Up first, we have a presentation by Marcella, our city clerk on the process of filling the mayor vacancy.

Good evening, Vice Mayor and Councilmembers.

Today I will be giving a brief presentation on the mayor vacancy process.

As you know, Mayor Ken Weiss resigned as mayor effective October 13th to take on a new role with NASCAR.

While the mayor did submit his resignation notice, he was previously set to leave office at the end of this year as his term expires on December 31st, 2024.

Pursuant to our city charter, the council must first fill the vacancy within 31 days for both councilmember and mayor seats.

Therefore, the position of mayor must be filled by November 14th.

And on the screen before you is the section within the charter that states the vacancies must be filled for both councilmember and mayor within that 31-day period.

To make this vacancy process unique, Avondale did recently hold a candidate election on July 30th, and the individuals on the screen were voted into office and are scheduled to be sworn in in just a couple months in January.

Mike Paneda was voted in as mayor, and Jeanette Garcia, current councilmember Gloria Solario, and Sherry Weiss were voted in as council members.

One that was held in 2014, another in 2017, and the third in 2021.

For the first one, on May 27, 2014, Mayor Marie Lopez Rogers resigned to run as she was running in a county election seat.

On June 2nd, 2014, City Council voted and appointed Ken Weiss as mayor.

That appointment was actually a motion that was brought from Vice Mayor Frank Scott at the time, which passed.

On June 9th, 2014, City Council interviewed applicants applicants in an open meeting.

However, due to a failed motion, staff were were directed to rec recruit additional people, which were brought back at the end of June, and City Council interviewed nine applicants in an open meeting and appointed Councilmember Iwanski.

In 2017, on August 19th, 2017, Councilmember Sandy Nielsen passed away, and pursuant to our charter, her seat was required to be filled within 31 days.

On August 28th, City Council met and gave direction to staff on a recruitment process to follow.

That recruitment process included publishing an ad in a newspaper, followed by a notice of interest period for a little over one week.

The very next day, the city clerk's office opened that notice of interest period, and on September 11th, City Council interviewed all applicants, which was a total of eight in an open city council meeting and appointed councilmember Condi to the seat.

And the last most recently in 2021, Councilmember Dennis provided her resignation notice on November 29th, 2021.

She did provide a one-month notice, which allowed us two months in total to fill her vacant seat.

On December 15th, the City Clerk's office initiated the recruitment process, which included a notice of interest period to be opened for two weeks.

Interested residents were asked to submit the notice of interest and the resumes to my office.

On December 31st, we sent all applicants to City Council and asked City Council to anonymously rank the applicants due to the amount that we received.

There was a total of 13 interested applicants.

On January 3, 2022, Councilmember Dennis's last day occurred.

And on January 24th, 2022, City Council interviewed the top four applicants in an open city council meeting and that same night voted to appoint Councilmember Gloria Solario for the position that she holds today.

For this current process, City Council have a few different options on how they may move forward.

For the position of mayor, they can appoint a current city council member tonight, which would include resigning that current seat that that person holds.

They can direct staff to follow the previous vacancy process, which would look something like this.

On October 15th, we would open a notice of interest period for a period of seven days.

On October 23rd, we would ask City Council to anonymous anonymously rank the interested applicants.

And on November 4th, at that city council meeting, City Council would interview the top applicants and appoint a new mayor.

Or City Council could direct staff to follow a new vacancy process.

At this time, Vice Mayor and Council, I'm happy to answer any questions you may have, and I'll pass the floor back to you all for discussion.

Um I'm Levi Willow.

Um been a resident of Avondale since um let me see, December of 2020.

Uh sorry, I just got off of work.

I like rushed here.

Um I wanted to make a public comment on um, I guess for the future mayor of Avondale.

Um my public comments have to refer to um the concerns for the vast amounts of apartments that are being built everywhere.

Um I know it's needed for the growth of the city.

Um but I can I can um genuinely tell you whenever I moved here in um December of 2020, and you drive down Avondale.

Um I didn't see I didn't foresee the farm fields turning into um just unlimited apartments.

Um it's kind of sad to me that that happened.

Um I live near La Jolla um high school, and I'm hoping to have kids here in the future.

And it it worries me for what will happen with the school systems in Avondale um being overloaded.

Uh I know we definitely have a problem with groceries um stores, and I know there's things being implemented.

Um then I do want to just make sure that I um mentioned that I had a pleasure of um talking with city manager Mr.

Corbin and also um Ms.

Gregory.

