Item number 11.1 zoning case PD 25-19.

Is it a request to change the zoning from community commercial CC zoning to a plan to development for CC uses plus auto repair garage major use limited to aesthetic and customization work with the development plan on approximately 1.717 acres of land addressed as 2504 South Cooper Street, generally located north of Colorado Lane and west of South Cooper Street.

The applicant is requesting a PD to allow businesses such as paintless dent repair, auto wraps, auto signage, upholstery, custom wheels, uh window tinting, stereo install, and communication accessories with all services being done inside the structure in the service bay, and no substantial disassembly of vehicles occurring.

Based on planning and zoning commission's stipulations, the applicant has provided a landscape plan with a few yucca plans along South Cooper Street and elevations showing a few upgrades to the exterior of the building.

Since the planning and zoning commission meeting, the existing two existing non-conforming pole signs have been removed.

This evening, the applicant David Dowling will present their case for us.

What we've got here basically forward.

It's the old Kellymore slash furniture more location.

What we're trying to get in there is a tenant that's doing vehicle wraps, um, which is not chemically related.

There's no prep, there's no disassembly of vehicles to put the wraps on, which is basically more or less advertising of some sorts.

Um it's all aesthetic.

Um just some samples of his work.

Um this is existing location over on Arkansas.

He keeps it clean, he keeps it tidy, keeps it in good condition.

Um this is kind of a zoning uh and the location is within this green circle.

Um the nearest residential is 0.35 miles away, and you can see by the green line where the distance is.

Um this is an existing condition elevation of how we're trying to improve it and get it up to par as far as aesthetics and curb appeal.

This is our proposed on the one zone.

Uh well, the neighbors to the south would be Regio Tires, which is a tire shop.

To the north would be um uh window temp place, if I'm not mistaken, across across the street would be uh the burger box and the safe light auto glass and to this, yeah.

You can come on up, help them if you want to, it's all right.

He knows what it is.

I don't care you David's up here struggling, trying to remember where everybody is.

But basically it's all automotive around us, north, east, west, and south.

Cars come in, get fixed up, and then yeah.

Uh it came in all black.

All we did was the blue um decals and advertisings on it.

It came in silver, it's been a while.

It was silver, I believe, and we just wrapped it satin black.

Um clean it up real quick, throw the wrap on there, and it rolls out and yeah, this is a Corvette.

Um it was white.

We did the red wrap on it and uh put the new wheels on it, and that's pretty much it.

So even when it comes to the wheels and tires, uh we're not necessarily like a tire shop where we're stocking all this product and stuff like that.

Uh usually we'll have like a customer pick a wheel, we'll order it, mount it up, they'll take their old stuff with them, and that's pretty much it.

We like to keep that at a minimum because it can stack up pretty quick.

You know, you see tire shops with tires and stuff all over the place.

We try to stay away from that.

We have wraps on the walls.

Um, yeah, we got to keep a clean work environment inside and outside.

That's that's how we attract business and high-scale clients to spend money with us, and we take a lot of pride in that, keeping the clean work environment and taking care of the cars.

But um, yeah, this is our current location.

Um, keep it clean, pretty simple on the outside.

And yeah, that's is pretty much what I got.

How are you gonna maintain sometimes these type of facilities can have too many cars parked out front that's on a major road right there?

I don't want cars stacked up in front.

Um, so that that would be the one thing I I would have some worry about.

So our our whole plan with the uh location is all of our all of our our vehicles that we drive to work and our uh you know uh installers that come to work, we're gonna park in the back.

And uh any cars we're working on, they're always indoors.

We never leave cars outdoors overnight.

The uh only thing the front lot would be used for is clients that are stopping by, dropping off, you know, stuff like that.

So even our personal cars, they will be parked in the back.

But we we never leave cars outside.

So I am working endlessly trying to get that fixed uh because it it is terrible the way it looks with all the tires in the back.

So I'm glad you're doing it, and I like the plants that you have out front, so it's not gonna take a lot of watering, uh, which is important.

The only thing you said something about we don't sell cars, but a couple of sales do go through.

I'm the owner of the building.

Uh live in Fort Worth, but I've been a business owner in Arlington for 25 years in that very area.

Uh so yeah, uh we feel like this uh putting an automotive shop in this area is really appropriate for the neighborhood because there's automotive all around it.

And I think that's one of the reasons the buildings kind of declined because it's had a hard time getting tenants in there because there's so much automotive stuff.

I wish David would have shown some of the pictures, but what's on our northwest is the school uh bus depot or bus shop or I think.

And it it yeah, and it's just uh uh uh eyesore to even look at, and that's one of our neighbors, you know.

We've got industrial in the rear edge.

