Summary of Proceedings

Carrollton Planning & Zoning Commission Meeting – July 7, 2022

The Carrollton Planning & Zoning Commission held its briefing session at 6:45 p.m. and its regular meeting at 7:00 p.m. on July 7, 2022, in Council Chambers at City Hall, 1945 E. Jackson Rd. All nine commission members were present. The chair briefly misspoke the date when calling the meeting to order, then corrected it to July 7, 2022. The commission approved the consent agenda and four public-hearing cases; three were unanimous, and one (Frankford Shopping Center) passed on a 7–2 vote. The four public-hearing cases were forwarded to City Council for the August 2, 2022, meeting.

Consent Calendar

  • Approved unanimously the June 2, 2022, meeting minutes.
  • Approved unanimously the replat of Austin Ranch Subdivision, Lot 1, Block 1, an approximately 7.1-acre tract at 5000 Plano Parkway, combining two adjoining tracts into one lot (Case PLRP 2022-078, Freddie Mac Park).

Public Comments & Testimony

  • No public speakers came forward for Case PLSUP 2022-054 (Texas Car One), Case PLZ 2022-044 (Graham Addition PD-212 Amendment), or Case PLZ 2022-079 (Lowe's Canopy Addition).
  • For Case PLZ 2022-077 (Frankford Shopping Center), Brian Morrow of 1020 Magnolia Drive spoke in opposition, arguing the proposed two-story modern building would be incongruent with surrounding one-story retail and raising concerns about drainage, dumpster/trash placement, noise, crime, and vagrancy.
  • Whitney Springer of 1018 Magnolia Drive spoke in opposition, citing the original PD's mezzanine design, aesthetic mismatch with the Old Denton corridor, traffic cut-through concerns, absence of photometrics, and requesting a list of prohibited uses.
  • James Cheney of 1016 Magnolia Drive spoke in opposition, noting a 56-inch gas line running under or near the property.
  • Comment cards in opposition were also submitted by Pam Crow, Lindsay Morrow, Eric Roth, and James Cheney.
  • The Frankford Shopping Center applicant offered to relocate the dumpster enclosure farther from the south property line.

Discussion Items

  • Case PLSUP 2022-054 – Texas Car One: Staff presented a request for a special use permit for used automobile or light truck sales on an approximately 1.86-acre light-industrial tract at 1729 South Broadway Street. The site plan includes 21 parking spaces and two landscape islands; staff recommended stipulations including indoor display/storage of vehicles, on-property loading/unloading, and no outdoor banners. The applicant described an internet-based dealership with minimal walk-in traffic.
  • Case PLZ 2022-044 – Graham Addition PD-212 Amendment: Staff presented a request to amend PD-212 for an approximately 5-acre tract at the northwest corner of Josey Lane and Parker Road (FM 544). The amendment would revise conceptual plans, allow a drive-through window without a technical site plan for Building A, and modify development standards. Staff noted a right-turn bay dedication and a 20-foot landscape buffer with a four-foot right-of-way encroachment along Josey Lane; no traffic impact analysis was required.
  • Case PLZ 2022-077 – Frankford Shopping Center: Staff presented a request to amend PD-57 for an approximately 2.2-acre O-2 office tract at 1033 West Frankford Road. The proposal replaces an unbuilt concept with a two-story building, revises the rear setback to about 52 feet, adds passive retail uses, modifies development standards, and removes the technical site plan requirement for the drive-through. Staff recommended a 50-foot minimum rear setback, limiting retail to approximately 3,600 square feet, and late addenda requiring the dumpster to be rotated 45 degrees and the westernmost driveway eliminated. Public opposition was substantial; commissioners discussed the retail definition, traffic analysis, pedestrian connectivity, and legal limits on considering aesthetics and economic viability.
  • Case PLZ 2022-079 – Lowe's Canopy Addition: Staff presented a request to amend PD-5 for an approximately 16.9-acre tract at 1253 East Trinity Mills to add a canopy to the Lowe's building. The applicant was not present; staff read a statement on their behalf. The canopy would cover four short-term parking/loading spaces and two drive-through lanes, add no impervious area, and require no tree removals. The previously approved tool rental expansion has not been built but remains on the plans.

Key Outcomes

  • Approved the consent agenda unanimously.
  • Approved Case PLSUP 2022-054 unanimously, with staff stipulations and an amendment to stipulation E removing the words 'on the vehicle inventory or elsewhere' so that banners, inflatables, balloon pennants, and similar signs/products are prohibited outdoors.
  • Approved Case PLZ 2022-044 unanimously with staff stipulations.
  • Approved Case PLZ 2022-077 with staff stipulations as modified: retail use as defined in CZO Article 34 and the 3,600-square-foot retail limit were removed, the dumpster rotation stipulation was added, and the westernmost driveway was required to be eliminated. The motion passed 7–2; Commissioners Foster and Martin voted against.
  • Approved Case PLZ 2022-079 unanimously with staff stipulations.
  • The four public-hearing cases were forwarded to City Council for the August 2, 2022, meeting.

Staff Reports & Other Business

  • Staff reported that City Council unanimously approved on June 21, 2022 the Neighborhood Services zoning text amendment and the smoking lounge/smoke shop retailer ordinance after rehearing.
  • Staff announced upcoming events, including a July 29 elected officials and commissions workshop in Southlake, an August board/commission meet-and-greet, an October boards and commissions dinner, and Focus North Texas 2023.
  • The commission discussed placing a future agenda item to consider moving regular meeting times to 6:00 or 6:30 p.m.; staff noted the meeting time is in the ordinance and should be formally agendized.

The meeting adjourned at approximately 9:00 p.m.
