3:52

The other plates to be approved are the replat second filing Rush Creek Ranch Estates, final plat of St.

4:00

Joseph Estates, Amending Plat Timberdale edition, and the first one replatting of unique homes.

4:09

Do I have a motion to approve these plates on the consent agenda?

4:29

4:33

All right, I do have a motion from Commissioner Ware and a second from Commissioner Payne, and these two are to approve four plats on the consent agenda.

4:44

Please cast your votes.

5:00

The uh the motion passes seven zero.

5:03

Right.

5:04

On the motion that we took off, or the uh plat that we took off of the consent agenda, that was the preliminary plat for the townhomes at the ballpark, townhomes of a ballpark and bar ballpark plaza.

5:20

We have a speaker and opposite.

5:25

Let's see, I don't think we have any speakers in favor.

5:28

Oh, we do, I'm sorry.

5:29

We have one speaker in favor, which will go first.

5:32

Uh Remington Wheat.

5:43

Good evening.

5:44

Uh I'm Remington Wheat with Bannister Engineering, 240 North Mitchell Road, Mansfield, Texas.

5:50

I'm here to represent the applicant for this project.

5:53

Um I think our preliminary plaque case is pretty straightforward.

5:58

Uh I think I'll just speak specifically to the concern that was raised.

6:04

Um my understanding is some uh community members are concerned about one of the trees we're planning to remove with this development.

6:13

And uh the tree preservation plan was submitted and approved with the zoning that was previously approved at City Council.

6:21

Uh but since the concern came up, I I looked into what we had in that tree preservation plan.

6:28

And I think the specific tree in question is listed as a 75-inch post oak.

6:33

Uh upon further investigations, it's actually 515-inch post oaks, so considerably less age involved in 515s versus 175.

6:44

Uh that particular tree is located within one of our proposed townhome units, so it wouldn't be possible to save that tree.

6:52

Uh if it was easy to or feasible to save the tree, the developer would be agreeable to that, but in this particular case, unfortunately, it wouldn't wouldn't be able to save it.

7:03

Um it it uh yeah, I'll be happy to answer any questions you may have.

7:12

Questions from the commissioners, Commissioner Ware.

7:17

Um, you're saying it's it's five trees that have grown together or yes, sir.

7:23

It's basically a multi-trunk tree, or you could consider it five separate trees or one cluster that are basically in one location that with a total uh caliper measurement of 75 inches, yes, sir.

7:37

I was informed by by the arborist that our uh 75 inch could actually be reduced to more like 52 based on a uh a different method of recording that same tree cluster that would meet the city's requirements, which would actually make our uh percentage of trees saved look better than what was previously approved.

7:58

So that that actually works in our favor.

8:03

All right, Commissioner Tolumbas.

Summary of Proceedings

Arlington Planning and Zoning Commission Plat Agenda Meeting - June 5, 2024

The Planning and Zoning Commission of the City of Arlington convened on June 5, 2024, at 5:36 PM in the City Hall Council Chamber. The meeting focused on approving several plats, with significant public testimony regarding the removal of a large post oak tree on the proposed Townhomes at the Ballpark site. The commission approved the consent agenda and the preliminary plat for the townhomes, with conditions.

Consent Calendar

  • Approved with Conditions: The consent agenda for plats to be approved with conditions was moved by Commissioner Ware, seconded by Commissioner Payne, and carried with 7 ayes and 0 nays. This included:
    • V.A: Replat - Unique Homes Addition
    • V.B: Replat - 2nd Filing Rush Creek Ranch Estates
    • V.C: Final Plat - St. Joseph Estates
    • V.D: Amending Plat- Timberdale Addition
    • V.E: Preliminary Plat - The Townhomes at the Ballpark and Ballpark Plaza (initially removed from consent due to public speakers, but later voted on separately)

Public Comments & Testimony

  • In Favor: Remington Wheat (Bannister Engineering, representing the applicant) explained that the tree in question is a multi-trunk cluster of five 15-inch post oaks, not a single 75-inch tree, and that it cannot be saved due to grading constraints.
  • In Opposition: Several residents spoke against the tree removal and urged better tree preservation:
    • Timmy Hazel (Impact Arlington) requested that future development plans highlight trees over 30 inches in caliper.
    • Sherry K. Hart noted the tree is part of the Cross Timbers forest and criticized the use of buffers for tree counts.
    • Julie Hunt (Arlington resident since 1984) requested the commission petition to amend the tree ordinance to identify large trees and discourage removal.
    • Vanetta Fuller Williams (Wood Creek resident) emphasized trust issues with the developer and asked for adherence to promises.
    • Grace Darling (Arlington Conservation Council, Molly Holler Wildscape, Green Arlington Foundation) called the tree removal an outrage and urged preservation.

Discussion Items

  • Preliminary Plat - The Townhomes at the Ballpark and Ballpark Plaza: The commission discussed the tree preservation plan and the legal requirements. Commissioner Talambas clarified that the plat only needs to meet the 28% canopy preservation approved by City Council, and that saving the tree is now a matter of appeal to the property owner. Commissioner Ware noted the developer had considered sacrificing a unit but grading makes it infeasible. Staff (Mr. Gatton) explained that the commission can only approve the plat with conditions per code, and any changes to the development plan would require a rezoning.

Key Outcomes

  • Approval of Minutes: The minutes of May 15, 2024 plat session were approved (6 ayes, 0 nays, 1 abstention).
  • Consent Agenda Approval: The consent agenda (excluding the townhomes plat) was approved with 7 ayes and 0 nays.
  • Preliminary Plat Approval: The Preliminary Plat for The Townhomes at the Ballpark and Ballpark Plaza was approved with conditions (motion by Chairperson Gibson, second by Commissioner Payne, 7 ayes, 0 nays). The commission encouraged the developer to continue discussions with the community before the final plat stage.
  • Adjournment: The meeting adjourned at approximately 7:00 PM (estimated from transcript).
