We have for you PD 25-14 addressed at 1112 North Collins Street.

Again, this is a 0.907-acre site, uh currently zone EDO community commercial with a request for a plan development for EDO community commercial uses plus a package liquor store.

And this is just the UDC's uh definition for a package liquor store as an established license by the state for the retail sale of liquor, malt, and venous liquors for off-premises consumption.

Again, this is the site location.

It's located, excuse me, uh along North Collins Street, uh less than a little less than a quarter mile north of uh ATT Stadium.

Again, these are the site photos, it's uh with it being located on uh North Collins Street is surrounded uh mostly by commercial developments with some residential uh developments across uh North Collins Street.

And again, this is the overall uh site location, just with highlighted here.

Uh what we're uh the PD is for is for this just specifically for this uh 2400 square foot site within this center that is currently a C store.

Uh the existing center again is uh 11,98 square feet center uh with various uses, uh restaurants, barber and styling salon offices, and this convenience use.

Hours of operation will be Monday through Saturday, 10 a.m.

to 9 p.m.

Uh, with two to six employees on site at any given time.

And again, based on the UDC requirements per all the uses, existing uses in the site, or and with the change if if approved for the package liquor store, the site does meet all the current minimum UDC parking requirements based on the uses in the center.

Yeah, this is just a site layout to showing the different uh units um uses on the site.

It does have access to access points uh off of North Collins Street to the existing center.

And then these are the packaged liquor stores uh within a two-mile radius of the site, uh, within the one mile, you have two packaged liquor stores.

There are actually four within the two mile radius.

This is just uh the coordination of uh consideration uh with coordination of other plans to evaluate the development proposal in context with existing infrastructure, connectivity and some mounting uses.

Encourage uh appropriate redevelopment and reinvestment, encourage uh the redevelopment of aging shopping centers uh with high vacancy rates.

And again, the staff recommendations if approved uh for consideration is uh staff recommends requiring the applicant to remove any of the illegal signage in the windows and bring the site into compliance with clean, visually appropriate and well designed signage, and additionally the gaps and shrugs along uh Collins Street uh be filled with more shrubs, and the applicant has agreed uh you know to add additional landscaping uh within that landscape setback uh buffer area along North Collins Street.

And we did receive you should have one letter of opposition we received uh in in the packet, and we did receive another one today uh after posting that you should have as well, and in speaking with the applicant prior to, I provided a list of signatures, which uh the applicant is is prepared to explain.

He is part of the group that well, there you are.

He's part of the group who owns the store located at 1112 North Collins.

Uh they they signed a lease to operate a convenience store in 2023.

Uh initially the business was doing great.

Um, soon after, though the 711 was actually constructed within maybe less than a half a block from the property.

And these guys have a mom and pop shop.

They have four stores in the DFW, so it's not like they can compete with the 711.

So their business started going down.

They tried cutting, they tried cutting prices, they tried cutting many different little things so that way you can get customers to come in more and slowly business just kind of dissipated.

They got into a point where they now feel like they either have to go this route, and this route came because they actually started asking their customers what type of business would be a business that they would like in that space only.

And so they started communicating with customers, and this is what they came up with.

This was their choice basically based on all the comments and questions that he that they received.

And so it's either they go this route, which is why we're here on this request to you guys, um, or they will have to figure out a way to shut down because they've they've gone pretty bad.

Their businesses really dropped dramatically.

And so, and in fact, that's one of the things that you know in the conversations I've had with him and his partners is basically pushing me to make sure that I can get whatever I can get you guys in so that we can move with the permit.

Unfortunately, I do want to apologize.

I wasn't here last month last year, last uh or last year.

Uh December, uh wasn't here and I wasn't able to make it.

I'm sorry that we had to request the extension.

Um I had a family issue, but uh nonetheless, they were patient with me, so here I am.

Um, so part of the part of the application includes improvements as well, uh, a complete remodel of the space, uh, as well as as Clifford discussed, as we're planning on bringing that row of trees.

There's a row of shrubs in the front of the the whole the whole shopping center.

It's kind of broken up into different spots.

I don't know if they died or I don't know if they either ever just wanted the whole world, the whole world to and we do have if you go to the landscape plan, please.

We're basically trying to bring in an entire line of shrubs as well as new young trees as well in the area.

Uh we will follow the urban forest uh recommendations for specific species that they like for us to bring there as well.

So we're also proposing uh to bring in trees not only in that row in the front that you see there, but then we're gonna also bring in another one at the top that it's not shown on this one.

Um, but it should have shown on that one because I have it here.

That's my mistake.

But we are preparing to bring in multiple trees, species to nature to Arlington, and so that's one of the things.

And then the complete remodel also included uh uplift of the phase, the facade will have to change to meet the new business.

The remodel will also have to meet um compliance with uh ADA, the American disability standards as well.

Um, if we are needing to make any changes to restrooms so that the ADA requirements are met, then we plan on doing that as well.

The remodel is a requirement because it's a completely new different business that we're gonna be running.

A C stores, a convenience store is not the same as a liquor store as far as as far as uh how you how you shelf or how you sell or how do you promote uh as well as the the people who are gonna be running the store.

Kamlesh and his group, they have a liquor store in Fort Worth of Altamisa, and they've run that store for a while now, and they have I've helped them as well with a couple of convenience stores in Dallas.

Um of the issues that they came into is the previous owner at of that store was having issues with bandals that were just coming in and you know acting out, or there were some people that were just selling drugs out there.

So what we recommended to them, and they actually came up with that idea, and that's the reason why we were able to get our SUP approved for the city of Dallas for that store on South Cleaver, is hire someone who's not only experienced with being a store manager or whatever, or let's just say that he's just a stalker, but hire somebody who has experience with some sort of security, right?