We've got automotive on either side, so yeah, uh I think it's more appropriate.

We feel that uh this automotive aesthetic work, which we've kind of compromised on because I know the city of an Arlington's kind of trying to get away from automotive, especially on the major thoroughfares.

It's a good match.

We feel like a lot of these items we've mentioned, which are wrapping and uh uh auto electrics, wheels, and uh PDR work, which is painless dust repair, they didn't even exist when the code book was written.

You know, all this stuff is relatively new, and this sector of business has kind of been excluded from the uh code book, and that's why we get the moniker of automotive major, which I think is like David said is kind of inappropriate for this business.

This isn't automotive major.

If you read the code book, automotive major is the disassembly of cars.

Uh and if you look that up in the dictionary, that means take a car to pieces.

The this this type these types of business may take a part off, but they're not really maintaining the cars.

So we we think that we kind of deserve to be in this neighborhood in the code book and P and Z agreed with me on this that possibly the code book needs to be uh addressed, and that needs to be looked at as far as these types of uh businesses.

I know the city wants to do high-tech stuff, and to me, auto wrapping is high-tech, so we feel that's appropriate.

Uh we have taken down our pole signs.

Uh we're not planning to put up monument signs.

We think we have good visibility from the street to put the signage on the building.

That is our plan.

Uh we have ordered the plants and got the the landscape starting.

Item item 11.2 zoning case PD 24-28 is a request to change the zoning from office commercial OC to a planned development for residential medium density RM12 and office commercial uses with a development plan on approximately 3.165 acres of land addressed as 5920 Matlock Road, generally located north of West Sublitch Road and on the west side of Matlock Road.

This PD proposes to keep office uses such as a medical office, appropriate retail and pharmacy uses on the northern almost one acre uh portion of the property and will contain uh at least 8,500 square foot building and to the south of the exist uh which will be to the south of the existing daycare site.

The southern 2.15 acres of the property, which is surrounded by single family residential and duplexes, will be developed with 29 two-story townhomes of approximately 1,800 square feet.

Uh we realize that in the staff report and the ordinance, uh we are silent about the short-term rental use that is allowed by right in RM12.

So we checked with the applicant just a few uh uh an hour ago, if the owner would agree to exclude the STR use in this townhome development, and he is acceptable to that.

So if council would like to exclude it from this PD, then please address it in the motion.

This evening we have the applicant Henry Wynn, the who will present the case for us.

When good afternoon, my name is Henry Wynn.

Uh the address is 1330 Glenfield Avenue in Dallas, Texas.

I just wanted to point out one thing while I go.

The total number of uh residential units we have to decrease from 29 to 24 now.

Yeah, because the the during working with staff they want to increase the landscape area, so we we agree to do that.

Basically, this staff uh has uh mentioned it is a the subject property is 5920, Matlock Row is a vacant piece of property right now.

It's currently zone uh office commercial.

The site is surrounded by residential multifamily to the north and residential single home to the east, south, and west.

This unused track of land is a prime opportunity for redevelopment to meet growing residential housing uh demand.

What we planned what we requested to change the zoning from office uh from OC to plan development for single family multi single for town home development.

Well, this is uh a concept plan.

We intend to build a uh retail building to the north and to the south.

We plan to put in 24 two-story townhome units, and each units is approximately 1,800 square feet with one car garage.

Here's the elevation of the town home and the retail building.

The objective is to create uh a vibrant community aligned with city growth plans.

Uh key features divert housing type, Green Space community areas, and suspend sustainable building practice.

Community benefits, we believe that this property will create job.

I mean, this development will create job during construction and increased tax base after the construction.

Um we will address residential housing needs and improve community quality of life.

Well, we did have three people at the meeting, and they're the ones that were concerned about the trees and all that.

So has that been addressed?

Yes, we already address a tree.

I'm here to present item 12.2, which is the first reading of an ordinance ordering a May 2nd, uh, 2026 special election for reauthorization of the street maintenance sales tax.

Um at the May 5th, 2018 special election, Arlington voters approved the adoption of a one-fourth of a of one cent sales and use tax to provide revenue for maintenance and repair of city streets.

Pursuant of section 327.007 of the Texas tax code.

The tax will expire on the last day of the first calendar quarter occurring after the eighth anniversary of the date the tax was last reauthorized, unless Arlington voters approve a reauthorization of the tax at an election prior to that time.

The tax is scheduled to ex the taxes scheduled to expire on December 31st, 2026.

The Texas Comptroller's Office has advised that the Comptroller's office will be will need a full calendar quarter prior to the expiration date to ensure the tax does not expire.

The May 2nd, 2026 uniform election date is the last available uniform election date to provide the Trump color Trump Comptroller's office that needed time.

