Charlotte City Council Zoning Meeting - August 18, 2025

The Charlotte City Council held a Zoning Meeting on Monday, August 18, 2025, at 5:00 PM in the Council Chamber of the Charlotte-Mecklenburg Government Center. The meeting was presided over by Mayor Pro Tem Danté Anderson and included an invocation by Councilmember James Mitchell and the Pledge of Allegiance led by Boy Scout Troop 8 from St. Matthew's Catholic Church. The agenda consisted of a Consent Calendar, Decisions on previously heard petitions, and Public Hearings on new rezoning requests.

Consent Calendar

  • Rezoning Petition 2025-037 (Eastgroup Properties, L.P.): 1.23 acres located north of Shopton Road, east of Pinecrest Drive, and west of Beam Road. Rezone from I-1(CD) ANDO and N1-A ANDO to N1-A ANDO and ML-1(CD) ANDO. Approved unanimously.
  • Rezoning Petition 2025-038 (Longvalley II, LLC): 7.76 acres located north of Forest Point Circle, east of Forest Point Boulevard, and south of West Arrowood Road. Rezone from B-D(CD) to OFC. Approved unanimously.

Public Comments & Testimony

  • Petition 2025-027 (Mission City Church and Freedom Communities): Residents Beth Lammons, Joyce Bunn, Philip Bunn, Bridget Harvey, and Dwayne Jordan opposed the rezoning of 4.77 acres on Valleydale Road from N1-B and CG to N2-A(CD) for up to 43 affordable townhomes. Concerns included traffic, loss of property, proximity to homes, litter, noise, and changing neighborhood character. The petitioner (Eddie Moore, Mark Talbot, Pastor Kyle Dillard) emphasized the need for affordable housing at 80% AMI and community benefits. Councilmember Malcolm Graham expressed skepticism due to the narrow entrance and proximity to existing homes.
  • Petition 2025-032 (Queen City Land): Resident Alison Ray Timothy (and 17 signatures) opposed rezoning 15.8 acres at Plaza Road Ext and Hood Road to NC(CD) and N2-A(CD) for 94 townhomes and commercial space. Concerns included broken promises about no building behind homes, traffic, lack of infrastructure, flooding, and property taxes. Petitioner Colin Brown noted the site is currently zoned for a shopping center and that 25% would remain undeveloped. Staff did not recommend approval in current form.
  • Petition 2025-042 (Bryan Elsey): Marjorie Parker, president of Hidden Valley Community Association, opposed rezoning 6.42 acres on Tom Hunter Road from N1-B to N2-B(CD) for 168 workforce housing units (60% AMI). Cited traffic dangers, lack of pedestrian crosswalks, and cumulative infrastructure impacts. Petitioner Brian Elsey offered to contribute to a benefit district for a crosswalk.
  • Petition 2025-060 (Mecklenburg County): No opposition; proposed rezone of 27.47 acres on East W.T. Harris Boulevard from R-20 MF(CD) to N2-C(EX) for a public park with inclusive playground and trails. Approved.
  • Petition 2025-043 (City of Charlotte): No opposition; rezone 2.37 acres on Chipley Avenue from N2-B to CAC-1. Approved.
  • Petition 2025-081 (City of Charlotte on behalf of Samaritan's Purse): No opposition; rezone 2.9 acres on Nations Ford Road from IMU to OFC. Approved to correct a text amendment issue.
  • Petition 2024-141 (NVR, Inc.): 107.31 acres near North Tryon Street and I-85. No public opposition; rezone to N2-B(CD) for 575 townhomes with park dedication. Discussed traffic and connectivity.
  • Petition 2025-009 (Davis Moore): 40.43 acres on Johnston Road. No opposition; rezone to INST(CD) SPA for hospital expansion. Approved.
  • Petition 2025-034 (Veer Homes, LLC): 6.20 acres on Allison Lane. No opposition; rezone to N2-B(CD) for 79 townhomes. Approved.
  • Petition 2025-040 (TDC Greenville, LLC): 2.21 acres on Statesville Avenue. No opposition; rezone to MUDD(CD) SPA with affordable units. Approved.
  • Petition 2025-046 (Northway Homes LLC): 0.17 acres on Tappan Place. No opposition; rezone from CG to N1-C. Approved.
  • Petition 2025-048 (Castlebridge Residential Development): 7.96 acres on Sunset Road. No opposition; rezone to N2-A(CD) for 80 townhomes. Approved.
  • Petition 2025-049 (High Street District Development, Inc.): 32.35 acres in ETJ near North Tryon Street. No opposition; rezone to N2-A(CD) for 190 townhomes with park dedication. Discussed cumulative impacts.

  • Petition 2025-053 (David Powlen): 34.03 acres on Albemarle Road. No opposition; site plan amendment for medical office expansion. Approved.
  • Petition 2025-054 (Bisbikis Property Group): 1.08 acres on Little Rock Road. No opposition; conventional rezone from N1-A(ANDO) to CG(ANDO). Approved.
  • Petition 2025-055 (Porcha Thomas): 0.52 acres on Parkwood Avenue. No opposition; rezone from NS to NC(CD). Approved.
  • Petition 2025-056 (Delray at Providence Road West, LLC): 10 acres on Providence Road West. No public opposition; rezone to N2-A(CD) for 110 townhomes. Discussed school capacity concerns.

Discussion Items

  • Traffic and Infrastructure: Multiple council members, including Malcolm Graham and Dimple Ajmera, raised concerns about state-owned road conditions and the need for better coordination with NCDOT. Reneé Johnson and others emphasized cumulative impacts on schools and infrastructure, requesting maps of approved developments within one-mile radii.
  • Workforce Housing: Many petitions included affordable housing components (e.g., 60% or 80% AMI). Councilmembers expressed support for increasing homeownership opportunities but noted location and site design must be appropriate.
  • Process and Transparency: Councilmembers LaWana Mayfield, Dimple Ajmera, and Reneé Johnson discussed the difference between conditional and conventional rezoning petitions, with staff clarifying that conventional petitions allow development under standard UDO rules without site-specific conditions.

Key Outcomes

  • Consent Calendar: Items 3 and 4 approved unanimously.
  • Decisions: Items 5 (DreamKey Partners) and 6 (EB Property Group) approved unanimously. Item 7 (True Homes) approved 10-1 (Mayfield opposed). Item 8 (Wilkes Asset Management) approved 10-1 (Mayfield opposed). Items 9 (Sage Investment Group) and 10 (Canvas Residential Partners) approved with Mayfield opposed. Item 11 (Summit Avenue Wesley Heights) approved unanimously.
  • Hearings Closed: All public hearings were closed by unanimous votes. No final decisions were made on hearing items; they will proceed to the Zoning Committee of the Planning Commission for review and recommendation at a later meeting (date not specified).
  • Notable Referrals: The Mission City Church petition (2025-027) was deferred for further discussion between Councilmember Graham, residents, and the petitioner. The Queen City Land petition (2025-032) and the True Homes petition (2025-042) were also sent to the Zoning Committee with staff recommendations for modifications.