That it's not gonna just escalate whatever situation happens in the space.

And so that's what we proposed to the city of Dallas, and that's what he came up with.

And he find he found someone that could that could you do have to pay more, obviously, because you have someone who has to be trained to be able to handle customers who are ruling, who customers who are in some cases you know addicted to drugs and things like that.

And so we need we needed someone who actually had the experience to do that, and that's one of the things that we're bringing here as well.

Um he is aware of you know some of the concerns that you guys may have, and we're here for any questions you may have.

So the reason for applying liquor is not just uh downgrade of business.

It's also many customers comes in every day asking for liquor.

So that was one of the reasons we wanted to apply for liquor.

We applied for liquor a year back as well, and uh we didn't know that the joining changed after that.

So we were approved first, and when we went to City of Arlington to pick up the paper, they said the zoning has been changed.

That was the reason, or we would have got the liquid license way back a year back.

Is it common in liquor stores to have additional crime in that area?

Well in liquory stores, the crime is very less compared to C stores.

And we have multiple we have two employees working at liquory stores, and we have we don't have any problem at all.

But in sea stores, we are having problems.

But in liquor stores, we never have any problems.

The site is approximately 0.234 acres or 10,192 square feet.

It is addressed 1012 Gay Lane, and its current zoning is residential single family RS 7.2.

They are requesting a specific use permit for a secondary living unit.

The subject site is located in a neighborhood just south of Randall Mill Road.

And here we see some images of the neighborhood up and down the street directly across the street.

Um and then the subject property.

The proposal is a 360 square foot secondary living unit.

The setbacks are six foot six inches from the rear and five feet from the side property line.

These do comply with the UDC setback requirements.

Uh would constitute a 21% lot coverage, which is below our 50% lot coverage maximum for this zoning district.

And the living unit is to be used for family, uh, as the UDC states.

The applicant has said that their mother would be living in the secondary living unit.

The floor plan consists of a bedroom, uh small bathroom, a little kitchen area, and a living space.

I'd like for you to just uh reiterate uh we this case was discussed upstairs during our work session, and uh Commissioner Blake had a really good question that I didn't know the answer to.

So how many uh buildings can someone have in their backyard?

You can have three accessory structures on a lot that's less than an acre.

Uh so that could be secondary living, uh just a shed, a gazebo, so up to three accessory buildings.

Um staff did a great job presenting uh really uh everything, all the details about this project.

So I won't uh be redundant, but I I just wanted to focus on the intent and the use of this um secondary dwelling unit.

It's a you know it's a pretty modest uh unit in the it behind the uh the property.

360 square feet, it's just a bedroom, bathroom, kitchenette, you know, it's uh you know one ten volt, not not even running two forties.

But um just a you know, it really uh accompanies the primary residence and and allows this to be used um for family purposes.

Um and that's really that's really all.

I mean, here's here's kind of an architectural um drawing of it so you can get a good idea of it.

But the layout it works out with the property, uh little walkway to it.

So it's uh I think we'll be it'll be a good addition to this property.

Um just the main purpose of it is my parents, uh mainly my mother.

Um, you know, they're getting up there in age, and with the way the economy is right now, it's uh it's hard for her to live on her own, uh, even just to have an apartment.

So I'd with her getting up there in age, I just recommended that maybe why don't you come live with us and uh we can help you out?

And I think this is the best uh option we found for her.

  • Applicant Robert Nunes (Alchemy Development Partners, representing owner Nayep family) stated the current convenience store (C-store) business has declined dramatically since a 7-Eleven opened within half a block. Surveys of customers led the owner to seek a liquor store use. The applicant noted they operate a similar store in Fort Worth and proposed a full remodel including ADA compliance, landscaping improvements (trees/shrubs), and hiring security-trained staff to manage potential issues. Owner Kamless Mandel stated customers frequently ask for liquor, and a prior liquor license application was delayed due to a zoning change last year.
  • One letter of opposition was included in the packet; another was received after posting (referenced as signatures). No oral opposition was presented.
  • Commissioner Sumpter moved to approve PD25-14 with the conditions from the staff report; Commissioner Ware seconded.

Public Hearing – SUP25-9 (1012 Gaye Lane)

The applicant (owner Martin Franco) stated the unit is for his mother to live in as she ages. The accessory structure would include a bedroom, small bathroom, kitchenette, and living space. Under the UDC, lots under 1 acre can have up to three accessory buildings; RS-7.2 does not by right permit secondary living units – only RE (Residential Estate) does.
  • Applicant Chris Trevino (CT4 Construction) and Martin Franco emphasized the intent to house Franco’s mother. Period. This time I'll ask our administrator to read the speaker guidelines and general decorum for the meeting tonight. We ask that the citizens and other visitors in attendance assist in preserving the order and decorum of this meeting and to provide for attendance at and participation in meeting without fear of intimidation, threats, or hostility. Again, this is a 0.907-acre site, uh currently zone EDO community commercial with a request for a plan development for EDO community commercial uses plus a package liquor store. And this is just the UDC's uh definition for a package liquor store as an established license by the state for the retail sale of liquor, malt, and venous liquors for off-premises consumption. Again, this is the site location. It's located, excuse me, uh along North Collins Street, uh less than a little less than a quarter mile north of uh ATT Stadium. Again, these are the site photos, it's uh with it being located on uh North Collins Street is surrounded uh mostly by commercial developments with some residential uh developments across uh North Collins Street. And again, this is the overall uh site location, just with highlighted here. Uh what we're uh the PD is for is for this just specifically for this uh 2400 square foot site within this center that is currently a C store. Uh the existing center again is uh 11,98 square feet center uh with various uses, uh restaurants, barber and styling salon offices, and this convenience use.
