Speaker 4

4:04

Thank you, Chair.

4:05

Commissioners, this is a this is a replat request in order to change the address for a property located here on the northwest corner of Bellmead and Golden Bear Drive.

4:19

The applicant is an addition requesting a sidewalk waiver.

4:24

As you can see, here is the plat.

4:26

It is meeting all requirements of our subdivision ordinance.

4:29

Moving on to the paving plan, I wanted to show you where the sidewalk waiver is being made.

4:36

As you can see, um the sidewalk waiver would only be made for the um portion of Bellmead Drive on the south portion of the property.

4:47

So it's the north side of Bellmead on the south side of the property, is where the sidewalk waiver request would be made.

Unassigned speaker

4:57

Uh I circled over there on the bottom left-hand corner.

Speaker 4

5:02

The um applicant is um mitigating the proposed removal of that sidewalk with the waiver and requesting that instead a mid-block crosswalk be constructed to connect to the south side of Bellmead Drive.

5:17

Um there is an existing sidewalk already on that portion along Bellmead where you can see the um crosswalk connects it, and then that larger more oval section that I circled shows the portion of the sidewalk that the developer would have to build in order to finish out that sidewalk so it reaches golden bear.

5:36

Um the site already has a sidewalk that they constructed along Golden Bear Drive, so then a crosswalk would um connect those sidewalks on either side of um Bell Mead along Golden Bear Drive to still establish connectivity.

5:52

Staff is recommending approval.

5:55

And um before I um ask if the commission has any questions.

5:59

I also want to point out that the purpose of the sidewalk waiver is uh in relation to a hardship related to the age of the trees, mostly live oaks along um the north side of Bellmead Drive in that property.

6:16

Um the potential impact on their route system should a four-foot sidewalk be built to the back of curb um could potentially create irreversible damage to those trees.

6:26

So, in order to better preserve the those trees based on their age and their size, um staff is in support of a sidewalk waiver, uh, especially with the consideration that there is still connectivity being promoted with the mitigation strategy uh proposed by the developer and their staff.

Carrollton Planning & Zoning Commission Regular Meeting – September 1, 2022

The City of Carrollton Planning & Zoning Commission held a regular meeting on September 1, 2022, at 7:03 p.m. in the City Hall Council Chambers. Eight of nine commissioners were present, with Commissioner Foster absent. The Commission approved a consent agenda, took action on one individual consideration item, held public hearings on eight items, and received an address from the new Mayor. The meeting adjourned at 9:20 p.m.

Consent Calendar

  • Minutes: The Commission unanimously approved the meeting minutes from August 4, 2022.

Individual Consideration: Texas Highlands Replat

  • Texas Highlands Addition, Phase 4 Lot 3R (PLSW 2022-122 / PLRP 2022-120): The Commission unanimously approved a replat and sidewalk waiver for an approximately 6.26-acre tract at the northwest corner of Belmeade Drive and Golden Bear Drive. The sidewalk waiver was granted to protect mature live oak trees, mitigated by a proposed mid-block crosswalk.

Public Hearings & Commission Actions

Item 3: Lone Star Villas Replat (PLRP 2022-118)

  • Project: A replat combining three adjoining tracts into 19 townhome lots on approximately 2.85 acres at the southeast corner of Old Denton Road and Whitlock Lane.
  • Public Comment: Three comment cards were submitted indicating support. No oral testimony was given against the project.
  • Action: The Commission unanimously approved the replat, officially finding the right-of-way dedication to be necessary and proportional to the proposed development.

Item 4: Pour Choices Amusement Arcade SUP (PLSUP 2022-113)

  • Project: A Special Use Permit for an amusement arcade (excluding adult arcade) in a 2,455 sq. ft. suite at 1107 South Broadway Street.
  • Public Comment: Architect Terry Wright spoke in favor of the project and asked staff to clarify the distinction between coin-operated arcade machines and free gaming machines found in restaurants.
  • Action: The Commission unanimously approved the SUP with staff stipulations.

Item 5: Diamond Flats PD Amendment (PLZ 2022-116)

  • Project: An amendment to Planned Development District 163 to allow a four-story, 328-unit multifamily development with 5,000 sq. ft. of ground-floor retail and a six-story parking garage on 6.9 acres at the northwest corner of Carrollton Parkway and SH 121.
  • Public Comment: Tim Hare (Church Administrator) and Pastor Brent Taylor of First Baptist Church of the Fields spoke strongly in favor of the project. Taylor cited the church's near-unanimous vote of support and expressed a preference for multifamily over retail to ensure a compatible use with the church's community sports complex.
  • Action: The Commission unanimously approved the PD amendment. The case was forwarded to City Council for consideration on October 11, 2022.

Item 6: Repeal of Planned Development 124 (PLZ 2022-132)

  • Project: City-initiated repeal of a PD for a 1.21-acre tract at 1401 West Hebron Parkway, originally approved for a car wash. The PD was deemed unnecessary after a Special Use Permit was recently approved for the site.
  • Action: Unanimously approved and forwarded to City Council.

Item 7: Repeal of Planned Development 139 (PLZ 2022-129)

  • Project: City-initiated repeal of a PD for a 4.62-acre tract at the southeast corner of North Josey Lane and East Trinity Mills Road, originally approved for a cell tower. The PD was deemed unnecessary after an SUP recently allowed a taller tower.
  • Action: Unanimously approved and forwarded to City Council.

Item 8: Repeal of Planned Development 191 (PLZ 2022-128)

  • Project: City-initiated repeal of a PD for a 66.46-acre tract at the northwest corner of Belt Line Road and Columbian Club Drive. The PD provided alternative building material standards, which are now preempted by state law, and was deemed inflexible for redevelopment.
  • Action: Unanimously approved and forwarded to City Council.

Item 9: Landscaping Text Amendments (PLZT 2022-133)

  • Project: A comprehensive update to Article XXV (Landscaping and Buffering) of the Comprehensive Zoning Ordinance.
  • Key Changes: Update terminology and organization; increase minimum landscape area from 10% to 15% of total lot area; allow curbless parking lot islands for innovative stormwater management; increase minimum buffer width from 5 ft to 10 ft; update tree planting ratios; and establish a variance process via the Board of Adjustment for artificial turf in hardship situations (artificial turf remains prohibited in city parkways).
  • Action: Unanimously approved (8-0).

Item 10: Infill Development PD Text Amendment (PLZT 2021-249)

  • Project: An amendment to Article XIX to allow Planned Development districts on lots smaller than five acres specifically for the purpose of infill development, a response to the city reaching 98% build-out.
  • Public Comment: This item drew significant public testimony. Members of Grace Lutheran Church spoke in favor, stating the flexibility would allow them to develop underutilized property. Several residents (Candy Peak Ross, Cindy Hilton, Jean Bassinger, Henry Lee, Rahat Khan, Barbara Rayleigh) spoke in opposition, arguing the change constitutes a de facto zoning change that threatens residential neighborhoods, encourages overdevelopment, and circumvents existing development tools.
  • Commission Debate: Commissioners expressed mixed views. Denholm characterized the change as minor given the existing public hearing process. Windrow and Yarborough were initially on the fence, emphasizing the need for high quality standards. Powell supported it, arguing the formal PD process is a strong tool for managing infill development quality.
  • Action: The motion to approve the text amendment with staff stipulations passed. The case was forwarded to City Council for consideration on October 11, 2022.

Other Business

  • Mayor's Address: The new Mayor addressed the Commission, thanking them for their diligent service and emphasizing the importance of their detailed reviews and recommendations as vital input for the City Council's decision-making process.
