And in my opinion, I I don't think it addresses the concerns that we had um regarding his background check.

When it comes to what he submitted to you are in the whole application process, are we are you affirming his death ship or his background?

His background, because what um the issues that came out in his background check were the three different social security numbers, different races.

I think the the um driver's license numbers were different, if I can recall correctly.

Um so the affidavit that he submitted saying that his uh driver's license was a specific number, a his uh social security ended in certain numbers, um, and then he submitted his birth certificate and social security card and his passport information.

And um, in my view, like it's a self-serving document because it's not from a you know an attorney or anyone from an A FBI, it's just him swearing under oath that these things are true and correct.

The only issue we had was from Mr.

Sherrano, so I I didn't have any issues with Mr.

Stolce's background information.

So uh the action, what I'm assuming uh to the attorney uh point of inquiry.

Is a couple actions is so this can move forward if he Zeus, if I'm saying all right, Mr.

Serrano, if he comes off, or if he goes and get another background with his current ID and present to us.

I'm just trying to understand the steps because we've been dealing with this.

So this is a very unique situation, all right?

And we're just trying to do our due diligence in this situation, and to me, it seems like the affidavit is self-serving.

He's just swearing to these things, right?

But there's no explanation as to why these were an issue in the first place.

He stood up here and said that his immigration attorney had to get a new uh um social security number because of an incident in California.

Uh the first couple of pages were like as it was just the last pages, um, as far as like citizenship, first place, all that got changed to the proper country, the race got changed.

Uh and the only thing that couldn't get changed was the last one, which was uh the final page, and that was the actual ticket that I got.

So on that one right there, I couldn't do nothing.

That information that's in that's in this was in 09 since then.

Uh Georgia has upgraded their system from back when I was living down there.

And when you say change, who changed it?

Well, they just upgraded systems, you know, because like I said, this was a whole no and understand the ticket, but when you said the raise and all this other stuff, yeah, change who yeah.

I had a I had to call the FBI, but like they had questions like you guys like hey, why does it say this?

Why didn't so that's why I had to go down to Georgia and see what was going on.

So you change fixed everything made the change.

And that's what uh attorney general's looking at right now.

Uh we wish to discuss the uh the uh information that someone sent to us anonymously concerning regards disparate enforcement of alcohol regulations in Chattanooga.

Uh what about the beer violation for a dollar general?

Okay, um discussion number one is the uh dollar general on Market Street and where is her it is right here.

So if you'll take a look in your package, you can see the report and recommendation of the beer board hearing officer.

Uh it was recommended that the uh the beer board impose a five working day suspension for this second violation of the Chattanooga Beer Code Section 5-52A as a civil penalty.

So does the board wish to uh affirm that and if so, when do we want the uh uh suspension to start yes, sir?

I to follow standard of what we've been doing is I think this is I think this should be a fine assessed with that as well.

This is the second violation.

Uh assessed with that also.

I think the um attorney is here as well.

Um I did not know for sure, and I had inquired about whether or not I'd be allowed to say anything at this part of the proceedings or not.

Um, one way or the other.

Um one, I guess I'll answer my understanding on the last question first, which I make a few brief comments.

Um, as indicated in our answer, and the record is my understanding is that my client was already assessed a five thousand dollar fine, which they paid within 48 hours of that fine.

Um we had uh asked and presented evidence.

I got um involved in the middle of this proceedings.

There had been evidence that had already been taken place and then it was continued, and it's kind of reached out to me to assist at the last moment.

Um while I understand the recommendation is a five-day suspension, uh, I would indicate and suggest that that recommendation not be followed.

Um we had put on evidence in reference to the fact of immediate action taken regarding suspension of this individual employee uh who had been with the company for less than 30 days.

The prior uh the prior incident was a different employee who was immediately terminated.

And as a matter of fact, at the uh hearing assessment, the actual records actually indicated that there had only this was a first-time violation, and actually I had pointed out to the detriment of my client that that was an error, and this was actually a second violation.

We have a new management team that was put in place as it relates to our business.

We are in the process and probably have mostly complied with the responsible vendor, but had not checked off necessarily all the boxes at the time.

We believe in the exercise of just discretion and uh the actions that we have taken that if anything should be considered if there'd be an additional fine, we had already promptly paid that one, but we would uh ask or suggest that it not be recommended in reference to the suspension, and of course, if by chance uh the theer board votes to the suspension of giving guidance as to when that would be applied or in event.

So I'm curious who imposed the five thousand dollar fine.

Um I don't know.

