespass and disorderly conduct may apply, as well as other charges.
5:46Should anyone be asked to be removed, the mayor will recess the meeting.
5:52All right, we're now going to play a video conveying the city of Tempe's native land acknowledgement statement.
6:05We acknowledge that Tempe lies on the ancestral land of the Native peoples who have lived here since time immemorial.
6:18The ancestral land of the autumn and stretches far beyond the boundaries of our city.
6:29The landscape is sacred to them.
6:31Embodying cultural values that are integral to their identity and way of life.
6:43The autumn empty Bosch continue to maintain a deep spiritual connection to this land.

8:45All right, first up, item five A one, Kids Own Awards presentation.
8:51So the mayor's office and the Tempe City Council are interested in honoring outstanding children in our community and adults who help provide quality care and education for those children.
9:01Tonight we are proud to honor and recognize those children and adults because of their outstanding participation in the kids' oen enrichment programs, serving 16 elementary and middle schools in the Tempe Elementary School District.
9:13So to help me with this presentation this evening, it wouldn't be right if I didn't invite up the superintendent of the Tempe Elementary School District, Dr.
9:32So for those of you who don't know, but I'm pretty sure if you're here tonight, you already do know.
9:36So this is for the benefit, I guess, of those at home.
9:39Kid Zone is an award-winning, state-accredited school age enrichment program administered by the City of Tempe in cooperation with the Tempe Elementary School District.
9:48It offers an exciting, safe place for students from preschool through eighth grade, where they may interact with their friends and participate in enrichment activities and develop new interests after school.
10:00KidZone could not have provided these services without the help and support of some outstanding school partners from the Tempe Elementary School District.
10:07While there are too many to mention this evening, there are three we'd like to particularly recognize.
10:12The dedicated school partners we honor tonight are individuals who demonstrate cooperation, mutual respect, and knowledge of the importance of quality out of school time in Richmond.
10:22They understand that significant learning still takes place before and after the school bell rings.
10:27Their support exemplifies how cooperation between the city and the school district can work at the highest level to make exceptional programming available to students at each school.
10:38So please come down when I announce your name.
12:37They were selected by the Kid Zone staff from each school because of these three things.
12:42Their kind and respectful attitude towards other children and staff, their initiative and enthusiastic positive participation, and their display of cooperation, good sportsmanship, responsibility, and leadership.
12:55So as we read the students' names, we ask that you each come up front to receive your certificate and that you remain standing up front until all of the students have received their awards.
13:04I ask that you also hold your applause, which I should always say no one ever does.
13:09So I don't really expect you not to clap for your children.

18:45And whereas 2026 marks the one hundred and fifty-fourth anniversary of this holiday, which is celebrated around the world.
18:53And whereas during this month, city departments and staff engage with business partners, local organizations, and residents to appreciate and plant trees.
19:34Now, therefore, I, Corey Woods, mayor of the city of Tempe, Arizona, do hereby declare April twenty twenty six as Arbor Month in Tempe, Arizona.

20:42Next up, uh, Sexual Assault Awareness Month.
20:48And for that one, I've got Tim Birch, Jack Willyn Webster, Chris Charlotte, Anastasia Stenchfield, our Care Seven Victim Services Reps, members of the Tempe Police Department, and members of our family justice commission, if you could all come forward.
21:16Thank you for helping us everything.
21:27All right, so this proclamation reads, whereas the city of Tempe is proud to recognize Sexual Assault Awareness Month and 25 years of raising critical awareness about the impact that sexual violence has on children, youth, adults, and families in our community.
21:43And whereas Tempe supports this year's theme, 25 years stronger, looking back, moving forward, to honor the history and growth of the movement, and highlight the wide range of resources available today through Tempe's Community Health and Human Services Department and Tempe Police Department.
21:59And whereas sexual violence refers to any type of unwanted sexual contact in which a person did not consent.
22:06Consent cannot be given if a person is under the influence of alcohol or drugs, asleep, unconscious, or otherwise incapacitated or underage.
22:16And whereas the City of Tempe Family Advocacy Center brings together the expertise, dedication, and compassion of our care seven victim advocates and Tempe Police Department to offer free resources and support and includes an important partnership with Arizona State University and the support of our Family Justice Commission.
22:33And whereas the City's Care Seven Victim Services Team served five hundred and three individuals and families who reported sexual violence, including child sexual violence last year.
22:44And whereas the recognition of Sexual Assault Awareness Month shows support for all individuals and their families, regardless of socioeconomic status, gender, sexual orientation, or ethnicity.
22:55And whereas the City of Tempe urges all Arizonans to stand in solidarity to build a future free from sexual violence and create a world where everyone is safe, valued, and respected.
23:06Now, therefore, I, Corey Woods, mayor of the City of Tempe, Arizona, do hereby declare April twenty twenty six as Sexual Assault Awareness Month in Tempe, Arizona.

