0:29

So anyway, we'll get started with the agenda.

0:33

Just any questions or changes or modifications to the uh meeting minutes for the February 3rd meeting.

Okay.

Speaker 1

1:01

We see no

Unassigned speaker

1:02

one.

Speaker 1

1:04

So let's move on to uh I guess new business.

1:09

First item up is um the garage waiver.

1:14

So you want to walk us through that one, Tom?

1:17

Sure.

1:18

It's a um a property that sits on a DN2 zone.

Unassigned speaker

1:23

Uh

Speaker 2

1:23

Yep.

Unassigned speaker

1:59

So

Speaker 4

1:59

I am Muni Jumpana, and I'm uh part owner of the V3 construction development.

2:04

Um the reason for we are requesting for the front load garage is like we don't have an alley access in the back on this particular lot, and there's a sewer line where we have to leave the easement, and uh the lot being like only like a narrow lot, we don't have like a space all the way to go back and put the garage in the back side.

2:26

Um so we tried different plans and uh we finally thought like you know, we if we we will at least request for a waiver to see uh the garage can be loaded front, and on the similar street, we have like a lot of other examples where the low garage is loaded in the front.

Unassigned speaker

2:43

So

Speaker 4

2:43

that we thought like that would be a great help for

Unassigned speaker

2:45

us

Speaker 4

2:46

to plan.

2:47

And we have kept our renderings also.

Speaker 1

2:50

Yeah, thank you.

2:51

We may have some questions for you at the regular meeting.

2:53

So I want to give you an opportunity to make a presentation now.

2:58

Sure.

2:58

Um

Speaker 5

2:58

any discussion or any questions every home except for one on the street has a garage facing the street.

Unassigned speaker

3:06

One

Speaker 5

3:06

right next to this property, and but the other one next to this property facing the street.

3:11

Yeah, I agree.

3:12

So

Speaker 6

3:16

microphone on

Speaker 1

3:18

the something up there a little bit.

3:21

There you go.

3:22

Yeah.

Speaker 4

Planning Commission Meeting Summary - February 17, 2026

The Bentonville Planning Commission held a Tech Review at 4:30 PM followed by a Regular Meeting and Public Hearing at 5:00 PM on February 17, 2026. The agenda included several land use waivers, rezoning requests, a major Planned Unit Development (PUD), and extensive public hearings on the proposed new Bentonville Community Code, Zoning Map, and Overlay Districts.

Consent Calendar

  • 8 items approved: The consent agenda included seven property line adjustments and lot splits, plus the Garage Waiver for V3 Construction at 420 SW Glover Street, which was moved from New Business. All were approved unanimously (7-0).

Public Comments & Testimony

  • Laurel Canyon LLC PUD: Applicants Chris Barrett and Bill Butler presented the project, noting it was reduced from 7 stories to 5 stories following staff consultation, and emphasized the need for increased density near the Walmart campus.
  • Bentonville Community Code: Architect Dave Burrisburg expressed general support for the code's direction.
  • Bentonville Zoning Map:
    • Developer Bill Butler urged the commission to take sufficient time to understand the map transitions and utility capacity implications.
    • New resident Scott Kilkenny urged the commission to integrate utility capacity planning into the zoning process.
    • Business owner Ronnie Robinson expressed confusion over the 300-page code and questioned public understanding.
  • Downtown Center Overlay District:
    • Representatives from the First United Methodist Church strongly opposed the overlay, stating the ground floor retail requirement limited church expansion and affordable housing development.
    • Property owners Toby Teeter and Nicole Pepper sought clarity on how the overlay would affect residential properties.
  • Downtown Neighborhood Overlay District:
    • Residents Judy Marquis, John Trellau, and Keely Bryce spoke in support of the overlay to protect historic character.
    • A property owner voiced strong opposition, arguing proposed setback requirements would unfairly prevent building a single-family home.

Discussion Items

  • Sidewalk Waiver and Fee-in-Lieu Policies: Staff presented draft criteria for fee-in-lieu and waivers. Commissioners debated specific thresholds, such as the 1/4 mile proximity to amenities and the 150-foot frontage exemption.
  • Clark Sidewalk Waiver (340 Crestview Drive): The commission rejected a direct waiver, instead approving a motion attaching a fee-in-lieu condition, allowing the funds to be used elsewhere.
  • Laurel Canyon LLC PUD (902-1002 SE 3rd Street): Commissioners discussed building scale, length (430 feet), height (60+ feet), and pedestrian-scale articulation. The PUD was approved, with final materials and articulation to be reviewed during Large Scale Development. The vote was 6-1.
  • Bentonville Community Code Review: Commissioner Dan raised several technical issues for staff review including limitations on cottage courts, townhouse lot widths, rooftop equipment screening, transition standards, and civic space definitions.
  • Downtown Overlay Districts: Staff acknowledged the Downtown Center Overlay language regarding ground-floor retail was poorly written. Boundaries and applicability to existing homes and churches were confirmed as major revision points.

Key Outcomes

  • Consent Agenda: Approved (7-0).
  • Clark Sidewalk Waiver (WAV26-0001): Approved with fee-in-lieu condition (7-0).
  • Faciszewski Rezoning (RZ25-0051, 401 N Main): Approved, R1 to DN-4 (7-0).
  • AP RE and Development Rezoning (RZ26-0001, 409 NW 7th): Approved, R1 to DN-1 (7-0).
  • Laurel Canyon LLC PUD (PUD25-0002): Approved (6-1).
  • Public Hearings Continued: All public hearings for the Community Code, Zoning Map, and Overlay Districts were left open. A final reading and potential vote are expected at the next planning commission meeting.
  • Overlay Districts Sent Back for Revision: Staff was directed to significantly revise the Downtown Center Overlay and address specific concerns with the Neighborhood Overlay before the next meeting.
