Beer board meeting.

7:31

Uh all meeting attendees must sign in the designated sign in sheet in order to qualify uh meet the sunshine law requirements.

7:39

Uh, we do ask everybody to turn off or silence your electronic devices at this time so as not to disrupt the meeting.

7:47

And individuals wishing to address the board must do so from the podium.

7:52

Please state your name before making your comments, and please speak up.

8:04

No motion.

8:06

All in favor of approving the minutes signify by saying aye.

8:09

Opposed.

8:25

So Lori, if you would take care of that for us, please.

8:58

So we have uh none.

9:02

Okay.

9:04

And we have new temporary beer permit applications.

9:20

Number two, and uh, Smart Music Project Twilight Grand Market.

9:46

One is one hundred food eight OLC.

10:01

It's gonna be consumer.

10:03

Um beer 1321.

10:07

And zoning is not signed off on that.

10:10

All right.

10:10

But everything else has been approved.

10:12

Okay, so they're just both those are awaiting zoning.

10:15

Zoning, yes.

10:15

Okay, very good.

10:24

Okay.

10:24

Is there anybody here representing these two applications today?

10:29

Okay.

10:31

All right, thank you very much then.

10:33

So hopefully the zoning will get on that and get it approved.

10:52

Okay.

10:53

Next item on our agenda is uh we need to call on that take any action.

10:59

Uh on the on the on two and third two.

11:04

That we're not.

11:05

No, well they're pending they're pending legal's approval.

11:08

Zoning zoning zoning, excuse me.

11:10

I'm sorry, apologize.

11:12

Pending zoning's approval.

11:14

So is that Zach?

11:17

No.

11:18

Yeah, that's that.

11:19

So I don't uh I don't see that we take any action.

11:23

I'm passing those to the regulator.

11:26

Well, do you want to pass them to the next meeting and then uh go from there and then I guess I see somebody walking in here that's the uh temporary for the twilight grand market?

11:41

Their date is August 30th.

11:44

Um so the board can either let regulatory approve once it's okay once zoning has done it, or um you could vote to approve pending zoning signing off so how we all want to do that because you if you want Zach said he's right on Market Street, so he's gonna wait on people of the meeting.

12:10

Uh yeah, yeah, we do.

12:12

So he's the knowledge you want to just put it off the jail or end.

12:15

So I'll tell you what let's do.

12:16

Is there a motion that we uh uh push these uh temporary beer permit and new beer application to the end of the meeting when Zach will be here from zoning?

12:27

He's on his way now, but he's late.

12:29

Question how do we get there?

12:31

Did we make a decision on number one first?

12:33

That's what we're done.

12:34

Yeah, that's that's what we'll do is we'll do uh number one.

12:40

Number one has been approved.

12:41

Number one has been approved.

12:44

Christie said it was nothing approved by regulatory.

12:46

Okay, maybe I didn't hear that.

12:50

Number two is is awaiting zoning and uh then the beer new beer application is awaiting zoning.

12:58

So is there a motion that we push this motion that we hold those two to the end of the meeting?

13:03

Right.

13:03

Thank you.

13:04

Is there a second?

13:06

We do have a representative number two smart music project twilight grand market.

13:11

He is here.

13:11

We're gonna we're awaiting the zoning person, so we're gonna put you at the push you to the end.

13:16

So there's a motion and a second.

13:17

Did I hear a second?

13:18

Yeah, yeah.

13:20

I don't remember who it was.

13:22

Okay, thank you, Ron.

13:23

All in favor of uh uh pushing the uh um new new temporary beer permit application and new beer applications to the end of the meeting.

13:36

Say aye.

13:36

Aye opposed, all right, very good.

13:39

Then we'll pick that up here in just a little while.

13:44

Okay, uh we've got something a little bit out of order here, but right now we need to uh review the beer violation vote from the board uh on the hearing of previous beer violation report and recommendations of hearing officer Trevor Ashley heard on August 7th, 2025 in reference to Yasmin Springs major paper entertainment LLC doing business as the Dream 2308 glass free and uh the hearing officer actually sustained the violation and recommended a 10-day suspension.

14:26

So now we must either vote to approve or change that to how we want it to be.

14:35

So is there a motion to affirm the hearing officer's recommendation and uh ruling of uh suspending a 10-day suspension?

14:47

I'll make a motion and we sustain uh 10 day suspension by that was um recommended by uh officer Trevor Trevor Ashley.

14:58

All right, is there a second?

15:01

Second all right, discussion to the motion okay, hearing none.

15:09

I'll call the roll.

15:10

Christy, yes, yes, Veronica, yes, Ron, yes, JW, yes, Reginald, yes, yes, and uh Zach is not here, and the chair votes, yes.

15:27

So that mo that uh uh passes, and so we uh affirm the violation.

15:37

Yeah, uh the dates of the date suspension.

15:41

Let's see, we need to make it uh we I had a question on the before we did the dates is ABC been there and I don't know who asked us to because they're not here at River.

15:58

Has ACBC already had a visit with them on what they wanted to do for this violation, or have they not showed up?