25:48Also, the next thing is item 5A4, which is sustainability and resilience commission appointment.
25:53I want to congratulate Brian Fellows on his new appointment to the Sustainability and Resilience Commission as outlined in item 7A1 on this evening's agenda.
26:02That brings me to item 5B, City Manager's reports and announcements.
26:05Uh let's see, Chief Deputy City Manager Greg Reese.
26:09Do you have any reports on behalf of the city manager?
26:16He so did that deliberately.
26:17He got my hopes up and they were dashed.
26:25All right, before we move into public appearances, I want to take a moment to address campaign related activity, especially that we are now in the 2026 election season.
26:33City council meetings are open to the public and are a vital form for civic engagement.
26:36We welcome all individuals, including candidates, to speak on matters of public concern during the public comment portion of the meeting.
26:43However, because this is an official city council meeting that is both televised and live streamed using city resources.
26:49We ask all candidates, including any current council members, to refrain from electioneering or campaign related activity while participating in this meeting.
26:57That means no discussing your candidacy, asking for votes or signatures, or displaying campaign materials such as signs, t-shirts, or literature while speaking.
27:05Thank you for helping us maintain the integrity and neutrality of our public meetings.
27:10Which brings me then to item six, public appearances.
27:14According to the Arizona Open Meeting Law, the City Council may only discuss, respond to, or take action on matters listed elsewhere on this agenda for discussion and legal action.
27:23The purpose of the open call to the public is to allow individuals to address the city council on any issue within the jurisdiction of the city council.
27:30No person shall speak more than once, and there is a limit of three minutes per speaker.
27:33In the interest of allowing all members of the public to have an opportunity to speak, in the case that there are such a large number of persons intending to speak during the meeting that it may deprive other members of the public from the reasonable opportunity to speak.
27:52Members of the podium shall refrain from making personal impertinent or slanderous remarks and from becoming boisterous while addressing the city council or while attending the meeting.
28:01Speakers will be taken first come, first serve in the order in which the cards are received.
28:05Speaker's visual aids and appearances by phone or recordings are not allowed.
28:08The city council was prohibited by state law from discussing, responding to, or taking action on matters raised during the call to the public, even if asked to do so by member of the public.
28:18So long as the subject discussed by the speaker is not listed as a specific agenda item for council's consideration for discussion and legal action.
28:26Individual members of the council may respond to criticism made by speakers, as staff to review a matter, or request a matter to be placed on a future agenda.
28:34With that said, I'm now gonna get to my list here.
28:37And let's see, the first speaker I have here is Dr.
28:48Uh Madam Clerk, is Dr.
28:50Wong in the uh virtual room by chance.
28:58That means I will go to my next speaker then.
29:00Uh that is Brennan Metcalf.

29:11Uh I live my name is Brenda Metcalf.
29:13I live in Tempe in the Lakes uh neighborhood.
29:17Um I just wanted to take a moment to um talk about something that is very crucial to our state, and that is water.
29:26Um so I was reading in my emails last week um when I was on vacation, a very sad situation.
29:34Um it seems like our state and the seven western states that are part of the Colorado River Compact have failed to reach negotiation.
29:42Obviously, the governor and other uh state institutions are in charge of that um negotiation with the states.
29:48Um the Trump administration is moving fairly soon.
29:52The Department of Interior to Implement its water compact.
29:56Um that is not good.
29:58Um Nikki being on AMO understands this.
30:01Uh I just wanted to say that you know, under that plan, um, interior plans to potentially cut um water releases from Lake Powell with Lake Mead to just 600 million, six, excuse me, six million acre feet, um, which is a 20% reduction from the amount that has previously been planned.
30:19Um, Tempe has agency in this flight, as do our other cities in the valley here, which have done a generally speaking a very fantastic job of conserving water.
30:28Um here in Tempe, we have the Cairo recomm water reclamation facility.
30:33Um and recently, Congressman Greg Stanton was here at City Hall.
30:36Um, and through the congressional appropriations process in fiscal year 26, got roughly a three million dollar earmark to help speed up construction on bringing that water facility back online.
30:47I know Tempe is not contingent, 100% contingent or even half contingent on the Colorado River negotiations, but I just wanted to urge the council to look at all possibilities to bring that online faster.
31:00Construction takes time.
31:01I understand that I'm not a wire scientist.
31:03But you know, Congressman Stanton has been a fantastic partner in this.
31:07Arizona State University is a fantastic partner in this.
31:10Um, and I just wanted to urge the council to continue working on that, get it done.
31:15Like, this is not, you know, everything depends on this water businesses, economic growth, our door day, Arbor month, everything.
31:22So just wanted to really thank you for your work on this.
31:25Keep it up and keep it going uh and speed it up.
31:32The next speaker I have is Danielle Davis.

