The overall site is approximately uh 35.3 acres addressed at 303 East Barton Road and 407 East Ember Crest Drive.

Currently zoned airport overlay for plan development for light industrial uses with a development plan.

And we are here today to uh relation to the revision to that development plan.

Again, just keep in mind we are only this portion of the site is uh where the revision to the development plan is uh to the the portion of the site to the um to the west across the future Dr.

And again, the reason we're here today is in compliance uh with the PD development plans per the code.

A permit substantially complies with the PD development plan is if it does not significantly, and then when we're concentrating on the C increase the improved densities, height, site coverage, or floor areas.

And uh the reason we're here today is they are actually increasing the square footage of one of the structures.

Uh keep in mind there isn't any increase or request for an increase in any square footage of the actual lot or any additional buildable space, it's just to um increase the square footage of the proposed structure.

And this is just the original PD approved layout, and we're focusing on the um the highlighted building three, which was originally approved in the PD, which came before you uh it was approved in council in June of 2021, and that building three was originally approved at 36,300 square feet.

And this is the overall site location, just as a comparison of the two with the uh originally approved PD at 36,300 square feet for that one structure, the new uh proposed structure will be 77,800 square feet.

The property was rezoned in June of 2021 to PDLI to allow for the development of Office Warehouse Business Park with three buildings totaling approximately 435,000 square feet.

The zoning request received unanimous approval from both Planning Zoning Commission and City Council at that time.

The impetus behind the request was the is due to the city's plans to extend MLK Junior Drive from Barden Road to Southwest Green Oaks, which will allow access to this site, amongst others in this area, and also increased mobility through this part of the community.

Commissioner Ware proposed a motion to approve with conditions: tree grates enlarged to 4x8 feet, five-inch trees, payment into reforestation fund, utilities buried, Balfour history honored, prohibition of short-term rentals, EV charging provision, and continued collaboration with adjacent property owner DJ Johansson and the historical commission. The motion passed 6-1.
  • Zoning Case ZA24-5 (1013 North Mesquite Street): Staff presented a request to rezone a 0.924-acre lot from EDO-RS-7.2 to EDO-RM-12 to allow townhomes, duplexes, or cottage homes. The applicant sought straight zoning rather than a planned development to avoid upfront engineering costs. Commissioners expressed concern that straight zoning would permit short-term rentals (which are allowed in the EDO district) and that no specific development plan was provided. The applicant offered to consider a deed restriction, but the city attorney noted that the city does not enforce deed restrictions. The motion to approve as straight zoning failed 7-0.