16:07

You know, I thought about that, but do they have the same code violations that the beer board has, right?

16:12

So this was a beer code violation.

16:14

Does he?

16:15

Yeah.

16:16

I I don't know that.

16:17

Yeah, well, I don't know if that's even they're separate relevant.

16:21

That's the way I it's a separate agency, yeah.

16:23

Yeah, so we it only reason I ask is if ABC wants to you know be in on that.

16:34

We usually give them two weeks from the day or whenever we decide to set uh uh penalties for uh if ABC doesn't want to be in it, we can go to one week set it off for one week instead of the two let me get my calendar out okay with each other I don't know so let's get our calendar out here just a second just so you know ABC does know about the violation.

17:07

Okay, uh I don't know if they're gonna do anything or not.

17:10

Right, gotcha.

17:11

I understand.

17:13

Uh so uh when would we like for this uh this 10-day suspension to start normally we give it uh is it two weeks?

17:26

Normally it's two weeks.

17:28

Um however I don't have the order ready today, okay.

17:32

So um if I could suggest that we do the two weeks so that I can prepare the order and they have service of it um before the the suspension actually goes into effect.

17:46

Okay, so is there a motion to set it for one be uh the September 4th?

17:55

Okay, so what we're looking for is a motion to start this suspension on September 4th.

18:03

I I didn't have a question.

18:04

No, okay.

18:06

Is there a motion?

18:10

How did I do have a question?

18:13

How difficult would it be to get it done in a week?

18:15

Because if we do it in a week, that's a major holiday.

18:19

It's a big drinking holiday, just something to consider if we can start the suspension then we can do it if we want multiple multiple violations, yeah.

18:31

So I uh astern we can set it difficult punishment, would hopefully get a point across good point, but um, I'm asking you would that be too much of a strain on you to get it served and dealt with by next week?

18:47

I can get it, I can get the order drafted today.

18:51

I need Dan's signature on it, and then um I can send it to Ms.

18:55

Bertha for I think we have their email addresses and whatnot, or it's just a it's just something to I'm thinking about it now.

19:05

You guys can think about it.

19:07

All right, so discussion about this.

19:11

Then I'll ask for a motion from the board I make a motion to suspend the license for the dream for the dates August 29th, which is a Friday to September 7th, which looks like a Sunday.

19:26

Uh all right, there's a motion.

19:28

Is there a second to that?

19:30

A second.

19:31

Okay.

19:32

Second by the thank you.

19:36

Uh discussion to the motion.

19:40

All right, I'll call the roll.

19:42

Uh Betsy?

19:44

Yes.

19:45

Reginald JW?

19:52

Yes.

19:53

Ron?

19:54

Yes.

19:54

Veronica?

19:55

Yes.

19:56

Brooke?

19:57

Yes.

19:58

Christy?

19:59

Yes.

20:00

And the chair votes, yes.

20:00

So it will start on.

20:05

29th.

20:06

Okay.

20:07

Very good.

20:07

Thank you very much.

20:16

September 7th.

20:22

All right.

20:26

Now let's go back.

20:27

We'll we'll circle back.

20:29

Zach, you're here now.

20:30

Zach, we've got two questions on zoning.

20:34

Yes, ma'am, please.

20:36

Back up for a minute.

20:36

You saw me swear for it, or just later about moving the truth?

20:39

The whole truth and nothing.

20:40

But the truth selling God?

20:43

So we're gonna start now.

20:45

Veronica.

20:45

Oh Veronica, yes, ma'am.

20:46

On the dates, we said August 29th through September the 7th.

20:50

Some of those dates, they're closed.

20:52

So we only should count the days that they're open, correct?

20:57

Well, I did the math on that, and the way she set it up, starting it on a Friday, it kind of takes care of except for the Monday and Tuesday that week.

21:08

It is still days that they're closed.

21:10

We can't validate them on days if they're closed.

21:17

I guess maybe in the order, the attorney can put the correct dates in the order, but yeah.

21:22

Well, uh what the bear board has voted on is uh August 29th through September 7th, and that's what will be reflected in the order.

21:32

Right and then that's only nine days too, so it's a 10-day violation.

21:37

From the 29th to the 7th is nine days.

21:40

What day are they closed?

21:42

I don't know.

21:43

No, they're not open every day.

21:45

Well, it's 10 days.

21:46

Yeah, it is 10 days.

21:48

Yeah, okay.

21:57

And normally it is 10 calendar days.

22:00

So we've always gone by working day.

22:03

The last time they had a suspension, it was based on the days that they were open.

22:07

It's hard to validate a place and they're closed.

22:10

Well, it appears they're open Thursday through Sunday.

22:14

Okay.

22:19

So the last time they were uh suspended was a three-day suspension.

22:35

So it was three consecutively, and I think we did kind of like break it up the three days.

22:45

It was another day.

22:47

We kind of re-ray consequences.

22:48

I think they had three days and a five day together.

22:51

Yeah, it was there was a five day in um February.

22:58

She did say the seven, didn't she?

23:00

Yeah.

23:02

Broke it up in February or not, it's still a violation is a violation, and if it's valid, how can you uphold a violation on closed days?