The quarter six sales tax, street maintenance sales tax, first approved by Arlington voters in 2002, is the primary uh funding source for day-to-day roadway maintenance operations for the city's 3,010 lane miles uh street network.

This dedicated sales tax generates about 25 million to 30 million annually, which typically accounts for 90 percent of Arlington's annual street maintenance budget.

He said medical records, pictures, and the letter from the doctor.

He got those.

It's been a week and he won't call me back.

But it's the same detective I get whether I'm returned we're reporting a stolen bicycle or getting stalked or getting sexually assaulted.

You don't understand.

I'm not going away.

God blesses me.

Next is is going to be petitions and flyers all the way until if I have to, in the name of Jesus, I will martyr myself during one of the beautiful laptop shows.

I need my dog back.

The lady that works, uh Jennifer, whatever her name is, that offered me help to get a foster so I could go to work and become unhomeless.

I'm Chris Wood from Fort Worth.

Arlington owns ATT Stadium, home of the Dallas Cowboys, investing in the surrounding entertainment district.

With this investment comes responsibility to ensure the well-being of all who perform at stadium events.

The Cowboys cheerleaders jump splits, a move where cheerleaders lock arms, so to not participate would endanger the fellow cheerleaders, jump and land in the full splits, often on unforgiving surfaces like turf or concrete.

This maneuver is dangerous, causing severe injuries like torn ACLs, joint, back and hip damage, and long-term chronic pain.

Young girls look up to the cowboys cheerleaders as role models.

Often they add this harmful step to their dance routines.

I have taken several steps to advocate for the removal of the jump splits.

I attended a cowboys game and a cowboys cheerleader's performance, wearing a t-shirt asking for no more jump splits.

So I now support the Fort Worth Vacara's soccer team instead of attending Cowboys games.

A shift in fan loyalty could have a negative impact on Arlington's entertainment revenue.

As stewards of public investment, please request the cowboys remove the jump splits, prioritizing the health of performers and the young fans who emulate them.

Members of City Council, City Manager, and City Secretary.

My name is Alberto Vasquez.

I live in the Prestonwood Westdivision in North Arlington.

I'm speaking as a homeowner to respectfully ask for the CD guidance regarding some going drainage, erosion, and sediment impacts in our neighborhood.

This is not an HOA issue or an individual homeowner issue.

It is a city stormwater control issue.

The water moving through this corridor is municipally generated stormwater.

It originates from public streets, public right-of-way, and city approved development.

And it is collected and routed through the city storm drainage system.

The volume and velocity of this water are determined by city infrastructure, not by homeowners or the HOA.

The erosion we are seeing is consistent with stormwater scouring caused by high velocity flows.

When water moves faster than the channels designed to handle, it destabilizes banks and transport sediments downstream.

A downstream HOA cannot slow upstream flows.

Redesign CD drainage or intercept watershed scale energy before it reaches private property.

Functionally, this corridor serves as a stormwater conveyance system, not a private amenity.

We're asking the CD leadership to address a stormwater velocity problem that homeowners cannot solve on their own.

Mayor Ross, distinguished members of the City Council.

Um here today to talk another one more time about our Preston Woods estate stormwater issue.

I wanted to do it from uh the homeowner's perspective.

And you know, one of the one of the biggest reasons you'll probably continue to see me as respectfully as as possible throughout this is 40% of our homeowners are actually on a fixed income.

They're retired in the 70s, 80s years old.

And um as you probably remember, this is a substantial, substantial uh cost to deal with.

So I just wanted to let you know that I mean there's too much division in this world.

We see it everywhere, and the one thing we can't let go is our homeowners is our is our actually our our um retired folks trying to help them so anyways.

I'll be brief here.

Um I um our neighborhood is being asked implicitly to absorb the consequences of stormwater that we do not control.

Water from our streets and surrounding city streets is routed into a single quarter that runs through our private property.

Uh when it rains and uh the corridor carries enormous volume and force.

Homeowners didn't design it.

Um we can't we don't control it, we can't control it, and and we don't have the ability to fix it on our own.

With uh this waterway um no longer functions as an amenity.

I it's I think there's thirty percent of us that moved in after after the event happened with uh with the breach of the dam, so we've never even seen the lake.

But that you know that that is neither here nor there.

The the uh the challenge is it's now a really a stormwater release system issue.

It it's there's no amenity there.

So the city um has recognized the corridor as part of the stormwater system.

City engineers have evaluated it, and emergency authority has has been exercised for um for there for drainage and public safety issues.

Yet the HOA does not have the authority, funding capacity or regulatory tools to manage stormwater velocity or prevent um scarring of this issue.