32:11I've lived in Arizona my whole life, born and raised.
32:14I've been a resident of Tempe for a little over three and a half years now.
32:18Could you speak a little louder?

32:28I've been a resident of Tempe for a little over three and a half years now.
32:34I just want to say it's an honor to be a resident here and to be speaking in front of all of you.
32:40As a resident of the community, I wanted to talk about the quality of life in our neighborhood.
32:46I wanted to bring a few issues to your attention.
32:49Not because I expect any immediate resolution, but because if nothing's ever said, then nothing's ever said.
32:57Over the past three years of living here, I've watched the city regress.
33:01I recently went to Tempe Beach Park around sunset.
33:05Beautiful sunsets, by the way.
33:07No one's ever been there.
33:08I recommend everyone visiting there to see the sunset at least once.
33:17They have these posts with photos, and I got to learn about the swimming hole and the veterans memorial and the founders of the park.
33:25Like, I don't even think people realize that Tempe Beach Park is the place where the Hispanic veterans of World War II successfully abolished segregation.
33:33And Tempe is a central hub for aerospace and defense expansion.
33:38These things are history.
33:40And it makes me really, really proud to be a resident of Tempe.
33:43But unfortunately, when I was at Tempe Beach Park, I was approached by a student.
33:49She asked me what I was doing there.
33:50She asked me if I was lost.
33:52And I tried to explain to her that I was just there enjoying the park, learning its history.
33:57Which I was surprised because she explained to me that the park was dangerous, and she said I needed to leave.
34:03She said if I didn't leave in the next 15 minutes, something bad would happen.
34:08I tried to ask her like what could be so bad about a park in a college town, but she had already started walking away.
34:13Like I said over the past three years, I watched the city just kind of go downhill a little bit.
34:17The trash in the graffiti continues to pile up and it never gets cleaned.
34:22As someone who practices graffiti in a very legal manner, I'm a huge fan of that form of self-expression, but not when it's just part of my language, the word penis man or cobra dug obscurities scribbled with black paint.
34:36The drug problem is unsafe.
34:38I tried to walk down Mill Avenue one morning so I could hike a mountain when I was encountered by a man who was exposed.
34:45Um he was self-stimulating, you know.
34:49Uh I can't think of like a professional way to say it, but he was on the patio over the restaurants as I walked by.
35:00My apartment complex had to take extra precaution by building gates around the corridors of our doors because they were getting so crowded with people looking for a place to sleep due to housing instability and insecurity.
35:06After learning about the history of the city, it really breaks my heart to see this place go downhill.
35:12I'm a huge You could have another like 15 seconds gonna you have to stop a couple of times.
35:17No, that's why I want to give you some of the time back.
35:19So hey, it's his birthday, you gotta be nice to him.
35:22So just kitty, keep going.
35:24I apologize, I'll wrap it up here.
35:27Um I really care about the city of Tempe.
35:29I think that this place has a beautiful identity to be safe and fun for all walks of life, all people, students, seniors, businesses, everybody.
35:38And I just care about the city, and I don't want to see a place that honors fallen veterans, police officers, and canine units be represented the way that it currently is, nor do I think a college town should be considered dangerous.
35:52The next speaker I have this evening is Alex Logman.
35:57Please come forward, state your name and city of residence.
36:00We have three minutes.
36:08I'm Alex Logan, and I'm a Tempe resident.
36:11On April 4th, I sent the city clerk and city attorney photos of political signs illegally placed in the Tempe right of away and cited the exact statues that those signs broke.
36:20I have gotten four different excuses back.
36:24First, the city attorney said it wasn't Tempe's jurisdiction.
36:28Maricopa County doesn't remove signs from Tempe Streets.
36:31The state of Arizona doesn't.
36:32The only legal authority to remove signs from Tempe right away is the city of Tempe.
36:38Second, he pivoted to a section of the statute that did not address the issue.
36:43I provide him with this correct section of the statutes that he missed.
36:47Third, he pivoted to resources, indicating that the city of Tempe does not have the funding to remove the signs.
36:54Last time I checked, the city attorney's office does not get to decide what funding priorities the city of Tempe has.
37:00That's the role of this council.
37:02Fourth, he pivoted to say the clerk's office reviewed the signs and found they were legal.
37:07They're demonstrably not legal.
37:10They're missing critical disclosures under Arizona law.
37:13We passed Prop 211, the voter right to know act in 2022, and the city of Tempe has not been paying attention to the law that this change that this proposition changed.
37:24Four excuses, one outcome.
37:27Tempe will not enforce the law.
37:29The bigger problem isn't ignorance of the statute.
37:32Every time I corrected the record, the goalposts moved.
37:35This pattern isn't analysis, it's avoidance.
37:38If Temp Tempe's position is that the Arizona campaign finance law is optional, say so on record.
37:4472.3% of Arizona voters passed Prop 211.
37:49It was the most successful voter proposition in Arizona history.
37:54And it was just three years ago.
37:58Tell us, Tempe, I'm sorry, tell us uh tell us if Tempe is not going to lift a finger to enforce it, be direct.
38:05We can have that argument.
38:07If I remove an illegal sign from the Tempe public right away, Tempe would come out after me with a class two misdemeanor.
38:15But when entities that are spending millions of dollars in our state to put up illegal signs to it, well, suddenly City of Tempe cannot find the authority.
38:26Rules for the not for me.
38:28I'm asking this council for two things.
38:31First, direct the city attorney's office to provide a written legal opinion of ARS 16-1019B before the meet 19th runoff.
38:42Not for excuses, one opinion based on law, not on how much paperwork it will create the city of Tempe's attorney's office.
38:50Second, if this is the quality of legal analysis that Tempe is getting out of the state getting from your team on state law enforcement, consider whether you have the right city attorney for the job.
39:03Okay, the next speaker I have this evening is Noah James Markham.

