Speaker 7

3:18

Yeah.

3:18

So uh this isn't we're making some more changes to Tile 19.

3:21

Um we said we went back in March and we adopted this, we'll be doing some like iterative changes for the next one to two years, dialing everything in to make sure everybody works exactly how we want it to work.

3:32

Um these are fairly minor changes that we're working with.

3:35

Uh well, at least I would say the second one is the Will Health Protection one, the ETJ one is is a is of a larger impact.

3:42

Um so as you all know, we have an extra territorial jurisdictional boundary uh area, so one and a half miles immediately outside the city's border.

3:51

Um we have subdivision review authority over that um based off of state enabling power to for for communities.

3:58

Um we have a minimum lot size of ten acres within the ETJ area for any new lot.

4:07

Um there the way we've historically uh managed to get around that.

4:13

If there have been in some cases some small land divisions like, you know, uh a parent wants to split off five acres for their kid, um, to have build another house or uh estate planning like we've done in the past.

4:25

Um we've used a third party agreement uh that basically states that if they're not contiguous to the city currently, then when they become contiguous, they would then annex in the city connect with water to water and sewer.

4:37

Or if it's a property that is already contiguous to the city, then in that case um they would basically everything would stay as it is, um but if they decided to try and develop the newly created lot, then in that case they would um then annex in the city.

Unassigned speaker

4:51

Uh this was actually created in response to uh to help out the county and the people in that in the ETJ uh to provide some flexibility.

Speaker 7

5:00

Um it was so it was kind of surprising when the last legislative session, the association associative counties actually kind of went forward and said that there is case law saying that you can't make a land division contingent upon a third-party agreement, and they held up our ordinance as an example of you know what you shouldn't be doing, and what was in violation of that.

5:25

So in response to that, uh we've just kind of gone, all right.

Altoona Plan Commission Meeting Summary: August 4, 2026

The Altoona Plan Commission met on Tuesday, August 4, 2026, at 4:30 PM in the Council Chambers at City Hall. The Commission addressed amendments to Title 19 of the Municipal Code, covering the Extraterritorial Jurisdiction (ETJ) lot division rules and the relocation of the Wellhead Protection District, ultimately recommending approval to the Common Council.

Consent Calendar

  • Approval of July 14, 2026 Minutes: Motion by Member Sue Roll, seconded. The motion carried on a vote of 5-0-2, with Members Dean Roth and Matthew Beeron abstaining.

Public Comments & Testimony

  • No members of the public provided comments during the Citizens Participation Period.

Discussion Items

Title 19 Zoning Amendments

  • ETJ Subdivision Exemption Restructuring: Planning Director Taylor Greenwell presented an amendment to restructure exemptions from the 10-acre minimum lot size in the Extraterritorial Jurisdiction (ETJ). The City previously used third-party agreements to allow smaller lot splits (often for estate planning), but the Wisconsin Counties Association cited this practice in case law as impermissible contingent approvals, using Altoona's ordinance as an example. The amendment removes the third-party agreement mechanism and instead permits lot splits in already subdivided neighborhoods (e.g., Red Pine) if the new lots are of a similar size to surrounding lots and no more than four lots are created.
  • Commission Discussion (ETJ): Commissioner Dean Roth expressed concern that the cumulative ("and") criteria for the new exemption would prevent its application to many of the rural estate-planning cases the Commission had historically handled. Greenwell acknowledged this limitation, describing the strict criteria as "partially by design" to manage growth pressure and legal exposure. He noted the City was "trying to be a good neighbor" and was disappointed its ordinance was singled out.
  • Wellhead Protection District Relocation: Greenwell explained the second amendment moves the Wellhead Protection Overlay District regulations from Title 19 (Zoning) to Title 13 (Water) for administrative efficiency, allowing the City Engineer to manage updates without requiring DNR review. No substantive regulatory changes were made.

Key Outcomes

  • Recommendation to Common Council: The Plan Commission voted unanimously to recommend approval of both Title 19 amendments to the Common Council for its August 27, 2026, meeting.
  • Parks System Plan Update: Greenwell announced the launch of a new Parks Plan update process. A community survey will be available from late August through November 2026 to gather public input on park amenities and priorities.
