Summary of Proceedings

Carrollton Planning & Zoning Commission – September 7, 2023

The Carrollton Planning & Zoning Commission met on Thursday, September 7, 2023, calling the regular meeting to order at 6:38 p.m. Seven of nine members were present; Commissioners Doyle and Powell were absent. The commission acted on a four-item consent agenda and held three public hearings: a used-car dealership SUP amendment, a school district lighted athletic field PD, and a short-term rental SUP request.

Consent Calendar

  • Approved the August 3, 2023 meeting minutes.
  • Approved replat PLRP 2023-078 for New Car Concepts Lot 1, Block 1 and Metrocrest Office Addition No. 1, Lot 1, Block 1, an approximately 2.748-acre tract at 1420 Westway Circle and 1910 Old Denton Road, to adjust lot lines and dedicate easements.
  • Approved replat PLRP 2023-079 for Cottonbelt West Industrial Park Lot 1, Block 4 and Block 4, an approximately 14.545-acre tract at 2080 and 2020 McDaniel Drive, to dedicate a mutual access easement.
  • Approved replat PLRP 2023-081 for Trinity Mills Professional Park Lot 1A, Block A, an approximately 2.342-acre tract at 2763 East Trinity Mills Road, to dedicate easements.
  • The motion to approve items 1-4 was made by Commissioner Overholt, seconded by Commissioner Foster, and passed unanimously (7-0, with two absent). Replats 2-4 were approved with stipulations.

Public Comments & Testimony

  • For the Texas Car One SUP amendment (PLSUP 2023-073), no public speakers appeared, but staff reported one written comment in opposition. Applicant Homan Sapossi spoke in favor, describing Texas Car One as an online/satellite dealership, explaining the need for 48 additional outdoor display spaces, and saying the service/paint shop performs only light reconditioning and outsources major work.
  • For the DeWitt Perry Middle School lighted athletic field PD (PLZPD 2023-074), no public speakers appeared; the chair noted one card in favor.
  • For the 2109 Marin short-term rental SUP (PLSUP 2023-077), five neighbors spoke in opposition: Robert Rizzo (2106 Marin), Francis Fu (2103 Marin), Gay McFarland (2105 Marin), Kathy Springs (2106 Marin), and Gretchen Grinnell (2135 Hunter's Ridge). Their concerns included property values, transient/motel-like use, parking and traffic on a corner lot, safety of children at nearby park/school, police workload, lack of a fence, and compatibility with an established single-family neighborhood. Applicant Fuang Din spoke in favor, promising guest screening, cameras, noise detectors, no street parking, and proximity to the property.

Discussion Items

  • Case PLSUP 2023-073 (Texas Car One, 1729 South Broadway): Staff Planner Mike McCauley explained that SUP-486 was approved about a year earlier with indoor-only vehicle display. The applicant requested outdoor display of up to 48 vehicles plus accessory repair garage and paint/body shop. Staff opposed the change, citing the corridor's no-outdoor-inventory vision, and provided denial stipulations. Commissioner Overholt questioned the city's objection to outdoor display but considered the paint/body shop inappropriate next to residences. The motion to close the hearing and approve with stipulations failed.
  • Case PLZPD 2023-074 (DeWitt Perry Middle School, 1709 East Belt Line Road): Staff presented a proposed planned development for a lighted athletic field with four light fixtures up to 70 feet high. The football field/track is allowed by right; the PD was solely for the lights. The proposal met the city's glare ordinance. Applicant Bobby Shaw, CFBISD Director of Facility Services, said the project replaces existing lights in a new location during a renovation. The motion to approve with stipulations passed unanimously and was forwarded to City Council.
  • Case PLSUP 2023-077 (2109 Marin): Staff recommended denial, citing neighborhood opposition and potential adverse impacts. Brian Passwords, Community Services Manager, outlined the city's new short-term rental ordinance: annual registration, inspections, on-site parking, occupancy limits, noise/curfew restrictions, and no special events. He estimated 300-400 unregistered short-term rentals citywide, with application intake starting in January. Commissioner Overholt expressed support for short-term rentals generally and moved to approve the request. The commission heard extensive neighbor opposition and the motion to approve with stipulations failed.

Key Outcomes

  • Consent agenda approved unanimously (7-0).
  • PLZPD 2023-074 approved unanimously (7-0) and forwarded to City Council for October 10, 2023.
  • PLSUP 2023-073 (Texas Car One) did not pass: 4 against, 3 for, 2 absent. The applicant has 10 days from the September 7, 2023 hearing to file a written appeal to City Council.
  • PLSUP 2023-077 (2109 Marin) did not pass: 4 against, 3 for, 2 absent. The applicant has 10 days from the September 7, 2023 hearing to file a written appeal to City Council.
  • The meeting adjourned at approximately 7:55 p.m.
