Discussion Items

  • Case PLSUP 2022-138 – Glass Doctor of North Texas Used Automobile Sales (Item 5): Staff reported that the applicant requested a continuance to the December 1, 2022, Planning and Zoning Commission meeting. The commission voted unanimously to keep the public hearing open and continue the case to that date.
  • Case PLSUP 2022-146 – Vapor Depot (Item 6): Staff planner Loren Shapiro presented a request for a Special Use Permit for a smoke shop retailer in an 875-square-foot suite at 1208 East Belt Line Road, Suite 112, within the Downtown Transit Center District. Staff recommended approval, noting that smoke shop retailers are generally allowed by right in other commercial districts but require a special use permit in transit center areas; staff also noted there are more than 50 smoke shops across the city. Staff stipulations would prohibit food and drink service and keep the business as a retailer. The applicant, Sikunder Lalani, stated he agreed to the special use permit conditions. No public speakers commented. The commission closed the public hearing and unanimously approved the special use permit with staff stipulations.
  • Case PLZT 2022-165 – CZO Text Amendment for Public Hearing Notice for CZO Text Changes (Item 7): Staff planner Loren Shapiro presented an ordinance text amendment to Article XXXI of the Comprehensive Zoning Ordinance relating to public notice for zoning ordinance text amendments. The amendment would reaffirm the city’s conformance with state law, which requires newspaper notice 15 days before City Council hearings and mailed notice to property owners within 200 feet at least 10 days before Planning and Zoning Commission hearings for map or boundary changes. The amendment would add language clarifying that CZO text changes may be noticed by newspaper publication without mailed notice to property owners, while preserving the existing mailed-notice requirements for rezoning and zoning map changes. Commissioner Kramer expressed concern that newspaper notices are not effective for residents who rely on the internet and suggested the city consider email notification to property owners. Commissioner Martin said the proposed wording seemed confusing. Staff noted that a prior text amendment would have required about 23,000 mailed notices and cost the city tens of thousands of dollars, and that notices are also posted on the city website. No public speakers commented. The commission closed the public hearing and unanimously approved the text amendment.

Other Business

  • Staff reported that the City Council had recently approved several items previously considered by the commission, including landscape regulation changes, a special use permit for an arcade, the Diamond Flats multifamily mixed-use development, repeal of planned developments for the Halliburton property, a car wash, a communication tower, and a resident suites project with a 90-room Hilton-brand hotel and a Hampton Inn. Staff also offered additional commissioner training and welcomed new commissioners.

Key Outcomes

  • Consent agenda items 1 through 4 approved unanimously with staff conditions.
  • Case PLSUP 2022-138 continued to December 1, 2022; public hearing left open.
  • Case PLSUP 2022-146 approved unanimously; forwarded to City Council on December 6, 2022.
  • Case PLZT 2022-165 approved unanimously; forwarded to City Council on December 6, 2022.
  • All votes during the meeting were unanimous.