And uh I believe they have our best interests, um, unlike Charles Montoya, and I would be interested to learn if there was anything with Charles Montoya and the vast amounts of apartments that have been installed and built in the city of Avondale because it's not only what's built right now, there's plans for more and more and more, and it's like never ending.

Um so it's just a little um concerning.

But other than that, you know, I appreciate Avondale for everything else, but it's it's the apartments that's concerning.

I appreciate this has been a quite interesting day, and I just want to first give honor to God, the Son, Jesus, and the Holy Spirit.

I hope the words of my mouth and the meditation of my heart are acceptable in thy sight, my strength and my redeemer.

As I take a look at my life's work and the path that brought me here, I'm trying to have equanimity.

I'm trying not to have a reaction.

I think all of us are gonna miss Ken.

And I think that we probably need to sit with that for a moment.

You know, we do we do um find excitement in his future, but I think somebody just mentioned the prior city manager, and our city attorney can probably confirm or deny whether we're still in litigation in regards to that person, and and I think that you know, concerns that are brought, we have no idea, you know, the penalty or anything that our former mayor or that person might have.

But when we look at our current posture as we approach this decision, our posture is the 2024 elections, and I guess I'm speaking to council specifically because I've seen a lot in my days in Avondale, but you know, on election day here in Avondale, I witnessed you know uh interference at the polls.

I I witnessed somebody um, you know, harassing people at the polls here in Avondale.

Two of our candidates were being um marginalized at the polls.

I saw that with my own eyes.

So I was here, and those of you who were here, you know I saw it.

You saw me watching.

And so, how did we all get to this dais?

We were all elected.

And how do we overcome voter suppression and influencing of elections here in Avondale is really the question because this to me, even our agenda, the way the agenda was built tonight, seems like it's a very influential process because the assumption is after we talk and have this discussion, we're installing a mayor, and I really did not come here to do that tonight.

I did not.

I came to learn from Marcella, and you always provide us with great information.

But I feel like our agenda is being influenced by outsiders, right?

So let me speak to why I feel this influence is important.

And I brought notes because I think that we need to not only speak to the elephant in the room, but address the elephant who's won the job because she has wanted to divide us.

We have a council member who has forced us into determining and telling everybody our party affiliation, and I've never had to do that to serve Avondale.

When I wake up and I serve Avondale, I have one client, and it's the people of Avondale.

That's it.

Whether you live here, whether you work here, whether you serve with me on the dais, our client are we serve the people.

And so today it was brought to my attention that the council member elect Jeanette Garcia noted in Twitter that the City of Avondale is having a special council meeting this evening because Avondale mayor is stepping down and they will have to vote a new mayor in and should be filling the seat for council member after we appoint our mayor.

If they do the right thing, they'll nominate Mike Pineda, who was elected to be mayor come January, and either myself or Sherry Weiss.

I nominate both Mike and Sherry.

Sherry was neutral council candidate whom they endorsed and supported.

These two were already elected by Avondale citizens, sincerely, council member elect Jeanette Garcia.

See, she's not here, and I want to bring her words here because she already put them out in the Twitter verse.

And I feel an undue influence to execute according to what she says, because I wanted to come here and make that decision at this meeting this evening, right?

I wanted to come and learn about this process.

I I don't want to make or take a recommendation for somebody who's living in Twitter right now and who'll be sitting amongst us.

I think that's immature.

And I really want to have it go a step further because I think some of the practices and things that we're seeing might need to be investigated by the state's attorney general.

I believe the state attorney general investigated matters regarding Mr.

Montoya.

Have we received a full report from them?

Vice Mayor, Council, Councilmember White.

Since that's pending litigation, I I would I don't feel comfortable answering that in this open session.

I can answer that in our next executive session update.

Absolutely, but I'm sure there was an AG investigation, and I'm sure the AG has enough to start looking at right now with this person who's speaking to us as well.

And when we think about things that have happened, I believe Councilmember Malone talked about our interaction at the detention center.

Um and also, you know, making us feel uncomfortable trying to serve.

I think that as we move forward, we want to make good decisions.

Some of the high marks for the city of Avondale is governance.

We have good governance here.

And I think that even as we have agendized what we want to do this evening, that doesn't give us the opportunity to really think through the process and actually entertain the process.

And so I think that with the intent of others to do us harm and divide us, I think we might need to press pause.

I think we have the opportunity to go into executive session today, but I really don't have the time for that either.

This is an unscheduled meeting.

I'm trying to manage my family.

I'm here.

I've made Avondale the priority, but I just made my daughter miss a wee ride to get to her AYAC meeting.

Um I'm forcing my son to be in the chambers this evening because I'm making Avondale, the city, the people a priority.