39:25Um mayor to the rest of the city council.
39:29Uh, my name is Noah James Markham, and I'm a great resident of Tempe.
39:35Um geez, some people complain a lot here, and I can see why I got punched on the side of the street.
39:42Um, on the sidewalk for having a Katie Hobbes sign out.
39:46I got punched in the face by a Native American out of nowhere.
39:50But I'd never gotten anything back from the uh police officers, but whatever.
39:56Um and then down here, downtown.
40:00I had today I was kind of protesting a little bit, and wow, I didn't know you guys had private security down here.
40:07I thought we have police officers.
40:09I don't know why we need private security down here.
40:11Is it really that bad down there?
40:13We can get rid of them.
40:16Um, and downtown no ab.
40:20I heard from uh council member Nikki Amberg about.
40:26We need when we're thinking about downtown no av.
40:31I I know we need the small businesses, but we also need the good restaurants too that bring people in.
40:38Like it's not just about these small businesses around here.
40:43We need to attract people to Tempe.
40:48Like it needs to be with better restaurants.
40:53I do not like these restaurants around here.
40:55I would not go through half of these restaurants here.
40:58I'd rather have a popular restaurant be down here than most of these restaurants down here.
41:03Um, and then also I'm kind of getting exhausted because I don't really see women police officers out here.
41:10It's just really men, white men, I don't really care.
41:14Um, and then please let the homeless be.
41:18They're not doing anything bad.
41:20I think everybody is doing things bad.
41:23Um the homeless are just living their lives.
41:26I don't see anything that is bad about them.
41:28And then I thank Greg Stanton for standing up with ICE.
41:32Um, because I love Grace Thanton.
41:35Um, even though there's some things we don't agree, but yes, ICE, we love it.
41:39And thank you so much.

42:03Um, I would like to thank council and staff for the Kyreen Canal crossing on Warner.
42:10Um I am now safely able to cross the street for my morning walks.
42:14And some of my neighbors that ride their bikes to work are now cycling five days a week because they're safer crossing the street.
42:21So it was a long time coming.
42:24I have had absolutely no trouble with cars stopping for it.
42:27And I just want to say thank you for looking out for our safety and putting in a crossing at the Kyren Canal on Warner.

