Summary of Proceedings

Carrollton Planning & Zoning Commission Meeting - June 2, 2022

The Planning & Zoning Commission of Carrollton, Texas, held a regular meeting on Thursday, June 2, 2022. The agenda included a briefing session at 6:00 p.m.; the regular meeting was called to order at 7:00 p.m. and adjourned at 7:43 p.m. All nine commissioners were present. The commission approved the consent agenda, conducted four public hearings, and received staff reports on recent City Council actions.

Consent Calendar

  • Approved the minutes of the May 5, 2022, meeting.
  • Approved a replat of Marchant Hebron Addition, Part 2, Lot 2R, Block A, an approximately 4.4-acre tract located on the south side of Nazarene Drive and north side of State Highway 121, approximately 385 feet north of Marchant Boulevard (Case No. PLRP 2022-065). The motion passed unanimously.

Public Comments & Testimony

No members of the public came forward to speak during the public comment periods for the four public hearing items. Staff noted that written public comments had been received for the AER Manufacturing case and that some telephone inquiries were received about the smoking establishments text amendment, but no opposition was voiced at the meeting.

Discussion Items

3. AER Manufacturing Alternate Screening Request (Case No. PLAW 2022-63)

  • Public hearing held for a request at 3405 Wiley Post Road on an approximately 13.535-acre tract.
  • The applicant sought approval to use a tilt-wall (not considered masonry) for approximately 425 linear feet along the southern perimeter instead of the required masonry screening.
  • Staff recommended approval with stipulations. The applicant stated his firm had worked with AER for over 30 years and designed the adjacent wall in 1995.
  • Motion to close the public hearing and approve with staff stipulations passed unanimously.

4. Coyote Ridge Golf Course Alternate Screening Request (Case No. PLAW 2022-060)

  • Public hearing held for an approximately 8.2-acre tract on the west side of State Highway 121, approximately 2,560 feet south of Carrollton Parkway.
  • The property is surrounded on three sides by single-family residences with a 10-foot retaining wall and substantial privacy fencing. The applicant proposed evergreen screening around a new equipment storage structure instead of a masonry wall.
  • Staff recommended approval. The applicant, representing Coyote Ridge Golf Club, explained that rising equipment prices and longer leases required better protection from sun and rain.
  • Motion to close the public hearing and approve with staff stipulations passed unanimously.

5. NS District Removal and LR-1 Land Use Amendments (Case No. PLZT 2021-250)

  • Public hearing held on a proposed zoning ordinance text amendment to eliminate the Neighborhood Service (NS) District and revise the LR-1 Local Retail District land use matrix by prohibiting theaters, beverage manufacturing, jewelry and silver manufacturing, and sign manufacturing.
  • Staff explained that no properties remain zoned NS; the three former NS properties were rezoned to LR-1 by City Council. Three of the four prohibited uses were already special-use-permit uses; theaters were allowed by right but unlikely to locate there due to height and lot size constraints.
  • Approximately 600 property owner postcards were sent within LR-1 areas and to owners within 200 feet; staff received no calls in response.
  • Motion to close the public hearing and approve with staff stipulations passed unanimously.

6. Smoking Establishments Text Amendments - Ratification of Ordinance 4066 (Case No. PLZT 2021-161)

  • Public hearing held to ratify Ordinance 4066, amending the Comprehensive Zoning Ordinance to separate 'smoke shop retailers' from 'smoking lounges,' add definitions (including 'smoking' as including vaping), require special use permits for smoking lounges, and adjust the districts for 'all other amusement and recreation uses and activities.'
  • Staff explained the ratification was needed because a March 17, 2022, Texas appeals court decision interpreted state notice requirements differently, requiring property owner notices in addition to the legal advertisement. No text changes were made from the version recommended by the commission in March and adopted by Council in April.
  • Staff confirmed the amendments are intended to tighten, not expand, where smoking lounges can locate. Council will consider the ratification on June 21, 2022.
  • Motion to close the public hearing and ratify Ordinance 4066 / approve the case passed unanimously.

Other Business - Staff Reports

  • Lauren Shapiro summarized City Council actions from May 3, 2022:
    • Approved a five-level multifamily residential building with retail and restaurant uses in the Trinity Mills Transit Center District (unanimous).
    • Approved alternative development standards for Plan Development 52 (Savoy 2 HOA), replacing a masonry wall with board-on-board fencing, and an associated special use permit (unanimous).
    • Approved a paint and body shop tent wrap at 1800 N. I-35 (unanimous).
    • Approved Mickey's Town Daycare at Marsh Lane and Keller Springs Road (unanimous).
    • Approved Carrollton Apartments on Belt Line (6-1 vote).
    • Approved zoning changes converting former NS properties to LR-1 (unanimous).
  • The Chair recognized Ms. Keller, who is leaving, thanking her for her service to the commission.

Key Outcomes

  • All motions passed unanimously (9-0), including the consent agenda and public hearing items.
  • Approved alternate screening requests with staff stipulations for AER Manufacturing (PLAW 2022-63) and Coyote Ridge Golf Course (PLAW 2022-060).
  • Approved the NS District Removal and LR-1 Land Use Amendments (PLZT 2021-250).
  • Ratified Ordinance 4066 and approved the Smoking Establishments Text Amendments (PLZT 2021-161); the item will be forwarded to City Council on June 21, 2022.