I'm actually pushing my family to the side because I've rearranged things here.

Because I think you Avondale is a priority.

Avondale is the priority.

But I'm I'm very uncomfortable because when I sit with my colleagues here and we have to make a decision, I feel like the unnecessary influence on our decision making is coming from organizations like Turning Point, Chase the Vote, I'll just speak it into existence.

I mean, there are MAGA people who do not want us to govern on our own.

They don't want us to use our own brains.

And that's because that is what she wore to the detention center.

So we we don't have to question that.

And in closing, I have to express nothing but gratitude.

Because people have elected me to serve with honor, and so I'm speaking on behalf of those people.

We want to aspire, we want to excel, we want to achieve.

But I think it makes me feel very uncomfortable to know that we're trying to make lives better, and people are targeting us up here.

I've been considered a bully.

We've been considered mean girls.

People have posted about us in the social media space.

And I think if we really wanted to execute, I believe in you, Mike.

I know you're gonna be a phenomenal mayor.

But I've even asked you to speak to this person and ask her to tone down her rhetoric about the city.

How are we gonna invite her to come and serve along with us with honor?

And she is trying to call the shots.

I don't want to do anything she recommended, which means I don't want to move to vote tonight.

If anything, I would like to move for us to explore our options.

But I would like the discussion to continue because I don't think we're taking this as serious as it needs to be.

And I don't think we should be um allowing ourselves to be victims of a situation we are in total control over.

And I really don't believe that we're gonna make a good decision if our decision is being told to us from Twitter.

And so if that's the decision we're making, I know that I choose not to participate this evening.

I think we need to take a break.

I think we've heard the options.

I think we have the opportunity to come back at our next meeting and have a work session and possibly go into an executive session and discuss these things amongst ourselves.

But I I've penciled out time, but I need to be able to pick my daughter up from AYAC, get my son home.

And I think that if people are going to use our time unwisely, I just want to share the circumstances I'm experiencing today and the pressure I feel and bring to the public record what is being done in private.

I don't know that I am uh ready to make a decision to instruct staff to spend the next two months trying to find a replacement for the mayor that would serve for two weeks, four weeks, whatever it might be.

Um I'm not an Instagram guy, sorry.

I stay off of social media as much as I can, so I'm not influenced by others.

Um my motion tonight would be to appoint our vice mayor who stood in and filled in as necessary through the past time when our mayor hasn't been here to be our next mayor, so we don't have to go through the process and discomfort of having them go out and find somebody else to put in or find out whatever we need to do.

So my recommendation is a motion to appoint Mike Benita as our next mayor to fill in for the next two two, two and a half months and then begin a service again once in uh January.

I too agree that you know as mayor, I was about to say vice mayor, but mayor Pineda said, um, we have a lot of momentum, and I think that's something that we've talked about in the past.

And you know what, we stand up here or sit back here and truly make decisions for our resident what you know with resident inputs.

The residents are our bosses.

I always say this all the time, you know.

We you know, we can be up here governing, but the residents are truly the people at the heart of the matter, and what a better way to, you know, we might not all agree at the same time and we have our differences, but what a greater thing to bring somebody on to our council that you know we feel you know we could bring up to speed, we can definitely work with them because we're all workable, we all have our own opinions, but we all work within one another pretty well.

Um and you know, even outside of work as well.

Mayor and Council, as we wrap up, uh, a couple things of housekeeping uh about these processes.

Um someone asked about the vice mayor's seat.

That'll be on the next agenda.

So council will um elect appoint a um vice mayor for the three months, and then again we'll do that again in January once the uh full new council is on board um for the the two-year term, which is normal, but this will be to replace your term as vice mayor, so we'll do that uh next week.

In addition, we'll be reaching out to our uh council new council member about the process, benefits and security and all that kind of stuff.

We'll get her on board or so she should look for a phone call from me uh and probably Marcella and a couple others uh tomorrow.

Um we will also be scheduling some pictures, possibly as early as Monday's meeting.

Um so stay tuned for that email.

So you know, put your finest on um because we do need to post this picture um for the next three months on our websites on our billboards and all that kind of stuff.

Um and again, we'll do it again in January, but we do want to have everything uh done correctly.

So a lot of housekeeping items coming up over the next couple of weeks.

Um but we'll we'll get on that as soon as as we can.

Councilman White Mayor.

Um unfortunately well, fortunately, I will be representing the city at uh in and Valley Metro out of the area.

I'm not sure if Pierre's staff is available to take a picture tonight of us to be able to post that.