47:18You have a busy agenda, and I hope I can be brief and quick so you can get on with your business.
47:22Um, I'm here on behalf of Lux Holdings that they own this property here.
47:26It's a vintage property for the 1970s.
47:28And you've probably driven up and down it many, many times out realizing what it is.
47:31It's kind of like um oftentimes it's not until you realize you want a car that you start to see it everywhere.
47:37So hopefully now that you see this property, you'll start to recognize it for what it is.
47:40It's just north of the 60 freeway.
47:42As you look at this property, it's actually made up of two separate detached buildings with a courtyard in the middle of it.
47:48And perhaps you might have gone to an office visit here from time to time.
47:51But on the map, uh the city's general plan map, it designates it for commercial uses.
47:57It's been residential office for a long time, and I think it's done a really good job being that area.
48:01But as a vintage building of that age, sometimes you start to see there's a need to up cape and to do uh a lot of maintenance, oftentimes deferred.
48:08And so, as a result, the owners of this group are a real estate company, they actually office in there, they do seminars within there, and they have a variety of different subtenants within the space, and started to have some success doing some of the real estate seminars in there, and then after one of the events, somebody said, you know, I really like to do my daughter's graduation party in the courtyard, which led to a great opportunity then to help re-inject a little bit of income to um offsetting some of the deferred maintenance of this old 1970s building.
48:35It was a great idea, and they've had some success doing it, but quickly found out that you actually need to have a different zoning category in order to do that.
48:41So we don't want to rezone the whole site commercial.
48:44I don't think this whole site should be commercial.
48:46And if I was to do that now, and if we were to disappear later on, you might have a different user who might want to do something different with it.
48:53But in cooperation with staff, we came up with a good solution.
48:56What we propose to do is simply just rezone the northern building and the courtyard.
49:01And what this does is it allows them to do their events as they have been doing, um, but with compliance and proper rules in place without converting the whole site into commercial and preventing it from being something any more than what it is.
49:13They still have office in this building, so it's mostly just on um a Saturday and an evening here and there.
49:18But for the most part, as you can see in this premise here, the suite where the event occurs essentially is in only suite 102.
49:25That's about a 2600 square foot space, and then that courtyard area outside.
49:29To give you some perspective on the photos of the property, you can kind of see this is the courtyard before, um, but in order to create a space that's a little bit more convenient for the event venue.
49:41They created this little outdoor putting green and a gathering space on the inside.
49:45It is an opportunity to do a couple um chairs and a little small stage if you wanted to have an event.
49:51But because of the size of the building, you really can't do much more than um uh small events in this place.
50:00So as a result, I think we worked closely with staff and the community to get a sense on how we can operate compatibly.
50:03We ended up creating a good neighbor policy.
50:05The point of this good neighbor policy is to make sure a couple of things.
50:07One that we always have an on-site parking attendant whenever we do have an event.
50:11That person will help direct on-site parking, we'll help reduce any off-street parking, and also make sure that we have the valet um working properly when needed.
50:20One of the other things that we've considered is how do we prevent maybe noise noise if it ever were to um become a concern?
50:26So we've decided to self-restrict ourselves for our um hours of operation, 9 p.m.
50:32on weekends, and most importantly, have a proactive complaint response policy in place.
50:37Part of that includes giving our contact info to all the residents along that street, not just of the building in general, but for the on-site manager.
50:43Lastly, and I think one of the most important things about this case, it can't be anything more than what we're proposing because we're not proposing to rezone the entirety of the site.
50:52It allows the building though to be reutilized, injects revenue back into it to offset some of the deferred maintenance.
50:58And I think most important, it allows the building to stay in office building.
51:02It just gives it a little bit of off-peak time use in order to um continue the success that they've had so far.
51:09So it is considered general plan.
51:10I think it's the type of use you'd expect to see along rural road and staff supports it.
51:14We don't have any opposition.
51:15And so that being said, I promise I'd be brief.
51:18I hope I didn't talk too fast, but I'm happy to take any questions you might have.

52:07First of all, there's the required neighborhood meeting, and then from any, there was only a handful of people attended, maybe five or six.
52:13Then was additional follow-up with them afterwards.
52:15What we found though is actually there's quite a bit of reders in the neighborhood, not actual owners.
52:19And there's um one particular house that seems to have a lot of college co-eds in there that might be one of the bigger problems in the neighborhood, not our particular office itself.

1:02:51It is a free drive-thru event for Tempe and Guadalupe residents, so you have to actually have your proof of residency uh to dispose of hard to recycle items like electronics, has household uh hazardous waste, scrap metal, clothing, all of that kind of stuff.
1:03:05So uh the materials are recycled, are repurposed whenever possible, helping to extend the life and actually keeps out tens of thousands of pounds of waste out of our landfills and helps support Tempe's sustainability uh goals.
1:03:19The cool thing is you have to stay in your car so you don't even actually get out to uh get the stuff out.
1:03:24And uh, you can bring the items and cardboard boxes but not plastic bags.