23:11

Right.

23:12

But we already voted and passed it.

23:15

It's a no point, it's closing.

23:18

But for future.

23:21

Yeah.

23:22

Okay.

23:27

Right.

23:28

All right, we'll go back to uh new temporary beer permit application.

23:38

Um smart music project twilight grand market te 94 Robert Davis organizer 92 Choo Choo Avenue, and it's August 30th, 5 to 10 p.m.

23:59

and September 13th is the rain date.

24:03

And the way things are going in Chattanooga, it's good to have a rain day, right?

24:06

Yes.

24:08

Okay.

24:10

Officer.

24:13

So is there any so is it still pending?

24:16

Yes.

24:17

I just approved it.

24:20

I just approved it.

24:22

So it's been approved.

24:24

So it's now approved by regulatory.

24:26

Uh is there are there any if you would state your name and tell us a little bit about what what your event is?

24:31

Sure, Robert Davis.

24:32

I'm actually the founder of Smart Music Project and also shop the market at OLC, and we host about 30 large events across Chattanooga and surrounding area now.

24:42

So any questions from any board members 922 Avenue is at the Chicho.

24:57

Yeah, we're at the choo-choo in the garden area.

24:59

Okay.

25:00

In the garden area okay.

25:03

No questions from any of the board members is there a motion to approve so move.

25:10

Second.

25:11

Second discussion.

25:13

To the motion right I'll call the roll let's go Christy.

25:19

Yes.

25:19

Brooke?

25:20

Yes.

25:21

Veronica?

25:22

Yes.

25:22

Ron Smith.

25:23

Yes.

25:24

JW?

25:24

Yes.

25:25

Reginald?

25:26

Yes.

25:26

Betsy?

25:27

Yes.

25:28

And the chair votes yes.

25:29

Very good.

25:30

Great.

25:30

Thank you.

25:31

Thank you guys.

25:31

Have a good day.

25:33

Okay now we're good.

25:43

All right now the uh next item is the uh new beer application 100 food eight LLC beer permit 1321 and uh so I think that's it yeah this is it are you are you here were you sworn in sir when they came in did you swear in uh I can leave okay so laurie you sound swear or affirm the testimony you're about to give you the truth the whole truth and nothing but the truth you got yes thank you what's your name Jeff I'm sorry to peace I put your name's on here yes that's my Chinese name but I go by Jeff okay go by one jazz okay got it speak up to you chin or son okay okay now so is zoning what's the status of the zoning on this one has not been reviewed yet it has not been reviewed yet looking at it now okay so at this time we cannot approve it until zoning has signed off on it and they have not reviewed it yet okay so there is no action that we can take today however as soon as zoning signs off on it then it will automatically be approved through the regulatory and you won't have to come back before us today.

27:20

Okay all right question first yeah Ron what kind of establishment is this what kind of is it a restaurant or is it a it's a restaurant it's a restaurant yes okay and what's the occupancy of this what does occupancy that many people can you see okay we have uh so for that location um I'd say around 30 35 do you have the certificate of occupancy yes you do or is it say uh I have to look at okay but the seats I talk about it's we all we have a small bar seats like a ramen bar if it's six if added that and two little bar um in front of the window photo another 10 seats so let's see if yeah that makes it close to 40 seats well my point to that all is that you got to remember that that occupancy level is you the staff anybody in there work and the people that are dining or whatever with you so you've got to be cautious of that because it's pretty important that you don't let it get overcrowded okay yeah I'm sure that's a something you would wish for maybe but uh it's a it's that it's but dangerous okay okay yes okay any other questions for board members so uh again this will be passed until the next meeting is there we'll probably need a motion to do that and subject to regulatory's approval why would you pass it would just defer to regulatory correct uh yes we would pass right yeah yes that's correct thank you uh so we would just so this will go back to regulatory okay all right so we don't need to take any action okay all right thank you all right thank you okay all right any discussion on the board any anyone wishing to make any public comments you should all try 100 it's very good very good is it okay good thank you I'm almost highway 153 okay good have to remember that uh okay if there's no public comments uh is there a motion to adjourn so moved oh wait all in favor of adjourning signify by saying aye aye uh we'll take about a five minute break and then the beer violation portion of the meeting will be started with uh the hearing officer in about five minutes

30:00

Okay.

30:02

If there's no public comments, is there a motion to adjourn?

30:07

So moved.

30:08

Oh wait.

30:09

All in favor of adjourning.

30:10

Signify by saying aye.

30:12

Aye.

30:13

We'll take about a five-minute break and then the beer violation portion of the meeting will be started with the hearing officer in about five minutes.

  • Suspension Dates: The board set the suspension to run from August 29, 2025, to September 7, 2025. Some members noted that the establishment is closed on certain days, but the board voted to enforce the 10 calendar-day suspension as set.

Zoning had been approved, and the board approved the permit unanimously.
  • New Beer Permit – 100 Food 8 LLC: The applicant, Jeff (Chinese name), described a restaurant with a small ramen bar and about 40 seats, located at 1321 (address).