Um in terms I don't have the uh the what information was passed on my client at the time and uh indicated in the answer that there was a five dollar five thousand dollar fine.

I was assuming in reference to the the beer board, which was um paid September 24th, 2025.

That was not from us.

It was not we we can't impose a fine of five thousand dollars.

So I would imagine that that's T ABC.

Tennessee Alcoholic Beverage Commission, TABC.

Um again, I was kind of in the middle of things, and so I was getting information bits and pieces at the last.

I don't understand that we could be able to represent that they'd fully satisfied everything to uh qualify and and documented a certification that would be protected from any suspension at the time.

Um but there was as was attached to our answer, the training had gone through in reference to employees.

This particular employee that was terminated, um, had been there less than 30 days.

Uh she did not specifically have a certificate, although she still wouldn't have uh she still wouldn't have been to the threshold where she would have been required to have it done.

I think it's 60 days uh in terms of of that, but uh so we we could not, and we were asked, and that was one of the reasons I think the first hearing that I was not in attendance that was passed uh because the um the manager that showed up was not familiar in reference to address that and and candidly um you know this was the first time that I had been involved with that process myself.

I'm regularly involved in other types of civil litigation.

Uh so I had immediately followed up and I've been getting with the home office uh along with uh we brought in the new district manager uh that was here uh who had also given testimony in regards to this.

So you know, pretty much it is already had been in process and maybe completely complete, uh, but we could not represent or have testimony at the time to tell uh candidly whether or not all the requirements had been satisfied at the time of this incident.

So the question before the board is whether we uh sustain the ruling of the administrative hearing officer, or what is the pleasure of the board sir?

Uh I make a motion that we do not accept uh the hearing officer's recommendation and we uh make attached to that motion of five wait a five-day suspension with a thousand dollar fine.

So I didn't know if y'all had already discussed it last meeting or at least read it last meeting and then started discussing it because it I don't know if people are watching online and they don't know what was discussed either just now because that was really weird.

So um, I guess a little bit more transparency on what was being spoken of or what lack of what you guys kind of just said, and then um going back to the penalties or um as it relates to the trainings according to the beer ordinances.

Um, I know we have the new hearing officers now, and I'm not really sure if they're aware of the training that can be imposed by the board if a um business has failed compliance or received a citation.

Um, just listening to the dollar general situation and them saying they're in the progress of becoming the process of becoming a responsible vendor.

Um, I think it's also important just to remind them that you do have the local training for the beer board.

Um, a lot of times a lot of the older applicants who were who did not apply and were required to take the training for beer only, um, they have never gone through any training, or their employees have never gone through any training.

So the best opportunity is when they come before you guys with the violation and have been found in that violation to return back to training.

That's good.

Um, it's very important.

Refresh your courses at least annually.

Um new employees as they're coming in, if they don't have a TABC certification that they are trained.

I think that's a gap when it comes to providing training to employees or providing training to businesses that have had a beer, an existing beer permit before you guys started implementing the training process.

So I just kind of wanted to bring that back up because that was um adopted a few years back for them to be required to have training if they have a violation and if you guys feel that to be a fit for the situation as it occurs.

Or maybe the letter is stating that uh that there's a role concern in the community or perception that uh alcohol-related laws and regulations are not being enforced consistently across establishment, such as black and Hispanic uh businesses.

So um that's basically what the letter is stating.

Um, that they're believed that they're subjected to more frequent inspections, stricter scrutiny, and harsher penalties compared to other establishments.

And they went on to list a few that they felt that was getting special treatment, which was here today, is champions, bar Watson, Naughty Parrot, Barn Grill, Books, Sports Bar.

Yeah, and they felt that the establishments listed in the document that were being uh may have been unfairly mistreated was cabanas, dream, home plate, and other black establishments.

And so that's the gist of the letter.

As you're as you're reading through that, you're looking at the violations that they're citing.

Most of those are criminal violations.

Those are criminal violations that would not be handled by regulatory.

So I would encourage anyone watching or anyone listening that if you are aware and you know of these illegal actions that are actually happening, call the police and make a report right then and there.

You can do that with your local officer.

The district officer can come and take that report.

And then that information gets passed along to the appropriate investigative unit.

As far as regulatory goes, you know, we're dealing with a permitting process that supports the city of Chattanooga.

So we're just trying to make sure that everybody is fair and in compliance across the board.

When it comes to these criminal actions that mostly are alleged in this packet, they need to be calling the police and making official reports.

So just wanted to make sure you guys were aware of that.
