- Verizon Cell Tower Update: A board member reported that, at the request of River City Company, a letter was sent to Verizon regarding a cell tower that needed to be moved to allow demolition. The board later received a response from attorney Hal North representing the cell tower company (Vogue Towers). The board learned that there was no agreement between the sports authority and any cell tower company; the original agreement was made between the Lookouts (baseball team) and Verizon in 2007. The cell tower is on sports authority property. River City Company has a temporary easement, not ownership. The Board of Zoning Appeals granted a variance on June 5 or 6 to relocate the tower, expected to be completed by mid-July. The delay is costing River City money due to halted demolition and liability concerns. The board expressed support for expediting the process. Verizon requested a copy of the notice of sale of the property, which does not exist. There was also discussion about a possible holdover payment check sent to the Lookouts, which the board never received; the board may be entitled to those payments as property owners.
- Election of Officers: The board deferred the election until later in the meeting, as chairman Hicks was delayed. A motion was made and seconded to retain all current officers by acclamation: Mr. Hicks as Chair, Vice Chair (unnamed), Mr. Lockhart as Treasurer/Secretary. The motion passed unanimously, with no opposition.

This has been noticed Maria here for a public meeting, so we're good about that. Yes, yes. Good. Um next will be election of officers, chair, vice chair, secretary, and treasurer. Yes, sir. If you want to delay that until Hicks gets here. Um but the approval of minutes from May 22nd uh from our last meeting. Uh I think everybody was here. Uh so if we don't have any question about those, make a motion to approve those minutes. Motion to approve. Second. Thank you. Um and then next we have the discussion on the Verizon cell tower that Mr. Hicks will probably have the have the uh information on. Well, I'm I may have more information than Hicks does on. Okay, well we'll go with you. Okay, so uh just wanted to let you know we were instructed to uh write a letter on behalf of the folks for River City uh to let the Verizon people know uh that there was a cell tower that needed to sort of be moved in that location. So I've I've written that letter on behalf of the board. I don't know if Maria put it in the uh bucket for you here today, but I'm I've accomplished that requirement, and then I have gotten some uh responses back at this point in time from uh an attorney for the cell tower group uh here, Mr. Hal North has sent me a letter uh back in r regarding them, and there was also action that was going in front of the Board of Zoning Appeals last week here regarding the uh movement of a a cell tower, and this is pretty important, and it was something we didn't know about. Uh there was no agreement with uh the sports authority for any cell tower to go up, even though we were the property owner for the event. It was apparently an uh an agreement that the lookouts had uh with the cell tower people here, and I think it's Verizon Company, which would cover much of your um I guess involvement with uh cell tower services in the downtown community here. And we didn't want to just uh tell River City to go ahead and bulldoze something where that might knock out everybody's cell service. So we do not have an agreement with them. It is on uh the sports authority's property at this point in time. And uh the folks from River City found this out whenever they were uh trying to get the demolition going. They have sent a letter on to the um folks uh with the cell tower company telling them that they're having to hold up work and it's costing them money to be able to do that while this is ongoing, and the Verizon people are not really uh doing a whole lot of uh activity other than telling them they're gonna try to get it done as quickly as possible. It's my understanding based upon the Board of Zoning Appeals uh meeting last Wednesday, they got author authority to be able to have a uh uh variance to be able to move this cell tower structure to a different location. I don't know uh they said that that would take uh at least towards the middle part of July before that can occur. So that may be slowing down the demolition of the property. At the same time, the River City folks are hyper about this because they have uh insurance in there for a stadium that's still standing here and the concerns about liability over that while that's ongoing. So just wanted to make sure y'all were aware of where where that is. And we have um gotten involved and shown them the documentation we have, but there were was no documentation to the sports authority or no agreement with the sports authority to have a cell tower uh there to begin with. And I I don't know exactly uh how the lookouts work that out. Have there been any pushback from Verizon on moving it? Uh the the folks from the um Verizon folks are saying uh they want to have a copy of the notice of sale for the property as they understood it was sold to River City, which it was not. There's a temporary easement at River City. And uh could you confirm whether you received a holdover payment check for a June that has been forwarded to the River City Company? And I have no clue of that because we don't uh didn't get any checks and have never have never gotten any checks. So Verizon was apparently paying uh the lookouts some amount for the cell tower that was on their property. Now that we knew a little bit about the uh uh the fact that there was a uh large billboard, but we didn't know about a cell tower. Yeah, they spoke about the billboard. Yes, is it about what to do with it? So is it on top of it? I'm not sure. I'm not sure. I can't see that's why I was like, where is this thing? It must be on the business. It's in the tree. Really?
